Full textThe emergence of mediation as an alternative dprocess in the United States and in France shows the real willingness of the American and French authorities to provide a concrete response to the problems of the civil justice, namely delay, costs and complexity of the procedure. Mediation is more flexible, faster and cheaper. For all these reasons, mediation can interest businesses in search for settled solutions rather than imposed decisions. Mediation can be judicial, that is to sayt it is proposed by the judge to the litigants while the trial has commenced, or contractual when the parties anticipate in a special clause the resolution of any difficulty arising of a contract by refering to mediation. In general, mediation is a contractual process in which the mediator assists the parties to use their right to negotiate agreements in order to settle their disputes but also to frame their business relations. This process is substantially different from the judicial procedure in the sense that it is essentially a form of negotiation: parties reach an agreement on a voluntary basis and thus they have the power to schedule the negotiation sessions as well as the final agreement. The primary goal of mediation is not the conclusion of an agreement because it is first a means of establishing dialogue between the parties so that they can engage in a reconciliation way. The parties’final agreement, generally named mediated settlement agreement, is essentially governed by the law of contract. If this contractual qualification is obvious enough because the agreement is the result of confidential negotiations between the parties, its international execution is far from being easy beacause of this contractual terminology

Full textThe Alternative Dispute Resolution methods (R. A. D. ) are sources of a large curiosity actually. Their identity, characteristics, and processes must be clarified to have a better knowledge. These R. A. D. , very innovative, are not completely successful in France, or even in United States or Asia. In France and Asia, they are rarely used. In the Untied States, it exist some very imaginative methods but practically, they are very uncommon. On the other hand, it seems that the R. A. D. Are more adapted to the international context where their development and institutionalisation are increasing. The international context is effectively more convenient for the use of new methods which are flexible, non coercive, non binding and very far from governmental laws. The processes proposed can be used anywhere, without any legal barrier. Among these methods, we can note the mediation (judiciary and not judiciary) success in France and abroad. The mediation seems to be the helpful alternative to classic justice

Full textTo create a channel of communication for those who are in most need, to learn to work and live together. Here are a few themes that reoccur once we(one)engage(s) in discussion with those working in Social Circus scene. I will summarize the two reasons that pushed me to make this research. Firstly, the desire to understand the function and evolution of the work of construction or reconstruction of social ties between children and adolescents in challenging life situations- particularly those from certain obvious minorities - and the rest of normal society. Secondly, the need to understand and to take note of how an artistic medium like that of the circus often considered archaic, old-fashioned and marginalized can have the tools necessary to aid minorities and be capable of helping them to develop their potential, build their self-esteem, enrich their lives, prevent social dysfunctions, solve problems and provoke social change on a personal level as well as a global level. The locations chosen for this research are: certain parts of North America and Brazil, particularly the state of Rio de Janeiro .Furthermore this study is intended to raise questions about what can be considered a discordance: the fact that those who would be most able to benefit from these programs are the least likely to be offered access to such an opportunity. I would also like to draw attention to the fact that African-Americans are still drastically underrepresented in the world of Circus Arts.How do we comprehend the implications of these programs ? How can strong, positive, social behaviors evolve inside of these places but also outside of their walls ? Precisely what role do these “Social Circuses” play when their aim is not primarily focused on training professional circus artists ?

Full textThe development of several forms of mediation between textile and fashion over a century and a haIf is a little-known sources of success of fashion and ready-to-wear in France. As of 1825 a designer from the Vosges mountains, Jean Claude, moved to Paris where he made sketches of proposals on behalf of its clients in Sainte-Marie-aux-Mines. He also sends samples of novelties that he identifies in Paris. In 1834 sampling becomes its activity. Established in the Sentier district in Paris, Jean Claude develops its activities toward industrials and from 1855 to schools (Roubaix) and associations of designers (Mulhouse). With a medal at the Exposition Universelle of 1878 in Paris Jean Claude's success bolsters new competition: sampling mediates the latest fashion trends towards professional textile in France and abroad. From 1920 the increased presence in Paris of buyers' offices for the department stores from New York drives the emergence of a new profession: the styling within the brand new 'bureaus of stylists ". It is also the beginning of a history in conversation between Paris and New York in the fashion world. After World War II American influence through women's magazines and productivity missions facilitates the development of women designers in Paris. In the late 1950s a first bureau of stylist is created and three others in the 1960s. Bureaus of stylist gain increasing influence thus confirming the role of mediation in the development of fashion

Full textFrom the beginning, Hollywood has used disparaging stereotypes about Latinos to create a series of threatening characters that give shape to the fears of the American society. This research focuses on the Latino film festival Cine Las Americas (Austin, Texas) and questions the explicit and underlying strategies used to deconstruct such stereotypes. First, the study analyzes the different phases that have allowed Cine Las Americas to become an institution between 1998 and 2017. The research also highlights the synergy with the city of Austin, « weird » Creative City, to show how it represents a fertile ground for the festival. It also situates Cine Las Americas in the historical context of Latino film festivals in order to understand their emergence at the turn of the millenium and their specificities.Second, after going over the Hollywood stereotypes about Latinos, the content of the movies from the first fifteen festivals (1998-2012) is analyzed to shed light on the corresponding counter-stereotypes, especially through the image of the migrant, the central figure of the movies about the border. The analysis sheds light on the unifying themes and the counter-narratives and questions Cine Las Americas’s Chicano heritage. Last, the research seeks to consider Cine Las Americas’s position in international and local networks from the beginning to 2017. It seeks to determine how the movies from « the Americas » are used to implement the anti-stereotype mission and to bring forth the collective figure of the Indigenous people, thus demonstrating how Cine Las Americas has become a Field-Configuring Event (FCE). This strategy confirms Austin’s driving force and portrays the organizors as cultural diplomats

Full textThe love triangle is an integral part of the structure and the syntax of Classical Hollywood Comedy. Based on this claim, we first highlight the place of this literary topos in the narrative construction, the mise-en-scene, the use of movie stars and the advertisement of 1930s-1940s Hollywood comedies, in the films of Ernst Lubitsch, George Cukor, Leo McCarey or Preston Sturges. Then, we draw from René Girard's literary and anthropological theory of mimetic desire and triangular conflict, and the two forms of mediations of desire he defines (the internal and the external mediations). This helps approach the way comedy illustrates the different expressions of desire of comic heroes, and the way conflict constitutes a vital part in any romantic process. It suggests how the genre ironically reworks Hollywood narrative conventions, its defense of romantic love and of modem democratic society, while seeming to perpetuate them faithfully
