Full textForeign trade plays an important role in economic development plans adopted by states : on the one hand, because imports are necessary for supplying industries and markets with products not manufactured on the spot, on the other hand, because exports help directly in solving the difficulties of balance of payments. Concious of the important role that foreign trade can play in the internal economy, four Latin American countries (Argentina, Brazil, Paraguay and Uruguay) decided to resort commercilally-oriented international legal instruments. Within the context of their reciprocal relations, these four countries sign on march 26, 1991 the treaty of asuncion, which will be the basis for the creation of the southern common market, mercosur, whose functionning will depend on rules adopted by organizations shared by these countries. On a world scale, Brazil,Uuruguay, Argentine and Paraguay are contracting parties, in order, to the gatt 1947 and on january 1995 they become members of the wto, in order to be able to participate more actively in multilateral commerce. The legal framework of commercial relations affected by easing of restrictions on trade, should also be adapted to promoting economic, even social, development in these four countries. However, this will not be an easy task, since the economic interests os states participating in international commerce are very often divergent

Full textThe MERCOSUR treaty does not correspond to any existing integration model on the international scene. This constitutive treaty adopted in 1991 has chosen a regional integration model different from the «European integration» model. The choice was made to embrace and transform the E. U. Vision and ambitions of the first models of integration to the specific characteristics of an association sui generis between developing countries. Because of this double choice, MERCOSUR is a « conceptual hybrid ». Influenced by pragmatism, MERCOSUR is an integration organization still « primitive » - rudimentary - which evolves legally and institutionally following needs and crises it goes through. Nevertheless, MERCOSUR is the fourth global trading force and for this reason an economical and commercial success. Backed by a legal personality under international public law since 1994, MERCOSUR has been a resounding success regarding its international outreach in recent years. However, the MERCOSUR treaty relations with third partners have an impact on the evolving organization. The MERCOSUR external activity is at the heart of two contradictory and logical trends of the Member States : control the MERCOSUR external policy and give MERCOSUR the ability to bind those partners in particular matters

Full textOHADA and Mercosur are two regional organizations that were created to enhance the integration and promote judicial and legal certainty for international traders. In other words, their goal is to help the economic development of member countries. From the operation of these two organizations, arbitration was favored as a means of resolving disputes in international trade. From there, it became possible to establish a link between the concept and the development of international commercial arbitration. Almost twenty years after the creation of OHADA and Mercosur, this study aims to assess the relationship between arbitration and development. This assessment is based on the observation of the influence of arbitration on the integration process and the contribution of this technique towards the improvement of judicial and legal certainty in international affairs

Full textSince 1999, the European Union began a new competitive approach in its relationships with Latin America and the Caribbean. In this respect, the first step has been made in the European Union-Latin America and Caribbean’ Summit [Rio Summit (1999)] with the launch of a new partnership called “Strategic Partnership”. In this context, all organisations of regional economic integration – not only the MERCOSUR the most competitive one – are considered as important partners. The change is due to external constraints as well as an external strategy. In the field of commercial exchanges, the goal is to attempt “mutual liberalisation of exchanges” on a fair and mutually profitable basis, defending at the same time “common values”. However, the traditional legal framework of the relations is obviously unsuitable for such an ambitious economic and political project. So, from a legal aspect, the European Union is confronted with the challenge of reforming the contractual frameworks of its relations with regional economic integrations in Latin America and in the Caribbean. The issue concerns an analysis of the evolution and restructuring of existing legal instruments of the European Union’s relations with Latin America and the Caribbean
Desde 1999, la Unión Europea instauró un nuevo enfoque en sus relaciones con América Latina y el Caribe. En este enfoque llamado “estratégico”, todas las organiza-ciones comarcales de integración económicas ubicadas en esta zona geográfica y no úni-camente el MERCOSUR, se pueden ver como interlocutores importantes. La primera cumbre Unión Europea /América latina/Caribe (cumbre de Rio) es una fecha importante en la evolución de las relaciones gracias al lanzamiento “de la colaboración estratégica”. En lo que toca a los intercambios comerciales, la meta declarada es alcanzar una “liberalización mutual de los intercambios” a partir de una base equitativa y mutualmente provechosa de-fendiendo a la vez ciertos valores comunes. Sin embargo, el marco jurídico en vigor durante una larga temporada se ha reve-lado inadecuado para el advenimiento de una ambición económica y política de esta impor-tancia. Por consiguiente, la Unión Europea se enfrenta hoy en día al desafío jurídico de la renovación del marco convencional de sus relaciones con las organizaciones de integración económica de América Latina y del Caribe. El asunto se refiere a un análisis de las rela-ciones exteriores de la Unión Europea desde el punto de vista de los desafíos jurídicos. Utilizamos el análisis sistémico para poner de relieve los factores explicativos de la evolu-ción y de la reestructuración actuales de los instrumentos jurídicos de las relaciones entre la Unión Europea y América-Latina Caribe

Full textBoth the European Union (EU) and the Southern Common Market (MERCOSUR) have constructed different public policies for the recognition of diplomas for either academic or professional purposes. The aim of these policies is to facilitate the mobility of its respective graduates within the countries members of each region.Despite the fact that they are two different regional integration processes, the construction of academic and professional recognition policies have several similarities. The two policies were spread out in two axis, an academic one and a professional one, as if they were fully separated areas from each other. Hence, we analyzed four issues in this work. First, the process that launches the European Commission (EC) in the early 1970s with the sectorial directives for the “regulated professions” and which, after various changes, culminating in Directives 2005/36/EC and 2013/55/EU. Second, the process initiated with the Erasmus Program’s implementation in 1986. This program provides the technical support for the intergovernmental launch the “Bologna process” in 1999. Third, in 1998 MERCOSUR decided to build a first experimental accreditation instrument of academic programs at the regional level (MEXA). After several changes, it has become a permanent device: the ARCUSUR. Finally, the Ministries of Foreign Affairs of MERCOSUR members have made some progress in implementing a protocol for the regional services sector and followed by different negotiations, the Council of the Common Market allowed the temporary professional practice from another device: Decision 25/2003. This dissociation between academic and professional recognition invited us to analyze two distinctive phenomenons. On the one hand, is to question the contemporary relations among the State or the EC and the different professional associations, the university and the construction of the divers European or MERCOSUR policies. And on the other hand, is to analyze the role of the State and the EC in the construction and the relation with normative or “recommendations” from international organizations
