Abstract The matrimonial regime represents the entirety of the legal provisions concerning the property relations between spouses during marriage, as well as the legal documents they conclude with other people, governing a (measurable) patrimonial asset. In addition to the legal community regime, with the adoption of the new Civil Code two new matrimonial regimes were introduced, namely the regime of property separation and the regime of the conventional community. Where the two spouses opt for one of the other two regimes, instead of the legal community regime, it is necessary that they should sign a marital agreement.

Resumen: El presente trabajo expone las relaciones entre la cuestión de la ley aplicable al régimen económico matrimonial en los casos de Derecho transitorio que han sido puestos de relieve por la jurisprudencia española y en particular por la SAP Barcelona 30 julio 2019. El estudio aborda la eliminación legislativa y jurisprudencia del punto de conexión discriminatorio “nacionalidad del marido”. También se explica la relación entre la teoría de la Drittwirkung y las normas de conflicto de leyes. Se distingue entre los matrimonios celebrados antes del día 29 de diciembre de 1978, los celebrados entre el día 29 de diciembre de 1978 y el día 7 de noviembre de 1990 y los que se llevan a cabo posteriormente. Finalmente, se exponen las razones por las que se aprecia una imparable emergencia de la residencia habitual común inmediatamente posterior a la celebración del matrimonio como punto de conexión para fijar la Ley reguladora del régimen económico matrimonial.Palabras clave: Iey aplicable al régimen económico matrimonial, nacionalidad del marido, Drittwirkung, Derecho transitorio, residencia habitual. Abstract: The present work deals with the law applicable to the matrimonial property regimes and transitional rules. The judgement rendered by the court of appeal of Barcelona on July 30th 2019 in examined. The husband’s nationality as a connecting factor is also studied and proves to be discriminatory and non compatible with the Spanish Constitution. In this scenario, the theory of Drittwirkung shows that the Spanish conflict rules are obviously subject to the Spanish Constitution. A distinction is made between marriages concluded before December 29, 1978, those celebrated between December 29, 1978 and November 7, 1990, and those carried out subsequently is made. Finally, this work analyses the reasons for an unstoppable rise of the common habitual residence after the marriage as a connecting factor to determine the Law applicable to matrimonial property regimes. Renouncing the binding nature of the legal matrimonial regime[1], upon adoption of the new Civil Code, the Romanian lawmaker consecrated the patrimonial freedom of the spouses to decide as they deem appropriate and fit with regard to the property that is the object of their property relations. The New Civil Code establishes the principle of the freedom of choice of the matrimonial regime, the future spouses having the choice to enter, outside the regime of the legal community of property (the only possible matrimonial regime according to the previous regulation of the Family Code), into a matrimonial convention, on the basis of which they shall “join” either the separation of property regime or the conventional community of property regime.Regardless of the matrimonial regime chosen, whether legal or conventional, there is a common core of imperative, non-derogatory rules, which provide a minimal protection of the property relations between spouses.The imperative primary regime is enshrined in the Civil Code in force, in Book II, About Family, Title II – Marriage, Chapter VI – Property Rights and Obligations of Spouses, Section 1 – Common Provisions, Paragraph 1 – About the General Matrimonial Regime (Art. 312-320), Paragraph 2 – The Family Dwelling (Art.321-324), Paragraph 3 – Marriage Expenses (Art.325-328).In this article, the property obligations of the spouses present in the text of the law under the name of Marriage Expenses (Art. 325-328 Civil Code) are the subject of a legal review, highlighting a higher degree of concern on the part of the lawmaker, as compared to the current one, in drafting the Family Code, in terms of their regulation in relation to the accelerated dynamics of social relations.[1] Under the Family Code, which was abrogated with the entry into force of the current Romanian Civil Code, the matrimonial regime of the spouses was that of the community of goods, unique, mandatory and immutable. Abstract: In a private international law context reflecting significant divergences between the ob­jective choice-of-law rules for matrimonial property regimes, the principle of party autonomy appears as a salutary solution, bringing certainty, predictability and simplicity, while satisfying also the spouses’ substantial interests. The study focuses on the rules devoted to this principle by the European legislator in the (EU) Regulation no 2016/1103, attempting to outline its regime and insisting, particularly, on its admissibility and on the limitations that accompany its practical exercise. Providing a sufficient fra­mework for discussion and helping to illustrate the implications of the European text, the rules of the Romanian Civil Code and of the 1978 Hague Convention on the law applicable to matrimonial property regimes will serve as a benchmark.Keywords: matrimonial property regimes, EU Regulation no 2016/1103, autonomy of will, electio juris agreements, states with more than one legal system, change of the applicable law.Resumen: En un contexto de derecho internacional privado que refleja divergencias significativas entre las reglas objetivas de elección de los regímenes matrimoniales, el principio de autonomía de las partes aparece como una solución saludable, aportando certeza, previsibilidad y simplicidad, al tiempo que satisface también los intereses sustanciales de los cónyuges. Nowadays, at the moment of contracting marriage the spouses establish the community property (matrimonial joint property) which complies a subordinate role for marriage. A novelty element which concerns even Romanian citizens is the enforcement of Regulation (EU) no 650/2012. Although the area of enforcement of the regulation should include all aspect of civil law regarding a deceased person’s patrimony, certain aspects were deliberately left out from the enforcement area of this regulation, as the questions governed by the law of companies or relating to matrimonial property regimes. To illustrate the effects of the death of an associate in a company, we will provide a short comparative presentation of the continuance of the collective society with the heirs of the deceased partner as regulated by Law no 31/1990 regarding Romanian companies as opposed to the French Civil Code. Also, our brief analysis of the Proposal for a Council regulation on jurisdiction, applicable law and the recognition and enforcement of decisions in matters of matrimonial property regimes, may shed some light on what is to come in matrimonial property regimes.

Abstract In 2019, the EU Member States started applying the Matrimonial Property Regulation, which concerns the property regimes of international marriages. This regulation is aimed at helping couples manage their property and divide it in case of divorce or the death of one spouse. One of the main features of this regulation is its openness to the parties’ choice. The parties are enabled – in cases foreseen in the regulation – to grant jurisdiction to the court of a Member State of their choice, as well as to choose the law applicable to their matrimonial property regime. Since this regulation is new and the track record of its application is rather short, the limits of party autonomy allowed under the regulation and its advantages still involve a high degree of uncertainty. This article provides an in-depth analysis of party autonomy as provided for in the Matrimonial Property Regulation. In addition, it scrutinises the issue of party autonomy in the Succession Regulation, which often directly interacts with the Matrimonial Property Regulation.

Current Trends in the Conflict of Legal Methods in Matrimonial Property RegimesSummaryThe difficulties relating to the determination of the law applicable to personal and property relations between spouses are one of the most significant barriers to the free movement of individuals between different countries. Due to the importance of matrimonial property regimes for the situation of third parties entering into legal relations with married persons, matrimonial property regimes also have a seminal impact on the security of free movement and exchange. This article presents an analysis of conflict-of-law methods used to determine the law applicable to matrimonial property relations under selected conflict-of-law regulations adopted in different countries, the proposed uniform European regulation, and the former Polish International Private Law Act (Ustawa o prawie prywatnym międzynarodowym) of 1965. It also contains an assessment of the relevance of new conflict-of-law rules that have been introduced at the national level. The article may be regarded as a background for the analysis of the arrangements presented in the new Polish International Private Law Act of 2011, which will be presented in a separate issue of this journal.

Council Regulation (EU) 2016/1103 of 24 June 2016 implementing enhanced cooperation in the area of jurisdiction, applicable law and the recognition and enforcement of decisions in matters of matrimonial property regimes (hereinafter: Regulation 2016/1103) provides for uniform rules which should facilitate delivering of judgments concerning matrimonial property in cross-border disputes in 18 Member States which established enhanced cooperation between themselves in the area of the property regimes of international couples. The application of the Regulation 2016/1103 should contribue to the application of other european instruments in the fi eld of european family law in divorce and succession proceedings. The paper presents rules on jurisdiction and applicable law under the Regulation 2016/1103 which should be applied in proceedings concerning matrimonial property regimes. Application of the provisions of Regulation 2016/1103 on jurisdiction and applicable law in proceedings for succession will be analyzed. The paper elaborates on certain potentially problematic solutions and open issues revealed through interpretation of provisions of Regulation 2016/1103 which could cause doubts and uncertainties for the court and public notaries. Possible solutions which could remove diffi culties and insuffi ciencies in the application of the Regulation 2016/1103 will be suggested.

Our paper focuses on several central points concerning pre-nuptial negotiations, the results of which were finalized in marriage contracts.There are two opposing systems of the law governing marital property regimes: the regime of matrimonial community of property or joint marital property, Gütergemeinschaft, and the regime of separation of marital property, Gütertrennung We compare two territories of the Habsburg Empire – the County of Tirol with the regime of separation of marital property dominating, and the Archduchy of Austria South of the River Enns (Lower Austria), with matrimonial community of property dominating in rural areas. For each territory, we concentrate on a single landed estate: Fridau-Weißenburg in the case of Lower Austria, and Innichen in the case of Tirol. Innichen was a small market town with a mixed economy based on agriculture and the trades; while the estate of Fridau-Weißenburg was more rural and agricultural and also preindustrial since the middle of the 18th century.

Será apresentado também a Súmula 377 do STF e sua interferência no regime citado, além de questionar até que ponto a imposição de regime de bens a septuagenários é proteção necessária ou representa interferência a esta parcela da população por parte do Estado. Através de pesquisa bibliográfica e análise dos artigos 1.641, 1.829 e 1.845 CC, espera-se demonstrar a dificuldade enfrentada pela parcela da população que, acima dos setenta anos, tem autonomia para decidir todos seus atos da vida civil, porém, de acordo com o Estado, não tem condições de decidir, por si só, o regime de casamento que melhor lhe convém.

Este texto tem por objetivo revisitar a clássica descrição de Melatti sob a luz de novos dados obtidos entre os Kraho, bem como de dados de outros povos Timbira – com destaque para a contribuição de Maria Elisa Ladeira sobre os regimes de troca matrimonial e onomástica entre os Kraho e Canela, e para a terminologia Apinajé descrita por Roberto DaMatta. A partir dos dados, proponho que é possível pensar um sistema terminológico comum aos povos Timbira. Dentre outras coisas, o artigo procura vislumbrar como a terminologia de parentesco se integra com as trocas matrimoniais e onomásticas, mesmo entre povos que, como os Timbira, não possuem regra positiva de casamento.

In 2010, France and Germany introduced a common optional matrimonial property regime of participation in acquisitions in both countries. One of its goals was to establish European harmonization, up until then a rare occurrence in the broad field of family law. The harmonization journey was continued by Belgium in 2018, when the Franco-German agreement was taken over in the Belgian Civil Code. This article evaluates the Franco-German regime from both an internal and an external point of view in order to determine the success of this operation. In the internal analysis, the regime will be presented as a modern and balanced compromise between the French and German domestic participation in acquisition regimes. In the external analysis, the regime will be qualified as a legal transplant in Belgium that at this moment in time does not survive the operation. Despite this seemingly negative evaluation, the regime may still increase its success rate, provided all actors involved take the required measures. In any case, the regime should be welcomed as harmonization initiative, considering that new projects may learn from its successes as well as from its stumbling blocks.

In Van der Merwe v Road Accident Fund 2006 4 SA 230 (CC) the court extended this exception to the notional purity of community of property to include patrimonial damages on the basis that section 18(b) discriminated unfairly against spouses married in community of property vis-à-vis spouses married out of community. The implications of this decision on commercial intercourse are discussed in this contribution against the background of prior decisions relating to the insolvency of spouses married in community of property.

As a result of the study and analysis of scientific sources of the private international law and legislation regulating property relations between the spouses, the author implemented the goal of the article, i.e. theoretical comprehension and determination of the legal regime of salaries, pensions and scholarships of spouses in the private international law on the basis of available scientific material and relevant provisions of the regulatory legal acts of some states. While writing the article, the author used a universal dialectical method of cognition which allows taking into account the relationship between and interdependence of legal phenomena; general scientific (systemic, logical, historical, analytical) methods; as well as private scientific (comparative juridical and formal juridical) approaches. Accordingly, the author concluded that salaries, pensions and scholarships become the common property of spouses from the moment they are received by the eligible spouse. This point of view is considered to be the most spread in the private international law.Key words: matrimonial property regime, property relations, property rights, salary, pension, scholarship.

The growth of Islamic matrimonial system in the present Indonesia was originally formulated in the 19th century of the Netherlands colonialism. There are several discourses among Dutch scholars in establishing an applicable law system since there are various legal system existed, and finally the colonial government issued legal dualism in order to preserve their hegemony. Provoked by several scholars the new constitution in 1854 was approved. In that, the Islamic matrimonial system was assimilated into Adat law and therefore the Islamic marriage system was allowed to be practiced in its own way. This Islamic matrimonial system was formed as a law under Dutch controls. Accordingly, the paper discusses Dutch hegemony system through applicable Islamic matrimony, and the development of this marriage as the formation of preserving hegemony. This paper arguably investigates Dutch hegemony system through applicable of Islamic matrimony. The analysis is guided by following questions: first, what are the reasons behind the implementation of indigenous legal institution such as Islamic marriage in preserving hegemony? Second, to what extent does the Islamic matrimony persisted within the applicable policy? The methodology is critical analysis of legal history contents, the data mainly taken from legal manuscripts which is a comprehensive view of law from a particular critical vantage point: a way of doing law, perhaps doing things with law. On top of dealing with loss, the couples have to navigate through a lot of administrative and legal obstacles to figure out the division of their property located in different Member States or governed by different national law. These proceedings are lengthy and expensive. European Commission, aware of the issue their citizens face, introduced two proposals for regulations on matrimonial property and property of registered partners. In 2013 the proposals did not get the required unanimity, in 2016 they are being re-introduced in enhanced cooperation.

The article discusses the results of a case file study conducted in cases concerning community property of spouses after cessation of the matrimonial community property regime. First of all, the authors present Polish nationwide statistics concerning the numbers of cases of this kind compared to other types of property division cases and in the context of contractual modification of marital property regimes. An analysis of results of the case file study covered the problems of assets covered by the division, the kinds of claims formulated by spouses, the course of court proceedings, including: the initial stage, evidentiary proceedings, final decision, and appeal against the judgment. One of the most important and, at the same time, most surprising findings made during the study concerned a considerable number of settlements made at early stages of court proceedings. Combined with the low number of mediations or appeals against the final judgment, this demonstrates that the examined cases were not very contentious.

Although the legislator prefers the institution of marriage and accepts it as a form of family relationship, the system of family relationships has altered as a result of social changes, which can also be seen in the legal regulation. Therefore, the framework of previous thinking, which is almost exclusively based on matrimonial property rights, has been modified by the social and economic changes and the consequent constant change in regulation and attitudes. As a result, not only matrimonial property regimes but also the legal relationship between persons living in a registered partnership or de facto partnership, and their relationship with third parties are covered by matrimonial property law as well. Consequently, it is necessary to apply a new comprehensive terminology to these property relations, which is family property law. However, it can also be stated that during the development of the family property regulation, the legislator sought to incorporate guarantees into the system during the analysis of the diversity of family relationships, which prevented the endangerment of family existence, the vulnerability of the weaker partner or the rights of minors belonging to the family. However, most of the protecting provisions in the family property law apply to persons living in a marriage (registered partnership), the property relations of de facto partners are less regulated, and they contain only partially, or under certain circumstances family protection standards, legal consequences, and safeguards. The reason of this is that the legislature protects and favours marriage in principle over the other two legally regulated forms of partnership, by which it encourages young people and couples to marriage which requires mutual responsibility, solidarity, and commitment.

Most countries of the world have at one time or another been confronted with questions of what principles or rules should guide the courts in readjusting the property rights of spouses at the dissolution of their marriage. Virtually all civilised countries have accepted marriage as an equal partnership of two legally equal individuals to which each one of them contributes in one way or another. Most policy makers agree that the partners contribute to the marriage through their division of labour and that these contributions although not equal in absolute terms are nonetheless of equal relative value to the welfare of the family.This recognition of the equal worth and equal importance of the two spouses to a marriage relationship has had profound effects on the matrimonial property regimes of numerous countries which have had to tackle the problem of the construction of a fair and equitable legal formula for the reallocation of matrimonial property rights at the dissolution of marriage. The fundamental problem has been whether a fair and equitable system is achieved by means of fixed rules of apportionment or through flexible discretionary judicial powers exercisable at the discretion of courts, in the light of the individual circumstances of each case.

On February 18, 1306, the city of Camerino signed a peace treaty with three neighboring communes (Matelica, San Severino, and Fabriano). Among its provisions was a plan for a series of marriages between the inhabitants of the four communes, which would have made a group of 140 men brothers-in-law through the exchange of 140 women. Analyzing this document and its extraordinary clause—which was never enforced and did not bring hostilities to an end—, this article examines the genesis of a gender regime in a specific historical, documentary, and relational context. Adopting a pragmatic approach to gender as a means for understanding social interactions, the article analyzes the roles elite men assigned to women of their communities in reconciliation rituals, matrimonial alliances as miniature figures of peace, and the systems established to ensure the transfer of dowries and the granting of citizenship. Under such gender regimes, women served as mediators, promoting peace in their households so that it would spread throughout the entire community. They also provided dowries and citizenship to men, allowing them to maintain their dominant role in society.

Resumen: El presente artículo aborda la problemática, doctrinalmente nada pacífica, que origina la designación de la ley española en el ámbito de las sucesiones mortis causa y del régimen económico matrimonial como consecuencia de la regulación de ambas materias, respectivamente por los Reglamentos (UE) 650/2012 y 2016/1103 y el sistema que estos instrumentos ordenan –el mismo en ambos– para la determinación de la ley aplicable cuando se trate de un Estado plurilegislativo, que es el caso de España. Habida cuenta de que el sistema de designación de la ley aplicable en el conflicto de leyes interno parte del principio de unidad de soluciones, esto es, de la aplicación a los conflictos internos de las mismas normas que se aplican a los internacionales, formalmente ubicadas, en su mayor parte y, en concreto, en las materias que nos ocupan, en el Capítulo IV del Título Preliminar del Código civil, una parte significativa de la doctrina española especializada argumenta que son las normas de Derecho Internacional privado allí recogidas –y no otras– a las que se refiere el sistema interno querido por el legislador español, aun cuando, en el caso concreto de dichas materias, hayan sido eliminadas y sustituidas por las establecidas en los citados Reglamentos. Given the fact that the application of Spanish law follows the principle of “unity of solutions”, i.e. the application of the same set of rules for both for international and merely and purely interregional cases –dispositions contained in Chapter IV of the Preliminary title of the Spanish civil Code–, some authors consider that some of these latter rules are still applicable despite they have been amended by the European legislator. The article critically analysis this doctrinal position and considers there is a better way for interpretation. However, both of them consider the necessity of a new system of internal conflict-of-law rules drafted by the Spanish legislator and given the new and current scenario.Keywords: Succession and matrimonial economic regime, Regulations (EU) 650/2012 and 2016/1103, referral to the law of a plurilegislative State, conflits of domestic and international laws.

Abstract:
Legal certainty will be severely jeopardised should it be possible at whim to proclaim the applicable matrimonial property regime governing spouses’ assets and liabilities to have been changed retroactively. The legislature prescribed clearly defined prerequisites to be met before any change regarding a couple’s matrimonial property regime can be sanctioned by the high court and then only for the future, but never with retrospective force. Under the dualistic systems that apply in South Africa since 1652 it has always been recognised that individuals living according to customary or indigenous law may by default govern their matrimonial property regimes and the law of husband and wife according to the applicable norms of indigenous law. By default these marriages were out of community of property although a couple could agree to change the default position and have their consensus in this regard registered. The couple M was married according to customary law in the erstwhile Eastern Cape in 1980 and the marriage was never registered. The default position should accordingly govern the matrimonial property regime of the couple resulting in no community of property and no accrual system. The husband’s legal capacity and competencies were consequently not restricted by the qualifications contained in section 15 of the Matrimonial Property Act 88 of 1984 because that chapter of the act was not applicable to a customary marriage concluded in 1980 and which is by default out of community of property. When the husband as registered sole owner in 2010 entered into a valid sale agreement to transfer his immovable property on the Cape Flats to the first respondent nothing hampered or restricted the parties’ capacity to enter into the applicable obligatory or real agreements. The property was subsequently validly transferred in the Deeds Register to the purchaser. The plaintiff’s claim as widow of the seller who since passed away, to have the property “retransferred” into her name because the sale and transfer was allegedly in contravention of section 15 of Act 88 of 1984, is unconvincing although the court held otherwise. The crux of the matter is not whether the first respondent should be safeguarded against the consequences of an alleged invalid agreement by the husband who acted without the involvement of his wife in 2010 by a reliance on section 15(9)(a) of that act. The emphasis should have been on how the alleged amendment of section 7(2) of Act 120 of 1998 in June 2021 could be deemed to apply retrospectively after the sale and transfer had validly been concluded for eleven years before the poorly formulated amendment of the act became law in June 2021. A contract of sale that was validly concluded cannot retrospectively become invalid because the legislature changed the requirements for the type of contract more than a decade later. The court’s point of departure for its judgment is, however, that the deceased was married in community of property: “The Recognition of Customary Marriages Amendment Act 1 of 2021, which came into operation on 1 June 2021, among others, amended section 7 of the RCMA that all marriages, which were entered into before or after the enactment of the RCMA, are regarded as in community of property unless such consequences are specifically excluded by the spouses in an antenuptial contract” (par 20). This, notwithstanding the clear legal position regarding the default matrimonial property regime for all indigenous marriages concluded before the commencement of Act 120 of 1998: out of community of property. The legislature was supposed to adhere to the decision of the constitutional court in 2017 in Ramuhovhi v President of the Republic of South Africa (2018 2 SA 1 (CC)) to amend section 7(1) of Act 120 of 1998 with regard to polygamous marriages and not to alter the legal position regarding monogamous marriages that were governed without any found negative consequences by section 7(2) of that act. Although the legislature neglected to explicitly declare that this amendment of section 7(2) should have no impact retrospectively, the implications of this poorly conceived judgment will necessitate a re-opening of all the millions of estates of people who have been married according to a customary marriage since 1652 because all those marriages will now be deemed to have been in community of property with the consequential implications for the distribution of all assets of the spouses involved with the dissolution of the marriages after the demise of the dying spouse. The legislature would have caused less harm if it read with comprehension the clear order of the constitutional court: “In terms of s 172(1)(b) of the Constitution, this order does not invalidate a winding up of a deceased estate that has been finalised or the transfer of marital property that has been effected.”

AbstractNgazidja Island in the Comoros archipelago (in the south-western region of the Indian Ocean) is an example of a matrilineal and matrilocal Muslim society. This article addresses the various ways in which the Ngazidja people negotiate gender and family relations by referring to matrilineal or Islamic norms and values, and the influence of Islamic reforms and Western norms. Matriliny is linked to a local political organization based on an age system and a male political assembly. This link explains the specific way in which matrilineal and Islamic ideologies are linked. Marriage is ruled by Islamic law, but alliances between matrilineal descent groups follow other rationales. The existence of two matrimonial regimes illustrates this distinction. The conceptions of fatherhood produced in Ngazidja shed light on the key issue of male authority in matrilineal and Muslim contexts.

On October 20, 1976, a new Insurance Act came into force in Québec. It was expected to solve, among other problems, most of those concerning the relationship between insurance law and matrimonial regimes and the interpretation of the relevant statutory provisions. Unfortunately, only a few articles in the marriage covenants section of the Civil Code were amended. This paper stresses the fact that the main problem in insurance law is the definition of basic elements, such as the policy, the proceeds, the owner and the beneficiary, and that the new act has failed to clarify the meaning of those terms. The paper analyses the notions of policy and proceeds, with regard to the partnership of acquests and the community of moveables and acquests, and comes to the conclusion that, although effective for insurers, the new act has not solved problems raised by the cases and the authorities.

In both the European Union and the United States, it is a dynamic period for private international law regarding immovable property issues. The predominant approach has been that these issues are governed by the lex rei sitae —that is, the law of the State where the immovable is located. However, through a comparative examination of recent EU Regulations on succession, matrimonial property regimes, and the property consequences of registered partnerships, and of the new Third Restatement of Conflict of Laws project in the United States, this article shows that on both sides of the Atlantic there is a trend toward reducing the scope of the lex rei sitae rule. It explores both the reasons for and the challenges posed by this trend. It also reveals that despite this trend, the lex rei sitae rule nevertheless persists in relation to certain «core» immovable property issues.

This paper is intended to serve as an introductory treatise on the subject of smart marriage contracts (SMC) as a manifestation of blockchain in matrimonial property law of contracts. It starts with a description of the origin and functioning of an SMC from a technical standpoint, while evaluating the legal nature thereof at the same time. Afterwards, we focus on the possibilities and means of an SMC’s establishment under German, Austrian, and Slovak law. Moving on, issues related to the content of a marriage contract establishing an SMC are examined. Then it is tested the permissibility of an SMC-related provision in a marriage contract referred to as a “registration clause”. Finally, it is delved into the question whether the appearance of an SMC in a marriage contract introduces any peculiarities to issues of private international law, namely from the perspective of the EU Regulations on property regimes of international couples.

A questão controvertida residia em determinar se a transferência de uma criança para outro Estado-Membro, devido a uma decisão administrativa tomada de acordo com o Regulamento n.º 604/2013, de 26 de junho de 2013, que estabelece os critérios e mecanismos de determinação do Estado-Membro responsável pela análise de um pedido de proteção internacional apresentado num dos Estados-Membros por um nacional de um país terceiro ou por um apátrida (Regulamento Dublin III) constituía uma deslocação ilícita de crianças, nos termos do Regulamento n.º 2201/2003, de 27 de Novembro de 2003, relativo à competência, ao reconhecimento e à execução de decisões em matéria matrimonial e em matéria de responsabilidade parental (Regulamento Bruxelas II bis) e da Convenção de Haia de 1980 sobre os Aspetos Civis do Rapto Internacional de Crianças (Convenção de Haia). Este caso põe em confronto o regime jurídico do rapto internacional de crianças e do direito de asilo. O que passaremos a analisar em seguida é em que termos é possível harmonizar a aplicação de ambos os regimes jurídicos, tendo em consideração o superior interesse da criança e, utilizando como exemplo ilustrativo, a referida decisão do TJUE.

Summary The article concerns the limitations of the freedom of shaping the legal relationship by the parties on the grounds of private international law binding in Poland. It is devoted to the specific issue of limitations of the effects of the choice of law on the grounds of the protection of third parties. The rules related to this issue have been included both in the sources of European law (“Rome I” and “Rome II” regulations, as well as in the Polish law – Private International Law of 2011). They concern the choice of law for contractual and non-contractual obligations, for a power of attorney and for matrimonial property regimes. The purpose of these rules is to protect the knowledge of a third party or the rights acquired by them. The article considers various possibilities to exclude the effectiveness of a law chosen for the protection of a third party, while respecting the wills of the parties to the legal relationship as much as possible.

Abstract:In spite of largely different techniques in family property law of the many European countries in protecting family members (continental Europe has well structured matrimonial property regimes and a reserved portions in the estate of the deceased, which both are nearly unknown in Anglo-Saxon law), the author discovers similar trends in the pursued objectives: upgrading the succession status of the surviving spouse at the expense of the rights of the blood family and abolition of the discrimination of children born out of wedlock. Those trends should be encouraged. Few are the countries granting some protection to the ‘recent family members’ like the surviving unmarried partner and the children of a ‘recomposed family’, not affiliated to the deceased. The author is in favour of a pan-European equilibrated solution with more respect for the possible wish of the deceased to protect these recent members or to guarantee them a reasonable minimum protection in the absence of any provision by the deceased if they need it.

In this article a synoptic evaluation is made in respect of the estate planning and wills of South African nationals working, investing or living in foreign jurisdictions, in the broader context of globalisation and internationalisation. Estate planners and testators may inadvertently leave family members in a financially vulnerable position or diminish family assets due to a non-appreciation of international private law. The importance of international wills, the role of testamentary trusts, and the potential impact and reciprocity of international instruments are considered. The most applicable Hague Conventions and the EU Succession and Matrimonial Property Regulations are discussed in an attempt to give an overview of the current legal position. In discussing the role of international private law, its practical application is illustrated by way of reference to a few jurisdictions popular among South Africans with multi-jurisdictional estates, namely Malta, Portugal, the Netherlands and the United Kingdom. Although there may be more popular emigration jurisdictions amongst South Africans, this contribution focusses on the South African who lives, works and plays in a European context, without necessarily cutting his or her ties with the homeland. Not all attempts to harmonise wills, deceased estates, succession and matrimonial property regimes have been met with the same levels of enthusiasm by the international community. Contributing hereto may be the fact that fiduciary law deals with sensitive and very personal aspects of individuals and is closely linked to the different worldviews of communities. It is argued that not only fiduciary advisers and will drafters, but also attorneys and notaries involved with prenuptial agreements, should be proficient in the workings and implications of the applicable international instruments. Lastly, an argument is made for more pragmatic and commercial style thinking in the arena of fiduciary law.

La Chiesa fin dall’inizio della sua attività ha ritenuto, per salvare la fede dei propri credenti, di proibire il matrimonio di un cattolico con una persona non battezzata. Questa proibizione abbracciava del resto anche il matrimonio di un cattolico con la parte battezzata appartenente pero all’eresia o alla scisma. Solo nel XIII secolo nella dottrina si è cominciato a distinguere fra l’impedimento dirimente esistente fra cattolico e non battezzato (disparitas cultus) e l’impedimento proibente esistente fra cattolico e un battezzato non cattolico (chiamato poi mixta religio). La disciplina giuridica della Chiesa Latina relativa all’impedimento di disparità di culto, come del resto a quella mixta religio, nel medioevo, quindi dopo il Trento e nei secoli seguenti incluso il periodo della vigenza del Codice di Diritto Canonico del 1917 era improntata da un rigore e ad una intransigenza assolutamente incompatibili con quell’atteggiamento di apertura e di comprensione verso le altre forme di credenza che ha iniziato il Concilio Vaticano II. Il nuovo clima ecumenico ha permesso di cambiare assai sostanzialmente la disciplina tradizionale nel campo dei matrimoni misti, tra l”altro per quanto riguarda l’unione di un cattolico con un non battezzato. Una riforma su questa materia apparve pertanto urgente. L’Istruzione „Matrimonii Sacramentum” della S. Congregazione per la Dottrina della Fede del 18 marzo 1966 è stato il primo passo nella strada verso gli ulteriori cambiamenti. Il papa Paolo VI per cui il problema dei matrimoni misti era uno dei più scottanti e urgenti ha proposto ai membri della prima assamblea generale del Sinodo dei Vescovi (nel ottobre 1967) un fascicolo dal titolo „Argmumenta de quibus disceptabitur in primo generali coetu Synodi Episcoporum, pars altera”, nel quale sono state inserite fra l’altro le questioni dei matrimoni misti. Come il frutto di questa consultazione si è mostrato il motu proprio dello stesso pontefice „Matrimonia mixta” del 31 marzo 1970. Il documento paolino ha rivelato un notevolo sforzo di adeguamento ai principi conciliari e ha segnato in tal senso un notevole progresso rispetto al precedente regime giuridico. Con la promulgazione il 25 gennaio 1983 dal papa Giovanni Paolo II del nuovo Codice di Diritto Canonico, in cui si codifica quasi ad litteram la legislazione del motu proprio di Paolo VI, resta invariato l’impedimento di disparità di culto. L’evoluzione della disciplina della Chiesa Latina in materia dei matrimoni fra cattolici e non battezzati, pur rivelando un significativo progresso rispetto al passato, dovrebbe continuare ad essere più adatta ai fattori sociologici caratteristici dalla cultura occidentale moderna.

Zagadnienia statusu prawnego osób pozostających w związku małżeńskim i objętych wspólnością majątkową małżeńską jako uczestników spółek handlowych, zwłaszcza kapitałowych, wywołują w praktyce obrotu prawnego wiele kontrowersji. Zarówno kodeks spółek handlowych jak i przepisy kodeksu rodzinnego i opiekuńczego regulujące reżimy majątkowe małżeńskie nie zawierają szczególnego unormowania skutków prawnych nabycia (objęcia) praw udziałowych w spółkach przez małżonków, lub przez jednego z nich, a zwłaszcza przynależności tych praw do określonego majątku małżonków – wspólnego bądź osobistego. Wobec tych osób stosowane są mają więc zastosowanie ogólne przepisy k.s.h. o obejmowaniu / nabywaniu praw wspólnika spółki (praw udziałowych). Obowiązuje również ogólna zasada ustawowego małżeńskiego reżimu majątkowego wyrażona w art. 31 § 1 k.r.o. Omawiane w artykule zagadnienie ujawnia szerszy problem, powstający na styku prawa rodzinnego oraz prawa spółek, polegający na ustaleniu relacji prawnej między umowami majątkowymi małżeńskimi a umową spółki (czy szerzej: relacji przepisów prawa spółek handlowych do prawa rodzinnego), a w konsekwencji wpływu i skuteczności postanowień intercyzy – umowy między osobami, z których jedna ma status osoby trzeciej wobec spółki – na skład osobowy spółki: organizacji prywatnoprawnej, której ustrój współkształtowany jest postanowieniami umowy spółki. The issues of the legal status of married persons and co-members of marital property as participants in commercial companies, especially capital companies, cause a lot of controversy in the practice of legal transactions. Both the Commercial Companies Code and the provisions of the Family and Guardianship Code regulating matrimonial property regimes do not contain any specific provisions for the legal effects of the acquisition (taking up) of participation rights in companies by spouses or by one of them, and especially the belonging of these rights to specific property of the spouses – joint or personal. Therefore, the general provisions of the Code of Commercial Companies and Partnerships apply to these persons. on taking or acquiring the rights of a partner of the company (share rights). The general rule of the statutory matrimonial property regime, expressed in Art. 31 § 1 Family and Guardianship Code. The issue discussed in the article reveals a wider problem arising at the interface between family law and company law, consisting in establishing the legal relationship between a marriage contract and the partnership agreement (or more broadly: the relationship between the provisions of commercial companies law and family law), and consequently the impact and effectiveness of – contracts between persons, one of which has the status of a third party to the company – for the personal composition of the company: a private-law organization whose structure is co-shaped by the provisions of the company’s articles of association.

Próximo ao efervescente núcleo minerador da freguesia de Nossa Senhora da Conceição de Guarapiranga, seus habitantes aproveitavam da possibilidade de angariar prestígio e sucesso econômico através da exploração aurífera, além da agricultura e pecuária, sem desatender o estabelecimento de um bom laço matrimonial.
