Abstract:
Ziel des Hugo Sinzheimer Moot Courts1 ist es, Studierenden die Möglichkeit zu geben, ihre Kenntnisse über das europäische Arbeitsrecht anhand eines konkreten Fallbeispiels zu verbessern und zu vertiefen. Er ermöglicht den teilnehmenden Teams aus verschiedenen Ländern, das europäische Recht in einem möglichst realistischen Umfeld, wenn auch simuliert, zu erleben. Im Folgenden wird zunächst der Hintergrund des Moot Courts kurz dargestellt, um anschließend auf dessen Zielsetzung und Organisation einzugehen. In einem weiteren Schritt wird der Ablauf des Moot Courts erklärt, der prinzipiell in drei Phasen unterteilt werden kann: die Vorlaufphase (Fallerstellung), die Vorbereitungsphase (Ausarbeitung der Schriftsätze) und die Verhandlungsphase (Plädoyers). Zum Schluss wird der didaktische und pädagogische Nutzen des Moot Courts erläutert.

Abstract:
<p>Moot courts are considered to be a common clinical legal education method. The purpose of the following article is to demonstrate advantages and disadvantages of using moot courts as a teaching method at high schools. This will be based on the experience of Street law assistants and their survey held among high school students. Gathered and analysed information will hopefully provide answers to the questions mentioned above. The article is divided into four parts. The first part introduces Charles University Law School Street Law course since it serves as prime source of our experience with high school students teaching and organising moot court. The second part deals with basic benefits and set backs of high school moot courts. The third part is dedicated to survey results presentation and the fourth part is composed of our experience of moot court organisation.</p><p>The purpose of our article is to offer basic information about the moot court simulation itself, present our survey research of high school students’ simulation perception and share our experience which might serve as encouragement for moot court organisation and also as basic advice on which common mistakes to avoid and what to pay close attention to.</p>

ABSTRACT Moot court is a common practice in law schools and growing in popularity at the undergraduate level. As part of the move to incorporate more active learning elements, instructors in a variety of courses include moot court elements in their syllabi. Courses, however, are not the only place where undergraduate students encounter moot court. Increasingly, students compete in moot court at the intercollegiate level. This paper examines those students who compete in moot court tournaments sponsored by the American Moot Court Association to determine what motivates these students and what benefits these students believe they receive from their participation. Survey results show that students are motivated to participate in moot court for academic reasons, that they believe their critical thinking and public speaking skills improve, and that, despite its heavy work load and difficulty, moot court is also fun.

Abstract:
The paper attempts to comprehend the place and role of moot courts in modern legal education. To achieve this goal, the concept and types of moot courts are considered. The author analyses the order of their organization and conduct as a business game in the course of studying an academic discipline (module) and as a competition (competition) among students of higher educational institutions. The main stages of preparing the team for participation in the modeling process are characterized. The author argues an opinion that there are significant advantages of using moot courts in legal education, and supports it with, apart from other things, the results of the author’s survey of students of Kutafin Moscow State University (MSAL) having taken part in different moot court competitions. The author also identifies some difficulties in the preparation of teams. The author concludes that moot courts have an important role in the training of highly qualified specialists to make them ready to solve complex legal issues and possess all the knowledge and skills necessary for this.

In April 2006, the Wilhelm Merton Centre for European Integration and International Economic Order of Johann Wolfgang Goethe University, Frankfurt organised a symposium in celebration of the 40th anniversary of the Convention on the Settlement of Investment Disputes (ICSID). At the symposium, young and up-and-coming scholars, together with experienced experts from both the profession and academia, discussed a broad range of issues relating to investment protection before a substantial audience. Frankfurt is also home to the Frankfurt International Arbitration Center (FIAC), founded in 2005 as a joint venture between the Frankfurt Chamber of Commerce and Industry (Frankfurt CCI) and the Deutsche Institution für Schiedsgerichtsbarkeit (DIS). Under an agreement between ICSID and DIS, the FIAC serves as a cooperation facility for ICSID arbitrations. It is one of only two cooperation facilities in Europe.

<p>This paper starts by discussing ways in which the current teaching system at the Nigerian Law School reflects a clinical approach. Issues examined include classroom participation, court and law office attachment, law dinners, moot court and other practice week activities. Certain issues are problematised and options for improving clinical teaching methods for large multicultural classes are proffered. Central to the options proffered is a project management approach where, for instance, students do not just participate in a moot court session, but the class executes a moot court project. This means that every stage of the project is constructed as a distinct, but integral exercise in which students need to develop competencies. This would create the opportunity for students to develop ‘extended’ lawyering skills of project management, reporting and evaluation in addition to the already established skills of research, interviewing, counselling, negotiation, advocacy and so on, much in the same way as medical doctors in training are involved in public health projects, within which they practice community medicine. Clinical projects would as much as possible, accommodate personal skills preferences, while methods of assessment suited to each area of competence would be developed and applied as part of the overall assessment of students’ performance.</p>

O presente trabalho visa a apresentar o papel das competições de julgamento simulado, i.e. Moot Court Competitions, na educação em Direito Internacional dos Direitos Humanos (“DIDH”). Para isso, apresentar-se-á a experiência da Atividade de Cultura e Extensão da Faculdade de Direito da Universidade de São Paulo (FDUSP) “Atuação em Sistemas Regionais e Globais de Direitos Humanos”, a qual, além de promover o ensino do DIDH, envia anualmente competidores para três competições internacionais: a Competição de Julgamento Simulado do Sistema Interamericano de Direitos Humanos, a Price Media Law Moot Court Competition e a Nelson Mandela World Human Rights Moot Court Competition. A fim de que se pudesse mensurar o impacto de tais competições no aprendizado e no desenvolvimento de habilidades dos alunos de graduação da FDUSP, foi aplicado um questionário a todos os estudantes que participaram de ao menos uma das competições oferecidas pelo grupo entre 2009 e 2017. No questionário, foi solicitado aos alunos que se autoavaliassem sobre diversas habilidades, antes e depois da participação nas competições. Dessa forma, o presente artigo apresenta os resultados da pesquisa empírica, concluindo pela efetividade das competições de julgamento simulado como instrumento de ensino.

Editorial NoteThe first Telders International Law Moot Court Competition was organized in 1977 on the occasion of the thirtieth anniversary of the Telders International Law Students Debating Society. Students from the Universities of Bonn, Cologne, Leiden and Strasbourg participated. The competition took place in the Peace Palace at The Hague and was an overwhelming success. Since then the competition has been held annually. Participation has expanded from three teams in 1977 to thirteen teams now. The eleventh session has been held in the Peace Palace from 14–16 April 1988. The case for the Telders International Law Moot Court Competition was written by Prof. Dinah Shelton.

ABSTRACT In September 2013 in the case of Divito v Canada (Public Safety and Emergency Preparedness) the Supreme Court of Canada dealt with the issue of whether section 6(1) of the Canadian Charter of Rights and Freedoms, the Charter, which grants Canadians the right to enter Canada was violated in a case where the Minister of Public Safety and Emergency Preparedness declined to consent to the transfer of a Canadian citizen to serve his sentence in Canada where the sentencing state had consented to the transfer. Another issue was whether sections 8(1) and 10(1)(a) and 10(2)(a) of the International Transfer of Offenders Act, which granted the Minister the discretion to consent or not to consent to the transfer, were contrary to section 6(1) of the Charter. In resolving the above issues, the Court referred to its earlier jurisprudence, academic publications and international law. Although the Court agreed with the government that the appeal was moot because the appellant had left the USA by the time it was heard, it held that it retained “a residual discretion to decide the merits of a moot appeal if the issues raised are of public importance” and that this case was one of public importance because “[t]he issues are likely to recur in the future and there is some uncertainty resulting from conflicting decisions in the Federal Court.” The purpose of this article is to highlight the interpretative tools invoked by the court and the implications of the judgement.

Moot court is onepractical learning method of procedural law learning that must be given to undergraduate law students. This learning method as a framework initiated by John Dewey as the achievement of progressive legal education, especially in criminal justice practices. The purpose of this learning method is to provide students with a deepening of criminal justice both based on theory and practice as well as provide opportunities for students to carry out the criminal trial practice by taking examples of criminal case decisions that have obtained permanent legal force. This paper specifically discovers, studies, analyzes and provides deepening related to criminal justice based on theory and practice for law students at the level of the Bachelor of Law program to obtain a progressive legal educationThe method used in this paper is empirical legal research method using primary data and secondary data based on a purposive sampling model with deep-interview concerning the practice of the moot court in law higher education. The results of this study indicate that students have gained a deepening of criminal procedural law, particularly in the implementation of criminal justice guided by supervisors and legal practitioners as tutors and instructors. This study also suggestedthat students have been able to practice criminal justice as true as actual criminal trials accompanied by supervisors and legal practitioners as their mentors in achieving progressive legal education.
