AbstractThe chapter maps out the elite of the early Danish temperance movement and shows how distinct moral elites within the movement interpreted the cause according to their respective value frames while integrating the emerging disease frame of alcoholism. Theoretically, it argues for introducing the thus far estranged perspectives of elite studies and framing approaches to each other. The concept of moral elite is consequently introduced and defined as an elite that is rich in the resources on which moral authority is built, here limited to educational resources, organizational resources, and publications. The chapter applies a mixed methods design. First, social network analysis (SNA) is applied to a unique dataset comprising biographical information on 28 temperance leaders found in the Danish Who’s Who. The analysis reveals three distinct clusters within the temperance elite. Analyzing texts by the most prolific authors shows that each of the three clusters has a distinct profile: an elite dominated by medical doctors and theologians who articulate a traditional value frame according to which medical doctors and pastors carry a responsibility for the community – a responsibility that is expanded through philanthropy and specialized institutions; a revivalist elite of theologians and laymen who pursue a revivalist Holiness and civil society frame emphasizing faith’s healing abilities and the importance of organizing beyond the national church; and an organic elite that represented small farmers and workers and pushed an Enlightenment frame of direct democracy, rule of law, and education. The second part of the analysis shows how each elite cluster integrated the “alcoholism as a disease” belief frame in their value frames: traditional elites as a cause for institutionalization, revivalist elites as a reason to bolster the resilience in the population through faith, and the organic elite as a reason to promote self-care and education. In the final sections of the chapter, I tease out how the moral elite perspective may have implications for social movement research, especially in terms of holding movement elites accountable.

AbstractLabour in Global South countries often has meagre social security protections and almost no representation in domestic legislatures. To address this deficit, labour law’s clear orientation towards “distributive justice” and emphasis on constitutionally protected freedom of association and collective bargaining rights have been core values for workers and labour movements in the South. Over the course of the last century, labour law has increasingly sought to assure “distributive justice” by departing from the confines of “corrective justice” and the slippery “ethical” basis of private law in both civil and common law systems. This chapter asks how both multinational corporations’ (MNCs) recent turn toward the use of codes of conduct in regards to labour and working conditions (labour codes) and, correspondingly, activists’ increasing reliance on the private law doctrines of tort and damages to resolve labour disputes, dilutes labour law’s focus on “distributive justice.” What problems and challenges do these shifts cause for labour law practice and theory? Taking the KiK case as an example, this chapter applies a critical legal perspective to address these questions.

This chapter deals with damages in the context of tort law. In this case, the greater the loss, the larger the damages award. The chapter examines this fundamental commitment. It argues that it is unfair that someone wealthy, like Mick Jagger, would be owed greater compensation if he were negligently injured in a crash involving his luxury car than the average person would be if the roles were reversed. The chapter pursues a justification for the kind of consequential loss-based tort that would enable someone like Mick Jagger to be so compensated, but finds none. The year 2018 was characterized for the international administrative tribunals by (at least) the following three elements, the first two of which were strictly related and linked to each other: the UN Appeals Tribunal’s delivery of the long-awaited judgment on 29 June 2018 in the case Quijano Evans et al. v. Secretary General, challenging the initial decision by the UN Dispute Tribunal to recognize an intangible right to an expectation of continued salary increases over time to the staff and personnel; the decision on September 2018 in the Jannick DEVAUX (II) and (III) case, where the Administrative Tribunal of the Council of Europe acknowledged the application of the general principle of equal pay for equal work in the international civil service sector. Noteworthy to stress is the fact that 2018 was also the year in which the ILO Administrative Tribunal, one of the oldest and most established international administrative tribunals, has the opportunity through the case A v. International Criminal Court (ICC) to clarify the meaning, content and scope of the protection of the international organizations’ staff for the moral damages suffered by their officers and staff personnel as a result of illegal arrests and detentions occurred during working missions abroad.
