Abstract:
This chapter describes how forced marriage has been treated by international human rights law. It shows how non-consensual marriage has been overlooked in refugee law, even when evaluating claims by refugees fleeing conflict. The chapter also analyzes forced marriage in international criminal law, focusing on the Special Court for Sierra Leone and the Extraordinary Chambers in the Courts of Cambodia. It demonstrates how international criminal law has introduced confusion over how to define and how to charge forced marriage. The chapter suggests that the lack of coherent analysis calls for more

Chapter 1 limns the chronology of speech and government-sponsored mass violence over the centuries. After an overview of pre-twentieth century hate rhetoric, it focuses on Ottoman propaganda in relation to the Armenian Genocide. It then describes the Nazi hate speech campaign against the Jews, the archetypal modern template for mass murder agitprop. It then moves to the post–Cold War period and examines the role of speech in the 1990s atrocities committed in the Balkans and Rwanda. The chapter concludes by examining more recent instances of atrocity rhetoric connected to mass crimes: postelect

Abstract:
Hate speech is widely considered a precondition for mass atrocity. Since World War II a large body of case law has interpreted the key offenses criminalizing such discourse: (1) incitement to genocide; and (2) persecution as a crime against humanity. But the law has developed in a fragmented manner. Surprisingly, no volume has furnished a comprehensive analysis of the entire jurisprudential output and the relation of each of its parts to one another and to the whole. Atrocity Speech Law fills this gap and provides needed perspective for courts, government officials, and scholars. Part 1, “Foun

The protection of forced migrants and the R2P doctrine are inexorably linked. Refugee and internally displaced person forced movements can be triggered directly through mass atrocity crimes, indirectly as people flee mass atrocities, and even by the international use of force triggered by R2P responses. A range of causes of displacement are international crimes and fall within the R2P. However, the international response to internal displacement situations, in particular, tends to highlight legal and humanitarian based forms of protection and assistance, necessarily limited by the issue of sov

This chapter studies the etiologies of genocide and mass atrocity and argues that self-exhibitionism provides a theoretical basis for interpreting the macabresque as a discrete phenomenon in mass atrocity violence. It also engages social constructionism in group dynamics through the concept of prototypicality. The chapter provides a critique of methodological simulation in social and political psychology, specifically, findings that emphasize obeisance, obedience, and obsequiousness found in the works of Milgram, Zimbardo, and others. The chapter demonstrates that the UN Security Council (UNSC) is increasingly applying sanctions with the aim of pursuing the individuals who have committed serious violations of international human rights law and international humanitarian law. The chapter argues that, while the use of UN sanctions to respond to a mass atrocity crisis does send an important signal of global condemnation, sanctions are likely to be most influential as one element in a long-term conflict resolution strategy. Because sanctions require time to take effect, their potential impact is strongest as part of an upstream

Paramilitary or irregular units have been involved in practically every case of identity-based mass violence in the modern world, but detailed analysis of these dynamics is rare. Exploring the case of former Yugoslavia, Kate Ferguson exposes the relationships between paramilitaries, state commands, local communities, and organised crime present in modern mass atrocities, from Rwanda and Darfur to Syria and Myanmar. Visible paramilitary participation masks the continued dominance of the state in violent crises. Political elites benefit from using unconventional forces to fulfil ambitions that v
