Abstract:
This thesis is made of two parts. Part I (Chapter 1 to 3) focuses on the ethical aspects of the current challenges in microfinance. Chapter 1 addresses the question of the place and importance of credit in development policies, through the debate on the right to credit. Chapter 2 and 3 then question the fairness of the interest rates charged by the microfinance institutions. Chapter 2 analyzes whether the fairness criteria depend on more basic principles of justice, such as Rawls’ principles described in A Theory of Justice (Rawsl, 1976). Chapter 3 then reviews some of the implicit and explicit definitions of fair interest rates and proposes an original methodology, with David Gauthiers’ contractuarian theory. It determines what a fair interest rate would be when lending to the poor.

Based on the results of the two first chapters, Part II (Chapter 4 to 6) focuses on the role of donors in microfinance. Chapters 4 and 5 use two original databases, of 67 and 100 MFIs respectively to study the impact of subsidies on the MFIs’ management, through their rating evaluation (Chapter 4) and MFIs’ performance and management decisions (Chapter 5). Chapter 4 will analyze the relationship between the quality of management, as rated by a specialized agency, and the amount of subsidies. Chapter 5 will study pricing policy, the clientele and the potential moral hazard of subsidized institutions. Concluding this analysis, Chapter 6 gives some guidelines on the use of donor subsidies, especially in their interaction with the new private commercial actors, such as investment funds.

AFRIKAANSE OPSOMMING: Die beleid van Norme en Standaarde vereis dat sekere kompetensies bereik word. Met ander woorde, die opvoeder as leermediator word bemagtig deur die Norme en Standaarde om sekere kompetensies te bereik. Onder Norme en Standaarde kyk hierdie studie na die verskillende ratio‟s wat op onderwys betrekking het. Hierdie ratio‟s vorm „n sameloop wat Inklusiewe Onderrig tot so „n mate strem, dat die gewenste kompetensies nie bereik kan word nie. Hoewel Inklusiewe Onderrig nie die enigste faktor is wat Norme en Standaarde bepaal nie, is dit wel „n belangrike een, en hierdie studie fokus dus daarop. Saam met Norme en Standaarde is daar ook sosio-ekonomiese faktore wat Inklusiewe Onderrig strem, en dit word ondersoek. In die lig van die probleme ten opsigte van die leerder:opvoeder-ratio, die leerder:m²-ratio, die woonpersele:skoolperseel-ratio, norme- en standaarde-toekenning, ongelykhede (ekonomiese, ouderdoms- en emosionele en fisiese ontwikkeling), enkelouerskap en fetale alkoholsindroom (FAS), word daar in die verhandeling gekyk na die haalbaarheid van die realisering van die drie kompetensies naamlik die praktiese, fondasionele en refleksiewe kompetensies. Die studie bevind dat die bereiking van kompetensies haalbaar is, mits daar aan die ratio‟s en die sosio-ekonomiese omstandighede gewerk word. Na aanleiding van my navorsing kan die meeste opvoeders verslag doen van hul werksaamhede, maar dit is egter nie die positiewe, progressiewe verslag wat van ‟n leermediator verwag word nie. Norme en standaarde is na my mening nog haalbaar omdat daar bewys is dat leerders, ondanks die negatiewe effek van die ratio‟s, asook die ontoereikende voorsiening (geld, menslike hulpbronne en voorrade) en die ekonomiese en ouderdomsverskille en FAS, tog die potensiaal toon om te leer. Die probleem is egter dat te veel leerders onderpresteer, uit die onderwys- en opvoedingstelsel verdwyn en nie deel raak van die ekonomiese hoofstroom nie. Deur dus aandag te gee aan die stremminge wat ek nagevors het, kan verseker word dat Inklusiewe Onderwys tot sy reg kom, kompetensies bereik word en die opvoeder ‟n suksesvolle leermediasie fasiliteer. ENGLISH ABSTRACT: The Norms and Standards for Educators policy states that certain competencies must be achieved. To this end the policy empowers the educator as learning mediator. With reference to the Norms and Standards, this study explores the different ratios applicable to education. These ratios form a combination which hamper Inclusive Education to the extent that the competencies cannot be achieved. Although Inclusive Education is not the only aspect which affects Norms and Standards, it is a very important one, and this study thus explores Inclusive Education. Together with Norms and Standards, there are also socio-economic factors that hamper Inclusive Education, which this study also explores. In the light of the problems with the learner:educator ratio, the learner:m² ratio, the residential erven:school erf ratio, the allocation of norms and standards, unequal economic circumstances, unequal development phases (emotional, physical and age), single parenthood and fetal alcohol syndrome, this thesis explores the feasibility of the realisation of the three competencies namely the practical, foundational and reflexive competencies. This study finds that, providing that attention is paid to the ratios and socio-economic factors, the achievement of competencies are feasible. My research shows that, while most of the educators can report on their activities, it is not the positive and progressive report which one expects from a learning mediator. Norms and Standards, in my view, is feasible since there is evidence to suggest that learners, despite the negative effect of the ratios and inadequate resources (finances, human resources and supplies), economic and age differences, Fetal Alcohol Syndrome (FAS), still displays the potential to learn. The problem, however, is that too many learners underperform, and then leave the school and education system. They then fail to become part of the main economic system. ENGLISH ABSTRACT: Since 1994 South Africa has undergone numerous social and political transformations. Transformation in this country has different meanings for different people, depending on the individuals perspective. The process of transformation has been slow for some, particularly those people who are eager to break away from a past, which has denied them basic individual rights. For others transformation has been too fast and thus a threat to their status quo. In view of this, transformation must be embraced by all through the realisation and admission that the apartheid era was inherently unfair to sections of the population and change must therefore be regarded as the levelling of the playing field. This study focuses on the generation of inequality, the uprooting of this evil and the implementation of equity. In addition, this study particularly focuses on how equity can be implemented in the workplace, why it is important to do so and what are the possible barriers to successful implementation. I will consider some of the theories that may be useful in initiating change. Finally, I will discuss the merits of the Employment Equity Act as legislation to enforce equity in the workplace.
AFRIKAANSE OPSOMMING: Vanaf 1994, het Suid Afrika verskillende sosiale en politieke veranderings ondergaan. Hierdie veraderings het verskillende betekenis vir verskillende mense, afhangend van die individuele se insig. Die proses van veranderings was te stadig vir sommige persone, veral diegene wie angstig was om weg te breek van die verlede, wat hulle ontneem het van hulle basiese individuele regte. Vir andere was die veraderings veels te vinning en was meer 'n bedreiging vir hulle onveranderlike hoë belangrike posisies. Met hierdie faktor insig, moet veranderings omhels word deur almal se opregte beseffing en erkenning dat die apartheid jare se alleen regte vir die een groep baie onregverdig was teenoor die ander groepe, dus moet veranderings aanvaar word as gelykmaking van alle onreelmatinghede. Hierdie studie is die fokus gerig op die jare van vasgevangheid in onregverdigheid en dat hierdie ongeregtigheid kan ontwortel word met die aanbeveling of vervangs van geregtigheid. Die fokus lê veral klem op hoe om gelyke regte by die werksplekke toe te pas.

Abstract:
Given the increased interdependency caused by ongoing task differentiation and precarious formal employment, this thesis asks why the stigmatisation of unemployed citizens and the retraction of unemployment benefits have received such widespread support in Australia. I contend that the concepts of dependency and independence, as reflexive but mutually exclusive dual values, are increasingly used as a framework for welfare discourse. I argue that this framework has ethical ramifications for collective well-being in Australia since it discourages citizens from acknowledging their own social and economic vulnerability. Using a combination of critical theory and discursive analysis, this thesis analyses discourses relating to poverty, unemployment and social welfare. It tracks the contradictions of this value dualism through selected forms of policy and media discourse literature and will challenge the negative moral valence associated with dependency, offering possible alternatives in the areas of moral anthropology, welfare discourse and social provision in order to reverse the stigmatisation of unemployed citizens.

ENGLISH ABSTRACT: This study was undertaken to evaluate whether a mentally competent mature human being, who is suffering an intolerable, irremediable existence resulting from an incurable agonising or devastating paralysing disease; has a moral, personal and civic right to end that life or have it ended by requesting assistance in meeting death in a humane, compassionate and dignified manner. ~ The righteousness of such assistance can only be gauged if it follows the repeated and voluntary request of someone who is presently not suffering from any psychiatric disorder, is presently mentally competent or had made such a written or verbal witnessed advance directive while mentally competent to do so. ~ This study will not deal with assistance in dying either active or passive which is performed on severely mentally and physically handicapped new-born babies with scant prospect of survival; nor with euthanasia for the relief of malignant or paralysing disease in those with life-long [anoxic, congenital, inflammatory or traumatic] mental incompetencies who have never had decision-making capacity. ~ This study will not address issues of aid-in-dying for mentally incompetent persons suffering from senile dementia, Alzheimer's disease, or permanent vegetative states due to brain pathology following anoxic, circulatory, infective, malignant or traumatic events, who have not made advance directives and who had never stated preferences concerning assisted euthanasia. The aim of this study is to outline the moral case advanced by those in favour of legalising Voluntary Assisted Euthanasia [VAE] also called Assisted Euthanasia [AE] and to develop ethically sound and practical proposals for policy and actions contributing towards the resolution of the moral dilemma faced daily by doctors when asked by mentally competent patients suffering from irremediable malignant or paralysing diseases or the agonising symptoms of end-stage Acquired Immune Deficiency Syndrome (AIDS) for assistance to end their lives. }ii> This study will cover and discuss the more important objections of those opposed to the legalising of assisted suicide for mentally-competent terminal patients who are irremediably suffering in their bodies or from dehumanising incurable endstage paralysing diseases and are near to an inevitable death. }ii> The insights of philosophers, theologians, physicians and sociologists on the subject of suicide and aid-in-dying, have been researched in the extensive literature that exists (both in print and in cyberspace) on these subjects and are presented with the study. }ii> The study tries to show that a competent adult in certain grim circumstances should have an inalienable human right, if not a constitutional one, to request assisted euthanasia or aid-in-dying or assistance in ending their lives. }ii> Such assistance must be subject to peer review, after careful assessment by a multidisciplinary team in the healing [both physical and spiritual] professions This paper will try to determine whether the actionalisation of voluntary assisted suicide or assisted euthanasia is murder or an act of compassion and empathy performed out of respect for a fellow human being's autonomy and in deference to their right to self-determination and self-realisation. ~ The relevance of this situation is that aid-in-dying is becoming one of the major, moral, religious, philosophical and bio-medical dilemmas at this time. ~ The author's position is that it is neither just nor ethical to prevent a mentallycompetent human being, who is tormented by agonising, incurable terminal physical or irremediable paralysing disease, from deciding to chose to die when he/she can no longer bear the torment and asking for professional assistance to effect this. This relief should be given not only to those who are able to make an enduring, informed contemporaneous decision, but also to those who [when they still had decision-making capacity] had previously made a considered informed advance directive about the use of ordinary and extraordinary medical methods of sustaining a life that had become merely an existence.

Abstract:
My broadest aim in this thesis is to explore some of the central ethical concerns of social anthropologists vis-a-vis the phenomena of development. In particular, what I want to bring out and examine is the dynamics of the 'moral experience' and 'moral force' of anthropologists in this area. I go about this by considering the historical unfolding of the anthropological conceptual and evaluative apprehension of planned social and economic change. On this basis, I also consider the nature of the critiques and contributions that social anthropology has generated. I also make an attempt to review the major conceptual moral controversies and agendas that are intrinsic to development from an anthropological perspective. Whilst the concepts and values that emanate from social anthropology are multi-faceted and many stranded, I believe that the anthropological standpoint is both distinctive and potentially counter hegemonic. I look specifically at the moral resources that can be unearthed from the emerging field of 'development ethics' which is largely articulated in terms of the maxims that are fundamental to Western moral and political traditions. I attempt to set out the terrain of the ethical deliberation of anthropologists involved in development in terms of some of the moral difficulties of Western society. I argue that Western moral reasoning, as a result of deep disagreements about the sources of value human life and society, tends to rely upon procedural, instrumental and coercive ethical frameworks. On this basis, one of my assertions is that communitarian arguments, whilst also being needed as a healthy antidote to the excesses of liberal individualism, also constitute a reflection of the aspirations of people(s), many of whom are beleaguered by the alienation, atomism and instrumentalism of modern society. The communitarian perspective also underpins a political commitment to supporting those besieged indigenous communities that struggle to defend their integrity in the face of the aggressive intrusions of the market mentality. This may involve supporting the maintenance of 'traditional' versions of moral reasoning, well being, and sociality (such as indigenous life-worlds), collective rights in the face of the fragmentary and individuating neo-liberal development policies, and to support the 'construction of new associative networks such as 'new social movements' that represent the aspirations, and embody the values, of marginalised and disempowered social groups.

This work examines the socio-economic context of the small town of Eichelborn in the Westphalia region of Germany. There, a local and 'moral' economy existed until the end of the 1960's that resisted the forces of integration into a wider self-regulatory market system for an exceptionally long time, continuing to rely primarily on simple craft production and small-scale farming for the local market. Employing mainly qualitative methods, the aim of research was to describe the economic and social structure of this place as well as to determine whether it functioned according to the principles of a pre-market society as indicated in Karl Polanyi's writings. The findings of my research show that one can, indeed, understand Eichelborn as a Polanyi-type community and as a 'moral' economy in which a strong interrelation and unity between the social and economic realms result in the reconciliation between 'personal self-interest' and 'morality'.

Abstract:
Pharmaceutical advertising involves the advertising of medicines, medical devices, and healthcare services. A review of available international literature indicates the belief that pharmaceutical advertisements negatively affect healthcare decisions made by consumers. Very little research has been conducted to determine how consumers in South Africa (SA) are affected by pharmaceutical advertisements. This study aimed to determine how consumers in the Nelson Mandela Metropole (NMM) perceive pharmaceutical advertisements. More specific objectives included the investigation of legislation in SA employed in pharmaceutical advertisements, the interpretation and misinterpretation of the advertisements, and the identification of problematic areas in this form of advertising. South African legislation applied to pharmaceutical advertisements was investigated by means of a literature review. A qualitative research design was also used to achieve the aim and objectives. This included a focus group consisting of six randomly selected participants in the NMM. A consumer survey, consisting of a 100 consumers obtained from 10 randomly selected community pharmacies within the NMM, supported the findings of the qualitative techniques. The themes identified in the focus group were incorporated into a questionnaire used in the consumer survey. Three randomly selected pharmaceutical advertisements were also decoded to interpret the components employed in each. The results determined that pharmaceutical advertising is a marketing tool that incorporates various emotional and psychological techniques to persuade consumers. It was also evident that consumers can misinterpret pharmaceutical advertisements. Various legal and ethical problems were identified in pharmaceutical advertisements. These results showed that pharmaceutical advertisements have the possibility of negatively affecting consumers’ healthcare decisions and warrants further investigation.

'Community' has long proved an integral element in commonsense thinking about a range of social problems and experiences, and with respect to crime the general conclusion is that more community will mean less crime. This study comprises a critical exploration of the resonance of community to New Labour's youth justice policy and to the lives of young offenders. The concept of community is of particular interest, as since its election in 1997 New Labour has been committed to forge a new political ideology of the 'Third Way', wherein communitarian ideas have proved central to the government's ambitions to revive and emphasise individual's responsibilities and obligations to civil society. Thus evident in the array of civil and criminal orders, which constitute the youth justice system in England and Wales, are constructions of community as both a 'moral resource' and as a 4moral claimant'. The former assumes that communities have inherent capacities in preventing and controlling youth crime, while the latter prioritises the community's right to demand the punishment and exclusion of those young people who fail to live up to their communal responsibilities. Given that communitarian responses are but the latest manifestation of the constant search for solutions t o youth crime, consideration is initially accorded to the historical shifts and continuities in both youth justice and community safety policy and practices. It is argued that a movement towards increasingly punitive, exclusionary and defensive responses to crime and young offenders has prevailed in recent years, and it is within this context that New Labour's prioritisation of communitarian thought has occurred. Attention then turns to the specificities of the government's commitment to communitarianism,within youth justice. Not only do New Labour emphasise young people's responsibilities to the community - rather than the community's, or indeed, the state's responsibilities to the young person- but it has also demonstrated its willingness to define. legislate and sanction with respect to those responsibilities it considers essential to the membership rights of the 'law-abiding' community. As such it is contended that the government's vision of community is essentially narrow, defensive and divisive. The analysis then draws upon semi-structured qualitative interviews with a sample of young offenders and Youth Offending Team practitioners to explore the resonance of community to the lives of young offenders and to their experiences of youth justice supervision. It is argued that community is a salient feature of the lives of young offenders which often provides for inclusionary experiences. However, the government's faith in the community to act as a 'moral resource' in preventing and controlling crime does not adequately account for the complex, transitory and ambiguous nature of young offenders' experiences of communal life. Furthermore, the punitive repercussions of the government's commitment to honouring the community's role as a 'moral claimant' serve to undermine the practitioner's ability to exploit the resources the community may have to offer to with regard to encouraging and motivating young people to desist from offending. Additionally, the emphasis on intolerance is likely to promote the community's disapproval and hostility towards young offenders. It is concluded that New Labour's commitment to communitarianism, and its particular envisaging of community, conjures a powerful exclusionary potential which is unlikely to engender positive outcomes for either the young offender or the 'law abiding' community.

Abstract:
In the last 30 years, in vitro fertilization (IVF) has created a significant amount of controversy around the world. Within the U.S., policy movement has been limited, occurring primarily at the state level, which has created a fragmented system of rules to manage the technology. However, there appear to be indications that how the issue is presented, and which actors are chosen to be represented in legislation, may impact the passage of policy, thereby also providing a reason for why little policy movement has occurred. In this study, pieces of federal, California and Georgia legislation were examined for the occurrence of differing frames, as identified by the actors presented, in order to determine whether different frames occurred in passed legislation than those found in failed legislation. It was determined that, while actors did not differ significantly between passed and failed legislation, there were some slight differences between actors used at the federal level, as well between the different state levels. Even further, the presentation of actors and their interests did appear to differ slightly between passed and failed legislation.

The Comprehensive Environmental Decision Making (CEDM) paradigm developed through this research conceptualizes CEDM through a particular way of seeing a commitment to man's relationship with his environment. Previous research has explored CEDK but the idea remains ill-defined. The challenge in this research is to reestablish the guiding ideas of the government-environment-citizens matrix, while at the same time describe a meaning and means of operation suitable for environmental professionals working in industry today, where the man-environment commitment is critical to economic growth and environmental quality. In this research a meaning and means of operation begins with Lynton K. Caldwell's guiding ideas. As an avenue of implementation, government structures established through The National Environmental Policy Act and the Pollution Prevention Act provide policy reinforcement. Accepting policy as a CEDM avenue the requirements of environmental understanding, information and perception are developed through aspects of the environment and sustainable development with rational ecology ultimately providing the guideposts and criteria whereby CEDM may be judged. Citizens are those environmental professionals where an ethic is shaped through systems learning with the Environmental Management System used as a framework to establish the CEDM network of relationships in the workplace. The professional's socially binding value is hypothesized as an obligation not to do harm. With this value orientation, rational ethics and systems thinking provide guidelines that direct the professional in evaluating and optimizing policy and business structures. The CEDM paradigm is illustrated as a social choice mechanism suited to the 1990s and beyond by using case studies to apply policy directions.

ENGLISH ABSTRACT: In recent years, so-called "anti-globalisation" protesters have become an expected, though to many an unwelcome feature at almost all meetings of international institutions and at intergovernmental summits. The protesters are usually portrayed as senselessly violent anarchists, ridiculed in the media as eccentrics and outsiders, while academics have as yet paid them little or no attention. This study attempts to determine whether the predominantly negative perception of the protesters is justified, or whether there is some merit to their concerns. The vague umbrella term anti-globalisation protesters tends to disguise the fact that many different and diverse groups are involved in the protest. Elements of social movement studies are drawn upon to structure the analysis of a number of groups that are represented on occasions of protest. The analysis reveals that the protests are well-organised, active in international networks, and rely very much on the internet to co-ordinate their efforts. From the perspective of social movement studies, the anti-globalisation league represents an interesting new phenomenon. This is due to its simultaneous presence in a multitude of countries, as well as its non-state focus. Effectively, the movement transcends state boundaries and state structures. The changing face of international politics is at the root of the formation of the antiglobalisation movement. A perceived loss of sovereignty and increased international multilateral co-operation has reduced the effectiveness of domestic and state-based campaigning and created an opportunity, if not the necessity, to form transnational groups that have international institutions as their focal point of protest. It is submitted that the movement may be a source for unconventional ideas that could go some way in addressing various problems related to the ever-advancing process of globalisation. This may be accomplished by way of greater formalisation of the movement, and possibly with support from other prominent voices who are not anti-globalisation activists as such, yet in essence share many of the concerns of the protesters. In this way, the anti-globalisation movement could develop into a credible entity to complement the functioning of existing international institutions.
AFRIKAANSE OPSOMMING: Protes aksies teen globalisering is gedurende die laaste paar jare 'n bekende, maar nie noodwendig 'n welkome verskynsel by feitlik alle vergaderings van internasionale organisasies en staatsberade. In die algemeen word die protesteerders beskou as gewelddadige anargiste, en word hulle in die pers as eienaardige buitestaanders beskryf. Academici het tot dusver ook nie veel aandag aan hierdie verskynsel bestee nie. Die doel van hierdie studie is om vas te stelof die meestal negatiewe opvattings van deelname in aktiewe protes teen globalisering geregverdig is. Die besware van die aktiviste is dalk realisties en nie ongegrond nie. Die vae begrip van anti-globalisering protesteerders is misleidend, omdat dit die groot aantal verskillende groepe tydens die protesaksies verberg. Beginsels van sosiale bewegingsstudies is geraadpleeg om die analise van verskeie groepe wat by protesaksies teenwoordig is, te struktureer. Hierdie analise wys dat die deelnemers aan protesaksies goed georganiseerd is, en dat hulle baie aktief is in internasionale netwerke, en hoofsaaklik op die internet staat maak om hulle bedrywighede te koordineer. ENGLISH ABSTRACT: This study explores leadership and productive school culture, and focuses on school leadership at selected schools in the Nzhelele West Circuit in the Limpopo Province. Leadership plays a pivotal role in the functioning of any organisation, be it in business or in education, and the concept of leadership has become more prominent over the last decade, and there are various debates around its meaning and what it entails. In order to develop a better understanding of leadership, a literature review is conducted. This review highlights the differences between leadership and management, and explores different leadership styles. With regards to productive school culture, this study indicates that schools may look alike in terms of their physical structure, composition of staff members and purpose of their existence, but may differ drastically on how they operate. This kind of culture represents the common shared values, rituals, ceremonies, stories and an internal cultural network that values heroes, such as an extraordinary teacher. I conclude that school culture and school leadership are inseparable issues because cultural management remains the responsibility of the school leadership This study finds that leadership is of vital importance in all organisations, and that the meanings of the concept of leadership have changed over years. Further, administering schools in a democratic fashion still pose tremendous challenges to the school leadership as a whole. It seems as if the schools which are part of this investigation still struggle to adjust to a democratic dispensation. This research therefore concludes that school leaders need to ensure that they are both good managers and effective leaders. They must also ensure that the culture at their schools is conducive for teaching and learning. Keywords: leadership, management, schools, leadership styles, productive school culture.
AFRIKAANSE OPSOMMING: Die studie behels leierskap en produktiewe skool kultuur, en ondersoek skool leierskap by verskeie skole in die Nzhehele-Wes kring in die Limpopo Provinsie. Leierskap speel „n belangrike rol in die funksionering van enige organisasie, en die konsep het meer prominent geword oor die afgelope dekade. Daar is ook verskeie debate rondom die betekenis van die konsep. Met die doel om „n beter begrip van leierskap te verkry, is „n literatuur studie voltooi. Die literatuur studie dui op die verskille tussen leierskap en bestuur, en verskeie leierskap style word ondersoek. Met betrekking tot produktiewe skool kultuur toon die navorsing dat skole dieselfde mag lyk ten opsigte van hul fisiese struktuur, personeel samestelling, en die doel van hul bestaan, maar mag drasties verskil in hulle funkionering. Dié tipe kultuur verwys na gemeenskaplike waardes, rituele, seremonies, stories en „n interne netwerk wat helde, soos buitengewone leiers, vereer. My gevolgtrekking is dat skool kultuur en skool leierskap onskeibaar is omdat die kulturele bestuur nog steeds the verantwoordelikheid van die skool leierskap is. Die studie bevind dat leierskap van kardinale belang in alle organisasies is, en dat die betekenis van die konsep “leierskap” oor jare baie verander het. Verder bied demokratiese skool administrasie nog steeds baie uitdagings aan skool leiers. Dit wil voorkom asof skole in die ondersoek ook probleme ondervind om aan te pas by „n demokratiese bedeling. Hierdie ondersoek kom tot die gevolgtrekking dat skool leiers moet poog om beide goeie bestuurders en effektiewe leiers te wees. ENGLISH ABSTRACT: Ethical decision making in business, the manifestation of business ethics in the individual, is influenced and shaped by various factors, including the external environment, organisational factors and society. In China business ethics, and consequently ethical decision making has emerged and developed mainly as a response to the economic reforms in response to globalisation. Globalisation, a product of the interaction of political and predominantly economic liberalisation, largely brought about by technological change, has become a household word since the last decade of the twentieth century. It is hailed by its advocates as a way to spread cosmopolitan values as well as better employment conditions and standards of living. Its critics, however, see it as a new wave of colonialism imposed by developed countries and multinational companies on poor countries, a synonym to exploitation and impoverishment of both people and nature. A contested issue on globalisation is concerned with its consequences as to the convergence of societies toward a uniform pattern of economic, political, and even cultural organisation, and thus to the formation of a global ethic. A change in approach towards intellectual property and the trends observed in patent applications indicate to what degree various countries have embraced the opportunities presented by globalisation. China is a prime example of a country that embraced the opportunities, and also made the required changes in policies and behaviour. Globalisation has changed the environment in which everyone is competing forever. International institutions play a significant role, and being part of treaties is paramount if countries want to play in the global market. Thus, globalisation changed the external environment that has an important influence on ethical decision making by individuals. These changes are followed by changes in countries' legal environments. As a result the rules by which companies have to play are also influenced, changing the way management should and eventually do behave, which will ultimately change the work experience gained by an individual. A change in individual factors will eventually change the ethical philosophy and the decision ideal of an individual, which also have an impact on ethical decision making. The end result is that globalisation has a profound influence on every factor that influence an individual making ethical decisions. However, these changes can take very long to start to manifest, a fact seen in the lag between policy changes and observing tangible changes in approach to intellectual property rights, as observed in China.
AFRIKAANSE OPSOMMING: Etiese besluitneming deur die individu word beinvloed deur 'n wye verskeidenheid faktore, waaronder die eksterne omgewing, die organisasie waarvoor die individu werk, en ook die kultuur gemeenskap. Sake etiek in China, en dus ook etiese besluitneming het ontwikkel as die resultaat van ekonomiese beleidsveranderinge wat teweeg gebring is deur globalisering. Globalisering is die produk van die grootskaalse liberalisering van ekonomiee, aangehelp deur tegnologiese vooruitgang. Voorstanders van globalisering glo dat dit die verspreiding en groei van kosmopolitaanse waardes tot gevolg het, en uiteindelik lei tot beter werksomstandighede en lewensstandaarde vir almal. Die kritici meen egter dat dit 'n nuwe vorm van kolonialisme is waardeur ontwikkelde lande en internasionale besighede die ontwikkelende lande uitbuit. Die mate waarin globalisering lei tot die konvergensie van gemeenskappe na 'n uniforme ekonomiese, politiese en kulturele entiteit, word egter betwis. Gevolglik word daar ook gevra of globalisering lei tot die totstandkoming van 'n globale etiese kode. Lande benader die geleenthede wat globalisering bied op verskillende maniere. Hierdie verskille is duidelik sigbaar in die benadering wat gevolg word met intellektuele eiendom. Die tendense oor die afgelope paar jaar in die aantal aansoeke om patente te registreer, verskil dramaties van land tot land. China is 'n goeie voorbeeld van 'n land wat die geleentheid met beide hande aangegryp het. Nie net is beleid aangepas om voordeel uit die geleentheid te trek nie, maar mense se houding het ook dienooreenkomstig verander. Globalisering het die omgewing vir kompetisie dramaties verander. Internasionale organisasies speel 'n belangrike rol, en die ondertekening van verskeie ooreenkomste is ononderhandelbaar om ten volle deel te wees van die globale ekonomie. Globalisering het die eksterne omgewing sodanig verander dat dit nie anders kan as om 'n impak te hê op die besluitneming van individue nie. Die veranderende eksterne omgewing het noodgedwonge gelei tot veranderinge in die wette van verskeie lande. Die reels waaraan besighede moet voldoen is dus ook beinvloed, en so ook die manier waarop bestuur moet optree. Uiteindelik sal hierdie ook die ervaring van werknemers verander, en dus 'n impak hê op etiese besluitneming. Die uiteinde is dat globalisering elke faktor wat 'n impak het op etiese besluitneming beinvloed. Hierdie veranderinge kan egter 'n lang tyd neem om gestalte te vind in die optrede van organisasies en indivdue. 'n Goeie voorbeeld word gevind in China. Dit het 'n geruime tyd geneem vanaf beleid ten opsigte van intellektuele eiendom ingestel is totdat organsiasies en individue 'n verandering in gedrag en optrede begin toon het deur patente ernstig te beskou.

Drawing on the concept of sexual geography, this study examines the social and political meanings of sexualized spaces in the urban geography of Portland, Oregon between 1970 and 2010. This includes an examination of the sexual geography of urban spaces as a deliberate construct resulting from official and unofficial public policy and urban planning decisions. Sexual geographies, the collective and individual constructions of sexuality, are not static. Nor are definitions of deviant sexual practices fixed in the collective consciousness. Both are continuously being reshaped and reconstructed in response to changing economic structures and beliefs about sex, race and class. Primary documents are used to build a conceptual geography of sexualized spaces in Portland at points between 1970 and 2010 with an emphasis on the policy and urban planning decisions that inform the physical designations and social meanings of sexualized spaces including prostitution zones, pornography districts and gay entertainment areas.

Resumo: Em sua obra, Durkheim nunca estudou especificamente a economia. Esta e o pensamento econômico só apareceram como pano de fundo ou foram mencionadas en passant. Contudo, isto não o impediu de elaborar análises sobre o estado da economia de sua época e nem muito menos apontar soluções para a mesma. A presente tese tem como objetivo sistematizar e desvelar o pensamento econômico do sociólogo francês, bem como analisar a validade de suas propostas para superar o estado de anomia em que a economia se encontrava. Para isto, partiu-se da hipótese de que, com sua reflexão, Durkheim buscou (re)moralizar a economia
Abstract: ln his work, Durkheim never studied the economy specifically. This economy and the economic thought only appeared as a backdrop or were mentioned en passant. However, that did not stop him from elaborating analyses on the state of the economy of his time or from pointing solutions to it. The present thesis aims to systematize and show the French sociologist's economical thought, as well as to analyze that validity of his proposals to overcome the state of anomie in which the economy was. ENGLISH ABSTRACT: This thesis is a study of the South African government‘s response toward Zimbabwean immigration, focusing on the period from 2000 to July 2009. The aim is to shed light on why the government has acted in the manner that it has, using a human security framework. South Africa‘s legal obligations under international, regional, and domestic law are investigated and the ethical debate concerning issues of entrance and borders is explored. Concepts of morality, universality, and human dignity are central to this discussion. Against this backdrop, the Zimbabwean migration is briefly analysed in terms of push and pull factors and numbers; and the legal debate concerning the classification of Zimbabweans is explored. The challenges Zimbabweans face in South Africa and how the government has dealt with the Zimbabwean immigration is covered. Key actors from civil society and government are interviewed in an attempt to engage opinions about the government‘s response. The main opinions as to why the government has responded in the manner it has are then discussed and other factors are considered. Issues of solidarity, land reform, and South Africa‘s involvement in the Zimbabwean mediation process are some of the factors considered. The conclusion of this study is that the South African government has not succeeded in meeting its legal obligations nor acted ethically concerning Zimbabwean immigrants. The particular sentiments of ex-president Thabo Mbeki, the solidarity amongst national liberation movements, regional considerations, and the capitalist interests of some South Africans are factors that carry the most weight in explaining the South African government‘s response to the Zimbabwean crisis and its subsequent migrants.

Suid-Afrika se regsverpligtinge onder internasionale, streek- en plaaslike reg, sowel as die etiese debat rakende kwessies soos die binnekoms van immigrante en grense, word ondersoek. Konsepte van moraliteit, universaliteit en menslike waardigheid , staan sentraal tot hierdie bespreking. Teen hierdie agtergrond word die Zimbabwiese migrasie kortliks ontleed in terme van die stukrag-en-trefkrag faktore en getalle; en word die regsdebat oor die klassifisering van Zimbabwiërs onder die loep geneem. ENGLISH ABSTRACT: The research is about my story as a learning-support teacher and includes the identity growth that I experienced between the period from January 2001 until December 2012. My approach of acceptance and compassion, within the atmosphere of performativity, leads to my writing process and becomes my auto-ethnographic journey. The writing process brings about change, to experience the performative as an action of ‘doing’ (in Giroux 2000:135) and a way of being within day-to-day situations (in Denzin 2004:273). By recording my experiences within changing spaces, I hope to make a contribution to academic literature, by drawing the reader into my experiences of the forming of my identity and the explication of the writing process as a journey. Writing my introduction to this research at the end of this process, I realise that this research has not only changed my story, but also myself as a person. I struggled to bring the story to a close. This is because I have realised that my story is still changing every day. I am becoming a performative ethonographer (Denzin 2004:262) and I see concrete situations and engage in a conversation with them. And through this writing experience I have registered an enrichment in my experience. My research does not make use of questionnaires or interviews. It is action-research, experienced in everyday things. My story with remembrances was already there before the research, though never told. Ball (1996) refers to this process as identification. This is the process through which I have gone to be seen, as well as the process through which one goes to see oneself, to a specific identity (quoted by Thompson 2004:45). My story begins with questions and reflections about my being different as a white woman, within my context of the two so-called ‘Coloured Schools’. Am I carrying a white scar? (Cixous 1998). I have experienced the writing process as a way of coming into knowledge. My research leads to questions, though not necessarily to answers. The writing process leads to my looking through a different lens of gaining a better understanding. Peace. And hope. I am learning – have learnt – that hope is an ontological necessity. There is a necessity to dream, to change, and to better the lives of others (Freire 1998:8 in Denzin 2003:263). My research develops rhizomatically (Honan: 2006; Richardson & Pierre 2005, quoted in Richards 2012:3). It is written in fragments of daily action. It is written in the knowledge of the impossibility of relaying experience as it is or was. As a teller of a story, I emphasise that I do not posit my characters as objects. Rather, they are presented in this research in a relationship of trust, existing between myself and them for a period stretching beyond twelve years. Meaning cannot always be relayed in words. Suggestions of meaning can lie in the relationship between texts (Parsons 2002:32 in Le Roux 2012:xi4).
AFRIKAANSE OPSOMMING: Die navorsing behels my storie as leerondersteuner-onderwyser en omvat my identiteitswording vanaf Januarie 2001 tot Desember 2012. My benadering van aanvaarding en meelewing binne die atmosfeer van performatiwiteit, lei tot my skryfproses en word my outo-etnografiese reis. Die skryfproses bring verandering, om die performatiewe te beleef as ‘n aksie van doen (Giroux 2000a:135) en ‘n manier van wees, binne dag-tot-dag-situasies (in Denzin 2004:273). ENGLISH ABSTRACT: The corporation is fast becoming, or may already have become, the prevalent structure in human society. As such, its successes and failures impact heavily on society as a whole. This study will endeavour to examine past shortfalls in corporate thinking and practice, explaining much of this by referring to lag between societal and corporate change in their respective responses to globalisation. It is furthermore argued that this change is still far from complete( d), if indeed it ever will be complete( d) with a fixed end. This global change, has to a large extent, caught corporations off guard, with their old management styles no longer providing results - with civil resistance to corporate activity resulting in some instances. The central aim of this study is to not only understand this situation, but also to explore potential remedies. In so doing two unique ideal states, namely the old and the new company, will be developed. With the old company representing corporate structure and thinking that no longer functions effectively. The new company, on the other hand, is not a present state but a future one. Thus it is the destination of the societal and corporate changes examined within this thesis. Consequently, the main subject examined will be a move away from the old company. Finally, it will be shown that dealing with problems within the corporate context no longer requires the heavy hand of yesteryear. Instead, a proactive approach should be adopted, both for financial and ethical reasons.
AFRIKAANSE OPSOMMING: Dit kan geargumenteer word dat korporasies binnekort die dominante struktuur in menslike organisasie kan wees, indien dit nie reeds die geval is nie. As sulks, het die suksesse en mislukkings van die korporasie 'n merkbare impak op die menslike samelewing. Gevolglik beoog hierdie studie om voormalige tekortkominge in korporatiewe denke en praktyk te ondersoek en te verduidelik, grotendeels met verwysing na die verskil in tempo waarmee beide die samelewing en korporasies reageer op die nuwe uitdagings wat gepaardgaan met globalisering. Dit word verder geargumenteer, dat hierdie proses van verandering geen voorspelbare einde het in die klassieke sin nie. Juis daarom het die voortdurende verandering oudmodiese bestuurstyle en tegnieke onkant betrap, met nagevolge wat strek tot by burgerlike verset. Sentraal aan die ondersoek van hierdie situasie is nie net die intensie om dit te verstaan nie, maar ook die soeke na strategieë om dit reg te stel. Om die onderneming te fasiliteer word twee ideaal state, naamlik die ou en die nuwe maatskappy ontwikkel. ENGLISH ABSTRACT: Recent literature on values suggests that advanced, industrial societies are displaying a marked shift away from traditional values that stress material prosperity, physical and economic security towards values that are more expressive of individual freedom, autonomy and growth. According to Inglehart, forces of modernisation and globalisation have initiated a number of systemic level changes, that have ushered in processes of objective and subjective individualisation, dramatically altering the nature and structure of human value orientations and societal norms. Work values, as expressions of general life values in the work context, are no exception to this process. In the new world of work, intrinsic work values that stress personal growth, development and self-determination should gradually replace extrinsic work values such as good pay, job security and status. An understanding of the nature, direction and distribution of such value change could prove invaluable to the organizational practitioner and policy maker, since work values playa pivotal role in shaping organisational structure, process and policy. According to Inglehart, a number of developing countries are displaying similar shifts towards individualised values. Although classified as a middle-income, developing economy, South Africa has undergone a number of prolific economic, political and cultural changes over the last decade that would undoubtedly have altered the nature, direction and distribution of work values in the country. It is in the light of these political, economic and cultural developments that the current study embarked on an analysis of the nature, direction and distribution of work value change in South Africa between 1990 and 2001. The analysis was informed by the proposition that the work values of South Africans citizens should reflect a shift in the direction of individualised work values between 1990 and 2001. South Africans have, however, been exposed to and socialized within vastly different social, economic and political environments. The study has therefore taken cognisance of the fact that work value change in South Africa should reflect the stark cleavages and differences that exist within the population, and attempted to plot the differences in the nature and direction of work values between the various social categories defined by race, gender, educational and occupational level. The secondary analysis of survey data from the South African components of the 1990, 1995 and 2001 World Values Survey was performed in order to fulfil the objectives of the study. Work values of South African citizens were measured in terms of four dimensions, namely work centrality; work values relating to the distribution of power in the organization; work values relating to work preferences; and work values relating to authority systems in the workplace. Use was made of simple uni-variate and bi-variate analysis, as well as the comparison of means where appropriate. The results of the analysis suggest that work values relating to work centrality and the distribution of power in the organisation have become increasingly individualised. Work values relating to work preferences and authority have, however, displayed a trend in opposition to individualisation. Comparisons of work value change across the various sub-groups of the population reflect the changing economic, social and political landscape of South Africa. The data suggests that as various sub-groups of the population are exposed to the systemic level changes characteristic of the new South Africa, traditional value differences informed by race, gender, educational and occupational level will be gradually transformed and replaced by new value patterns untainted by the inequalities of the apartheid era. The analysis concludes by examining a number of explanations for the value changes described, and attempts to infer implications for the formulation and implementation of workplace policy and practice in South Africa. The high and increasing levels of unemployment and the increasing participation of women and previously excluded racial groupings into the South African labour market have increased perceptions of job insecurity in South Africa and have resulted in an expanding number of South Africans placing increased emphasis on traditional work preferences and systems of authority. Should this trend persist, the development of individualised work values will continue to be hindered, rendering the South African business environment less competitive and increasingly fraught with high levels of distrust and uncertainty. We suggest, therefore, that human resource practitioners and policy makers embark on the challenging task of reframing individual perceptions surrounding the meaning of work in South Africa, so as to better prepare South Africans for the challenges brought about by the new world of work
AFRIKAANSE OPSOMMING: Onlangse literatuur oor waardes dui daarop dat vooruitstrewende industriële gemeenskappe 'n merkbare verskuiwing toon weg van tradisionele waardes wat materialistiese welvaart, tasbare en ekonomiese sekuriteit beklemtoon, na waardes wat groter klem lê op individuele vryheid, outonomie en ontwikkeling. Volgens Inglehart het kragte van modernisering en globalisering 'n aantal sistemiese veranderinge teweeg gebring wat op hul beurt prossesse van objektiewe en subjektiewe individualisasie ingelei het en wat aanleiding gegee het tot 'n dramatiese verandering in die aard en struktuur van menslike waarde-orientasies en gemeenskapsnorme. Werkwaardes as uitdrukking van algemene lewenswaardes in die werkkonteks is nie 'n uitsondering in die proses nie. Vergelyking van werkswaarde-veranderinge oor die verskillende sub-groepe van die bevolking weerspieël die veranderende ekonomiese, sosiale en politieke landskap van Suid-Afrika. One year after the terror attacks of September 11, 2001, the administration of President George W. Bush introduced a revolutionary foreign policy strategy--the Bush Doctrine. Proponents of this strategy advocated the use of American 'hard power' as a tool to promote freedom and democracy, beginning with the invasions of Afghanistan and Iraq. Opponents of the doctrine saw it as dangerously nationalistic, with the potential to entangle the United States in a myriad of protracted international conflicts. This thesis will identify aspects of nationalism within post-9/11 American foreign policy and illuminate the incompatibility of nationalism and the fundamental tenets of conflict resolution. This study theorizes that nationalism played a significant role in the development of the Bush Doctrine. Although its advocates promote specific policies historically associated with nationalism, as a rule they have not acknowledged its influence. Conversely, opponents of the doctrine acknowledge this influence and warn of its destructive characteristics. The study presented herein identifies nationalism as a powerful force in American culture and politics--one that has a profound influence on American foreign policy and on the longevity of our foreign wars.

Scientific discoveries, developments in medicine and health issues are the constant focus of media attention and the principles surrounding the creation of so called ‘saviour siblings’ are of no exception. The development in the field of reproductive techniques has provided the ability to genetically analyse embryos created in the laboratory to enable parents to implant selected embryos to create a tissue-matched child who may be able to cure an existing sick child. The research undertaken in this thesis examines the regulatory frameworks overseeing the delivery of assisted reproductive technologies (ART) in Australia and the United Kingdom and considers how those frameworks impact on the accessibility of in vitro fertilisation (IVF) procedures for the creation of ‘saviour siblings’. In some jurisdictions, the accessibility of such techniques is limited by statutory requirements. The limitations and restrictions imposed by the state in relation to the technology are analysed in order to establish whether such restrictions are justified. The analysis is conducted on the basis of a harm framework. The framework seeks to establish whether those affected by the use of the technology (including the child who will be created) are harmed. In order to undertake such evaluation, the concept of harm is considered under the scope of John Stuart Mill’s liberal theory and the Harm Principle is used as a normative tool to judge whether the level of harm that may result, justifies state intervention or restriction with the reproductive decision-making of parents in this context. The harm analysis conducted in this thesis seeks to determine an appropriate regulatory response in relation to the use of pre-implantation tissue-typing for the creation of ‘saviour siblings’. The proposals outlined in the last part of this thesis seek to address the concern that harm may result from the practice of pre-implantation tissue-typing. The current regulatory frameworks in place are also analysed on the basis of the harm framework established in this thesis. The material referred to in this thesis reflects the law and policy in place in Australia and the UK at the time the thesis was submitted for examination (December 2009).

ENGLISH ABSTRACT: This dissertation argues that women on the African continent experience moments of internal exclusion in higher education discourses. Although women are statistically represented in higher education discourses, they remain subjected to internal exclusion on the grounds that their contributions are evidently unsubstantive. Through a conceptual analysis of women’s experiences of African higher education, the study reveals that internal exclusion can be attributed to patriarchy, male chauvinism, authoritarianism and a gendered view of equality, mostly generated in people’s social, political and cultural practices. I contend that a ‘non-gendered’ ethics of care can undermine the debilitating effects caused by the internal exclusion of women in higher education discourses. By examining the implications of a reconstituted ethics of care for teaching and learning at higher education institutions on the continent, the study offers some ways in which exclusionary higher education practices can be remedied. This dissertation contends that, if higher education in Africa were to halt the dilemma of internal exclusion and move towards engendering a reconstituted ethics of care, both conceptually and pragmatically, then it stands an authentic chance of cultivating compassionate, imaginative and responsible citizens who can reason, not only for themselves, but for humanity as well.
AFRIKAANSE OPSOMMING: Hierdie proefskrif argumenteer dat vrouens op die vasteland van Afrika momente van interne uitsluiting ondervind. Alhoewel vrouens statisties goed verteenwoordig is in hoër onderwys diskoerse, bly hulle steeds onderhewig aan interne uitsluiting op grond daarvan dat hulle bydrae nie genoegsaam geag word nie. Gegrond op 'n konseptuele analise van die wedervaringe van vrouens in hoër onderwys in Afrika, bevind hierdie studie dat interne uitsluiting van vrouens toegeskryf kan word aan patriargie, manlike chauvinisme, outoritarisme, en 'n geslagsblik van gelykheid wat meestal aanslag vind in mense se sosiale, politieke en kulturele praktyke. Ek voer aan dat 'n nie-geslagtelike etiek van sorg die verlammende effekte van interne uitsluiting van vroue in hoër onderwysdiskoerse kan ondermyn. Die studie stel maniere voor hoe uitsluitende hoër onderwys praktyke beredder kan word deur 'n ondersoek van die implikasies van 'n rekonstruksie van 'n etiek van sorg aan hoër onderwys instansies op die vasteland. Cette approche emporte une déformation du droit pénal de fond et un recul de la protection normalement garantie par celui-ci, essentiellement par des atteintes au principe de la légalité criminelle et une instrumentalisation du mécanisme de la responsabilité pénale. In so-called technical subjects which relate to the rules of organisation and operation of the stock market, criminal law is used as an ancillary discipline, ensuring the effectiveness of these regulations. This approach leads to a distortion at the core of criminal law and adecline in the protection which is normally guaranteed by, essentially, violations of the principle of criminal law and a manipulation of the mechanism of criminal responsibility. As a result, the contribution of criminal law to the morality of the stock market is limited to therequirements of fair trial, the balance between administrative sanctions and penalties that have been achieved through abiding to the general principles that govern the criminal.Yet regardless of the scope of its intervention, the criminal law remains with its fundamentalmoral values. It can only contribute to the morality of the stock market by being normative.The use of the criminal sanctions must therefore be limited to the suppression of the ruse, aswitnessed by the creation or operation of a situation of imbalance between individuals. The criminal law should no longer be at the service of the regulation of markets, but see its efficiency guaranteed by it. Far from being foreign to the concerns of competition inherent tothe key components of the markets, this approach would lead to the reconciliation of morality and the economy of the markets themselves

The problem of youth has been a key issue in South Africa since 1994, with youth seen as needing extra guidance and leadership if they are to bring about the country that many hope for. The interest in youth is also spurred on by recent studies that claim that once adolescents establish certain behavioural patterns that it becomes difficult to modify these patterns. Little research exists that describes the ordinary sociological experiences of youth, especially on sensitive issues that attract a lot of public attention- such as teenage sex and pregnancies, and what is perceived as the ‘slipping of youth morals’. There is great concern that youth are experimenting with sex at too early an age in their social and political development (Frimpong 2010: 27). In my thesis I focus on the thinking, choices and decisions that learners at one high school in Cape Town seem to make with regard to sex and sexuality, and how their choices seem to be influenced by a variety of discourses attached to the provision of a sex education programme at the school; discourses that organise their everyday thinking and actions in very concrete ways. A key goal of the study was to disarticulate and re-articulate the deficit mentality that shapes discourses of sexuality in South Africa, and to develop ‘sexual’ stories and strategies of story-telling that allow the voices of learners to be heard (Pillow 2004). My focus in this study is mainly to explore how the sex education programme reconstitutes youth’s sexual identity. In my qualitative study I challenge the tendency to view youth participation in teen sex using mainly an abstinence-only discourse, and suggest that sex education programmes ‘contaminate’ and ‘mutilate’ youth understandings of sex and sexuality in quite complex ways.

This thesis evaluates the policy of mandatory detention for asylum seekers maintained by successive Australian governments against several core liberal principles. These principles are derived from various accounts of liberal political thought and the major themes and criticisms inherent in the public debate over the policy. The justifications of the policy given by the Australian government and the criticisms enunciated by scholars, refugee advocates and non-government organisations with respect to the policy strongly correspond with the core liberal principles of fairness, protecting the rights of the individual, accountability and proportionality. The claims of the critics converge on a central point of contention: that the mandatory detention of asylum seekers violates core liberal principles. To ascertain the extent to which the claims of the critics can be supported, the thesis selectively draws on liberal political theory to provide a framework for the analysis of the policy against these liberal principles, a basis for inquiry largely neglected by contributors to the literature. This thesis argues that, on balance, the mandatory detention policy employed by successive Australian governments violates core liberal principles. The claims of the critics are weakened, but by no means discredited, by the importance of the government's maintenance of strong border control. In the main, however, criticisms made by opponents of the policy can be supported. This thesis contributes to the substantial body of literature on the mandatory detention policy by shedding light on how liberal principles may be applicable to the mandatory detention policy. Further, it aims to contribute to an enriched understanding of the Australian government's competence to detain asylum seekers.

ENGLISH ABSTRACT: This dissertation’s primary focus is why torture is used when torture is not an effective means of gathering intelligence. To answer this question the argument for the use of torture, commonly known as the ticking time bomb argument, is discussed. Due to psychological and physiological processes during torture interrogation it was found that torture cannot be relied upon to deliver truthful information. Torture was also found to adversely affect the institutions that are needed for its establishment. After torture has been found to be of no utility in terms of the appropriation of information the question of why torture is still used is answered by means of discussing societal dynamics as well as the political process surrounding torture. On the societal front it was found that American public opinion towards torture is ambivalent. The reason for this includes a host of socio-psychological factors such as the in-group out-group bias as well the War on Terror as a political ideology in its own right. The notion that anybody is likely to torture is also explored by means of discussing the Milgram’s Obedience Experiment as well as the Stanford Prison Experiment. On the political front the notion that the abuses at Abu Ghraib and Guantanamo Bay were the work of a few bad apples is dispelled since it formed part of a deliberative political process that tried to make torture a legitimate foreign policy measure. The reason for the existence of this process is the failure of international and domestic checks and balances. On the international front U.S. unilateralism as foreign policy principle is cited as the reason for the ineffectiveness of international measures to stop torture. On the domestic front the permanent rally around the flag effect due to the permanent state of mobilization in the War on Terror is cited as the reason for the failure of domestic checks and balances. The lessons learnt from the research enables the creation of measures on how to stop torture even when it is found that the necessary political will is not present within the Obama administration. In the absence of political will it must be manufactured by means of the actions of civil society, the free press and the international community. It was found that the most effective means would be the creation of a committee of inquiry to create the political memory of the use of torture and how it was established. Additionally a memorial must be erected as well seeing that inquiries create political memories but they do not sustain it.
AFRIKAANSE OPSOMMING: Hierdie tesis se fokus is om na te vors waarom marteling gebruik word as dit nie ‘n effektiewe wyse is om inligting in te win nie. Om hierdie vraagstuk te beantwoord word die argument vir die gebruik van marteling naamlik die tikkende-tydbom-argument bespreek. Asgevolg van sielkundige en fisiologiese prosesse tydens ondervragings wat gebruik maak van marteling kan daar nie op marteling staatgemaak word om die waarheid op te lewer nie. In 2005, the House of Commons (HoC) Health Committee produced a report on The Influence of the Pharmaceutical Industry – the first of its kind since 1914. The inquiry concluded that there were ‘over-riding concerns about the volume, extent and intensity of the industry’s influence, not only on clinical medicine and research but also on patients, regulators, the media, civil servants and politicians’, and stressed the need ‘to examine critically the industry’s impact on health to guard against excessive and damaging dependencies’ (HoC 2005, p. 97). It also noted that it is important to comprehensively analyse pharmaceutical regulation in order to ascertain whether there are systemic problems: In some circumstances, one particular item of influence may be of relatively little importance. Only when it is viewed as part of a larger package of influences is the true effect of the company’s activity recognised and the potential for distortion seen. The possibility that certain components of any such campaign are covert and their source undeclared is particularly worrying. (HoC 2005, p. 97) This study addresses this recommendation and was primarily conducted to examine whether recognised concerns are merely ad hoc or as a result of systemic flaws in the current system of pharmaceutical regulation. The work addresses a gap in the academic literature by drawing on the fragmented criticisms of the pharmaceutical industry in order to produce a model to illustrate how various stakeholders collaborate with drug companies to promote licensed products, and to explore the nature of the relationships between these elite stakeholders. The thesis begins with a literature review which determines who is involved in pharmaceutical regulation; how the regulatory system works; and explores the key role of communication in this process (Chapters 1 to 3). The recurrent theme is the neglect or exclusion of the patient/consumer, which leads to the development a model of intra-elite communication in drug regulation called Pharmaffiliation (Chapter 3). The thesis then looks for evidence to support or refute this model, using multiple methods (Chapter 4). Four case studies (with specific selection criteria) are chosen to test the model’s constructs and indicators (Chapters 5 to 8). The research uncovers systemic problems in the current system of pharmaceutical regulation which can ultimately harm the patient/consumer, and the implications of these findings are discussed (Chapter 9). Solutions on a micro-level include consumer involvement in decision making processes, which can be enhanced through public education and awareness campaigns and the instigation of public inquiries whenever drugs are withdrawn from the market (HoC 2005, p. 105). On a macro-level, however, this will involve critically exploring neoliberal capitalism and the empowerment of the citizenry (Street 2001).

This research project responds to the observation of radical ecologists and ecopsychologists that our present approaches to environmental change are widely limited to technological, behavioural and cognitive strategies, and lack a deep understanding of the complex psychological and sociocultural interrelationships that underpin human perception and behaviour. To gain a deepened understanding of our ecological crises from depth psychological, holistic, and transpersonal perspectives, a number of counsellors, psychotherapists, naturopaths, and one environmental educator were either interviewed or completed questionnaires that explored the meaning of the terms ‘environment’ and ‘sustainability’. They were also invited to express their views on environmental deterioration and what it means to them to live sustainably. The knowledge obtained from the research participants, an extensive literature review, and my professional experience as a psychotherapist, workshop facilitator and trainer, suggest that the current dominant theories and practices of environmental education, and other change practices, are limited in their effectiveness. The study proceeds with a discussion of key issues related to the ecological approach proposed in this study; and of emergent areas such as environmental education, education for sustainability, deep ecology and ecofeminism. A critique focuses particularly on the common assumption of conventional learning paradigms that deep change can be achieved without addressing emotional resistance to such change. By using the work of the Resilience Alliance, “a multidisciplinary research group that explores the dynamics of complex adaptive as a reference point it is argued that our need to compensate for our fragmented selves leads to significant resistances to changes in consciousness. The study concludes with a summary of the main findings and thoughts on possible sustainable and unsustainable futures.

Mozambique is undergoing intensive socio-economic reforms to reconstruct war damages and develop the nation. The reforms consist of economic liberalisation through structural adjustment and monetarist economic stabilisation, e.g. government withdrawal from economic activities, privatisation, deregulation, reduction of tariff levels on imports and tax on investments, cuts of expenditure on social services, restrictive credit system, focus on monetarism, increased taxation on individual income, etc. The nature of these reforms, on the surface, leads to morally questionable conditions. There is social chaos and disintegration, high indices of corruption, subtle recolonisation, decline of civil services, etc. At the bottom lie the market ethics and fundamentalist theological discourse by dint of which the World Bank and the International Monetary Fund deny historical consciousness, lack institutional memory, vest themselves with unquestionable international authority, dictate and impose policies without accountability for the social consequences. If there is any hope for Mozambicans, it lies in development ethics which relies heavily on the liberation motif, historical consciousness, and African Heritage.

The concept of ethical leadership has been intrinsically evident for over a century, but studies have only recently been documented that have attempted to observe and analyse the phenomenon. The concept has become more popular in the information age as companies start to employ additional knowledge workers who search for enhanced meaning in their respective occupations. The gold mining industry in Africa has improved substantially as conflicts have subsided slightly. As such, industry leaders need demonstrate better skills of engagement when managing legacy issues. While the shareholders’ interest remain high on leaders’ radar, leaders need effectively manage operations to address issues that might not be immediately evident in balance sheet, but that nonetheless have an effect on economic sustainability of the gold mining entities. Given that the concept of ethical leadership is known, there are still scandals that have recently been documented that involve leaders who have made decisions that led to demise of entities for which they were responsible. The purpose of this research was to explore ethical leadership and its association with sustainable economic performance within gold mining industries. The study aimed to analyse companies that have an African footprint, while originating from South Africa. A qualitative research method was employed following a phenomological approach to obtain insights of how African leaders have operated gold mines in Africa and have managed operations that performed very well. The aim was to crystallise and distil the findings for the use by future leaders so that they could avoid future scandals and not destroy shareholder value and disappoint stakeholders. The personal and leadership traits of ethical leaders were reviewed with the aim of determining the mental development that would be required, as well as which aspects would require consideration when determining the effects on economic sustainability. The African leaders interviewed were familiar with the concept of ethical leadership, economic sustainability and implicitly understood the association of ethical leadership with economic sustainability. The concept of ethical leadership generated two new terms, as described by the interviewees that could be infused to the definition to cater for an African context. The concept of “Ubuntu” and “displaying appropriate conduct” were the two terms that were derived from the leaders. The concept of greed was identified as a strong impediment towards economic sustainability. The gap of iii displaying that ethical leadership has a favourable outcome towards economic sustainability was demonstrated. By attempting to close this gap, it could help curb unemployment rates, as decisions would be made differently. From the propositions made, which were all proven successfully, there remains opportunities for future quantitative studies to be undertaken to add insight to the existing body of knowledge.

The purpose of this work is to show the importance of ethical consistency and its application in the decision-making process when allocating health care resources with respect to the Canada Health Act. Based on the specific decisions in its history and the development of its principles, I suggest that the Act can be interpreted as indicating a particular moral basis and that this could have an influence on how resources are allocated. I will focus on three claims supporting the argument that services can be delivered in a consistent and methodical manner that respects this particular moral foundation. First, the outcomes of decisions justified by simultaneous use of logically incompatible and distinct moral theories are problematic. I suggest that an approach to reasoning that uses one type of moral theory throughout the decision-making process results in less ambiguous outcomes. Second, based on key points in the history of the Canada Health Act, I believe there is a moral theory, deontological in nature, and that it captures the spirit behind the Act's development and current formulation. Third, decision-makers in Canada should follow one deontological theory when allocating health care resources to avoid inconsistencies, and to work within the moral framework of the Act as I have interpreted it. A delivery system that consistently follows this procedure may have different outcomes than the current methods of macro-allocation, and these differences may have effects on the amount and availability of health care services.

This paper focuses on the possible input of African Ethics into the global warming and climate change discourse in light of the economic dilemma of sustainability. The paper argues that African Ethics through its concept of Ubuntu can make a worthy contribution to the issues surrounding sustainable development, ecological debt and international climate change talks. In a world where the lives of the affluent nations impact drastically on our climate and necessitate calamitous climate disasters and cause the poor to suffer, why is it that the international community has not reached any noteworthy climate change solutions? The same poor countries are also burdened by payment of huge debts and poor climate change adaptation and development. Can African ethics make some contribution to these challenging issues brought by global warming and climate change? The dissertation seeks to tackle these questions by employing a qualitative methodology informed by Gadamer’s philosophical hermeneutics and using the research design of Boff’s ecological holism and Murove’s relational paradigm. However, in order for African ethics to make such a viable contribution the paper seeks to reveal the philosophical and economic substrata sustaining the incessant degradation of the ecology. This opens us the entry point for African ethics through Ubuntu to engage with other voices in the search for solutions to the global warming and climate change crises.

The vision for this project is to aid in approaching climate change by providing an improved understanding of environmental concern. There are two missions. First, to develop heuristic models of environmental concern, and to utilize their constructs to assess environmental behaviour and environmental concern in a population. The model is intended to provide a depiction to aid in better understanding environmental concern and may aid in framing and developing intervention strategies to mitigate harmful effects of climate change. Broadly, assessments of environmental concern have been operationalized in two ways, as a unidimensional construct, ranging from high concern to low concern, or as multidimensional constructs demonstrating underlying reasons for environmental concern. Examining two multidimensional assessments reveals limitations of both and gaps between their underlying constructs. A reading of value-orientated theories from environmental ethics literature identifies six constructs for use in a multidimensional assessment of environmental concern. Utilizing equivalent constructs to the previous multidimensional assessments and expanding “nature” and natural entities into three separate categories results in six constructs intended to fill the gaps of the previous multidimensional assessments and may addresses some of their limitations. This reading also provides a theoretical foundation for designing items to relate to the six constructs. A theory map is presented which demonstrates constructs relating to an expanded narrative for use in multidimensional assessments. Climate change is a complex and often poorly understood phenomenon. Furthermore, it is clear that human behaviours are the underlying causes of climate change. Cross-disciplinary research and integration of several disciplines and fields of inquiry are necessary for developing sound approaches to climate change. Experimental philosophy and empirical ethics are discussed as guiding methodologies for this project. Meta-ethical fallacies and two considerations from the philosophy of science aid in contextualizing this research and provide epistemological limits for deriving ethical conclusions from facts about the world. A survey consisting of 11 sociodemographic items, the revised NEP scale’s 15 items, an existing 17 item environmental behaviour scale, and six 10 item original scales relating to six constructs based on value-orientated theories from environmental ethics and presented in the heuristic models, was drafted. An electronic version was designed and emailed to firstyear Life Science and Economics students. The environmental behaviour scale and the revised NEP scale are significant and correlate moderately positively, corroborating the hypothesis, that there is a relationship between environmental behaviour and environmental concern. While three of the six original scales (egocentrism, sociocentrism, and sentiocentrism) were unreliable, did not have many significant relationships with other variables, and require further development, the other three (nihilism, biocentrism, and ecocentrism) succeeded in corroborating the hypothesis, that there are underlying dimensions of environmental concern, and that they are significantly related to environmental behaviour. The project’s implications and recommendations discusses different intervention strategies in response to climate change as well as environmental communications and education, and how the heuristic models may aid in these topic’s endeavours. The project concludes by identifying a lack of environmental concern in two South African President’s State Of the Nation Addresses and stresses the need to improve environmental concern and increase the frequencies of people engaging in environmental behaviours. Of these, 113 households were followed over 4 waves (2), over a 12-month period, and across two cohorts referred to as affected (3) and non-affected (4) households. Data on the household were collected from the financial head (5) using the diary method. The methodology for this study was done after a review of 33 HIV/AIDS economic studies conducted around the world. The study obtained buy-in and support from various stakeholders in government, nongovernment organisations, community, academic and funding institutions as from people living with HIV/AIDS. Due to the comprehensive design of the research instrument, the study is able to draw relationships between the various facets of the household and the possible influence that HIV/AIDS has on them. Methodologically, the study found that there are "hidden" costs of morbidity and mortality that needs to be quantified. The costs of health care and funerals are higher in the affected cohort, as expected, due to the frequency of illness or death and not necessarily because there are cost differences as a result of whether a household member has HIV/AIDS or not. The key finding is that affected households re-organise themselves in terms of household size, composition and structure as well as through transfers in, income from grants and other non-market sources, especially to pay for funeral costs. Surviving members are affected not only socially and economically but also psychologically and the needs of this group should not be ignored. Abstract:
The importance of considering gender in the effective delivery of international humanitarian assistance (IHA) is well appreciated by the international humanitarian community. Yet evidence suggests that the translation of this appreciation into effective policy and practice remains elusive. This thesis investigates the conceptualisation and implementation of gender policy across the international humanitarian system. It argues that global humanitarian responses continue to fail in consistently addressing gender-based issues and remain ad hoc despite a relatively constant global discourse on the issue. The thesis pursues this argument in three parts. Part One reviews the theory, ethics and policy that drive IHA, including its gender work. It explores the theories of cosmopolitanism and communitarianism in international relations and the place of feminist theories within these. Drawing on this analysis, the thesis then moves on to discuss the history and contemporary expression of the international humanitarian system, considering its effects for gender work. Part Two examines humanitarian response in the field, exploring three case studies where humanitarian organisations responded to different types of emergencies in disparate parts of the globe. These case studies focus on responses to the ongoing displacement crises in South Sudan (2011 onwards), the cholera outbreak in Papua New Guinea (2009-2011) and the Great East Japan Earthquake and Tsunami (2011). Through analysis of interviews and organisational documents, this section reveals that the implementation of gender policy is subject to the fulfilment of several conditions related to organisational mandate, emergency type, and pre-existing gender structures in the particular context. Together, these conditions suggest that the liberal feminist framework guiding gender work is inappropriate for, and ineffective in, the current international humanitarian system. Drawing together the arguments of Parts One and Two, Part Three elaborates that a deficit exists in the policy and practice of gender work in IHA as a result of its fundamental theoretical underpinning. To address this deficit, the thesis concludes by advocating for a change in prevailing approaches to gender in IHA. The thesis suggests that attention to a critical feminist ethics of care may be able to reform gender work to make it compatible with the various conditions of particular humanitarian contexts.

Education in South Africa requires a framework for the implementation of policies pertaining to the management of values in schools. The transition from the former apartheid system and its authoritarian value system to a democratic dispensation has necessitated a value system, characterised by fairness and openness. A primary assumption of the researcher is that all human action is underpinned by values, which are hidden and only observable in human behaviour. A literature study explored the philosophical thinking around values and stipulations about values occurring in international human rights documents. Furthermore, in order to contextualise an understanding of values, policies and legislation intended to shape democracy in South Africa were studied to identify core democratic values and moral principles, particularly with regard to the role of the principal and teacher in school management. Management models based on an understanding of school climate, culture and ethos were also examined to explore values inherent in the different leadership styles embraced by principals and teachers. Against this background, a qualitative inquiry was undertaken in three rural secondary schools in the North-West Province. Research sites and participants were selected by judgement sampling and data concerning the values embedded in the school culture and ethos and expressed by the principal and teachers were gathered through observation and interviews. Focus group interviews were held with teachers and in-depth individual interviews were conducted with the principals to identify how participants enact their roles in transmitting values to learners. The findings indicated that principals are not fully prepared to form partnerships with other stakeholders in the management of values, particularly in the management of traditional African values. External factors that impact values formation in schools, such as unreliable transport systems, result in a school culture which lacks a sense of urgency. Poor infrastructure and maintenance create an unpleasant school environment. Matters are aggravated by inadequate support by the Department of Education, teacher unionism and a lack of parent involvement. The study closes with recommendations to empower schools, parents and the community to participate actively in education so that social capital can be unleashed to strengthen democratic values in schools.

Canadian fisheries are in crisis. On both the Pacific and Atlantic coasts, stories abound of fisheries closures or failures and coastal communities in difficulty. A new approach to fisheries policy is required, one which recognises the intrinsic value of all participants in the fisheries ecosystem and is capable of providing guidance on how to make policy decisions. The principles of environmental ethics provide a framework for developing justice-based fisheries policies. The environmental ethics literature is first explored, with special attention to fisheries issues. From this review, a justice-based framework is identified, in which five types of justice are viewed as pertinent to fisheries concerns. This framework is then translated into an assessment tool, based upon the Rapfish method for rapid appraisal of fisheries and using a set of justice-based ethical criteria. These criteria are evaluated and, through a paired comparison survey, further explored. An assessment of a range of Canadian marine fisheries is conducted using these ethical criteria. Subsequently, a modified Rapfish assessment, using the original criteria supplemented with additional customised criteria, is conducted for Aboriginal fisheries for Pacific salmon in British Columbia. Additionally, a study is conducted which explores preferences regarding the abundance and diversity of fisheries ecosystems. Finally, the commercial fishery for Pacific salmon in British Columbia is presented as a case study. The Rapfish assessment results are presented, and considerations as to how to operationalise just policies for this fishery are suggested. Recommendations include: balancing the composition of the commercial fleet, based upon ecological impacts of the various gear types; encouragement of local stewardship and community involvement; and inclusion of various forms of knowledge in fisheries management and decision-making.

In Alberta, decision-making in the health system has been devolved to seventeen Regional Health Authorities (RHAs). This thesis undertakes a broad analysis of the values that underlie this regionalization. Divided into two parts, the first half of the thesis develops a liberal egalitarian theory for the distribution of resources in society that turns on the importance of providing all people with the basic resources required to plan for, develop and achieve their life goals. Four requirements for any health system that seeks to uphold the values inherent in this theory are then articulated. These requirements include the need for the health system to be sensitive to the broader determinants of health, and the need for understanding the concepts of health and disease within the context of the social and cultural communities that the system is meant to serve. Part One concludes with an argument suggesting that expressions of Canadian values cohere with the normative theory developed. In Part Two the evolution of Alberta's regionalized healthcare system is traced. The values implicit in the regionalization of the health system in this province are then examined for their congruence with the four requirements developed in Part One. Following this, the ethical difficulties faced by RHAs are considered. The thesis culminates with thoughts on the ethical challenges Alberta's regionalized healthcare system must confront, offering recommendations for how some of these challenges may be addressed. It is concluded in the thesis that while a regionalized health system is not necessary for meeting the requirements elucidated, these standards can be met with a regionalized approach. However, at least in the case of the Alberta experience, a number of important changes would have to take place for this to occur. Among these changes is a paradigm shift in the way health and disease are understood towards a more evaluative approach; the recentralization of public health initiatives to the provincial level; and an overall change in governmental health policy recognizing that many areas of society, and consequently the policies of government agencies beyond a disease-based healthcare system, impact health and well-being.

Abstract:
This thesis argues that Christian doctrine does not condone environmental destruction (as many believe); rather, Christian doctrine promotes care for the Earth and supports a number of norms which are consistent with the requirements of sustainable development and useful for planning for sustainable development. Discussion begins with an explanation of the importance of norms and beliefs in planning, and proceeds to outline common criticisms of Christian norms and beliefs respecting the environment. These criticisms are considered valid to the extent that blame is placed on destructive practices which often characterize ill-formed social expressions of Christian norms and beliefs; however, these criticisms may be groundless in terms of a good understanding of Christian doctrine. This point provides a basis for examining Christian doctrine more closely, to see whether or not it condones destruction of the ecosphere. Christian doctrine, logical argument, and a review of relevant literature are used to respond to the above mentioned criticisms. Analysis shows that Christian doctrine provides a basis for caring for the Earth and that one should not dismiss Christianity because of misguided attitudes and actions of professed Christians. Nine ecological norms are derived from Christian doctrine. These norms are shown to be consistent with the requirements of sustainable development, and the findings of non-Christian scholars. Usefulness of these norms is demonstrated through a case-study evaluation of the ecological sustainability of Canada's Green Plan (GP). Applying Christian norms to the GP shows that the GP endorses some important environmental initiatives but is rooted in norms and beliefs which contradict each other and are inconsistent with the requirements of sustainable development. Christian norms therefore prove to be helpful in pointing out weaknesses in the GP. Coupled with the facts that Christian theology does not promote environmental destruction, and that Christian norms enjoy the support of non-Christian scholars, the conclusion is that Christianity has been overly criticized respecting the environment and that Christian norms can and should be used to plan for sustainable development.
