Full textThe Turkish mass-medias have a great influence and play a dominant role in shaping the public opinion and giving trends regarding evolutions of relationships between the EU and Turkey. Let us recall that the Helsinki summit in December 1999 approved its candidature to become full member of the EU. This candidature was refused on December 17, 1989 by the EC for economic and demographic reasons, but masking others, of a cultural and religious nature : the freezing of relations was unavoidable. The years 1990 will mark the brutal collapse of the USSR, reducing the place of Turkey in the favor of east european countries. In spite of the Association council EC-Turkey confirming criteria equality for all the applicant countries, the Luxemburg summit of December 1997 plead an economic delay and democratic deficiencies to move it apart from the European field. Having a chaotic but competitive economy, a dynamic society and a domestic market supported by a strong purchasing power from part of the population, Turkey has good chances. The permanence of a high inflation rate since the 90's and an uneven distribution of incomes remain nevertheless its weak points. Having the essential characteristics of a modern and laic State, the country is slow in implementing the institutional reforms needed to harmonize democracy and State of right as in European countries. The political and social life, since Mustafa Kemal Atatürk reforms, has been modelled on a Europeanization basis. The EU would be well advised to reinforce this large neighbor and NATO allied so that it can be viewed as model by other countries of the region. Its implication in Balkans along with Greek-Turkish relationships evolution are signs going in this direction. From the point of view of the European security, Turkey can assert its key position within the NATO. Suffering from a negative image, it must use new technology for get rid of generally accepted ideas. Its strengthening in various interior fields remains ignored by international opinion public. Having however the support of the United States and the invitation of Europe, an eventual final refusal is actually not on the air. Progress made to integrate the EU is a boosting factor, having to be used for the country and its population

Full textThe globalisation of communications has become a paradigm for the legal organisation of communications,which raises the question of how law can adapt to this process. Indeed, through the development of satellite communications and the integration of networks, of which Internet is the best known, sounds, images and data are now transmitted beyond national borders. The hypothesis of convergence, due to the digitalisation of information, brings into question the legal and technical separation of communication activities. However, underlying this process, policies are clearly in favour of worldwide legal model based on the logic of the market and competition regulations. This research work is an investigation of the two aspects of the globalisation process : the reality of technical progress and the symbolic importance of the process, characterised by lobbying for deregulation and liberalisation to promote competition and free market mechanisms

Full textIn the recent years, the audiovisual sector has seen a signifiant evolvement and development in the states members of OCDE. This expansion has been accompanied by development of the private audiovisual sector and a correlating unprecedented merger movement in the media sector both in Europe and the United-States. Faced with this movement, most of the democratic states are concerned as to the high level of integration of such a special sector. Consequently, by its potential negative impact on pluralism (and even to the democracy itself), they have tried to limit risks against pluralism. The methods used by these states have mainly focused on competition law and media law. Whether media law provisions, especially audiovisual communication law provisions, are effective tools sufficient to ensure pluralism, would not seem to be the case. Moreover, with technological changes in progress, we may wonder if the media sector should not merely and purely be subject to antitrust law, which is becoming more predominant in the media sector

Full textThere are huge institutional differences between France, Belgium and England, be it in the functioning of criminal justice or in child welfare. The policies adopted to fight against child sexual abuse therefore vary widely. However, the way in which child sexual abuse emerged as a policy issue has been similar in the three countries: the focus, the time frame, the actors, the dynamics and the discourse were identical. These “unexpected convergences” are difficult to explain with a purely institutionalist approach, since the latter generally pays scant attention to the emergence phase and tends to over-estimate the influence of domestic institutional constraints. Whereas the emergence of paedophilia can be explained as the result of a series of short-term (major cases) and long-term factors (the recognition of children as a category deserving public attention); of micro (role of actors) and macro-elements (transformation of the cognitive context), the convergence between these emergence processes seems to be due in part to the integration of a number of actors in international networks (international conferences and associations, epistemic communities). This gives rise to a series of boundary questions regarding: the contours of the policy issue (child sexual abuse having been redefined as a result of the emergence process); the boundaries of public policy, be they vertical (relationships with the international level) or horizontal (with the civil society); disciplinary boundaries, as the role of lay people suggests that we need to bridge the gap between public policy analysis and political sociology; and the role of the state, in relation to the private sphere

Full textAt a time when the model of media self-regulation is becoming increasingly popular in Europe, with an increasing number of press councils, but also at a time when the model is being fundamentally questioned following the Anglo-Saxon scandal of the News of the World, this research attempts to define the benefits and limits of media self-regulation for media freedom. In general, this research tries to show how the collective accountability of journalists can support and promote media freedom. In other words, this research explores the relationship between media freedom and accountability. It shows that if the State and the courts, as democratic representatives, can be attributed to better define the responsibilities of journalists ideally serving the public interest, others consider that journalists should rather define their responsibilities themselves in order to limit as much as possible the temptation of state control of the "watchdogs" of the democratic system. This research tells us that the right balance between regulation and self-regulation of the media depends on the nature of the political regime and journalistic cultures and traditions. It shows that a collective journalists’ accountability can promote and defend media freedom when safeguards exist to limit the exploitation of the system. It also shows that media self-regulation can in no way create the conditions for media freedom. Finally, this research highlights the benefits of media self-regulation in the digital era

Full textThis thesis proposes a reading of the representations of otherness in the press as a mean of constructing identity. On the basis of a French-Hellenic approach, we build a method for understanding the practices, the representations and also the bias of the mechanism for the construction of a European identity.The representation of otherness does not appear ex nihilo, but it participates in a strategy of repulsion and closure of the European identity towards the Other. This strategy is based in the transmission and the transformation of the discourses of differentiation that form an institutional mean for the construction of stereotypes towards the Other. Hence, another-space appears, into which the representation of reality it‟s reflected and crystallized.Therefore, a European identity it‟s constructed into a context of divergence, a fact that points out the stakes of its legitimization. Between an occidental heritage and different national interests, the policy for the construction of a European identity is established from a strategy of exclusion, which induce the European people to unite culturally in front of the risk of the Other

In fact we always have to take into account the impact of child care modes on this participation. For this reason, the presence of relatives in the household, who constitute a potential source for child care, has also an affect on woman's decision to participate in the labour force. Considering the impact of female participation on the labour market , we find that the increase in the number of women in the labour force has a negative effect on the wage level of younger workers

Full textEn ce qui concerne l’accès des émissions aux réseaux câblés, la thèse met en avant le besoin de sauvegarder un service public de l’audiovisuel. Celui-ci est défini comme un ensemble des règles qui visent à la fois le paysage audiovisuel propre à chaque Etat membre (par exemple pluralisme) et le contenu des émissions proprement dit (émissions informatives, éducatives, épanouissement culturel etc.). Le droit communautaire primaire et dérivé, tel qu’interprété par la Cour de justice, fournit les moyens de conciliation entre, d’une part les intérêts généraux et, d’autre part, les exigences découlant de la libre prestation de services et de la libre concurrence.
En ce qui concerne l’application des droits intellectuels, la thèse aborde la problématique liée à l’épuisement ou la subsistance de ceux-ci. Dans le cas de la câblodistribution, la Cour a affirmé la subsistance du droit. Cette position est corroboré par la nouvelle directive européenne sur le droit d’auteur et les droits voisins dans la société de l’information. La thèse appuie la position de subsistance en considérant qu’elle constitue une condition essentielle pour la juste récompense des auteurs.
Enfin, la thèse aborde les questions plus spécifiques qui naissent à propos de la convergence technologique et juridique. Tout d’abord, il est avancé que le service public de l’audiovisuel n’est pas uniquement lié à des contraintes techniques, mais essentiellement à des objectifs qualitatifs (contenu des émissions). Ainsi, la thèse plaide en faveur de la pérpetuité du service public de l’audiovisuel dans l’ère du numérique. Par ailleurs, des questions plus spécifiques (comme l’accès à la boucle locale, l’interconnexion des réseaux et la numérisation des infrastructures) ont été examinées.

Full textThis dissertation questions the identities of the Lusodescendents regarding the emergence of multiple identities in Europe. If focuses on the relationship between the identities observed in France and Portugal with the identities of the Lusodescendents, based on the results of a survey of 956 subjects living in the Île-de-France. The first part deals with the effects of European construction of identities ; according to the Eurobarometer data, it categorizes the evolution of identities in Europe during the period 1992-2002. The identities observed in France and Portugal are then more closely analysed, regarding the significance given by the two countries to European construction and migrations. Finally, it attempts to define the convergencies and specificities observed within the European Union, in terms of immigration policies, citizenship and nationality, relating to the national identities. The second part introduces a typology of the forms of identification of the Ludodescendents, wich focuses the analysis on the specific countries. Each type of identification suggest specific forms of valorization of the Portuguese origins, life in France and European construction. The relationd between forms of identities and attitudes, opinions and representations of the Ludodescendents are emphasized, regarding the following points : representations of France and Portugal, opinions concerning the Portuguese community in France and the Portuguese living in Portugal, perception of Portuguese origins, social contacts, values, educational norms, Portuguese language

Full textThe action of the European Union in the area of freedom, security and justice, testifies, since the beginning of 2000s, of an increasing interest for the minor. This is an evolution justified doubtless by changes, in Europe, about the position of the minor in society and in international migrations. These changes affect all the addressed matters (asylum, immigration, crossing of borders, civil law and penal law). We see, for example, a lot of unaccompanied minors in the migrations or the claiming of an increase of juvenile delinquency. Yet, if the minor must enjoy the same rights as every person, he must also benefit from a specific treatment to respect his autonomy and his vulnerability. This study wonders about the ability of the law of the area of freedom, security and justice, to grant to the minor a sufficient singularization and protection. For that, the analysis is interested in the normative interactions in this area (national, international and european norms) which will allow to underline improvements and faults of the EU law

For its part, the International Organization of Francophonie (IOF), which is not a regional integration organization, could not institute such an instrument and the Francophone identity is still at issue. Full textMigrations are a transnational phenomenon that its management has traditionally called attention from the destination states exercising its sovereignty. With the arrival of globalization, the migration perspective has changed. Migrations have an increasingly more important place in the government’s agenda, which has understood that migration management needed the cooperation and the joint action at an international level. The governance of migration involves multiple challenges for the destination countries as well as the countries of origin and for the international community. On one hand, it presents the interest of controlling the arrival of migrants, with a strong influence of security conceptions; on the other hand other ideas have immerged that consider migration as tools for development. Those ideas aim to profit from the effects that are considered as benefits of migration and to stop the negative effects. Finally, we consider the existence of the circumstances that can put in danger migrant’s human rights and for which some measures should be taken. Reconciling the interests surrounding the management of migration is not a simple task. For finding ideal management framework for the governance of migration and the protection of migrant’s human rights, we will explore 5 hypotheses. We will analyze the global administration of migration; the regional administration (in the framework of Latin America); the protection of migrants as vulnerable people having universal rights, as well as the protection from the migrant’s state of origin (in the particular case of Colombia). The assets and the challenges of each one of those discussion environments will be analyzed as well as its contributions to migration’s governance and migrant’s protection
