Abstract:

The article studies such a concept as modus operandi in the practice of crime investigation as a unique and integral behavior for the criminal. It is determined by the modus operandi through a correlation with personal landmarks, mental and physical state, level of intelligence and other individual characteristics of the criminal’s personality. The use of this concept along with the method of committing a crime is justified. The issues of modernization and improvement of the modus operandi as a necessary given of the development of criminal activity of each individual are discussed. The autograph is considered as an additional characteristic element of the modus operandi, which allows you to see the “criminal message” that characterizes the personal qualities of the criminal. The author substantiates the need to pay attention to repetitive, albeit modernized, details in the sequence and the actions of the criminal themselves, since in similar situations the behavior is stereotypical. Having worked out the ideal modus operandi for himself, which leads to the satisfaction of needs, the criminal is afraid of its rejection, as this may lead to capture. Accordingly, the study of modus operandi helps in identifying the perpetrator, combining crimes into a series through the characteristics of personal stability and predictability. This makes it possible to solve not only the crimes committed, but also to prevent the criminal acts that are being prepared.

Abstract:

China and India celebrated their embryonic relations with a documented modus vivendi i.e. “The Panchsheel Agreement”. This concord highlighted five principles of peaceful coexistence between India and China. The Tibet region was the nucleus of this agreement. Nevertheless, after four years of its celebration, eyebrows raised from both sides in 1959 when China started its unification process and India welcomed the Dalai Lama, a separatist leader of the Tibetan region. This caused bitterness between India and China and both the states reversed to their retrospective modus operandi, which later on graduated into a full-fledged war between the two countries in 1962. Despite their limited modus vivendi in the 21st century, both the states tend more towards their intrinsic modus operandi. This analytical study is discussing the Sino-Indian relations through the lenses of Modus vivendi and Modus operandi and its implication for Pakistan.

Este artigo apresenta alguns elementos para o debate em torno da proteção social a pessoas deficientes no Brasil. A recente incorporação da deficiência como uma questão de direitos humanos na agenda governamental brasileira tem desafiado a formulação e o modus operandi das políticas sociais dirigidas a esse segmento. O artigo parte da discussão em torno da passagem do conceito de deficiência de uma perspectiva estritamente biomédica para sua compreensão noâmbito das relações de desigualdades impostas por contextos sociais com barreiras a corpos com impedimentos. Ao considerar as recentes alterações nas políticas públicas dirigidas a pessoas com deficiência, o artigo centra a análise nas mudanças que vêm se operando no Benefício de Prestação Continuada e os desafios presentes na sua articulação com o processo de construção de uma nova institucionalidade para a política de assistência social brasileira.

Abstract:

It is a well-known fact that some criminals follow perpetual methods of operations known as modi operandi. Modus operandi is a commonly used term to describe the habits in committing crimes. These modi operandi are used in relating criminals to crimes for which the suspects have not yet been recognized. This paper presents the design, implementation and evaluation of a new method to find connections between crimes and criminals using modi operandi. The method involves generating a feature matrix for a particular criminal based on the flow of events of his/her previous convictions. Then, based on the feature matrix, two representative modi operandi are generated: complete modus operandi and dynamic modus operandi. These two representative modi operandi are compared with the flow of events of the crime at hand, in order to generate two other outputs: completeness probability (CP) and deviation probability (DP). CP and DP are used as inputs to a fuzzy inference system to generate a score which is used in providing a measurement for the similarity between the suspect and the crime at hand. The method was evaluated using actual crime data and ten other open data sets. In addition, comparison with nine other classification algorithms showed that the proposed method performs competitively with other related methods proving that the performance of the new method is at an acceptable level.

The article analyses the different perspectives of study that, from the point of view of Social Anthropology, the cemetery offers when describing a society and its cultural patterns. Our modus operandiis exemplified in the case of the municipal cemetery of Murcia, Nuestro Padre Jesús, and in the biography of one of its inhabitants, the Murcian businessman Tomás Erades. To study him allows us to describe the Murcian society of the late nineteenth and early twentieth centuries, their marital and gender, health and economic patterns.

Abstrak Liberalisasi adalah proses tersusun dalam mempromosi dan menerapkan bentuk-bentuk pemikiran bebas dalam minda masyarakat khususnya umat Islam. Matlamat asasnya adalah untuk membebaskan pemikiran umat Islam daripada pandangan-pandangan turath yang dianggap tidak munasabah dan menyekat kemajuan. Kepercayaan daripada matlamat ini jelas bertentangan dengan prinsip-prinsip asas Ahli Sunah Waljamaah yang menuntut umat Islam berpegang teguh kepada al-Quran dan hadis serta pandangan-pandangan mujtahid dari pelbagai bidang dan sudut. Tulisan ini bertujuan mengenal pasti modus operandi penyebaran pemikiran liberal dalam masyarakat Islam di Malaysia. Kajian ini menggunakan pendekatan kualitatif yang melibatkan analisa kandungan dan temu bual separa berstruktur bersama lima orang belia yang menyokong idealisme liberal dan agenda liberalisme kepada masyarakat Islam di Malaysia. Dapatan temu bual dianalisis menggunakan kaedah analisa perkataan dan thematic. Hasil dapatan kajian menunjukkan gerakan liberalisme di Malaysia mempunyai kerangka modus operandi yang tersusun dalam menyebarkan fahaman tersebut kepada masyarakat di Malaysia. Mereka menggunakan sembilan (9) kerangka modus operandi iaitu persepsi, prinsip, motif, skala, propaganda, perkaderan, proksi, lingkaran sosial dan indoktrinasi. Dapatan ini mendedahkan tentang modus operandi gerak kerja liberalisme dalam mempengaruhi pemikiran masyarakat Islam dan menjauhkan masyarakat daripada peraturan hidup Islam yang sebenar. Namun begitu, kekuatan Islam yang terkandung di dalamnya akidah, syariah dan akhlak dapat menjadi perisai utama dalam mendepani pelbagai ancaman pemikiran khususnya ancaman liberalisme di Malaysia. Kata Kunci: Liberalisme; Pemikiran Islam; Ahli Sunah Waljamaah; Islam; belia Abstract Liberalization is a structured process in promoting and implementing forms of free-thinking in the minds of the people, especially Muslims. Its basic purpose is to free the minds of Muslims from the views of turath which are considered unreasonable and to hinder progress. Beliefs of this aim are clearly at odds with the fundamental principles of the Sunnis who require Muslims to adhere to the Qur'an and the hadith as well as the views of the mujtahid from various fields and angles. This paper aims to identify the modus operandi of disseminating liberal thought in the Muslim community in Malaysia. This study uses a qualitative approach that involves content analysis and semi-structured interviews with five youths who support liberal idealism and the liberalism agenda for the Muslim community in Malaysia. Interviews were analyzed using word and thematic analysis methods. The findings of the study show that the liberalism movement in Malaysia has a modus operandi framework in place to disseminate that understanding to the Malaysian public. They use nine (9) modus operandi frameworks namely perception, principle, motive, scale, propaganda, proportion, proxy, social circle, and indoctrination. This finding reveals the modus operandi of liberalism's work in influencing the thinking of the Muslim community and keeping society out of the true rules of Islamic life. Nonetheless, the Islamic power contained in the creed, sharia and morals can be a key shield in dealing with various threats of thinking especially the threat of liberalism in Malaysia. Keywords: Liberalism; Islamic thought; Ahlus Sunnah wal Jamaah; Islam; youth

Abstract:

This report presents the development and evaluation of the suspect retrieval system based on modus operandi developed by the National Research Institute of Police Science in Japan. The database used in the system stores a large number of records consisting of the modus operandi of prior offenders. A score is assigned to each record, where each score represents the similarity of the modus operandi between each record and a crime under investigation. The similarity is statistically calculated based on the choice probability of each modus operandi. Suspects in the database are rank ordered according to scores. The higher a rank is, the more likely a suspect is expected to have committed the crime under investigation. The validity of the system is evaluated with data about Japanese burglars (n = 12,468) and some factors influencing the accuracy of the retrieval are discussed.

Resumo Este ensaio é resultado de reflexões decorrentes de dez anos de estudos realizados a partir da análise histórica das seguintes organizações: os Einsatzgruppen, o complexo de Auschwitz e os campos de extermínio da Operação Reinhard - Sobibór, Belzec e Treblinka, que compuseram o Estado Nazista; as organizações terroristas Al-Qaeda e Estado Islâmico, com presença em diversos países por meio de redes de células cooperativas. Essas organizações foram ou são atuantes no contexto da modernidade, sendo caracterizadas pela prevalência da reprodução sociometabólica do capital e da instituição da racionalidade instrumental. As organizações totalitárias caracterizam-se por possuírem modi operandi próprios na forma como promovem os assassinatos e os extermínios sistemáticos e planejados de pessoas, geralmente antecedidos pela adoção de práticas de violência. Apesar dessas particularidades, todas elas têm como fundamento o estabelecimento de uma política de terror social, a prática da aniquilação do humano e a instituição do mal.

Abstract:

A variety of macromolecules and small molecules—(oligo)nucleotides, proteins, lipids and metabolites—are collectively considered essential to early life. However, previous schemes for the origin of life—e.g. the ‘RNA world’ hypothesis—have tended to assume the initial emergence of life based on one such molecular class followed by the sequential addition of the others, rather than the emergence of life based on a mixture of all the classes of molecules. This view is in part due to the perceived implausibility of multi-component reaction chemistry producing such a mixture. The concept of systems chemistry challenges such preconceptions by suggesting the possibility of molecular synergism in complex mixtures. If a systems chemistry method to make mixtures of all the classes of molecules considered essential for early life were to be discovered, the significant conceptual difficulties associated with pure RNA, protein, lipid or metabolism ‘worlds’ would be alleviated. Knowledge of the geochemical conditions conducive to the chemical origins of life is crucial, but cannot be inferred from a planetary sciences approach alone. Instead, insights from the organic reactivity of analytically accessible chemical subsystems can inform the search for the relevant geochemical conditions. If the common set of conditions under which these subsystems work productively, and compatibly, matches plausible geochemistry, an origins of life scenario can be inferred. Using chemical clues from multiple subsystems in this way is akin to triangulation, and constitutes a novel approach to discover the circumstances surrounding the transition from chemistry to biology. Here, we exemplify this strategy by finding common conditions under which chemical subsystems generate nucleotides and lipids in a compatible and potentially synergistic way. The conditions hint at a post-meteoritic impact origin of life scenario.

Abstract:

Vaccination is one of the most efficient strategies for the prevention of infectious diseases. Although safer, subunit vaccines are poorly immunogenic and for this reason the use of adjuvants is strongly recommended. Since their discovery in the beginning of the 20th century, adjuvants have been used to improve immune responses that ultimately lead to protection against disease. The choice of the adjuvant is of utmost importance as it can stimulate protective immunity. Their mechanisms of action have now been revealed. Our increasing understanding of the immune system, and of correlates of protection, is helping in the development of new vaccine formulations for global infections. Nevertheless, few adjuvants are licensed for human vaccines and several formulations are now being evaluated in clinical trials. In this review, we briefly describe the most well known adjuvants used in experimental and clinical settings based on their main mechanisms of action and also highlight the requirements for licensing new vaccine formulations.

Abstract:

This article is based on study of the tricksters’tricks played by the heroines of the Russian epos known as bylinas. Variants of bylina plots with female protagonists have been contemplated, taking into consideration the concept by Michel de Certeau of two modes of practices – tactic and strategic –a nd James Scott’s concept of “the weapons of the weak.”The narrator informs the audience first about the modi operandi under various circumstances, and second about the underlying values governing the choice of this or that modus operandi. Systematic studies of variants of bylina plots confirm the fact that the narrators pay a lot of attention to the personality, appearance and agency of epic heroines. The cunning tricks, daring deceptions, bold choices and exceptional physical fortitude of the heroines surprise the singers of the tales. The activities of female characters are analysed in the social context. The story-telling is a method of teaching modes and ways of real-life behavior. The bylinas’ singers are rendering their personal experience and knowledge in fictionalized form.

Metode penelitianyang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, pendekatan konsep dan pendekatan kasus. Kesimpulan: (1) Perbuatan tindak pidana korupsi dengan modus operandi ucapan terima kasih memberikan hadiah uang dalam bentuk Mandiri Traveller Cheque (MTC) keseluruhannya senilai Rp 5 milyar termasuk dalam tindak pidana korupsi “pegawai negeri menerima suap” (Pasal 12 huruf a UU No 31 tahun 1999) dan “pegawai negeri menerima hadiah yang berhubungan dengan jabatannya” (Pasal 11 UU No 31 Tahun 1999); (2) Pembuktian modus operandi dengan cara menerima hadiah, merupakan unsur Pasal 12 huruf a maupun Pasal 11 meskipun unsur menerima hadiah telah terpenuhi, unsur lainnya dari pasal tersebut juga harus terpenuhi, sehingga majelis hakim sampai pada kesimpulan terdakwa telah terbukti secara sah dan meyakinkan bersalah melakukan Tindak Pidana Korupsidan dapat dipertanggungjawabkan atas kesalahannya. Saran:Majelis hakim diharapkan terus ditingkatkan dalam pengkajian aspek hukum materil berkaitan dengan konsep-konsep hukum yang harus dibuktikan dipersidangan. Abstract:

Urban agriculture (UA) has turned into a diverse and complex movement. Important challenges will be to set accurate expectations by civil society in relation to UA development, and to find ways to discuss UA in governance and collaboration networks from an aggregate point of view. However, analytical tools that allow comprehensive study of UA initiatives (UAIs) are absent. This article elaborates on a conceptual framework from the COST Action Urban Agriculture Europe (Prové et al. 2015) and evaluates findings that result from applying the framework to four UAIs. We found that, analytically, the framework generates in-depth information on UAIs, and argue that it can be a useful tool in networks that are responsible for collaboration, support, or governance within the UA movement. We also discuss its usability issues and discuss future research.

Abstract:

The article analyses the complex influence of dangerous changes, which took place after 2014 in the international political environment in Europe, on the ongoing transformations, suggests essential revision of national policies of the five Nordic countries (Denmark, Norway, Iceland, Sweden and Finland) in the field of their security and defenсe. The degree of military and political tension in the North of Europe has increased significantly after 2014. The conflict is escalating due to additional deployment within the so-called reinforcement of the “eastern flank” of the Alliance with three allied battalions, and NATO weapons in the Baltic States and Poland. However, great strategic stability in the zone of direct contact between NATO and Russia is still possible to maintain. The international political situation in the subregion has also deteriorated markedly as a result of the U.S., NATO and EU sanctions policy against Russia, strengthening of transatlantic relations of the Nordic countries, and reinforcement of allied ties within the framework of the Western bloc policy as a whole. It noted signified not only a revision in favor of further strengthening of transatlantic ties in the policy of bloc allegiance of the Nordic countries – members of NATO (Denmark, Norway, Iceland), but also an obvious intensification of practical cooperation between formally non-aligned states (Sweden and Finland) with the Alliance structures. The Nordic Defenсe Cooperation (NORDEFCO) has also started to acquire a risky pro-Atlantic style, losing its previous autonomous subregional nature. Apparently, in the present complex situation, the Nordic Five is disposed to solve security and defence problems by: 1) having a greater many-sided cooperation with NATO; 2) giving a real, limited meaning to the European Union in the military-political sphere; 3) continuing to bear pressure upon Russia for the purpose of limiting Russian influence in the subregion, especially in the Baltic region. In the near future, the problem of NATO accession for Sweden and Finland may remain in the same precarious condition unless some dangerous force majeure circumstances occur in the Baltic region.

Penelitian ini bertujuan untuk mengetahui bagaimana cara/modus seorang PNS melakukan korupsi dalam pengadaan barang dan jasa pemerintah serta sejauh mana cara/modus tersebut berpengaruh pada pertimbangan hakim dalam menjatuhkan putusan. Penelitian ini menggunakan metode pendekatan yuridis normatifs. Pegawai Negeri sangat rentan terhadap tindak pidana korupsi karena jabatan dan wewenang yang disalahgunakan dapat mengakibatkan kerugian negara. Pegawai Negeri melakukan tindak pidana korupsi dengan cara atau prosedur yang berbeda dan berciri khusus, meletakan kepentingan pribadi diatas kepentingan masyarakat dan sesuatu yang dipercayakan kepadanya tidak dilaksanakan sebagaimana mestinya sebagaimana disebut modus operandi. Modus operandi yang dilakukan oleh PNS dalam pengadaan barang dan jasa pemerintah terjadi dalam semua tahap pengadaan yaitu tahap persiapan,pengadaan, dan pelaksanaan. Modus operandi juga berpengaruh pada putusan pidana pelaku terkhusus pada tinggi rendahnya pidana. Semakin tercela perbuatan semakin tinggi pula pidananya.

This study aims to find the appropriate model for the modus operandi of a financial institution called Waqf-Ventura Capital Syariah (WVCS). WVCS is integration between social finance (waqf) and commercial finance (Ventura capital). This WVCS has been adopted in Indonesia but the right form of operation is still yet to be found. In addition, this study also looks for appropriate contracts able to be practiced within the WVCS itself. WVCS is conceptualized based on the content analysis of cash waqf operations, profit and loss sharing modes and venture capital strategies. It has been found that there are at least 3 alternative models of operation for this WVCS. Firstly, the waqf fund is pooled into the capital; secondly, the waqf fund is pooled into a third-party fund; and thirdly, the waqf fund is pooled into both the capital and third party-fund. These unique operandi of WVCS could be adopted, as long as there are mudharabah dan musharakah contracts for development of the Indonesian Economy.

Abstract:

MicroRNAs (miRNAs) are non-coding RNAs that regulate a wide range of biological pathways by post-transcriptionally modulating gene expression levels. Given that even a single miRNA may simultaneously control several genes enrolled in multiple biological functions, one would expect that these tiny RNAs have the ability to properly sort among distinctive cellular processes to drive protein production. To test this hypothesis, we scrutinized previously published microarray datasets and clustered protein-coding gene expression profiles according to the intensity of fold-change levels caused by the exogenous transfection of 10 miRNAs (miR-1, miR-7, miR-9, miR-124, miR-128a, miR-132, miR-133a, miR-142, miR-148b, miR-181a) in a human cell line. Through an in silico functional enrichment analysis, we discovered non-randomic regulatory patterns, proper of each cluster identified. We demonstrated that miRNAs are capable of equivalently modulate the expression signatures of target genes in regulatory clusters according to the biological function they are assigned to. Moreover, target prediction analysis applied to ten vertebrate species, suggest that such miRNA regulatory modus operandi is evolutionarily conserved within vertebrates. Overall, we discovered a complex regulatory cluster-module strategy driven by miRNAs, which relies on the controlled intensity of the repression over distinct targets under specific biological contexts. Our discovery helps to clarify the mechanisms underlying the functional activity of miRNAs and makes it easier to take the fastest and most accurate path in the search for the functions of miRNAs in any distinct biological process of interest.
