Abstract:
This article examines the quality of democracy in Cambodia, arguing that Cambodian democracy since its inception in 1993 has evolved from unstructured competitive authoritarianism toward an authoritarianism characterized by the presence of a stable hegemonic party system wherein the minimum criteria for democracy have been severely curtailed. Although the quality of democracy has declined, the regime’s legitimacy has risen, due mainly to sustained economic growth and political stability, and increased patronage-based development. Economic performance-based legitimacy has become path-dependent; without growth the ruling party’s legitimacy might be called into question. Given the current political, social, economic and international contexts that favor economic growth with political stability, Cambodia will sustain a dominant party authoritarian regime with limited quality of democracy.

Abstract:
The sociologist and anthropologist Gilberto Freyre (1900-1987), author of The Masters and the Slaves (1933), and historian Sérgio Buarque de Holanda (1902-1982), author of Roots of Brazil (1936), are considered some of the main interpreters of Brazilian society, having produced works that continue to impact the understanding of Brazil, according to some researchers, these were the works that "invented Brazil". In this essay, I seek to analyze the impact of the experiences these authors had abroad during the production process of their best-known works. In the case of Gilberto Freyre, I highlight his academic training in the United States, and in the case of Sérgio Buarque de Holanda, his free training in Germany. I believe that due to different academic and cultural experiences abroad, Gilberto Freyre and Sérgio Buarque de Holanda developed different interpretations of Brazil. Based on the analysis of their biographies and their best-known works, I seek to highlight how some of the main interpretations of Brazilian society were only possible due to the "intellectual diaspora" in which these authors participated, trying to understand the influences permeating their work.

Abstract The Covid-19 pandemic truly has been called a global crisis. To fight the spread of the virus, many States have introduced measures that seriously restrict or affect fundamental rights, ranging from procedural rights to the freedom of movement and the right to personal autonomy. In Europe, it is to be expected that many cases concerning such rights infringements eventually will come before the European Court of Human Rights (ECtHR). This contribution aims to give an insight into how the Court will likely give shape to its proportionality test in such cases. It thereby predicts that open balancing review – for which the ECtHR is famous – will play a much less important role than methods of reasoning by analogy and procedural review.
