Full textBackground Equal and good care is a right for every person in Sweden according to National Board of Sweden. Previous studies show that patients in geriatric care are exposed to abuses of various shapes. The most common form of abuse is neglect of the resident. To give good care the care workers need to respect and maintain the integrity of the resident. Aim The aim of the study was to investigate if care workers in nursing homes observed any abuse against the elderly and what kind of abuse. The aim was also to find out what possible causes of the abuse could be and investigate the care workers knowledge of Lex Sarah. Method Study-specific questionnaire with quantitative approach. Result The result shows that 69 of the 80 respondents had noticed any kind of abuse or neglect in the last six months in their nursing home. The most common abuse or neglect was inadequate care of the teeth and hygiene among the elderly. The respondents think that lack of education and stressful situations may be the cause of the abuse and neglect. Conclusion The study shows that abuse and neglect does exist in Swedish nursing homes. Causes of the current abuse is ignorance and lack of time among careworkers. The knowledge of Lex Sarah was high among the careworkers.

Full textWhen selling a property there is much information, in regards to the property’s physical standard, which should be discussed between the parties; the realtor, the buyer and the property owner. In relation to the buyer and the property owner, the realtor will be known as a loyal, independent person that carries expert know-ledge in regards to selling property. Therefore the realtor should carry the liability to inform the buyer about physical errors according to the property, that has been found, or for some other reason will be known, or if there is a reason to suspect an error, that can be of importance to the buyer. The focus point of this thesis is the magnitude of the realtor’s liability to inform the buyer on physical errors, according to FML 16§ 3st., and to examine what kind of physical errors that the buyer have the right to be informed of. Because if the realtor do not respect the obligations according to FML 16§ 3st., legal sanctions will be given. The author will also examine if the legal rule, FML 16§ 3st., is predictable and appropriate. To examine the magnitude of the realtor’s liability to inform the buyer on physical errors, the legal relation between the buyer and the property owner has to be taken into account according to JB 4:19§. The fact that the realtor also carries a responsibility to submit to good faith and fair dealing will also be interesting. The principal legal issue will be based on the unclear preparatory work, regarding to FML (2011:666) 16§ 3st., and the magnitude of realtor’s liability to inform the buyer on physical errors. Furthermore, there is no case law given by the Swedish Supreme Courts, and that is one more reason why the area is so hard to apply. The legal position will therefore stay unclear, according the realtor’s liability to inform the buyer about physical errors of the property.

Full textThis study focuses on how the Swedish health care sector is dealing with whistleblowers. Although the care mandate is clearly defined there is a margin of interpretation for what is good and poor health care. This study is based on seven separate whistleblowing incidents where Swedish healthcare organizations have failed, according to the whistleblower, their duty to provide proper care. Thestudy aims to analyze the organizational response to whistleblowers, i.e. criticisms made by employees through external, non-traditional channels. In the context of this study various forms ofabuses caused the whistleblowing incidents however the whistleblowers claim they reacted to the poor quality of care and working conditions caused by weak leadership, lack of understanding ofhealthcare mandate and incorrect financial priorities. The conflict between whistleblowers and healthcare organizations is often based on the contradiction between the legal-bureaucraticframeworks and normative values. Although certain whistleblowers (employees) are well-positioned within the organization and therefore have good insight into the business and understanding of processes, the healthcareorganizations do not necessarily act on the criticism and status quo remains. Consequences of whistling are that healthcare organizations tend to focus the following actions on the whistleblowers instead of addressing the issues causing the whistleblowing. Whistleblowers are often being accusedof not being loyal to the organization or failed their confidentiality obligations. In the context of this study, whistleblowing incidents from both the public and private sector have been studied and thereis no evidence that suggest that one or the other would show a higher degree of organizational cognitive capacity. The organizational response to criticisms from employees via non-traditional channels is defensive alternatively disputed, whether it is a public or private healthcare organization.
