Full textThe Turkish mass-medias have a great influence and play a dominant role in shaping the public opinion and giving trends regarding evolutions of relationships between the EU and Turkey. Let us recall that the Helsinki summit in December 1999 approved its candidature to become full member of the EU. This candidature was refused on December 17, 1989 by the EC for economic and demographic reasons, but masking others, of a cultural and religious nature : the freezing of relations was unavoidable. The years 1990 will mark the brutal collapse of the USSR, reducing the place of Turkey in the favor of east european countries. In spite of the Association council EC-Turkey confirming criteria equality for all the applicant countries, the Luxemburg summit of December 1997 plead an economic delay and democratic deficiencies to move it apart from the European field. Having a chaotic but competitive economy, a dynamic society and a domestic market supported by a strong purchasing power from part of the population, Turkey has good chances. The permanence of a high inflation rate since the 90's and an uneven distribution of incomes remain nevertheless its weak points. Having the essential characteristics of a modern and laic State, the country is slow in implementing the institutional reforms needed to harmonize democracy and State of right as in European countries. The political and social life, since Mustafa Kemal Atatürk reforms, has been modelled on a Europeanization basis. The EU would be well advised to reinforce this large neighbor and NATO allied so that it can be viewed as model by other countries of the region. Its implication in Balkans along with Greek-Turkish relationships evolution are signs going in this direction. From the point of view of the European security, Turkey can assert its key position within the NATO. Suffering from a negative image, it must use new technology for get rid of generally accepted ideas. Its strengthening in various interior fields remains ignored by international opinion public. Having however the support of the United States and the invitation of Europe, an eventual final refusal is actually not on the air. Progress made to integrate the EU is a boosting factor, having to be used for the country and its population

Full textThe globalisation of communications has become a paradigm for the legal organisation of communications,which raises the question of how law can adapt to this process. Indeed, through the development of satellite communications and the integration of networks, of which Internet is the best known, sounds, images and data are now transmitted beyond national borders. The hypothesis of convergence, due to the digitalisation of information, brings into question the legal and technical separation of communication activities. However, underlying this process, policies are clearly in favour of worldwide legal model based on the logic of the market and competition regulations. This research work is an investigation of the two aspects of the globalisation process : the reality of technical progress and the symbolic importance of the process, characterised by lobbying for deregulation and liberalisation to promote competition and free market mechanisms

Full textIn the recent years, the audiovisual sector has seen a signifiant evolvement and development in the states members of OCDE. This expansion has been accompanied by development of the private audiovisual sector and a correlating unprecedented merger movement in the media sector both in Europe and the United-States. Faced with this movement, most of the democratic states are concerned as to the high level of integration of such a special sector. Consequently, by its potential negative impact on pluralism (and even to the democracy itself), they have tried to limit risks against pluralism. The methods used by these states have mainly focused on competition law and media law. Whether media law provisions, especially audiovisual communication law provisions, are effective tools sufficient to ensure pluralism, would not seem to be the case. Moreover, with technological changes in progress, we may wonder if the media sector should not merely and purely be subject to antitrust law, which is becoming more predominant in the media sector

Full textAt a time when the model of media self-regulation is becoming increasingly popular in Europe, with an increasing number of press councils, but also at a time when the model is being fundamentally questioned following the Anglo-Saxon scandal of the News of the World, this research attempts to define the benefits and limits of media self-regulation for media freedom. In general, this research tries to show how the collective accountability of journalists can support and promote media freedom. In other words, this research explores the relationship between media freedom and accountability. It shows that if the State and the courts, as democratic representatives, can be attributed to better define the responsibilities of journalists ideally serving the public interest, others consider that journalists should rather define their responsibilities themselves in order to limit as much as possible the temptation of state control of the "watchdogs" of the democratic system. This research tells us that the right balance between regulation and self-regulation of the media depends on the nature of the political regime and journalistic cultures and traditions. It shows that a collective journalists’ accountability can promote and defend media freedom when safeguards exist to limit the exploitation of the system. It also shows that media self-regulation can in no way create the conditions for media freedom. Finally, this research highlights the benefits of media self-regulation in the digital era

Full textLa famille est une notion paradoxale. Bien qu’universellement connue, elle n’est pas l’objet d’une acception consensuelle. Les différentes sciences sociales, ainsi que les différentes branches du droit ne parviennent pas à s’accorder pour en donner une définition unanime. La famille présente également le paradoxe de relever de l’intime tout en dépendant de la sphère publique en ce qui a trait à sa reconnaissance et à l’exercice des droits qui en découlent. Ces dernières années, la notion de famille a subi l’influence grandissante des droits fondamentaux et de l’internationalisation des relations personnelles. Le droit, norme rigide et générale, semble éprouver des difficultés à appréhender la complexité et la variabilité d’hypothèses familiales. Dès lors, l’utilisation de notions floues par le législateur offre au juge un pouvoir important d’appréciation de ce qui constitue une famille. Dans ce contexte, l’étude comparée de la jurisprudence de la Cour européenne des droits de l’homme et de la Cour suprême du Canada permet de mettre en exergue les éléments pris en compte par les juges au moment de se positionner dans un contentieux familial. Si l’élaboration d’une définition ne semble pas permettre de déterminer efficacement les contours de la notion de famille, l’utilisation d’un mécanisme semble, à l’inverse, offrir une approche plus souple du phénomène familial. Les variables au coeur du mécanisme utilisé dans cette étude sont au nombre de deux et correspondent aux multiples versants que peut regrouper une famille : un versant structurel, qui sera lui-même divisé en deux composantes, une juridique et une biologique, et un versant fonctionnel. Cette dichotomie permet de prendre en compte le réel et le complexe dans un domaine très évolutif. De plus, elle propose des clés de réflexion en invitant les juristes à penser la famille sans créer de liens de causalité entre les différents versants de la famille qui s’articulent constamment, se rencontrant souvent, s’opposant parfois.
Although universally known, there is no consensual agreement of the concept of family. The different social sciences, as well as the various branches of law, can’t agree on an unanimous definition. The family presents the paradox of being intimate while depending on the public sphere with regard to its recognition and exercising of the rights related to it. In recent years, the notion of family has been increasingly influenced by fundamental rights and the internationalization of personal relationships. The law, which is normally rigid, seems to have difficulty apprehending the complexity and variability of family situations. Therefore, the use of vague opinions by the legislator offers the judge more latitude of what constitutes a family. In this context, the comparative study of the jurisprudence of the European Court of Human Rights and the Supreme Court of Canada highlights the elements taken into account by judges when they take up family litigation. While the elaboration of a definition does not seem to be able to effectively determine the frame of the notion of family, the use of a mechanism seems, on the contrary, to offer a more flexible approach to the family phenomenon. There are two variables at the heart of the mechanism used in this study that correspond to the two sides a family can fall into: a structural side, which itself will be divided into two components, a legal and a biological one, and a functional side. This dichotomy makes it possible to take into account the real and the complex in a very evolutionary area. In addition, it offers the keys to reasoning by inviting jurists to think about the family without creating causal links between the different sides of the family that are constantly articulated, often agreeing, sometimes conflicting.

Full textThis thesis proposes a reading of the representations of otherness in the press as a mean of constructing identity. On the basis of a French-Hellenic approach, we build a method for understanding the practices, the representations and also the bias of the mechanism for the construction of a European identity.The representation of otherness does not appear ex nihilo, but it participates in a strategy of repulsion and closure of the European identity towards the Other. This strategy is based in the transmission and the transformation of the discourses of differentiation that form an institutional mean for the construction of stereotypes towards the Other. Hence, another-space appears, into which the representation of reality it‟s reflected and crystallized.Therefore, a European identity it‟s constructed into a context of divergence, a fact that points out the stakes of its legitimization. Between an occidental heritage and different national interests, the policy for the construction of a European identity is established from a strategy of exclusion, which induce the European people to unite culturally in front of the risk of the Other

For this reason, the presence of relatives in the household, who constitute a potential source for child care, has also an affect on woman's decision to participate in the labour force. Full textThis comparative analysis reconstitutes the conditions of emergence and institutionalization of public policies regarding the conciliation of family and professional life in France, Sweden and the United Kingdom at the beginning of the 20th century and during the 1960s, before questioning their evolution in the recent period of the 1990s to nowadays. Focusing on the forms and justifications by which governments have chosen to intervene in the organization of care services for young children and of parental leave measures, the analysis insists, on a first level, on the structural differences that dominate the national cases historically. On a second level, a series of recent gradual changes are demonstrated, following in the three cases a common pattern: One part forms a process of “defamiliasation”, indicating an intensified public involvement in the care of young children at the same time as an increasing variety in the provision of care services. The other part translates a process of “parentalisation”, pointing at a new public involvement in the organization of domestic care work within the family in order to favour parents’ professional participation as well as a more equal sharing of care responsibilities between women and men. The similar redefinition of the boundaries between public and private in the three countries indicates a convergence-trend, spurred by a more egalitarian public conception of gender relations. Considered in the context of an intensified European integration, this trend shows how European public policies are becoming ever more interwoven displaying a case of Europeanization where the influence of Europe can be neither certified nor excluded

Full textEn ce qui concerne l’accès des émissions aux réseaux câblés, la thèse met en avant le besoin de sauvegarder un service public de l’audiovisuel. Celui-ci est défini comme un ensemble des règles qui visent à la fois le paysage audiovisuel propre à chaque Etat membre (par exemple pluralisme) et le contenu des émissions proprement dit (émissions informatives, éducatives, épanouissement culturel etc.). Le droit communautaire primaire et dérivé, tel qu’interprété par la Cour de justice, fournit les moyens de conciliation entre, d’une part les intérêts généraux et, d’autre part, les exigences découlant de la libre prestation de services et de la libre concurrence.
En ce qui concerne l’application des droits intellectuels, la thèse aborde la problématique liée à l’épuisement ou la subsistance de ceux-ci. Dans le cas de la câblodistribution, la Cour a affirmé la subsistance du droit. Cette position est corroboré par la nouvelle directive européenne sur le droit d’auteur et les droits voisins dans la société de l’information. La thèse appuie la position de subsistance en considérant qu’elle constitue une condition essentielle pour la juste récompense des auteurs.
Enfin, la thèse aborde les questions plus spécifiques qui naissent à propos de la convergence technologique et juridique. Tout d’abord, il est avancé que le service public de l’audiovisuel n’est pas uniquement lié à des contraintes techniques, mais essentiellement à des objectifs qualitatifs (contenu des émissions). Ainsi, la thèse plaide en faveur de la pérpetuité du service public de l’audiovisuel dans l’ère du numérique. Par ailleurs, des questions plus spécifiques (comme l’accès à la boucle locale, l’interconnexion des réseaux et la numérisation des infrastructures) ont été examinées.

In countries where they are traditionally well established, if they don't break through, they remain an important player in political and parliamentary life, particularly in Cyprus, Czech Republic, Finland and Sweden. It is therefore relevant to question the phenomenon: why this return in force of the radical left parties? What are the causes? Who are the actors in favor of this renewal? Answering these questions can only be done through a comparative analysis.The thesis aims to answer two questions that have structured its writing:1 / why is the european radical left transforming itself, what are the factors causing this transformation by encouraging its leaders to operate it, and what is the nature of these transformations?2 / What are the objectives and expectations of these transformations, and how do they translate into the rallying of new voters in the elections?We start from the premise that a party does not change in vain. Full textEuropean families are nowadays an undeniable reality. This reality is taken into account through the emergence of a genuine European private international family law, understood as the set of rules of conflict of jurisdictions and conflict of laws provided by the European Union to apply to European family relationships. Given the novelty of the subject and the uncertainty of its constituent concepts, it is necessary to analyse the foundations of European private international family law, in order to be able to better understand it and to enhance its operation. The study ofthese foundations reveals the need to develop a European private international family law thatmobilizes all methods of private international law, effectively articulating them around the centralrole of the rule of conflict of laws, the real cornerstone of the system. The European Union is currently far from realising such a comprehensive and coherent system. Nonetheless it would be possible to overcome the failure of the current situation through the development of a European private international family law that effectively organises the plurality of national family rights,while ensuring the effectiveness of family duties. The European private international law should therefore incorporate the need to respect the national legal systems and effectively implement this respect through the elaboration of a system of private international law that is conceived around a rule of conflict of laws designed to take account of the inevitable national dimension of family law. The European Union, while offering a private international law respectful of the concept of a “plurieluniversel”, could hence (re-)discover the identity of the pluralistic unity in diversity. Thus, it could gradually let emerge the identity of a genuine European citizen, identifying herself and himself withthe diversity of national laws and the harmonious coordination of this diversity, not only in order to protect the fact that each national family law is the result of a democratic process in which citizens directly concerned can actively participate, but especially in order to guarantee that each Member State can continue to defend its national core values in the context of European federalism
