Abstract:
Abstract. The scientific study is dedicated to the study of the pecu­ liarities of establishing legal facts in the conditions of the military aggression of the Russian Federation against Ukraine (since 2014), as well as the limits of the court’s discretionary powers in this area. The authors, within the framework of this theoretical and applied work, while delineating the limits of the court’s discretionary powers, singled out the general conditions for establishing a legal fact in the order of civil jurisdiction, classified legal facts related to military aggression in Ukraine according to the order of establishment, and also carried out a detailed comparative analysis of the revisions of Article 317 of the Civil Code of Ukraine, which underwent significant changes in connection with the adoption by the Verkhovna Rada of Ukraine on July 1, 2022 of Law of Ukraine № 2345-IX «On Amendments to Certain Legislative Acts of Ukraine Regarding the Peculiarities of Proceedings in Cases Establishing the Fact of Birth or Death of a Person in conditions of war or state of emergency and in temporarily occupied territories». A legal evaluation of these changes was given and their effectiveness was analyzed taking into account the already formed judicial practice. Peculiarities of the Georgian and Moldovan models of establishing the facts of the death/birth of a person in the temporarily occupied territory are singled out, since in the past Georgia and Moldova, like Ukraine, were «lucky» to experience the «care of a brotherly neighbor». Taking into account the military realities in Ukraine and the prevailing circumstances, an opinion is expressed as to whether it is possible to introduce features of the Moldovan and/or Georgian models in Ukraine.
 The purpose of the study is to outline the limits of the court’s discretionary powers regarding the establishment of legal facts in the conditions of the military aggression of the Russian Federation against Ukraine (since 2014). Isolation of the general conditions for the establishment of a legal fact in the procedure of civil jurisdiction. Taking into account the specific conditions and on the basis of the study of the judicial practice of the Unified State Register of Court Decisions, the classification of legal facts related to military aggression in Ukraine, according to the order of establishment. Analysis of key legislative changes made to the provisions of the Civil Procedure Code in terms of simplifying the procedure for establishing the fact of birth and death of a person in the temporarily occupied territory, under conditions of war and state of emergency. As well as a comparison of the relevant versions of Article 317 of the Civil Code of Ukraine to provide a legal assessment of the effectiveness of the changes made. Highlighting the key features of the Georgian and Moldovan models of establishing the fact of birth and death of a person in the temporarily occupied territory with the possibility of further borrowing and adoption of experience, as well as the implementation of such in Ukraine.
 Research methodology. The method of system analysis and compa­ rison was used during the research.
 Analysis of recent research and publications. A qualitative description of separate proceedings as an institution of civil procedural law is given in the works of M. M. Yasynok, O. O. Markova, V. Yu. Mamnytskyi, T. M. Balyuk, Y. M. Sadikova, Yu. V. Bilousov. The scientific works of A. V. Kostruba, K. I. Hychka, G. V. Kykot, V. V. Masyuk, and V. V. Komarov are devoted to the issue of establishing facts that have legal significance in separate proceedings under the Code of Civil Procedure of Ukraine. In addition, the study of the relevance of the indicated issues proves that the problems of legal regulation of the procedure for establishing the fact of birth and death of a person in the temporarily occupied territory of Ukraine are not fully studied. Although it is worth noting the significant contribution to research in this area by K. V. Husarova, I. M. Volkova, T. A. Stoyanova, M. H. Sviderska, O. I. Ugrynovska. and Pinyashka M., as well as other specialists in the science of civil procedural law. The empirical basis of primary source research is the modern legislation of Ukraine, as well as the legislation of Georgia and Moldova.In addition, it should be noted that M. Basilashvili covered the issue of comparative legal analysis of registration of civil status acts in Ukraine and Georgia in her research.
 Conclusions. It is obvious that cases on the establishment of facts of legal significance occupy an important place in judicial practice. The dynamism of social relations, and therefore the constant change of legislation in the conditions of war (since 2014), made it necessary to establish a new type of legal facts – a legal fact related to military aggression in Ukraine. The study of judicial practice on this issue gives reason to assert that the judicial body’s approach to the consideration of the specified category is becoming more and more qualitative. Aspecial role in the formation of the unity of judicial practice in solving the issue of establishing legal facts related to military aggression in Ukraine is played by the Supreme Court, which always stands guard to protect the violated rights of individuals. The legislative changes analyzed in this scientific study in terms of simplifying proceedings in cases of establishing the fact of birth or death of a person in the territory where a state of war or emergency has been imposed, or in the temporarily occupied territory of Ukraine, can rightly be called progressive, appropriate and necessary, since such are dictated by the realities of wartime in our country. Moreover, they will contribute to the unification of judicial practice in the matter of establishing the fact of birth and death of a person in the territory where a state of war or emergency has been imposed, or in the temporarily occupied territory of Ukraine. But the legislator still has a lot to work on in this matter. The regulation of the institution of establishing the fact of birth and death of a person in the temporarily occupied territory in Georgia and Moldova has many features, original legal norms that give grounds to conclude about the possibility of implementing specific positive points of foreign models of establishing the specified types of legal facts in Ukraine by improving Ukrainian legislation and applying in the Ukrainian legal space.

AbstractThe chapter explores the trajectories of the evolution of political science (PS) in four former Soviet Socialist Republics (Estonia and Lithuania, the Republics of Moldova and Belarus) after the USSR collapse. Departing from the premise that PS is appreciated as the science of democracy, the authors claim that its identity and autonomy are particularly important. Research shows that PS in these countries started from the same impoverished basis (“scientific communism”), but it soon took diverse trajectories and currently faces specific challenges. Democracy, pro-Western geopolitical settings and the shorter period of Sovietization contributed to the faster and more sustainable development of PS in two Baltic States. However, in Estonia, political developments have led to the retrenchment of PS and to downsize of universities’ departments and study programmes. In Lithuania, political scientists are very visible in the public sphere. In Moldova, its uncertain geopolitical orientation and a series of internal political conflicts have led to the weak identity of PS and questionable prospects for its further institutionalization. In authoritarian Belarus, PS as an academic discipline exists within a hostile political environment and under a hierarchical system of governance offering practically no degree of academic freedom.

AbstractIn the last chapter, the authors take stock of the challenges which are besetting the European Union’s (EU) internal and external borders from the perspective of contemporary events and crises, and evaluate them in the context of a changing international environment. They consider what can be learned from past experiences concerning the internal borders which in the last decades were lifted only to be reinstated again, and the hardening of the EU’s external borders in order to keep unwanted pressure from irregular immigration at bay while facing off hybrid security threats, terrorism and organized crime. The chapter analyzes the geopolitical shift from the perspective of the EU’s quest to protect internal policy progress, such as the greening of the economy, against political actors which challenge the principles of the rules-based international order. The chapter concludes by discussing the implications of the war in Ukraine on the European security architecture, and the prospect of a future enlargement to Ukraine, Moldova, and the candidate countries on the Balkan Peninsula.

Moldova is a relatively small, landlocked country with few natural resources apart from its agricultural land. In last years, the contribution of small and medium enterprises (SMEs) was a little bit lower than 30% of the national GDP. This modest contribution corroborated the relative weight of SMEs in turnover and employment, which has decreased since 2010. Moldova's business environment remains sensible to the volatile macroeconomic environment, structural challenges in the financial sector, crisis in the banking sector, internal political instability, and regional geopolitical instability. The aim of this chapter is to analyze the business environment in Moldova in terms of the existing regulatory framework, identifying barriers and constraints, and analysis of programs and policies to strengthen it, along with synthesizing and developing recommendations to enable the business environment. Technology business incubators and their role in the Moldova's economy are analyzed in the final section. Analytical findings of the author are illustrated through several interactive figures.

This chapter is devoted to revealing the importance and definition of the logical relationship of components related to an effective product policy of modern medium-size winery of the Republic of Moldova. The chapter presents a comparative analysis of modern marketing definitions of product policy of an enterprise. The purpose of the author is the research and marketing disclosure of the nature of the product policy as one of the key management tools of a modern winery. A structural model of the marketing product policy components has been developed. The approaches proposed for implementation in the Moldovan wineries would allow the analysis of the product policy effectiveness. The major part of the text includes a presentation of the activating methods of teaching implemented by the author on a course of Polish to children in Moldova. She used primarily lively songs and educational games with motor activities. The pupils satisfaction and engagement proved that the applied teaching methods were appropriate and efficient.

Abstract:
The article is devoted to the study of the Bulgarian copy of the Parenesis of Ephraim Sirin from the library of the Romanian monastery Putna, No. 38. Based on the filigree of the manuscript and the nature of the handwriting, the author dates this copy to the end of the 14th XIV century, and not the 15th century, as is customary in a number of works by the Romanian researchers. The manuscript has not yet been taken into account among the monuments of the “Alexandrian” (“Popgerasimov”) cursive writing, including the possible manuscripts of the Tyrnovo Book School. The analysis showed almost complete identity of the text of this manuscript in its preserved part with the text of the Parenesis copy of the second half of the 16th century from the National Library of Romania No. 4882, which, having the title of the 1st edition of the translation, thus allows us to attribute the Putna copy No. 38 also to the 1st edition of the translation of the Parenesis of Ephraim Sirin. This fact, since the copy No. 4882 is Slavic-Moldovan and comes from the library of the Moldovan monastery of Biserican (Joseph's hermitage), allows us to talk about the existence of the Slavic-Moldovan Parenesis tradition. Preliminary comparative analysis of the incipits of the copy No. 38 with the senior Parenesis copies of the 1st edition (Slavo-Moldavian copy No. 4882, Bulgarian NLKM copy No. 297 and RNL. F.P.I.63, Bulgarian Real copy No. 3/7, Serbian NLKM copy No. 298, Old Russian RNL copy Pogod.71a) showed that the text of the copy No. 38 has a number of unique lexical and syntactic differences in comparison with the text of these copies. The syntactic changes in the homilies that make up Parenesis consist in changing the word order of individual phrases and constructions, and the lexical changes are expressed by replacing synonymous words. The presence of 29 cases of line jumps (haplography) in the copy No. 4882 allows the author to believe that this copy, together with its not yet found antigraph and the Putna copy No. 38, actually represents an independent, separate, “Moldovan” (by the region of its existence) version of the 1st edition of the Parenesis of Ephraim Sirin.
