Abstract:
Grzegorz Malec’s “There Is No Darwin’s Greatest Secret”, a review of my book Nullius in Verba: Darwin’s Greatest Secret, takes one extremely minor finding from my book and, despite his best efforts, manages to disconfirm just one of thirty examples of that minor finding. He then takes that one disconfirmed mere minor example and presents it as evidence that he has disconfirmed all the original major findings in my book. By so doing, his deceptive review goes far beyond the counter-academic deviance of mere cherry picking, it is more a case of gross misrepresentation to the point of de facto fact denial amounting to historic revisionist behaviour.

Abstract:
ABSTRACTMedieval epistemology begins as ideal theory: when is one ideally situated with regard to one's grasp of the way things are? Taking as their starting point Aristotle's Posterior Analytics, scholastic authors conceive of the goal of cognitive inquiry as the achievement of scientia, a systematic body of beliefs, grasped as certain, and grounded in demonstrative reasons that show the reason why things are so. Obviously, however, there is not much we know in this way. The very strictness of this ideal in fact gives rise to a body of literature on how Aristotle's framework might be relaxed in various ways, for certain specific purposes. In asking such questions, scholastic authors are in effect pursuing the project of social epistemology, by trying to adapt their ideal theory to the circumstances of everyday life.

Abstract:
It has been argued that some recent experimental findings about the mere exposure effect can be used to argue for aesthetic antirealism: the view that there is no fact of the matter about aesthetic value. The aim of this article is to assess this argument and point out that this strategy, as it stands, does not work. But we may still be able to use experimental findings about the mere exposure effect in order to engage with the aesthetic realism/antirealism debate. However, this argument would need to proceed very differently and would only support a much more modest version of aesthetic antirealism.

Where does the quality of an artwork reside? Is it in the work or in the perceiver and her culture? Belief in the former can be called aesthetic realism, the latter aesthetic antirealism. Nanay suggests that Cutting is an antirealist because he has found that multiple brief exposures to an artwork enhance viewers’ judgments of it. In fact, Cutting is agnostic on the distinction, but as a scientist is unable to discern how quality might be objectively measured in art.

Internet memes, which constitute a significant portion of social-media content and an important vector of users’ communicative exchange, have by now turned from mere entertainment to a news source. However, they are still approached rather uncritically by young audiences. A survey was conducted among Russian students (N = 138) at the National Research University Higher School of Economics, and it identified not only the “problem spots” of the Russian memosphere but also a number of skills in decoding information, which are necessary today as part of “Meme Literacy.” These skills range from an adequate assessment of the type of message and verification of the news topic to the fact-checking of the verbal and visual content the meme is based on.

AbstractThe great bulk of what we are pleased to deem knowledge comes to us via the words of others. But such knowledge is limited to (mere) information or plain fact. Theoretical, Ethical and Aesthetic discourse are three regions in which, even when we accept the words of others, we transmit content with what I dub prefaces, not flatly, not in our own voice. Explanation of this is suggested: in these regions assertions claim truth without claiming knowledge. So fact-theory and fact-value differ from plain fact for similar reasons, reasons which alleviate the urge to downgrade ethical discourse to the expressive or prescriptive.

Abstract:
In this era of internationalism and multiculturalism, some music programmes may be hanging by this very thread: the belief that through the mere exposure of students to ‘songs from many lands’, a cultural harmony and a multicultural understanding might be achieved. Yet the question must arise among educators as it has frequently done among ethnomusicologists throughout the twentieth century. Is music, in fact, universally understood? And with little or no formal education to undergird the culture-specific meanings that music may encompass? This paper will review relevant ethnomusicological literature from the turn of the century onward, in an attempt to make sense of the truth or deception behind the statement music, the universal language’, and as a means of seeking out why romantic notions and politically-correct directives may be driving the continuance of the premise that ‘all music is created equal’. Emic and etic views of music, and issues of bimusicality and multimusicality are also addressed relevant to teaching music from the perspective of diversity (culture-specific distinctions) or universality (homogenous properties).

”Merely fact-minded sciences make merely factminded people.”“ …the positivistic concept of science in our time is, historically speaking, a residual concept. It has dropped all the questions which had been considered under the now narrower, now broader concepts of metaphysics….all these ‘metaphysical’ questions, taken broadly – commonly called specifically philosophical questions – surpass the world understood as the universe of mere facts. They surpass it precisely as being questions with the idea of reason in mind. And they all claim a higher dignity than questions of fact, which are subordinated to them even in the order of inquiry. Positivism, in a manner of speaking, decapitates philosophy.”Edmund HusserlIn ethical literature associated with controversies at the beginning and end of human life, there is often a two-part structure: first, basic facts about the topic are presented in a more or less descriptive format, then there is the ethics or policy.

Abstract:
The typical method of acquiring a property right involves transfer from a previous owner. But sooner or later, that chain of transfers traces back to the beginning. That is why we have a philosophical problem. How does a thing legitimately become a piece of propertyfor the first time?In this essay, I follow the custom of distinguishing between mere liberties and full-blooded rights. If I have thelibertyof doingX, then it is permissible for me to doX. But the mere fact that I am at liberty to doXleaves open the possibility that you might be at liberty to interfere with my doingX. Accordingly, liberties are not full-blooded rights, since my having arightto doXhas the additional implication that others are not at liberty to interfere with my doingX. When it comes to mere liberties, interference is not a violation. You can violate rights, but you cannot violate liberties.

Abstract:
N. L. A. Et u.
Between 1962 and 1977, the m. P. L. A. (the popular movement for the liberation of angola), an anticolonial organisation whose creation was marked by many controversies, put into place a more or less coherent political-military structure with a rather weak theoretical base. It was subsequently characterised by numerous crises and recurrent dissensions which led to a strengthening of the structural base, but contributed to a turbulent history whose major points will be discussed in this paper. These crises and dissensions were the result of socio-cultural, ethniclinguistic, regional, racial and ideological oppositions within the movement itself and continued when the m. P. L. A. Became a party-state. These events took place against a background of a difficult and fragmented guerilla struggle, poorly equipped and culminating in a most fragile independence. After the collapse of the colonial regime, within an international and regional context of the cold war, the m. P. L. A. , against all expectations, managed to supplant its rivals (f. N. L. A. And u. N. I. T. A. ) and unilaterally take over power in angola. To do this, the m. P. L. A. Made full use of its local and international alliances, particularly that of the socialist bloc. This, however, influenced internal developments in the country (notably, the so-called "nitiste" cris in 1976-77) as well as its future political-ideological choices on the international

This thesis is presented as a volume of 416 pages divided in four chapters followed by a bibliography encompassing 39 authors and assembling 120 books or articles. As a clinical thesis it is articulated around the symptom as a formation of the unconscious and the phantasy from the point of view of the clinical verification. These aspects are articulated to the unconscious question of the maternal other making irruption in the the child's body by the effect of a deleterious source of an unconscious satisfaction that the organic pathology can represent. Having demarcated her area, the choice is justified by the clinical field from which the author submits her methodological choices and her theoretical objectives to the imperatives of the treatment. In the first chapter the pathogenic impact of the phantasy through the irruption of an organic symptomatology of an infantile asthma is illustrated. The second chapter entitled + from the irreducible of the trauma to the implication of the subject in the desire ; presents the case of lesions leading the subject to undergo an hysterectomy. The following chapter is consecrated to the intricacy of the symptom and the phantasy finding its clinical counterpoint in the case of blindness in cambodia. An approach of epileptic seizures is presented in the last chapter dedicated to the definition of what the author defines as + a clinic of anguish ; the latter constituting + a non preventive dimension of the symptom ;. An intermediate function between "jouissance" and desire, anguish can play an operational role in the treatment. This approach of going beyond the limit of the anguish justifies the clinical hypotheses underlying the proposed work. This thesis aims to bring - in a perspective rigorously circumscribed to the psychoanalytical clinic - an instrument that puts at work a fundamental concept of the human being at the crossing of a clinic of affects such as the anguish and a clinic of representations

Abstract:
Biotechnologies' evolution has allowed for a wider general use of organs and products of the human body. The individual as well as research centres and industries can dispose of the human body in a way unimaginable up to now. Juridical and ethical debates seem to show an opposition betwen two points of view. On one hand there are those who think of the body as object, which allows the person to have a subjective right on it. On the other hand there are those for whom the body is untouchable and unvaluable for the person. The complexity fo the "body question" makes this type of dichotomy insufficient. Indeed, the body is subject and object at the same time. Its is sacred under certain circunst ances and instrumental under others. To think abour the very problem differently we try to underline the difficulties encountered by law as well as the obstacles confronted by scientific thoug, by means of a multidisciplinary approach of the problem (historical, juridical and philosophical); this will be done through inserting the matter within its historical context and offering a perspective that intergrates the different aspects of the human body

Abstract:
"Beyond Anglo-French prejudices. French and British leaders facing anglophobia from Fashoda (1898) to Mers el-Kébir (1940)". Had anglophobia a decisive impact on the policy-making of French and British leaders at the end of the 19th and the beginning of the 20th centuries? This dissertation relies on official and local documents, as a means of testing whether anglophobia, defined as a "systematic" hatred of Britain, had penetrated the elites. Although certain individuals in this period are more anglophobic than others, they do not manage to construct a coherent grouping. At the opposite end of spectrum, a long tradition of anglophilia was rejuvenated by the 1904 Entente cordiale. Many elites tried to develop ever closer ties between France and Britain, throughout the period. The term "anglophobia" is not therefore appropriate to describe relations between Britain and France at this time. It is the view of this thesis that "historical myths" is a more fitting and nuanced descriptor

Abstract:
As a semi-enclosed sea, the Mediterranean sea is particularly vulnerable to pollution. Maritime transport make an handsome contribution to it. It causes accidental discharges and operational ships gener ated wastes due to the numerous tankers and chimical bulks that cross the Mediterranean sea daily. Despite the important preventive policy framework erected in the 1970' in order to protect the Mediterranean sea, maritime pollution is still poorly controlled in this area. This inefficacy of preventive policy framework is largely due to flag states failing to control ship conformity that is too weakly counterbalanced by port states controls. Mediterranean harbors under-equipment of reception facilities for ship residues is likely to contribute to the failure of the elimination of operational pollution. .

Schneider, Frédéric. "Les energies marines renouvelables face au droit." Thesis, Nice, 2013. http://www.theses.fr/2013NICE0010.

Full text
Abstract:
The issue of marine renewable energies raises complex legal problems which interest the Law in its International, European and Domestic dimension. The effervescence of public and private initiatives on the matter requires a tailored approach to improve and develop legal instruments to support development of ocean energies. This approach elicits three levels of analysis. According to the International Law, it is marked by an environmental objective resulting from public interest. In this sense, marine energy conversion does not generate greenhouse gas emissions and its impact on the marine environment is generally minimal. With the help of these renewable energies, States will be able to respect their supranational commitments, particularly regarding climate change. In addition, the Law of the Sea provides legal certainty in the use of ocean space, by defining not only rights but obligations to coastal states. At the European level, legal certainty is connected to the target of at least 20 % share of energy from renewable sources in the Union's gross final consumption of energy by 2020, and is especially encouraged by the North Seas Countries' Offshore Grid Initiative in the context of the Europe's emerging renewable energy market. On a National perspective, the analysis of Comparative Law highlights the best practices related to offshore renewable development in terms of promoting investment and sustainable ocean management

Abstract:
This commentary analyses Article 9.1.7 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning a right assigned by mere agreement between the assignor and the assignee. Art 9.1.7 stipulates that a right is assigned by mere agreement between the assignor and the assignee, without notice to the obligor. The consent of the obligor is not required unless the obligation in the circumstances is of an essentially personal character. The fact that an agreement in writing is not required is implied by the reference to a ‘mere’ agreement. However, some formal requirements may apply due to mandatory rules of the applicable domestic law which apply under Art 1.4. Some legal systems distinguish between the effectiveness of the assignment of a right as between the assignor and the assignee (inter partes) and as towards third parties, such as the obligor or creditors (erga omnes). This commentary also considers the burden of proof relating to the essentially personal character of the obligation.

Abstract:
Arguing that it is a mistake to understand the moral community’s ratification of new moral norms along the lines of a political community’s adoption of legal norms, this chapter characterizes the ratification stage as involving a broad, inclusive awareness among living persons of the fact of global convergence on what is by hypothesis a new candidate moral norm and of each other’s reflective acceptance of this norm; and a broad and inclusive acceptance of the process whereby a new norm reasonably arose at all three stages (input, convergence, and ratification) and in how they interconnect. Limiting the participants needed for ratification to those presently alive is appropriate in light of the facts that living people anyway do more to influence future generations by establishing mere conventions than by creating new moral norms, and that future generations would have the power to rescind any new moral norm.

Homo Sacer, Giorgio Agamben’s transformative twenty-year project in political ontology, is framed at its very outset in terms of Aristotelian philosophy – read, as we will see, from a strongly medieval, Heideggerian and Arendtian perspective. As a locus classicus of the juxtaposition of the two Greek terms for life, zoe (‘the simple fact of living common to all living beings’) and bios (‘the form or way of living proper to an individual or a group’), Agamben (HS 1–2) cites a passage in Aristotle’s Politics that notes that there is a certain ‘natural delight (euemeria) and sweetness’ in the ‘mere fact of being alive itself’ (to zen auto monon), which makes human beings hold on to it for its own sake, provided that the mode of life (bios) that this being-alive amounts to is not fraught with excessive difficulty.

Abstract:
This chapter explores the defences available to a prima facie case of abuse. Two preliminary issues had to be clarified first: the burden of proof and the thresholds of anti-competitive effects. When a prima facie case of abuse has been established, the dominant undertaking acquires the burden of adducing sufficient evidence to substantiate a defence. This calls for the determination of the degree of probability of the anti-competitive effects that the competition authority or claimant must prove. Defences under Article 102 can be divided into mere defences and objective justification. Mere defences do not plead a new primary fact but are limited to challenging the weight or significance of the evidence adduced by the competition authority or claimant. Objective justification is a defence that pleads a new primary fact consisting of benefits that contribute to long-term social welfare maximization.

Abstract:
we’ve laid the foundations. Now we’ll build the building. But first, let’s take stock. A large bunch of software ideas have paraded gamely past the reviewing stand one-by-one, trumpets blaring; and by this point, it may no longer be easy to keep them all straight. So here is a quick summary. Garden-variety infomachines are (of course) a fact of life. Ensembles are also a fact: Programmers build and run them every day. Linda is a fact; its presence continues (at least for now) to expand, as a research topic and as a practical tool. The roping together of networked computers into a single “hypercomputer” is a new fact— esoteric stuff; but it’s such an obvious and compelling idea, and it’s working so well in practice, that it continues to come on strong. The world Tuplesphere is of course a non-fact. It’s a mere forecast. But—some sort of integrated worldwide communication scheme, based on persistent information objects, will eventually exist. That’s a forecast that is almost inevitable. The Trellis as a working ensemble is a fact. Substantial prototypes are up and running; they perform as advertised. The Trellis as a daily tool is a mere forecast. The Trellis is still a creature of the research lab; but it’s packed and ready to leave home. The FGP infomachine is a fact, too: Real prototypes are up and running. Like the Trellis, it’s still a laboratory creature. Like the Trellis, it will be ready to leave home soon. But the FGP infomachine that leaves home first will be a simple, in some ways primitive version of the system that further research will eventually produce. An FGP machine that can cope with “emotion,” with full-fledged pseudomemories or with human language is a mere forecast. Of course, we don’t need all this fancy stuff for a Mirror world. The FGP software that exists today isn’t far from meeting all of our immediate Mirror world needs. These are the Mirror world’s ingredients—Trellises and FGP machines; above all, ensembles, and the software technology to build them cleanly and support them efficiently. The raw materials are in place.

Abstract:
With more and more courses being offered online teachers are constantly being asked to change their teaching style. Online courses have taken another turn with the innovation, which are the MOOCs. MOOCs being non-fee paying courses, delivered mostly by recognised universities, course organisation and management was bound to change. With less than 10% successful completion rate for MOOC courses and keeping in mind the Mauritian context, the Open University of Mauritius decided to offer a hybrid MOOC. By hybrid Daniel Peraya suggests blended courses that is online training and face-to-face sessions. It is more about tutoring and guiding students rather than mere teaching. Our main objective is to show the effectiveness of a Hybrid MOOC in terms of organisation and course structure. The methods used in this paper are: a survey questionnaire and data from a Moodle platform. The fact that this course has been organised in a blended mode has helped the participants to reach the end of the training with a higher completion rate, face to face sessions helped students to interact, the use of Moodle as an additional platform accessssed by a restricted number of participants proved to be helpful to get aquainted to online learning.

Abstract:
Abstract It has become obvious that certain singular phenomena cannot be explained by a mere investigation of the configuration space, defined as the solution set of the loop closure equations. For example, it was observed that a particular 6R linkage, constructed by combination of two Goldberg 5R linkages, exhibits kinematic singularities at a smooth point in its configuration space. Such problems are addressed in this paper. To this end, an algebraic framework is used in which the constraints are formulated as polynomial equations using Study parameters. The algebraic object of study is the ideal generated by the constraint equations (the constraint ideal). Using basic tools from commutative algebra and algebraic geometry (primary decomposition, Hilbert’s Nullstellensatz), the special phenomenon is related to the fact that the constraint ideal is not a radical ideal. With a primary decomposition of the constraint ideal, the associated prime ideal of one primary ideal contains strictly into the associated prime ideal of another primary ideal which also gives the smooth configuration curve. This analysis is extended to shaky and kinematotropic linkages, for which examples are presented.

In ASME 2012 Internal Combustion Engine Division Spring Technical Conference. American Society of Mechanical Engineers, 2012. http://dx.doi.org/10.1115/ices2012-81045.

Full text
Abstract:
Fuel efficiency is now the over-riding engine development objective. With approximately 50–60% of the input fuel energy in an internal combustion engine lost through thermal and mechanical inefficiencies, friction has been targeted as the arch nemesis in any engine development program. A significant portion of the parasitic frictional losses is due to the top compression ring. This suggests that optimization of tribological performance of the compression ring conjunction warrants much more attention that it has been hitherto afforded. Studies reported thus far take into account ring-bore conformance, based on static fitment of the ring within an out-of-round bore, whose out-of-circularity is affected by manufacturing processes, surface treatment and assembly. The various static fitment analyses presume quasi-static equilibrium between ring tension and gas pressure loading with the generated conjunctional pressures. This is an implicit assumption of ring rigidity whilst in situ, which is in fact not the case in practice. The transient nature of combustion variation means that mere static or quasi-static force balance is inappropriate. Furthermore, the bore is not a right circular cylinder. Thus, its radial cross-sectional out-of-roundness and its axial variation introduce further transience in the ring-bore conformance. Consequently, the net force applied to the ring induces its modal behaviour, which accounts for its instantaneous in situ shape within the bore. These considerations are not taken into account in the often idealized ring-bore tribology. The paper provides transient solution of ring-bore conjunction, when subjected to ring in-plane modal behavior, when the conjunction is subjected to a mixed regime of lubrication, comprising hydrodynamic viscous action and boundary interactions.

Full text
Abstract:
Abstract For more than 10 years, silicon thinning techniques have been relegated to an art form of mere necessity to enable complex optical probing and circuit edit analysis. Silicon thinning is a fundamental aspect of diagnostic analysis and while it is well-understood that limitations in the area of silicon thinning can severely limit high-quality diagnostic results, poor thinning results have generally been accepted as standard environmental operating conditions with which optical probe and circuit edit engineers must cope. Presented here is a scientific approach to thinning silicon to enable predictable high-precision, high-quality results. Remaining silicon thickness (RST) has been debated throughout the years because it was uncertain how much thinning was excessive. Primary perceived limitations included mechanical constraints (package / die warping) and post-thinning thermal control. Adding to the complexity of the discussion has been the fact that RST has been largely uncertain because analysis usually involved determining how much silicon was removed rather than how much silicon remains. All of these challenges have been overcome. A novel process has been developed to ultra-thin bulk Si to as low as 10um remaining Si thickness, eliminating the need for the Laser Chemical Etcher for circuit edit and improving optical emission probing considerably. This sample preparation process has been used on Intel Core2 Duo products with a success rate of 98%. Post FIB unit testing is a critical step in this debug process. A technique was developed to calibrate the change in thermal resistivity of the ultra-thin unit such that it will remain within 100ps of its original FMax performance in 90% of tests.

In ASME 2013 International Mechanical Engineering Congress and Exposition. American Society of Mechanical Engineers, 2013. http://dx.doi.org/10.1115/imece2013-64250.

Full text
Abstract:
The emergence of a defect in a mechanical system is always associated with a change in the vibration’s behavior in the spectral and temporal domains. Fault detection by vibration analysis is based on monitoring the behavior of a mechanical component by examining the evolution of fault indicators in real time. However, mere traditional bearing diagnosis is not sufficient to ensure effective and reliable assessment of the component’s health condition. Coupling several fault indicators extracted by different signal processing technique adds more reliability and accuracy to the diagnostic process. Classifications methods are used to analyze the evolution of fault, yet only static methods are solicited which results in overlooking a great source of useful information. In fact, fault indicators issued from turning machine are evolving; they change constantly over time, particularly when the defect is growing. In such situations, static classification methods are a poor choice that deprives the user of the information conveyed in the evolution of the indicators over time. The dynamic classification of fault indicators in dynamic classes can provide useful information about the behavior of the damaged bearings. This information can also be used to predict the end of life of the components. Unlike the static classification, the dynamic classification introduces a new dimension (time), which allows real-time detection of the fault and better visibility of the bearing behavior revealed by the motion and the temporal evolution of classes formed by the indicators. This paper proposes a dynamic classification method that uses several fault detectors to assure the accuracy of the diagnostic and follow up any changing in the behavior of the bearing by analyzing the classes’ time evolution. The proposed multi-features dynamic classification is a new method for fault detection and health condition monitoring for bearings; this technique utilizes multiple features, including traditional features extracted from the raw signal, two special features extracted by wavelet analysis, and the spectral kurtosis, coupled with a nonlinear principal component analysis. This method of classification clusters the multi-features into several classes, the first class represents the healthy state of the bearing, and the other classes represent different damaging state. Monitoring the evolution of the” defective condition” class allows us to draw several useful information, such as the rate of degradation, the relationship between the cluster’ surface and density and the bearing state. The chosen dynamic classification method will be validated by analyzing several degradation bearings from a fatigue bench of thrust ball bearings SNR51207.

Full text
Abstract:
Along with the development of computing technology, large-eddy simulation turns to be a useful tool for practical study. For fast estimation, the front line researchers still use the Reynolds-averaged Navier-Stokes (RANS) method nowadays. RANS still is the major tool for gas turbine chamber (GTC) designers, but there is not a universal method in RANS GTC spray combustion simulation at present especially for the two-phase turbulent combustion. Usually there are two main steps in two-phase combustion: the liquid fuel evaporation and the gas mixture combustion. Thus, three widely used turbulent combustion models: the Eddy-Break-Up and Arrhenius model (EBU), Laminar Flame-let Model (LFM) and Eddy-Dissipation-Concept (EDC) turbulent combustion models are firstly tested against a methane-air turbulent gas jet flame (Flame D) measured by Sandia Lab and next a two-phase turbulent swirl spray combustion in a complex GTC. The predictions of the LFM model are the best in jet flame simulation to show its ability in gas combustion prediction. The comparison between the simulation results and the experimental results showed that LFM model could properly consider the interaction between turbulence and chemistry in the gas combustion in most regions; EBU model overestimated the turbulent effect in most regions; though EDC model takes the chemistry effect into account, the turbulence seems be overestimated too. The simulated GTC performed well in experiments especially when the fuel-air mixture equivalence ratio (MER) in its main-reaction-zone (MRZ) is 0.7, so the three combustion models are all applied in this case, with the same 90° spray angel, same material properties and the same discrete ordinates (DO) radiation model. In LFM prediction, the high temperature regions are distributed around the margin of the circumfluence zone and the downstream regions after MRZ, which does not agree with the test observation. The LFM model deals well with the gas combustion, so the reason for this poor performance must be of kerosene evaporation. LFM model is a fast-chemistry model, but the kerosene reaction rate is not very fast and the evaporation makes the global reaction slower. Furthermore the mixture fraction is a conservation scalar in FLM model but it is changed by the kerosene evaporation especially in the MRZ where the kerosene was mainly vaporized. Generally, the EBU and EDC results are better: the high temperature regions are mostly in MRZ when MER is 0.7. The EDC model also has good predictions of different MERs in MRZ. When MER is 1.3, the unburned kerosene continue reaction after primary-air-holes; when MER is 0.3, there is nearly no kerosene there. Additionally, effects of the spray angle, material property are studied.
