Full textArgentina ha sido considerada tradicionalmente como un país que garantiza el derecho de libertad religiosa. La casi total ausencia de conflictos religiosos violentos en su historia ha contribuido a reforzar esa imagen. La figura del consabido “crisol de razas” se ha extendido sin demasiada dificultad también a las religiones. No obstante, esta posición parece ser demasiado simplista, ya que omite considerar la visión de los actores más vulnerables de la relación Estado – Iglesia: las minorías religiosas. Cabe pues preguntarse: ¿Es el actual sistema constitucional de relaciones del Estado con las minorías religiosas el mejor posible –es decir, el más respetuoso de los derechos y garantías debidos a las personas pertenecientes a estos grupos–, teniendo en cuenta el entorno normativo y social argentino? Si la respuesta fuese negativa, ¿qué modificaciones admite el sistema para mejorar en el sentido señalado? En la presente investigación se intenta dar respuesta a esos interrogantes, para lo cual se parte de un repaso de la historia de las minorías religiosas presentes en el territorio nacional. Se analizan luego las normas constitucionales, las de los tratados internacionales y las de las constituciones provinciales que regulan las minorías religiosas. Luego se repasa la realidad socio-cultural de las principales minorías religiosas presentes en el país. A continuación se analiza si el actual régimen de regulación estatal del factor religioso genera dificultades a las minorías religiosas, y en todo caso, cuáles sean esas dificultades. Finalmente, se anticipa cuáles podrían ser los modelos alternativos al actual sistema vigente en el país; se los estudia brevemente y se analizan las ventajas y dificultades de su aplicación. La tesis concluye con una propuesta de reforma al sistema argentino de relaciones Iglesia – Estado.
Argentina has traditionally been considered a country that guarantees the right to religious freedom. The almost total absence of violent religious conflicts in its history has reinforced this image. The figure of the "melting pot" has spread without too much difficulty also to religions. However, this position seems to be too simplistic, since it fails to consider the point of view of the most vulnerable actors in the relationship State-Church, namely, the religious minorities. This raises certain questions: is the current constitutional system of relations between the State and the religious minorities the best (i.e. the most respectful of the rights and guarantees owed to persons belonging to these groups), considering the regulatory and social frame of the country? If the answer is negative, what amendments could be done to the system to enhance it? In this research these questions are intended to be answered, for which it is made an historical review of religious minorities in the country. Then the federal constitutional norms, the international treaties, and the provincial constitutional norms that rules religious minorities are analyzed. It is also reviewed the socio-cultural reality of the major religious minorities present in the country. It is then examined whether the current system of constitutional regulation of religion generates difficulties for religious minorities, and in this case, what those difficulties are. Finally, it is anticipated what could be the alternative models to the current federal system; they are analyzed briefly, and the advantages and drawbacks of its application are exposed. The dissertation concludes with a proposal to reform the Argentine system of relationships Church - State.

Full textLa colección de narrativa erótica «La sonrisa vertical» (Barcelona: Tusquets Editores) nació en plena transición democrática, en 1977, de la mano de Luis García Berlanga y Beatriz de Moura, con un doble propósito: rescatar un género literario hasta aquel momento censurado por las leyes franquistas y apostar por la narrativa de jóvenes autores, tanto en lengua catalana como española. El interés de una colección de estas características no es exclusivamente literario, ya que, dada la época turbulenta en que se gestó y la apuesta ideológica de la editorial, albergó volúmenes con una notable voluntad de ruptura política y moral. En este sentido, no escasearon las representaciones de personajes con sexualidades heterodoxas, entre las cuales, dada la legislación vigente (Ley de Peligrosidad y Rehabilitación Social), bien podrían incluirse las de lesbianas, gais y personas trans. Esta tesis doctoral pretende ofrecer un análisis de las muy diversas creaciones de autores españoles e hispanoamericanos que, en especial, favorecieron la representación de personajes lésbicos entre 1977 y 2014 con el objetivo de valorar su entidad literaria y su relevancia histórica y social.
The collection of erotic narrative «La sonrisa vertical» (Barcelona: Tusquets Editores) was born in full democratic transition, in 1977, it was created by Luis García Berlanga and Beatriz de Moura, with a double purpose: a genre up to that moment censored by the laws rescuing Francoists and betting on the narrative of young authors, both in Catalan and Spanish. The interest of a collection of these characteristics is not exclusively literary, since, the turbulent period in which it was gestated and the ideological bet of the publishing company, lodged volumes with a remarkable will of political and moral breach. In this sense, the representations of characters with heterodox sexualities were not scarce, among which, given the current legislation (Law of Dangerousness and Social Rehabilitation), well those of lesbians, gays and people could be included trans. This Ph. D. dissertation intends to offer an analysis of the very different creations of Spanish and Latin American authors who, especially, favoured the representation of lesbian characters between 1977 and 2014 with the aim of valuing their literary entity and their historical and social relevance.

Full textLa siguiente investigación se titula “Subjetivación no-heterosexual en los marcos del VIH/SIDA: los flujos de la gubernamentalidad serológica”, y fue realizada por Inger Flem Soto, con la guía académica de Carolina Franch Maggiolo y de Luna Follegati Montenegro, para la obtención del grado de Magíster en Estudios de Género y Cultura, mención en Ciencias Sociales, con fecha de graduación el 01 de marzo, 2017 La tesis se sitúa desde la necesidad de analizar críticamente las modos en que la noheterosexualidad en Chile se ha visto socialmente configurada por la epidemia del VIH/SIDA, comprendiendo que la serología ha infligido una carga estigmática trascendental sobre estos sujetos en particular. La investigación se realiza primordialmente desde la teoría biopolítica y lecturas feministas, comprendiendo la problemática desde la compleja articulación de sus diversos elementos y aristas. La investigación comienza analizando las campañas de prevención de VIH/SIDA realizadas en Chile, examinando los discursos de sexualidad deseable y la construcción de un «sujeto de riesgo» que se han forjado como reverso del discurso estatal biomédico. Full textThis dissertation defends that, based on the Peruvian Constitution of 1993, it is possible to justify that the State has a mandate to implement a national curriculum that includes content on sexual orientation diversity, aimed towards the eradication of discrimination in and from the school. First, it is argued that contemporary constitutionalism and the theory of legal argumentation serve as a proper framework to structure a discourse on fundamental rights. On this basis, the general premises of the right to equality and the right to education recognized on the Peruvian Constitution are outlined. Second, the dissertation presents a general overview on the theories of sexual orientation and the legal treatment of discrimination based on sexual orientation in the world. Afterwards the studies on the problems of LGB children in school are examined as well as the proposal of an inclusive curriculum as a requirement of an education for all. Third and finally, based on the philosophical, constitutional and educational premises abovementioned the investigation hypothesis is validated.

Full textThe present study aims to describe and compare the leadership styles applied in student leader of five colleges LGBT in Lima. In order to accomplish this objective, questions for a semi-estructured interview where made based on the Multifactor Leadership Questionnaire Short Form (MLQ -5X) developed by Bass and Avolio (1994) where the authors contrast the self-reporting leader and member perception´s about the community. Findings revealed that there´s consistency in both perceptions of leadership, furthermore they revealed that three communities applied a transformational leadership style; on the other hand, two communities applied avoidant leadership style. In addition, there are differences in the level of participation and community organization. Regarding this point, the implementation of five axes to qualify each community is proposed: (i) accepted leadership, (ii) agency, (iii) social relations, (iv) support of the institution and, (v) representation Since this proposal is finally suggests the development of new leadership models that fit the actuality of LGBT university communities, including participative leadership approaches which are proposed.

Full textThis study begins for the concern that primary school students in the Cusco region and particularly rural communities of Ccarhuayo and Ocongate, according to the census evaluations, didn’t achieve the expected learning levels as indicators of program Intercultural Bilingual Education (IBE). The thesis identifies the causes in the management field, searching why expected learning in communities have not achieved, and will allow to improve the policies of the EIB, both in their design, implementation and management, to approximate the good expected results in the skills of students, which is the purpose of the EIB schools. So, the objective of the investigation is identify the problems on the implementation factors and IBE policy management in the educational institution of the rural communities of Ccarhuayo and Ocongate during 2012 and 2013 that obstruct to achieve the expected levels of student learning at the elementary school. The findings of the thesis are around the design, implementation and management of EIB policy. This study compared the E.I. managed by the MINEDU with E.I. supported by the NGO "Fe y Alegría" and shows that the first one is just in the process of begin the implementation. In practical terms we have identified that in classrooms operated by the MINEDU, the EIB policy was not met. Teachers have inadequate profile and don’t have diversified curriculum, children do not have texts in Quechua and Spanish for all courses and have no supervision, and those responsible for managing obviate its pedagogical role, focusing exclusively on administrative matters. In this thesis there are proposals to improve the mechanisms, implementation strategies and the management of human talent.

Full textThe Romani population is the most discriminated minority in Europe, sharing centuries of history with the majority society and in which it has suffered many kinds of discrimination and persecution. Considering the context of marginalisation and silence that Romani voices have experienced, this work aims to deepen the debates in the communication field in order to comprehend media and cultural consumption by Romani people and how this consumption contributes to or interferes in their way of relating to the majority society. To analyse such consumption, we used two methodological approaches: ethnography and semi-structured interviews. The sample consists of twenty Romani men and women who resided in the Barcelona province, in Catalonia, at the time of the research. They answered questions related to their preferences for contents in diverse media such as television, radio, print press, magazines, and internet. They were also asked to talk about their leisure time such as cinema, theatre, music, reading, and other activities. Moreover, the interviews led to reflections about discrimination and the Romani representativeness on media. Despite their historical, social and economic context of marginalization, it was possible to verify that Romani people do not reject the mainstream culture, even though it is almost completely produced from a non-Romani’s perspective. If we consider the importance of mass media and cultural products as sources of social cohesion, we conclude that the Romani population does not seek to be isolated from the majority society. In addition, we did not detect that this community particularly follows productions that are directly related to their population, although there is an interest to contents related to their identity. From the citizenship’s standpoint, we noted that the sample that we interviewed has a quite critical view about the way their people are, on the one hand, portrayed and, on the other, invisibilised by the media. Our interviewees showed to be aware of the discriminatory processes reinforced and/or created by mass media.

Full textEsta tesis investiga la paradoja de por qué el nivel de discriminación contra las minorías cristianas árabes fue mayor en Egipto que en Siria, y por tanto por qué el paso del nacionalismo “árabe” a la “reislamización” de la política fue mayor en el primer país que en el segundo (hasta el comienzo de su Guerra Civil). La explicación se encuentra en las diferentes estrategias de supervivencia utilizadas por sus dictaduras ante la aparición de una fuerte oposición islamista que cuestionaba la existencia de los regímenes árabes seculares. La variación de estrategias se debe a su vez a la mayor o menor congruencia entre la identidad religiosa de las élites gobernantes y la mayoría de la población. Cuando la identidad religiosa población-elite coincide y se da un importante desafío islamista, la discriminación será alta. Cuando no coincide, o no se da el desafío islamista, la discriminación religiosa será menor.

Full textIntroduction: Different publications report a higher prevalence of depression or anxiety among the LGTBI population, associated to the different factors. The Peruvian National Institute of Statistics and Informatics (INEI) carried out the first survey of lesbian, gay, bisexual, transgender, transvestite and intersex people (LGBTI) using a virtual questionnaire. The objective is to evaluate the factors associated with self-reported depression and/or anxiety among LGBTI people in Peru. Methods: Cross-sectional analytical study based the First Virtual Survey of LGTBI population in Peru 2017. The population included people resident throughout Peru, who were contacted via LGTBI associations in order to answer a virtual questionnaire, whose data was collected by the INEI. Prevalence ratios (PR) were obtained in crude and adjusted form using Poisson regression. Results: 23.4% self-reported having suffered depression or anxiety in the 12 months prior to the survey; finding association with age (PR 0.97 for each additional year), female sex at birth (PR 1.19), being bisexual with respect to being gay (PR 1.26), being non-binary with respect to being cis-gender (PR 1.23), not having a partner (PR 1.39), not having a job (PR 1.18), having suffered violence/discrimination at some time (PR 1.89), not having had family acceptance (PR 1.15) , and having carried out forced sexual labor (PR 1,84). Conclusions: The prevalence of depression and/or anxiety in the LGTBI population was high. Factors were found associated with self-report of depression and/or anxiety. This information can be used to highlight the mental health problems among the LGTBI population, and design interventions that address the modifiable factors.

Full textThe purpose of this study was to explore the relationship between internalized homonegativity and protective factors against minority stress (social support, community connectedness, collective action) that stem from interpersonal relationships in people with LGB identities. Using a qualitative approach, two lesbians, two gay and three bisexual people participated through semiunestructured interviews. Results showed that interpersonal relationships play a crucial role in the process of acceptance regarding the sexual minority identity. However, this process is hampered in most cases by the internalization of heteronormative ideas that come from the same interpersonal relationships that later become a protective factor. Therefore, there is a need to further explore the role of interpersonal relationships to validate the experience of belonging to a sexual minority.

Full textDespite being in Europe for over five centuries, and being the largest ethnic minority on the continent with a population of more than 12 million people, the Roma people is the most rejected and excluded social group both within Europe and in Spain. As demonstrated by the rate of severe poverty of the Spanish Roma population, which is almost 6 times higher than that of the rest of the population; or access to postgraduate studies, since only 2% of the Spanish Roma community has managed to finish college, while nearly 35% from the rest of the population has higher education. Furthermore, the Roma community is facing discrimination specifically because of their ethnic origin in all social spheres. This discrimination, identified by the main international bodies as Anti- Gypsyism further complicates the social and educational inclusion of the Roma people. In fact, despite numerous efforts and public policies in favor of the inclusion of the Roma people, the situation of this community is improving at a considerably slow pace. This set of unfavorable circumstances, coupled with the added social and educational practices that are not endorsed by the scientific community and which target vulnerable groups such as the Roma people, are met with prejudices and stereotypes which contribute and continue to perpetuate the Anti-Gypsyism which is embedded in many spaces. However, more and more initiatives and actions are being carried out to fight against school failure, poverty, improving the social and educational conditions of the most disadvantaged groups, as is the case of the Roma community. Notable in this respect are the performances of Successful Educational Actions (SEA) identified by the project under the sixth framework program INCLUD-ED, whose social impact, particularly in relation to the educational success and the social inclusion of the most disadvantaged groups, has already been stressed in numerous scientific publications. This thesis, developed within the framework of a “FPI” PhD Fellowship of the Ministry of Economy and Competitiveness, and linked to the I+D+i project “Successful educational and social actions to overcome poverty", attempts to make a scientific contribution that will help transform the educational and social situation of the Roma people, continuing the line of investigation previously initiated by the above-mentioned projects, and placing special attention on the case of the Roma community. Therefore, this research work is carried out in 3 stages (2 schools and 1 public administration) where the application of SEA is involved when working with the Roma people. Through communicative orientation qualitative field work, this thesis has counted with the participation of 31 people: 9 educational professionals (of whom 2 were Roma people), and 22 Roma people who are participating in SEA, and who reside in neighborhoods with a high concentration of poverty. The results obtained show that with the implementation of SEA those Roma people whom participated, in particular, those living in disadvantaged neighborhoods that are traditionally excluded from the processes of participation, are transforming into actors and assets and are becoming agents of their own social inclusion. Also, due to their participation in SEA, the Roma people are developing and offering important contributions to fight against poverty and the Anti-Gypsyism which exists. Finally, our analysis highlights the need to implement actions endorsed by the scientific community, especially in relation to the most vulnerable groups of people, such as the Roma community, which claim educational and social success and express the rejection of actions which do not contribute to social improvement.

Full textIn the context of criticism of the gender system, the present research aims to analyze the content of the comments expressed in news about the LGBT community published on the Facebook pages of the main national newspapers during 2017. These expressions were analyzed qualitatively, under which could be established two axes of analysis depending on whether people are for or against the LGBT community: a) the justification for their position, thus expressing their idea of "moral", and b) negative emotions towards the group considered external, based on the differences with them. So that, the analysis focuses on gender stereotypes and sexual prejudices. These, associated with negative intergroup emotions, generate the use of moral disconnection mechanisms and the human rights approach for the justification of violence and equality, respectively. Finally, it is discussed how, in the context of greater exposure of the LGBT community, social networks can function as a way to evoke the heteronormative gender system and replication of violence.

Full textThe present study aimed to explore the relationships between symbolic violence, minority stress and perceived social support in transgender women, trans-femenine and travesti individuals in Lima and Callao. For this purpose, a mixed methodology was carried out. The first study adopted a qualitative approach; therefore, interviews took place in order to explore the manifestations of symbolic violence through participants’ speeches and experiences. Results show the predominance of six psychological processes involved in the positive disposition towards heteronormativity. The second study acquired a quantitative methodology (n = 55), and highlighted direct relationships between the majority of the subdimensions of the studied constructs. In addition, the obtained results show that the participants who experience a greater impact of symbolic violence are those older, catholic, with a lower access to education and non-articulated ones.

Full textThe social situation of older gay men is largely unknown. There are circumstances that suggest that it is a group that may be experiencing situations of social vulnerability related to different social circumstances as the existence of damaged relationships with their families of origin, the absence of offspring in most cases and the existence of inequalities in health issues such as HIV incidence or of certain emotional disorders. Gay men have traveled from a social model of hard homophobia, called pre gay, to a model of greater respect for the gay collective. The thesis examines the characteristics of each model. We want to know the life trajectories of a group of gay men, a diagnosis of the social group, to describe responses that launched this social group and to propose a model of social work practice consistent with information obtained. This research makes use of procedures and data quantitative and qualitative to get an overview of a phenomenon little studied. We use online surveys, focus groups, interviews and participant observation. The results show paths of life marked by change and social participation and social situation for the majority of the community does not seem too unfavorable although there are some situations of loneliness and isolation that are found mainly in services specialized care. Moreover, there is an emerging international social movement in favor of LGBT seniors. Finally, we propose a Social Work critical breakthrough towards collective practices.

El texto incluye una breve descripción del marco normativo peruano, como también una mirada a la magnitud de la representación indígena reciente en el Parlamento. Full textThe feminization of migration in the world raises the need to look at migratory processes and integration processes from a gender perspective, which allows understanding these processes from various dimensions. For that reason, this research on the integration of Bolivian women living in Barcelona invites us to ask ourselves some questions such as: What do we understand by integration? What is the current status of the integration of Bolivian women? Is the integration of Bolivian women possible? What are the elements that favor and hinder the integration of Bolivian women? Specifying the problem focuses on the current state of integration of Bolivian migrant women in the Barcelona metropolitan area and the elements that favor or hinder this process. This study starts from the idea that Bolivian women do not integrate into the host society due to many factors such as structural, labor, legal, economic, family, etc. that hinder such integration. The method of this project consists of a mixed sequential explanatory method on the integration process of the Bolivian women's group. In this sense, a questionnaire has been applied to know the opinion of Bolivian women is essential because it has allowed us to extract very relevant aspects of their integration process. The next step is to describe, analyze and understand this process through interviews applied to professionals who work or have worked with this female group in order to complement, reinforce, verify and deepen the integration process of Bolivian women; Both techniques are complemented by observations, informal interviews and the thesis journal. We found that a large part of the Bolivian women surveyed work in the classic labor niches (domestic workers, hourly cleaning, care for the elderly) with the risk of eternalizing themselves. They also do not enjoy job stability and have little chance of exercising labor mobility as a result of family emergencies, since many of these women are heads of household, and to this it must be added that some of these women exercise transnational motherhood. This situation sometimes puts them in a defenseless position before the system that oppresses them without the possibility of “breaking the glass ceiling” and distancing them from being able to integrate and participate in the host society.

Full textTaking an initial glance at minorities in Syria, we see that they are completely integrated into the country and that they enjoy a full life, in peace without problems. Even though behind all this exists an invisible wall resulting from the current political situation. However, if we look beyond this wall, it is here where we start to see things differently and is where we find the objective of my investigation; focusing on the analysis of the roll of Syrian minorities, mainly the Christian minority, their relation with other minorities and with the majority during the twenty-one centuries from the beginning of the existence of Christianity and particularly over the most recent decades. To know how these minorities were born, it is important to study them from the beginning, from the very start of the Christian era and to know how they later emerged and started to form different groups that were called Tawa´ef in Arabic (religious confessions). The legal situation of the country has also been analyzed to reach an understanding of the reasons why the family code of Christians was different from that of Muslims and Druze. During the sixties the nationalization of many companies caused the loss of the acquired influence of these minorities, which weakened their power. The search for citizenship and participation in all sectors of life including the political one was one of the main reasons that initiated the revolution, in which Christians also participated. Their objective being to achieve liberty and all the rights that were denied under the regime of Al-Assad, dreaming that the Arab spring would change the situation in Syria and transform it into a secular state where religion and policy are not united. This same call for liberty is the cause of the emigration towards a peaceful life in countries with political stability. I have formed this work as a study of the situation of minorities under totalitarian regimes, analyzing the Syrian Christian identity and citizenship, its integration in the country and its future prospects.

Full textEn la Europa actual, los idiomas del estado entran en contacto con una gama de idiomas de inmigrantes y un conjunto de idiomas regionales. En tal contexto, los encargados de elaborar políticas enfrentan cambios en la demografía y en las actitudes en cuanto a los derechos y la integración. Las investigaciones actuales que abordan el aspecto integratorio de las políticas lingüísticas por lo general pasan por alto el papel desempeñado en dichas políticas por la traducción. Esta tesis procura arrojar luz sobre esta función con frecuencia soslayada. Con dicho fin, este estudio se concentra en la política de traducción, la cual es el resultado de gestión, práctica e ideas de traducción. La tesis comienza con una revisión bibliográfica de carácter interdisciplinario en la cual se exploran de manera crítica los escritos de académicos en los campos del derecho, las ciencias políticas, la economía y los estudios de traducción en lo referente a los derechos de las minorías lingüísticas. Tras ello se presenta un análisis de las obligaciones de traducir en virtud del derecho internacional, lo cual permite proseguir con un estudio de caso sobre la política de traducción en el sector público del Reino Unido. En particular, dicho estudio de caso examina las políticas de traducción que se reflejan en ciertas disposiciones legislativas que se aplican al Reino Unido en su totalidad y también a sus regiones de forma específica. Todo ello se desarrolla en los capítulos que abarcan las políticas de traducción halladas en el gobierno (a nivel local), los servicios de salud y el sistema judicial. Estas políticas de traducción no se analizan sino con el fin de recalcar el hecho de que las decisiones referentes a la integración y la inclusión tienen un elemento de traducción que se debe tener presente.
In contemporary Europe, state languages come in contact with a tapestry of immigrant languages and a set of ever more legitimized regional or minority languages. In this context, policymakers are faced with changing demographics and attitudes about rights and integration. Current research on language policies as they pertain to integration largely overlooks the role of translation. This thesis hopes to shed light on this oft-overlooked area. To do so, the thesis focuses on translation policy understood to be that which is the result of translation management, practice, and belief. Translation policy is not explored as an end unto itself, but rather, it is highlighted to stress that policy decisions regarding integration and inclusion have a translation dimension to them that ought to be considered. The thesis will explore some of the difficult questions in understanding what integration means for linguistic minorities and in the end argue that translation plays a role in the integration of linguistic minorities in the UK.

Full textThe main objective in this study is to analyze and expose the situation of LGBTI people in Perú, based on the case Azul Rojas Marín et al. V. Perú, for which it will deepen in data, doctrine, and jurisprudence, as the arguments and the reasoning that the Inter-American Court of Human Rights use to resolve the case. The final conclusions of the work are that this case is extremely relevant because is the first time that the Inter-American Court of Human Rights has ruled on torture and violence by state agents against LGBTI people. The Court declares the Peruvian State responsible for the violation of the right to equality and non-discrimination, personal liberty, personal integrity, and judicial guarantees to detriment of Azul Rojas Marín, as well as the violation of the right to personal integrity to detriment of Azul Roja’s mother. In addition, the Court declares that the Peruvian State failed to comply with international obligations and decrets several means of legal redress, one of the main ones being the development of a special due diligence standard for the investigation and justice administration in cases of violence against LGBTI people. However, the Court does not consider the intersectional approach and does not deepen into the Peruvian context of violence against the LGBTI people, this being important to justify the special due diligence standard proposed in the judgment.
