AbstractThis chapter presents a critical analysis of the capacity of the nation-state to develop and implement effective policy interventions on behalf of national labour interests in highly globalized industries. This follows the consistent observation that, under neoliberal capitalism, governments have lacked the power and/or will to implement pro-labour legislation in the same way as they have done for capital (Fourcades-Gourinchas and Babb 2002; Peck 2004; Kotz 2015). This discussion is developed with reference to the Tonnage Tax policy, introduced by the UK government in 2000, as the key policy strategy to revitalize the ailing shipping industry (Department for Transport 1998). In the broadest terms, the strategy is a tax concession designed to attract British ship owners to re-flag their ships to the UK national register, retain the majority of their ship management in the UK and train British seafarer cadets (Selkou and Roe 2002; Brownrigg et al. 2001; Gekara 2010). The core of the strategy, i.e. the tax element, represents an alternative system of calculating corporation tax for shipping companies based on fixed rates and with reference to a shipping company’s total operating tonnage per year rather than its total income, which represents a highly reduced rate of taxation. To specifically address the decline in the British national seafarer labour market and the supply of British officers, a Minimum Training Obligation (MTO) was included for all British-registered ships, which simultaneously incentivized and compelled shipping companies to increase their cadet recruitment and training activities (Selkou and Roe 2002).

This chapter describes the crisis that led to the calling of the convention that created the federal Constitution in 1787. Although the Articles of Confederation that united the thirteen states lacked the powers to tax and regulate trade, the country was not doing too badly economically or demographically. But the state legislatures were abusing the great power that had been granted to them in the revolutionary state constitutions and tending to ran amuck. The multiplicity, mutability, and injustice of state legislation, especially with the printing of paper money, led reformers to use the weakness of the Confederation as a cover to scrap the Articles and to create an entirely new and powerful central government.

This chapter examines how Parliament's use of language affects central government powers by looking to judicial interpretation of immigration law. Using an adapted legal model of judicialisation, it considers how immigration and asylum laws delegate power from Parliament to the government in order to show how well different state institutions can jointly comprehend legislative language and coordinate in its delivery. The chapter draws on discourse analysis to test the descriptive claim that immigration legislation has become more indeterminate, and logit regression analyses to test the implications of this change for judicial behaviour. The results reveal rapid increases in government losses on appeal after 1995, which coincide with similarly rapid increases in the enactment of indeterminate legislation. The chapter suggests that the effectiveness of immigration law is undermined by its indeterminacy.

The “power of the purse” is one of the fundamental powers of the parliament. This power is defined as a parliament’s authority to determine the amount of public expenditures to be made and the category and amount of taxes to be collected from citizens. To exercise this power, parliaments must debate and review the budget drawn up by the government to ensure that it reflects the preferences of citizens. Nevertheless, it is quite apparent that parliaments today do not sufficiently debate government budgets and do not completely exercise their existing authority. This development weakens the political function of the budget process and sometimes leads to non-optimal budget outcomes. Information and communication technologies (ICTs), particularly websites, are significant tools that parliaments have at their disposal to address this problem. When they are effectively designed, parliamentary websites can contribute to more efficient outcomes to the budget process by enabling the members of a parliament and the citizens they represent to involve themselves in that process. This chapter addresses the potential contributions of parliamentary websites to the budget process. These contributions promise to make budget information more transparent and understandable. This chapter engages in this task by using a content-analysis methodology to examine the website of the Turkish parliament.

This chapter discusses the relevant provisions of Art. 70 et seq. of the Grundgesetz (GG) with regard to legislation, and more specifically the division of legislative power between the federal government and the states. The division of powers between the federal state and the states means that, for each area, either one is responsible. In the case of conflicts between federal and state law, it generally suffices to determine that either the federal state or the state lacks the required legislative power. This observation probably remains accurate even after the federalism reforms of 2006. The chapter first considers the apportionment of legislative power between the federal state and the states after the 2006 federalism reforms, focussing on the exclusive legislative powers of the federal state and its newly regulated concurrent legislative power, before analysing the Federal Constitutional Court's jurisprudence concerning legislative powers and the legislative process.
