<strong>ABSTRACT</strong> During the Montana Constitutional Convention of 1889, John Wesley Powell, envisioning a landscape of watershed commonwealths, proposed that Montana adopt watersheds as the boundaries of its counties. The idea did not catch on. Over time, the power of local governments to regulate land use has grown immensely, but the misfit between their political boundaries and environmental policy problem sheds has persisted. When admitted to the Union in 1889, Montana and South Dakota included two identical anti-corruption provisions in the legislative article of their respective constitutions. One of the measures prohibited bribery of public officials, and the other barred corrupt solicitation by them. These measures reflected a common concern about government corruption in the western territories during the late nineteenth century. In the mid-1970s, state courts began to interpret state constitutions independently of the federal constitution in a way that provided greater protection for individual rights at the state versus federal level.
