Willem Mengelberg is undeniably the greatest conductor in Dutch music history. In his biography, Frits Zwart carefully examines a musical life lived. Mengelberg was not only one of the world’s greatest, he had an excellent reputation as a trainer of orchestral ensembles, responsible for the international reputation of his own Concertgebouw as well as many others including the New York Philharmonic. A champion of numerous composers, including Mahler and Strauss, Mengelberg was the founder of the renowned tradition of annual performances of Bach’s St. Matthew Passion. As Chief Conductor of Amsterdam’s (now Royal) Concertgebouw Orchestra, Mengelberg developed it into one of the world’s most illustrious, simultaneously forging a music life of international eminence for its city of residence. His recordings bear witness to a singular musical interpreter. In 1920, Mengelberg was even more popular than his own Queen, yet a mere thirty years later he died in exile, banned to his remote Swiss chalet. Willem Mengelberg fell from grace, becoming a despised, disputed target of gossip, jealousy and rebuke. His dubious role during World War II has since overshadowed his extraordinary career. Zwart contests that few have ever surpassed Mengelberg‘s international musical legend.

Abstract:
This chapter examines the problems Aristotle’s discussions of bodily identity posed for Aquinas, who wanted to maintain that individual bodies would necessarily be reconstituted from their own matter at the resurrection. Aristotle appeared to suggest (in De generatione et corruptione) that a human body could remain the same despite the exchange—by wastage and nourishment—of all of its matter over a lifetime. So was the soul the only carrier of identity? Aristotle had little to say about the continuity of a body’s material after its death, and furthermore his Physics dispensed with atoms. Aquinas would rely heavily on Averroes in solving these problems. Central to the solution would be a concept of ‘body’ as a kind of ‘quantity’, or physical structure. In particular, Averroes endowed matter with a quasi-corpuscular structure of its own (‘indeterminate dimensions’), which fixed matter’s identity across change.

Abstract:
This chapter establishes the place of material continuity in Aquinas’s account of the identity between the mortal and resurrected human body, disagreeing with interpretations that imply the sufficiency of the soul in accounting for personal identity. It examines questions of food and cannibalism, and the role of the body’s dimensive quantity, or ‘accidental’ corporeal form, in guaranteeing its material identity. It discusses Aquinas’s account of postmortem bodily continuity, and his treatment of material identity across bodily decomposition. Here, Aquinas tries to rely on Averroes’ concept of a quasi-corpuscular structure in matter, arguing that traces of the body’s quantity can remain to identify its matter across decay. This conflicts, however, with an important Aristotelian principle—the priority of substance to accident. This highlights a fascinating point of tension between tradition and innovation in Aquinas’s thought. The chapter concludes with a focus on Aquinas’s discussions of Christ’s corpse, questioned at Paris.

Abstract:
This chapter gives a brief description of Hawking radiation, which involves a combination of general relativity and quantum field theory and leads to a thermodynamical interpretation of the laws governing the evolution of black holes. The study of the Penrose process near a Kerr black hole leads to the conclusion that its irreducible mass can only increase. A similar but more general conclusion was reached by Hawking, who showed that the sum of the areas of the horizons of black holes interacting with matter can only increase, with the condition that the cosmic censorship hypothesis is valid and that the matter obeys the so-called weak energy condition. The chapter concludes with the Israel theorem, which allows one to argue that if gravitation is described by general relativity, then not only do black holes exist, but all black holes are represented by the Kerr–Schwarzschild solution.

This chapter discusses the law on maritime claims. Maritime claims are civil or commercial matters and, as there is no special exclusion that puts them outside the subject-matter scope of the instruments, they are covered by both Brussels 2012 and Lugano 2007. The normal rules in Brussels and Lugano apply to maritime claims, both <i>in rem</i> and <i>in personam</i>. Thus, a maritime claim may be brought against a shipowner if the shipowner is domiciled in the Member State of the forum; and claims in contract or tort against a shipowner domiciled in another Member State may be brought under the appropriate provisions of Brussels 2012, Article 7. The chapter also covers the rules on salvage cases and proceedings for the limitation of liability.

The special feature of exclusive jurisdiction is that it has two aspects: not only does it confer jurisdiction on the specified court, but it also deprives all other courts of the jurisdiction they might otherwise have had. It may arise because of the intrinsic importance of the subject-matter for the country concerned, or it may be the result of the choice of the parties. The latter is the case with regard to choice-of-court agreements. This chapter considers the situations in which Brussels 2012 and Lugano 2007 lay down rules of exclusive jurisdiction that apply irrespective of the will of the parties. The relevant provisions are contained in Brussels 2012, Article 24 and Lugano 2007, Article 22. They apply even if neither party is domiciled in the European Union (or Lugano area). This chapter covers immovable property, companies and other legal persons, public registers, intellectual property, and enforcement of judgments.
