The traditional rule at common law precluded restitution for payments made by mistake where the payer's mistake had been one of law. That rule was set aside in New Zealand in 1958. Other jurisdictions are likely soon to follow. This article considers the law of mistaken payments absent the traditional rule. Assuming restitution is available for mistakes of law, ought the payer's ability to recover nevertheless differ according to whether the mistake was one of law or one of fact? The Common European Sales Law (CESL) sets the conditions in which the mistaken party is prima facie entitled to rescission and compensation from the other party. Some of the CESL's provisions, however, are inconsistent with efficiency. First, under the CESL, as long as the mistake is fundamental, for the mistaken party to be allowed to rescind the contract, it is sufficient that the other party caused the mistake. From an efficiency perspective, however, causation is not enough to allow rescission. Second, the CESL permits rescission when one party failed to disclose information to the other p

This article seeks to examine the question of what the essential nature and definition of a mistake is. It examines whether it can be properly distinguished from ignorance. The article then seeks to examine the requirement of provability, first in the context of mistakes of fact and then in that of mistakes of law. A Dworkinian approach is taken, arguing that it is possible to be mistaken as to the law. The article then shows why an opinion or misprediction cannot be seen as a mistake, before turning to the topical issue of the manner of the recent removal of the mistake of law bar. Using Dwor

AbstractThis article argues that mistakes in written contracts should be corrected under the equitable doctrine of rectification rather than the common law of interpretation. But rectification on the basis of a common mistake should only be granted where both parties are actually mistaken. Any other approach is inconsistent with the nature of the equitable jurisdiction, and blurs the boundary between common mistake and unilateral mistake rectification.

Generally speaking, the definition of the mental element in crime does not even strive to encompass all the varieties of the psychological processes which accompany the commission of an offence, but sorts out only such components of it which legal policy dictates to be useful and workable. For instance, generally speaking, no notice is taken of the motive or of the intensity of passion, or whether the mental element was spontaneous or premeditated. This is a thesis about criminal culpability and the need for a moral theory of criminal fault. The liberal positivist ideal of separating law and morals has resulted in the moral reductionism of the doctrine of mens rea. Originally a normative concept that was used to evaluate blameworthiness in moral terms, mens rea has been transformed into a descriptive concept that merely identifies the technical, psychological mental states that are required for particular offences. It is argued that the doctrine of mens rea should be recast in an overt normative mould. This work does not suggest t

Abstract:
The populist Radical Right party, Vlaams Belang (VB), has consistently proved itself a successful electoral competitor in Belgian politics.
