Abstract:

Since the creation of the Belgian state in 1830, the kings, head of state, always tried to expand their political influence. Part of this strategy was the treatment of the ministers as individuals, not as a council. The process of democratisation and the development of political parties pushed back this royal influence. In the meantime, as a result of the fact that coalitions were necessary to establish a government, the Council of Ministers was developping more and more as an institution. That was necessary to gain some governmental stability. Thispermanent Council was not stated in the constitution of 1830. King Leopold III did the same during the thirties as his predecessors and tried to block this evolution. The Second World War established the circumstances to expand his power. The Council ofM inisters choosed for the western democracies. Leopold III did not. Nevertheless the dynasty was not treathened but Leopold, who was not able to adapt, had to forsake the throne. After the war, the Council of Ministers was acknowledged as one of the most important institutions of the Belgian political system.

Abstract:

Listening carefully, one might have heard the sigh of relief breathed in Brussels and other EU capitals on 3 May 2007, when the Court of Justice of the European Communities (ECJ or Court) eventually delivered its first judgment on the European arrest warrant (EAW), giving the green light to this flagship instrument of EU judicial co-operation in criminal matters. However, what came as a relief for executive-branch officials, quite likely disappointed some of Europe's judges and legislators, as well as many academics and independent observers. For them, it must have seemed as if a long, tension-filled story had come to a bitter end.

Zusammenfassung Nach langen Diskussionen seit der Veröffentlichung des Grünbuchs und der Regulierungsentwürfe der EU-Kommission ist die europäische Reform der Abschlussprüfung zum Abschluss gekommen. Nach Beschluss durch das Europäische Parlament vom 03.04.2014 und Zustimmung durch den Ministerrat vom 14.04.2014 wurde neben der Anpassung der Achten EG-Richtlinie (2014/56/EU) eine neue Verordnung für die Prüfung von Unternehmen des öffentlichen Interesses (EU Nr. 537/2014) verabschiedet. Der nachfolgende Kurzbeitrag gibt einen Überblick über die neuen Rahmenbedingungen der europäischen Abschlussprüfung und zeigt den nationalen Umsetzungsbedarf auf.

Abstract:

Damit Öffentlichkeitsbeteiligung der Öffentlichkeit, der Politik und der Verwaltung nützt, muss sie qualitätsvoll durchgeführt werden. Daher entwickelte eine interministerielle Arbeitsgruppe unter Beteiligung von Ministerien, Interessenvertretungen, NGOs und externen FachexpertInnen im Rahmen eines Projekts im Auftrag des Bundeskanzleramtes und des Lebensministeriums "Standards der Öffentlichkeitsbeteiligung". Die Standards wurden im Juli 2008 vom Ministerrat beschlossen und damit im Bereich der österreichischen Bundesverwaltung zur Anwendung empfohlen. Sie sollen nun VerwaltungsmitarbeiterInnen bei der konkreten Durchführung qualitätsvoller Beteiligungsprozesse unterstützen. Die Standards der Öffentlichkeitsbeteiligung wurden selbst in einem partizipativen Prozess entwickelt. Zu Beginn wurde ein gemeinsames Begriffsverständnis zur Öffentlichkeit und zu den drei Intensitätsstufen der Beteiligung (Information, Konsultation und Kooperation) geschaffen. Danach wurden Standards zu den drei Phasen eines Beteiligungsprozesses, der Vorbereitungsphase, der Durchführungsphase und der Monitoring- und Evaluierungsphase nach Abschluss des Prozesses, formuliert. Erste Anwendungsversuche – einerseits beim Konsultationsprozess zum Entwurf der Standards selbst, andererseits bei einem ersten Pilotprojekt – zeigen, dass die Standards der Öffentlichkeitsbeteiligung durchaus praxistauglich sind. Auch für elektronisch unterstützte Beteiligungsprozesse sollen die Standards ein hilfreiches Qualitätsfundament bieten.

Zusammenfassung Spätestens, wenn am 1. 9. 2018 die Sommerunterbrechung des politischen Brüssel zum Ende gekommen sein wird, beginnt der Countdown für die von der EU-Kommission gemachten Gesetzgebungsvorschläge zu laufen. Denn vom 23. bis 26. 5. 2019 werden Wahlen zum Europäischen Parlament stattfinden. Dies bedeutet, dass de facto ab Anfang April 2019, wenn die Parteien in die heiße Wahlkampfphase eingetreten sind, Gesetzgebungsvorschläge, die die Kommission gemacht hat und welche dem ordentlichen Gesetzgebungsverfahren (Art. 294 AEUV ) unterliegen, mindestens bis zum Zusammentritt des neugewählten Europäischen Parlaments, wahrscheinlich aber sogar bis zur Amtsübernahme der neuen Kommission voraussichtlich im November 2019, im Wesentlichen „auf Eis“ liegen. Zwar gilt auf EU-Ebene nicht das Diskontinuitätsprinzip, so dass die anhängigen Gesetzgebungsvorschläge auch nach der Neuwahl des Europäischen Parlaments anhängig bleiben. Jedoch schließt sich Ende März 2019 faktisch das Zeitfenster, innerhalb dessen anhängige Gesetzgebungsvorschläge der Kommission vom Europäischen Parlament und vom Ministerrat im Gesetzgebungsprozess verhandelt und ggf. verabschiedet werden können. Vor diesem Hintergrund will der Beitrag einen Überblick über Inhalt sowie den Verfahrens- und Sachstand wichtiger Gesetzgebungsvorhaben der EU-Kommission in den Bereichen der Finanzmarktgesetzgebung, insbesondere auf den Gebieten des Bank- und Kapitalmarktrechts geben. Wegen der Fülle der noch anhängigen Gesetzgebungsverfahren wird dieser Überblick in zwei Teilen erfolgen, von denen der erste Teil in diesem Heft veröffentlicht und der zweite Teil im kommenden Heft (5/2018) der ZBB erscheinen wird.

Abstract:

The role of Protestantism in the German Democratic Republic (the GDR) has been strongly disputed since the ‘turn’ and reunification of 1989/90. Many of the disagreements derive from different interpretations of the relationship between State, Church and Society in the GDR. This paper first describes the state institutions which formulated and executed church policies for the Communist Party of the GDR (the SED), and then surveys relations between Church and State, offering an explanation for actions and motivations on both sides. The thesis advanced is that the decisive phase of the transformation of a ‘bourgeois’ Church into a ‘Church within socialism’ took place between 1958 and 1978, and that the preceding and subsequent periods merely had the character of ‘past history’ and ‘epilogue’.A variety of institutions influenced Church–State policies in the GDR. First, at government level, there was until 1957 a department for ecclesiastical affairs controlled by the deputy prime minister ; after that date, there was an official secretary for church affairs, answerable to the chairman of the government (Ministerrat). At party level in the SED, there was a working group for church affairs which was part of the secretariat of the SED's central committee, answerable to the first secretary or the secretary-general of the central committee. The central committee office included a member with specific responsibility for church affairs, generally the second in line after the party chairman. In the Ministry for State Security (MfS), those involved were the head of the so-called ‘main department for social superstructure’, together with a representative of the minister or the minister himself, and the heads of administration in individual ‘Lands’ or districts.
