Abstract:

Abstract:
<p>Moot courts are considered to be a common clinical legal education method. The purpose of the following article is to demonstrate advantages and disadvantages of using moot courts as a teaching method at high schools. This will be based on the experience of Street law assistants and their survey held among high school students. Gathered and analysed information will hopefully provide answers to the questions mentioned above. The article is divided into four parts. The first part introduces Charles University Law School Street Law course since it serves as prime source of our experience with high school students teaching and organising moot court. The second part deals with basic benefits and set backs of high school moot courts. The third part is dedicated to survey results presentation and the fourth part is composed of our experience of moot court organisation.</p><p>The purpose of our article is to offer basic information about the moot court simulation itself, present our survey research of high school students’ simulation perception and share our experience which might serve as encouragement for moot court organisation and also as basic advice on which common mistakes to avoid and what to pay close attention to.</p>

Abstract:
ABSTRACT Moot court is a common practice in law schools and growing in popularity at the undergraduate level. As part of the move to incorporate more active learning elements, instructors in a variety of courses include moot court elements in their syllabi. Courses, however, are not the only place where undergraduate students encounter moot court. Increasingly, students compete in moot court at the intercollegiate level. This paper examines those students who compete in moot court tournaments sponsored by the American Moot Court Association to determine what motivates these students and what benefits these students believe they receive from their participation. Survey results show that students are motivated to participate in moot court for academic reasons, that they believe their critical thinking and public speaking skills improve, and that, despite its heavy work load and difficulty, moot court is also fun.

Abstract:
This research project evaluates the short-term (< 1 month) response of saproxylic insects to the seasonal availability and tree species of recently cut logs. Using four harvested sites located in the balsam fir-paper birch forest of Forêt Montmorency (Quebec, Canada), we evaluated the taxonomic richness, visitation rates and colonization rates of saproxylic insects on logs cut on different dates during the summer season. Taxonomic richness and visitation rates were assessed using trunk-window traps, while colonization rates were obtained by debarking and dissecting exposed logs. Xylophagous insects were more likely to colonize balsam fir and black spruce logs than paper birch logs. Our results also showed a colonization of the logs by xylophagous insects less than a month after cutting, with higher colonization rates over a period ranging from mid-July to mid-September. These xylophagous insects were mainly Monochamus prob. scutellatus and Urocerus prob. albicornis, which are primary colonizers known to damage commercial logs. We recommend prompt harvesting of conifer logs cut during the period ranging from mid-July to mid-September to minimize damage to harvested logs.

Marijon, Eloi. Thesis, Paris 5, 2013. http://www.theses.fr/2013PA05S009.

Full text
Abstract:
Background – Although such data are available for young competitive athletes, the prevalence, characteristics and outcome of sports-related sudden cardiac death have not previously been assessed in the general population. Methods – A prospective and comprehensive national survey was carried out throughout France by the French Institute of Health and Medical Research from 2005 to 2010, involving subjects aged 10–75 years. Case detection for sports-related sudden cardiac death, during competitive or leisure activities, including resuscitated cardiac arrest, was undertaken via emergency medical services (Service d’Aide Médicale Urgente, SAMU) reporting and web-based screening of media releases. Data were collected according to Utstein’s style. Incidence calculations were reported by million of inhabitants as well as million of sports participants. Specific analyses were also carried out among women and specific sports. After having documented major regional survival disparities, we identified to which extent conventional evidence-based individual factors, known to be associated to survival, were distributed among different groups of survival. Moreover, we assessed if functional outcome was variable among groups of survival. Factors associated with survival were analyzed using regression logistic model. Results – The overall burden of sports-related sudden cardiac death was estimated between 5 and 17 cases per million inhabitants per year. Only 6% of cases occurred among young competitive athletes, with a specific incidence calculated to 9.8 (95% CI 3.7–16.0) per million per year. After considering participation rates, incidence in men sport participants was estimated from 11.2 (95% CI 10.4–12.1) to 33.8 (95% CI 30.9–36.8) per million of participants per year, dramatically higher than women-related incidence, particularly in the 45–54 year range (relative risk 0.03, 95% CI 0.01 to 0.07). By contrast with women, the incidence of sports-related sudden cardiac death in men significantly increased over age categories (p<0.0001), and incidence rates were substantially higher in men aged >35 years than men aged 35 years or less (RR 2.51, 95% CI 2.10–3.01). The mean survival rate at hospital discharge was 15.7% (95% CI 13.2–18.2), with major regional disparities among districts (from 0 to 47%), with however a highly similar favorable neurological outcome (80%). No difference was observed regarding subjects’ characteristics and circumstances of occurrence (including presence of witnesses, delays of intervention and public use of automatic external defibrillators) across survival groups. By contrast, major differences were noted regarding bystander initiation of cardiopulmonary resuscitation (15% to 81%, p<0.001) and presence of initial shockable rhythm (29% to 79%, p<0.001). Public use of automatic external defibrillator was dramatically low (<1%). Independent factors for survival included bystander cardiopulmonary resuscitation (OR 3.73, 95% CI 2.19–6.39, p<0.0001), initial shockable rhythm (OR 3.71, 95% CI 2.07–6.64, p<0.0001) and short delay between cardiac arrest and resuscitation (OR 1.32, 95% CI 1.08–1.61, p=0.006). After adjustment on individual factors, only population education to Basic Life Support was significantly associated with survival (OR 1.64, 95% CI 1.17–2.31, p=0.004).Conclusions and perspectives – Sudden cardiac death is a public health issue, with the need for a multidisciplinary approach involving Emergency Cares, Cardiology, and Epidemiology. Regarding sports-related sudden death, our conclusions are the following (...)

Abstract:
The overall objective of the study presented in this paper is to explore the perceived effects of a massive online open course (MOOC) that focuses on attention deficit/hyperactivity disorder (ADHD). Specifically, it aims to measure the effects perceived by MOOC teachers on their sense of self-efficacy (SEP) in teaching students with ADHD. This research also aims to explore and document the training needs of participants, the MOOC's capacity to meet them, the level of satisfaction of participants, the perceived contribution of the training and coaching methods deployed on the continuing professional development of participants, and the perceived effects on the behaviours of the students targeted by the interventions. Divided into four units spread over seven weeks, the MOOC Le point sur le TDAH: comprendre, soutenir et accompagner les jeunes offers an overview of ADHD based on recent scientific literature to enable teachers to better understand its symptoms and manifestations and to explore various intervention approaches likely to help them better support their students in their development and learning. The MOOC was evaluated among teachers who participated in the training (n = 178) using a pre-experimental design with one group pretest and posttest measure. Descriptive analyses as well as paired t-tests were carried out in order to achieve the research objectives. The results highlight participant satisfaction and indicate that the training appears to have contributed to the development of teachers' selfefficacy and knowledge, as well as to the improvement of their intervention practices for students with ADHD. At the same time, the results show that teachers perceived an improvement in the behaviours of the students targeted by the interventions deployed. Finally, this paper concludes with a discussion of the results and implications for practice and further research.

Charles, Florence. Paris 5, 2008. http://www.theses.fr/2008PA05H055.

Abstract:
The research undertaken is in the field of French language teaching. It investigates the key conceptions and representations underlying the logic and dynamics of teaching/learning lexis in cycle 3 (the last 3 classes) in primary schools. The main thread of the research explores the notion of the "right word". This notion guides and organises the teaching/learning of lexis to a certain extent and can be considered as the key to understanding the conceptions and representations operating in the recommended, stated and actual practices. The aim of enrichment, which represents a main aim that is juxtaposed to the aim of the appropriate use of words, the expectation that the pupil will re-use the words studied, which will then become "right words", highlights the operational character of this notion. Other central features of teaching/learning, since they are intertwined with these aims and expectations, also support this operational character: the pride of place given to the semantic component, the importance of the study of lexical relations of a semantic-type, the knowledge of language registers, which focuses on appropriate use, the conceptions that consider learning in metalinguistic terms. Teaching/learning of the "right word" and the use of the "right word" does however raise questions. A qualitative "leap" is required of the pupil, who must often, according to a conception of recycling and transfer, progress from knowing a word to using a word. According to the data studied, the lexico-syntactic and discursive dimensions prove to be less influential in teaching/learning. Finally, the use of the "right word" is not a foregone conclusion, due to the fact that several variables come into play. The conceptions and representations brought to light, therefore, seem to favour teaching of the "right word" rather than use of the "right word"

Abstract:
AbstractModern constitutionalism is based on the paradigm that courts are inherently entitled and obliged to enforce the constitution of the respective polity. This responsibility of courts also applies in the context of the European Union to both the CJEU and national constitutional courts. The present chapter argues that in the face of constitutional crises the CJEU and the Hungarian Constitutional Court shy away from applying the law as it is to the full. The reasons behind this unwarranted judicial self-restraint are most different: the CJEU aims to avoid conflicts with national constitutional courts whereas the Hungarian Constitutional Court has been facing a legislative power also acting as constitution making power willing to amend the constitution to achieve specific legislative purposes or to undo previous constitutional court decisions. Yet both courts respond to expediencies that do not follow from the law they are called upon to apply. It is argued that rule of law backsliding requires these courts to abandon the unnecessary self-restraint and exploit the means already available.

This chapter discusses what it means to ‘handle precedent’, to ‘interpret statutes’, and to do justice ‘fitted to the needs of the times in which we live’. It provides answers to the following questions: When and how should policy arguments be used? How should foreign case names be pronounced in a moot? What is the correct way to refer to a case? Is it acceptable to give a personal view of the relevant law? When is an authority binding on a moot court? How can one escape from an inconvenient authority? In what circumstances can a case be overruled? How and when can a case be distinguished in law from another? How and when can a case be distinguished on its facts from another? What is the distinction between a judge's finding of fact and his or her decision on the law? What is the status of a judgment of the Divisional Court? Is a ‘Jessel’ better than a ‘Kekewich’? When is a change in the law a matter for Parliament and when is it a matter for the courts?

Abstract:
This chapter demonstrates the relevance of mooting for professional practice. It shows that mooting insists upon exacting standards of behaviour, dress, personal presentation, research, preparation, information management, time management, and communication. Mooting provides students with a set of skills than can make them better lawyers. At the very least it will equip students to work within a team, and to a deadline, and to present the fruits of teamwork in a robust, attractive, and memorable way. The chapter provides answers to the following questions: How should colleagues be liaised with and should their arguments be known? Are there any rules of fair play to be observed in mooting? Should the original law reports be produced in front of the moot court? When should skeleton arguments be used and what form should skeleton arguments, if permitted, take? Should Latin be used in the moot presentation? Is a professional courtroom manner important? What is the dress code for a moot? How should colleagues and opponents be addressed and referred to?

Abstract:
This chapter provides insights into the state of racial inequality in the US today, with a particular eye on income, wealth, jobs, and education disparities. Do these factors continue to be predicted by race? If they do not, then there really is no need to consider race when making policy at the national and state levels or in higher education. The discussions over affirmative action and how it should be implemented would be moot. This chapter also provides an examination of the impact of education in general and in particular for minorities. We look at how the elimination of affirmative action at the state level has affected enrollment of minorities in higher education. We then provide a look at the history of affirmative action related to higher education in the courts. As such, we offer a detailed synopsis of past court cases that have set the stage for how affirmative action is viewed and used in higher education today. In this light, we discuss the ever-present and surprisingly controversial notion of diversity and how it shapes the affirmative action landscape. We end the chapter by discussing our methodological and analytical strategies for the remaining portion of the book.

Abstract:
Castle Garth is the name of the fortified area once enclosed within the castle walls. In the fifteenth century Newcastle became a county in its own right, however, the Garth, being within the castle walls, remained part of the County of Northumberland. The Great Hall, a building separate from the Castle Fortress (the “Keep”), which in later years became known as the “Old Moot Hall”, was used by courts that sat at regular intervals in every county of England and Wales. The Fortress then became a prison for the County and was used as such until the early nineteenth century. Beginning in the fifteenth century, unlicensed traders, taking advantage of the fact that the city authorities had no jurisdiction over the Garth area, settled there with their commercial activities. From the time of Charles II (1630-1685), the area then became famous for its tailors and shoemakers, who grew particularly abundantly on the path known as “Castle Stairs”. In 1619 the fortified complex was rented by James I to the courtier Alexander Stephenson, who allowed the civilian houses to be built inside the castle walls. After the civil war, new houses were added until, towards the end of the eighteenth century, Castle Garth had become a distinct and densely populated community, with a theater, public houses and lodgings. The main urban transformations were started in the early nineteenth century with the construction of the new Moot Hall called County Court. From 1847 to 1849 the fortified enclosure was partially compromised by further intersections with the infrastructure for the construction of the railway viaduct, thus interrupting direct access from the Castle guarding the Black Gate. Despite the development of the contemporary city has affected the preservation of the ancient fortified palimpsest, a strong consolidated link is still maintained by the sedimentation of values of material and immaterial culture. The proposed contribution intends to present this process of integration between fortified structure and city highlighting today the state of the art, the conservation, restoration and enhancement initiatives undertaken in the last forty years.

Abstract:
Urban mobility has been highlighted as one of the most relevant themes in Smart Cities. Alongside this, following a principle of resource optimization and seeking greater sustainability, bicycle sharing systems have stood out as a resource that can be used to assess urban mobility. The correct analysis of these data and the understanding of the dynamics in these systems can aid in decision making, in addition to optimize the complex urban mobility system. Thus, this work analyzes a Bicycle-Sharing System dataset, which is enriched for us with meteorological and seasonal information. In order to achieve our results, we recognize cyclist activity patterns related to date and climate information, as well as we identify a set of parameters that influences bicycle rental flow. Finally, we explore the relationship between these parameters and patterns, in order to present predictive regression models for rental flow prediction. In our results, Random Forest algorithm was the best approach for the creation of an effective regression model, explaining 95% of the explanatory variables.

MacLean, Nancy. How Milton Friedman Exploited White Supremacy to Privatize Education. Institute for New Economic Thinking Working Paper Series, September 2021. http://dx.doi.org/10.36687/inetwp161.

Full text
Abstract:
This paper traces the origins of today’s campaigns for school vouchers and other modes of public funding for private education to efforts by Milton Friedman beginning in 1955. It reveals that the endgame of the “school choice” enterprise for libertarians was not then—and is not now--to enhance education for all children; it was a strategy, ultimately, to offload the full cost of schooling onto parents as part of a larger quest to privatize public services and resources. Based on extensive original archival research, this paper shows how Friedman’s case for vouchers to promote “educational freedom” buttressed the case of Southern advocates of the policy of massive resistance to Brown v. Board of Education. His approach—supported by many other Mont Pelerin Society members and leading libertarians of the day --taught white supremacists a more sophisticated, and for more than a decade, court-proof way to preserve Jim Crow. All they had to do was cease overt focus on race and instead deploy a neoliberal language of personal liberty, government failure and the need for market competition in the provision of public education.

Abstract:
The emergence of modern complex systems is often exacerbated by a proliferation of information and complication of technologies. Because current complex systems challenges can limit an organization's ability to efficiently handle socio-technical systems, it is essential to provide methods and techniques that count on individuals' systems skills. When selecting future employees, companies must constantly refresh their recruitment methods in order to find capable candidates with the required level of systemic skills who are better fit for their organization's requirements and objectives. The purpose of this study is to use systems thinking skills as a supplemental selection tool when recruiting prospective employees. To the best of our knowledge, there is no prior research that studied the use of systems thinking skills for recruiting purposes. The proposed framework offers an established tool to HRM professionals for assessing and screening of prospective employees of an organization based on their level of systems thinking skills while controlling uncertainties of complex decision-making environment with the fuzzy linguistic approach. This framework works as an expert system to find the most appropriate candidate for the organization to enhance the human capital for the organization.

Full text
Abstract:
A systematic approach to tree planting and management globally is hindered by the limited synthesis of information sources on tree uses and species priorities. To help address this, the authors ‘mined’ information from 23 online global and regional databases to assemble a list of the most frequent tree species deemed useful for planting according to database mentions, with a focus on tropical regions. Using a simple vote count approach for ranking species, we obtained a shortlist of 100 trees mentioned in at least 10 of our data sources (the ‘top-100’ species). A longer list of 830 trees that were mentioned at least five times was also compiled. Our ‘top-100’ list indicated that the family Fabaceae (syn. Leguminosae) was most common. The information associated with our mined data sources indicated that the ‘top-100’ list consisted of a complementary group of species of differing uses. These included the following: for wood (mostly for timber) and fuel production, human nutrition, animal fodder supply, and environmental service provision (varied services). Of these uses, wood was most frequently specified, with fuel and food use also highly important. Many of the ‘top-100’ species were assigned multiple uses. The majority of the ‘top-100’ species had weediness characteristics according to ‘attribute’ invasiveness databases that were also reviewed, thereby demonstrating potential environmental concerns associated with tree planting that need to be balanced against environmental and livelihood benefits. Less than half of the ‘top-100’ species were included in the OECD Scheme for the Certification of Forest Reproductive Material, thus supporting a view that lack of germplasm access is a common concern for trees. A comparison of the ‘top-100’ species with regionally-defined tree inventories indicated their diverse continental origins, as would be anticipated from a global analysis. However, compared to baseline expectations, some geographic regions were better represented than others. Our analysis assists in priority-setting for research and serves as a guide to practical tree planting initiatives. We stress that this ‘top-100’ list does not necessarily represent tree priorities for the future, but provides a starting point for also addressing representation gaps. Indeed, our primary concern going forward is with the latter.
