Abstract:
Parasomnias are complex behaviors occurring out of or during sleep. Parasomnias are increasingly presented as proof of an automatism in criminal cases involving violence. The sleep forensics expert must have an up-to-date understanding of current sleep science and research, diagnostic and clinical techniques, and the legal requirements of expert testimony and scientific evidence. Sleepwalking and related disorders typically follow sudden, partial awakenings from deep sleep. Higher-level cognition is severely limited or absent, and complex behaviors often consist of “automatic” behaviors not initiated or guided by memory or planning. Sleepwalking and related disorders are noted to occur during deep sleep and often require a genetic predisposition or priming factors. Prior cases of sleepwalking violence find that the victim of sleepwalking violence—most often a family member—seeks out the sleepwalker. The history of sleepwalking includes reports of episodes and sometimes criminal court cases of murder, assault, and rape.

Abstract:
Within the legal system an assumption exists that witness testimonies should be independent of one another; however the evidence suggests that this is frequently not the case. Witnesses commonly discuss the event with each other. It is important to determine the effects of cowitness information on the validity of eyewitness testimony. It is generally recognized that discussion between witnesses can be detrimental; the possibility of false information (or information that the participant never saw) entering recall is a key concern. We review the prevalence of cowitness discussion, legal opinions about cowitness discussion, and finally experimental research investigating the effects of discussion on eyewitness memory. We also provide some suggestions of how to prevent cowitness discussion and contamination of testimony.

Abstract:
This chapter examines defensive cyber operations in a fashion similar to kill chain analysis. It presents an outline of how baseline network defense is done, and what technologies and techniques contribute to that mission. This includes memory forensics, penetration testing, and incident response. It shows as well how those efforts are likely to be insufficient, and how advanced states have an incentive to go further and intrude into other states’ networks for defensive reasons—operations that are sometimes called counter-computer network exploitation. It is these intrusions, which are genuinely defensive, that can be misperceived and interpreted as offensive intrusions—leading to a cycle of escalation.
