Abstract:
In early 2012, 76 heavily armed police conducted a raid on a house in Auckland, New Zealand. The targets were Kim Dotcom, a German national with a NZ residency visa, and several colleagues affiliated with Megaupload, an online subscription-based peer-to-peer (P2P) file sharing facility. The alleged offences involved facilitating unlawful file sharing and United States federal criminal copyright violations. Following the raid, several court cases provide valuable insights into emerging ‘global policing’ practices (Bowling and Sheptycki 2012) based on communications between sovereign enforcement agencies. This article uses these cases to explore the growth of ‘extraterritorial’ police powers that operate ‘across borders’ (Nadelmann 1993) as part of several broader transformations of global policing in the digital age.

Recuerdo cuando daba clase para futuros químicos en una universidad presencial; cuando tocábamos el tema de la propiedad intelectual e industrial, hacía levantar la mano a todos aquellos alumnos que querrían patentar alguno de sus inventos, como por ejemplo un medicamento nuevo o un proceso químico innovador. La mayoría levantaban la mano. A continuación, mientras tenían la mano levantada, les pedía que aquellos que descargaran o hubieran descargado alguna vez un archivo de la red de forma ilegal, bajaran la mano. También, la mayoría las bajaban. ¿Era una paradoja? ¿Era una incoherencia fruto de la juventud? No lo creo, más bien son las dificultades de la época en que les ha tocado vivir.

Con la llegada de ciertos proyectos de vídeo a la carta al mercado español, como iTunes (2010) o Google Play (2012), la espera de Netflix (2011/2015) y Amazon (2012/2015) o el anuncio de la creación de Ultraviolet (2010), un portal de VoD que agrupa a los principales proveedores de contenido (entre ellos, a las majors de Hollywood), junto al cierre de Megaupload en 2012 por el FBI en Estados Unidos, se ha observado un interés creciente por parte de los medios de comunicación por el mercado del VoD en España. Este hecho, sin embargo, no tendría sentido en sí mismo si la propia industria en España -y con ello, el mercado del vídeo bajo demanda-, no hubiese madurado y contado con una oferta cada vez más completa.

Abstract:
This thesis examines the on-going anti-piracy and anti-file sharing measures taken by media conglomerates and big content as misguided attempts at addressing changing consumer expectations and social and technological norms. These measures include legislation such as the Stop Online Piracy Act (SOPA), Preventing Real Online Threats to Economic Creativity and Theft of Intellectual Property Act (PIPA), Anti-Counterfeiting Trade Agreement (ACTA), and Cyber Intelligence Sharing and Protection Act (CISPA); and litigation against both extremes of the spectrum: from the world's largest file sharing search engines like The Pirate Bay, and cyberlockers like MegaUpload, to private citizens who illegally downloaded a few movies or a few songs. The manner in which the entertainment industry's largest, most expensive, and highest-profile anti-piracy measures in the recent years have been received by groups from IT corporations to human rights organizations, researchers, politicians, legal and internet experts, and millions of citizens worldwide are of focus; and how this translates into an unpopular public image is explored. Piracy is underlined as a service and distribution problem, and various international studies are presented in exploring the relationship between illegal downloading and legal purchases.
