Full textMarine protected areas (MPAs) are increasingly considered for their ability to improve species conservation and, potentially, fisheries yields via the export of fish and larvae to fished areas. Critical knowledge gaps remain on the impacts of fish movement for MPA functioning and on how MPAs protecting moderately to highly mobile populations may be effective without being extremely large. Here, different models are used to address these knowledge gaps. First, a conceptual model was developed to explore the impacts of fish movement versus larval dispersal on MPA effectiveness. Results demonstrate that fish movement has a stronger negative impact on population persistence in MPA networks than larval dispersal. Redistribution of the fishing effort formerly in MPAs and concentration of fishers on MPA borders dramatically reduce persistence and yields for mobile populations, while they marginally change results for populations with dispersing larvae. Two applied models examining the effects of MPAs targeting specific fractions of migratory populations were then developed. A spatially-explicit model was used to study the effects of MPAs on two South African hake populations undergoing ontogenetic migrations. Results show that MPAs targeting juveniles considerably increase hake spawning biomass. This increase in biomass improves the yields of some, but not all fishing fleets. A per-recruit model was used to assess MPA effects for reef populations migrating to form transient spawning aggregations. Applying the model to two populations from Seychelles, MPAs protecting spawning aggregations are found to improve fish reproductive potential in general, but not yield-per-recruit

Full textThe evolution of contemporary international law often leads to the question of its fragmentation. The presence, in the Law of the Sea, of both a universal and a regional approach contributes towards nourishing this debate.The present research focuses on the relationships, in terms of interaction, between universalism and regionalism within the Law of the Sea. It attempts especially to understand the mechanisms of these interactions and their stakes.At first, the study is devoted to the analysis of normative and institutional interactions. One can observes that the cleavage of the legal order of the seas is more apparent than real, since universalism and regionalism are engaged in relationships showing their intertwining nature.Secondly, the study is turned towards the impact of these interactions, not only on the universal and regional approaches, but also on the legal order of the Sea. Indeed, it appears that the relations between these two components of the Law of the Sea, influence in a decisive way the governance of the oceans as a whole. This influence can be seen in the creation as well as in the effective application of the rules of this international governance

Full textThe numerous threats that marine environment face, coupled with the evidence for a global biodiversity loss during last decades have lead to an increasing need for setting up conservation measures. Particularly, delimiting Marine Protected Areas (MPAs) within the French Southern Territories, which are home to an exceptional biodiversity and extensive human activities through industrial fisheries, would be extremely beneficial for species conservation. In order to identify areas of ecological significance for biodiversity, which could be good MPA candidates, the use of distribution data from top marine predators seems to be ideal. Thanks to their high position in trophic network, they are likely to integrate lowers trophic level species distribution. Moreover, they are easy to observe trough at-sea observation campaigns, and easy to equip with telemetric devices thank to their central place foraging that lead them to return regularly to their colony during breeding season. Here, we analyse distribution data and develop habitat models from several top predators species in both subantarctic and tropical regions to highlight biodiversity hotspots within the French Southern Territories. This work could thus be use as a basis to define potential boundaries for a future MPA
