Abstract:
Legislative authority in South Africa is divided among the national, provincial and local spheres of government. Section 43 of the Constitution provides in this respect that the legislative authority of the national sphere of government is vested in Parliament; that the legislative authority of the provincial sphere of government is vested in the provincial legislatures; and that the legislative authority of the local sphere of government is vested in the municipal councils. The allocation of legislative authority to municipal councils gives rise to a number of complex questions. One of these is the extent to which municipal councils are entitled to pass legislation that deals with the conservation and protection of the "environment". This issue was considered by the KwaZulu-Natal High Court: Pietermaritzburg in Le Sueur v eThekwini Municipality [2013] ZAKZPHC 6 (30 January 2013). In this case the High Court found that even though the functional area of "environment" has been explicitly allocated to the national and provincial spheres of government and not to the local sphere by the Constitution (see Schedule 4A of the Constitution), municipal councils are entitled to pass legislation that deals with the conservation and protection of the "environment", at least in those circumstances where it forms a part of "municipal planning". While there is no doubt that the functional area of "municipal planning" does encompass certain specific environmental matters at the local level, it does not encompass the broad area of the "environment", as the High Court suggests in its judgment. The approach adopted by the High Court, therefore, is open to some criticism. The purpose of this article is to set out and discuss the High Court’s judgment as well as the criticisms that may be levelled against it in the light of the allocation of legislative authority to the three spheres of government.

There is no compulsory, solid and independent expertise of municipal acts at present time. An attempt to justify the necessity for legal and anti-corruption expertise, when the municipal legal acts are in the federal register, was made. The solution of problems, set out in the article, directly related to the improvement of legislative regulation of powers separation between the different levels of public authority on keeping the Federal Register municipal legal acts.

Abstract:
The paper systematically analyzes the legislative activity on the development and adoption of municipal legal acts. Such activity is defined as a municipal law-making process. Based on the positions of scientists delimiting the municipal law-making process at the stage, and their corresponding analysis, the optimal number and features of each stage of the law-making process at the municipal level are determined.As a criterion for distinguishing the stages of the municipal law-making process, the author proposes to use the target criterion, which allows us to identify specific procedures at each stage. It is noted that only after the execution of the procedures of the first stage the conditions for the transition to the implementation of the procedures of the next stage of the municipal law-making process arise.The author identifies two areas of the law-making process at the municipal level — the referendum process and the law-making activity of local authorities, as well as their features. Given that the population is the main subject of the referendum municipal law-making process, and the implementation of the constitutional right of citizens to hold local referenda is very difficult due to certain legislative restrictions, the author formulates proposals aimed at enhancing the legislative initiative of the population of municipalities.

Many Ontario municipalities between the 1870s and the 1920s tried to influence the pace and form of urban growth by granting inducements to manufacturers. This research note offers a summary of the Ontario legislation relating to such inducements. It defines the forms of assistance municipal councils might grant to industrial enterprises and the restrictions on the powers of municipalities, as these were amended from time to time. The legislative framework of bonusing is considered in four periods: 1867-1892; 1892-1900; 1900-1924; after 1924; and excerpts from the legislation are presented in an appendix. Some implications of bonusing in the study of urban history are suggested.

Abstract It is an essential ingredient of sovereignty that every State has an absolute jurisdiction to determine the laws that apply within its territory and to determine, by its laws, the organ of the State that has the competence to make laws and the procedures to be followed. The competent organ that makes municipal law (the legislature) is usually different from the organ that makes international law (the executive). As a result, and following the dictates of separation of powers, while the executive is competent to enter into treaties, its competence is eroded by the competence of the legislature when a treaty is intended to be applied to municipal subjects; such a treaty intrudes into the competence of the legislature. When this occurs, the municipal applicability of the treaty would turn on the requirements specified by municipal law. This is the function of section 12(1) of the 1999 Constitution (as amended). This section bars the executive from transforming its treaty-making power into legislative powers by requiring legislative approval for the application of a treaty in Nigeria. Expectedly, the section has been variously interpreted and applied by Nigerian courts. This paper examines the views expressed by the Supreme Court in JFS v. Brawal Line Ltd and argues that the Supreme Court failed to give proper expression to the dualist nature of that section.

In the article the analysis of legislative base which regulates references with a waste in Ukraine, and also activity of all authorities involved in this sphere are carried out. In this connection it is necessary to distribute accurately administrative obligations between separate establishments. For qualitative management of a household waste, finances should be provided. Working out and introduction of stimulus is necessary for the use of a waste, as e secondary raw materials in manufacture. In general the, process of implementation in the Ukrainian legislation to the legislation European will partially solve these problems with a waste. Municipal mergers have been widely used as a tool for administrative reform. The goal of most municipal mergers is to increase the efficiency of service provision, but their impact on local democracy has been neglected. In particular, little is known as to how mergers affect performance of local legislatures. In filling these gaps, this study uses a dataset of 754 Japanese city-level governments from 2008 to 2014 to examine how mergers influence legislative performance. After controlling for potential confounding factors, the analysis shows that municipal merger is negatively correlated to legislative performance.

Esta dissertação tem como motivação a pergunta: Como é o Poder Legislativo Municipal no Brasil? É comumente assumido que Câmaras municipais são menos importantes que o Poder Executivo para elaboração e produção de políticas nos municípios brasileiros. Argumento que este é um entendimento equivocado baseado em estudos conduzidos com poucas informações em que não existem evidências empíricas suficientes para sustentar isto. A fim de apresentar um novo e mais completo entendimento sobre as Câmaras Legislativas Municipais, analiso três tópicos. Primeiro, se as Câmaras são profissionalizadas e bem estruturadas. Segundo, o perfil sócio educacional e ocupacional dos candidatos e vereadores comparados com o da população municipal. Terceiro, o conteúdo dos projetos de lei apresentados pelos vereadores. Utilizo dados do Censo do Legislativo, do Tribunal Superior Eleitoral e de um banco de dados original, conduzo uma série de testes que incluem da estatística descritiva a modelos de regressão. A análise mostra que (1) as Câmaras Municipais são pouco profissionalizadas e parcamente estruturadas; (2) candidatos e vereadores possuem escolaridade mais alta e são provenientes de ocupações mais prestigiosas do que a média da população. Todavia, as Câmaras são as instituições representativas mais acessíveis a indivíduos das camadas mais baixas da população; (3) vereadores podem propor leis em importantes áreas e que se algumas destas áreas são muito regulamentadas (como a saúde e educação), outras não são (por exemplo, habitação e regulamentação do solo). Portanto, não é correto dizer que não existem políticas importantes no Poder Legislativo Municipal.
This dissertation has as its motivation the question: How is the Municipal Legislative Branch in Brazil? It is commonly assumed that Municipal Chambers are less important than Executive Branch to elaborate and produce policies in Brazilian municipalities. I argue this is an equivocal understanding based on studies conducted with few information and that there are not sufficient empirical evidences to sustain it. In order to present a new and more complete knowledge about Municipal Legislative Chambers, I analyze three issues. First, if the Chambers are professionalized and well structured. Second, the socio-educational and socio-occupational profiles of candidates and council members compared with the municipal population. Third, the content of the bills presented by council members. Using data from Legislative Census, Superior Electoral Court and an original dataset, I conduct a series of tests including descriptive statistics and regression models. The analysis shows that (1) Legislative Chambers are little professionalized and poorly structured; (2) candidates and council members are better educated and from more prestigious occupations than the population mean. However, they are the most accessible representative institution in Brazil for individuals from lower layers of the population; (3) council members can propose bills in important areas and if some are very regulated (such as health and education), others are not (for instance, housing and soil regulation). Therefore, it is not correct to say that there are not key policies in Municipal Legislative Branch.

With the 1988 Federal Constitution municipalities acquire financial, adminstrative and political autonomy counting with importants prerrogatives regarding public politicy production relevant to citizien. Considering that, the presente study discuss councilors action regarding one of theirs main activities, legislate. Therefore it was analise the presented bills in nine municipalities of Parana State on the period from 2009 to 2012. The aim is to analise the bills content brought by the municipal Legislative and discuss the relations of Executive and Legislative in the law-making process. Thereunto it was resort to some legislative activities indicators as such the data rate and success rate dominance. The theme, scope and effect are part of a classification of the bills. In reference to the bills theme, the Legislative is a potent producer of honorific, social and urban bills. On the other hand, the Executive produce economic and administrative bills, result of their constitutional prerogatives. Regarding the scope, the Legislative bills ar majority individual and sectoral. On the effects of proposals, council members generally prefer not to submit bills that burden the population directly, but in a diluted form.
Com a Constituição de 1988, os municípios adquiriram autonomia financeira, administrativa e política, contando com importantes prerrogativas em relação a produção de políticas públicas de relevante aos cidadãos. Considerando o exposto, o presente estudo discute a ação dos vereadores, em relação a uma de suas principais atividades, a de legislar. Para tanto, analisou-se os projetos de lei ordinárias apresentados em nove municípios do interior do Paraná, no período de 2009 a 2012. O objetivo é analisar os conteúdos dos projetos propostos pelo Poder Legislativo municipal e discutir a relação entre os Poderes Executivo e Legislativo no processo de construção de leis. Para isso utiliza-se alguns indicadores da atividade legislativa destas instituições, como a taxa de sucesso e dominância. Compõe a analise uma classificação temática, da abrangência e dos efeitos dos projetos de lei. Os resultados apontam que a relação entre os Poderes é marcada pelo predomínio do Executivo sobre o Legislativo em municípios pequenos e médio. Com relação a temática dos projetos o Poder Legislativo municipal é um contundente produtor de projetos honoríficos, sociais e urbanos. O Poder Executivo por sua vez, propõe projetos de cunho econômico e administrativo, frutos de suas prerrogativas constitucionais. A respeito da abrangência, os projetos propostos pelo Legislativo são em sua maioria individual e setorial. Sobre os efeitos das propostas, os vereadores em geral preferem não apresentar projetos que onerem a população de forma direta, mas sim de maneira diluída.

The Brazilian Federal Constitution, enacted in 1988, considers the Municipality as a federate entity, granting it political, administrative and financial autonomy. When granting municipal autonomy, the Federal Constitution has created two local government powers, the Executive and the Legislative; it also sets down the system of direct elections for mayor and representatives. As a parallel to the government powers, the Federal Constitution has empowered the people-elected Municipal House to pass and enact the Municipal Organic Law, a self-organizing legislation for the Municipality. Notwithstanding theses powers, the Municipal House still performs their duties inherent to the Legislative Power: representation, control and, especially, drafting legislation by means of the legislative procedures, to assure the Municipality the use of their constitutional competence. Based on the 1988 Constitution, the author of this study aims at describing the Municipal Legislative Power and elaborate on its structure, function and competences as emanating from the federative system, the democratic principles and the historical context of Municipalities in Brazil.
A Constituição Federal de 1988 elevou o Município à condição de ente federado, conferindo-lhe autonomia política, administrativa e financeira. Ao assegurar a autonomia municipal, a Constituição Federal instituiu dois poderes locais de governo, Executivo e Legislativo, e estabeleceu o sistema de eleição direta para prefeito e vereadores. Aplicando princípio simétrico dos poderes de governo, a Constituição Federal conferiu à Câmara Municipal, eleita pelo povo, a função de aprovar e promulgar a Lei Orgânica do Município, que é a Lei de autoorganização do Município, além das demais funções típicas do Poder Legislativo: de representação, de controle e, especialmente, a de elaborar as normas jurídicas, através de processo legislativo, assegurando ao Município o exercício de suas competências constitucionais. O presente estudo parte da origem do sistema federativo, dos princípios democráticos e do contexto histórico do Município no Brasil para caracterizar o Poder Legislativo Municipal e delinear a sua estrutura, funções e competências, a partir da Carta de 1988.

Com o crescente aumento do uso das tecnologias de informação e da implantação de documentos digitais nas Câmaras Municipais, ligadas ao processo legislativo municipal, surge inquietação em relação a forma como esses documentos são elaborados para serem recuperados e disponibilizados no futuro. É preciso refletir se as inovações, mudanças e atualizações em softwares, hardwares e suportes informacionais acompanharão o processo de evolução tecnológica. Torna-se necessário pensar na conservação e preservação digital para a recuperação da informação dos documentos arquivísticos digitais legislativos municipais em longo prazo. O objetivo desse estudo foi a preservação digital dentro do contexto da informação do documento arquivístico legislativo municipal, visando a elaboração de modelos de código de classificação e tabela de temporalidade e destinação, e de metadados para documentos do processo legislativo municipal. A metodologia utilizada foi a análise exploratória e descritiva, baseada no levantamento bibliográfico. Destaca uma abordagem sobre documento arquivístico, documento arquivístico digital, documento legislativo municipal e preservação digital e preservação de documentos arquivísticos digitais legislativos municipais. Com análise dessas informações foi possível concluir que os documentos arquivísticos digitais legislativos municipais necessitam desde a sua origem seguir procedimentos adequados para a sua preservação, desde a implantação de um Sistema Informatizado de Gestão Arquivística de Documentos, como de Repositórios Arquivísticos Digitais Confiáveis e plataformas de acesso, que sigam os requisitos estabelecidos pelo CONARQ e demais órgãos e colegiados responsáveis pela gestão arquivística. Desta maneira será possível manter a autenticidade dos documentos em longo prazo.
With the increasing use of information technologies and the deployment of digital documents in the Municipal Councils, linked to the municipal legislative process, there is concern about the way these documents are designed to be retrieved and made available in the future. It is necessary to reflect if innovations, changes and updates in software, hardware and information media will accompany the process of technological evolution. It is necessary to think about digital preservation and preservation for the retrieval of the information of the municipal legislative digital archives in the long term. The objective of this study was the digital preservation within the context of the information of the municipal legislative archival document, aiming at the elaboration of classification code models and temporality and destination tables, and of metadata for documents of the municipal legislative process. The methodology used was the exploratory and descriptive analysis, based on the bibliographic survey. It emphasizes an approach on archival document, digital archival document, municipal legislative document and digital preservation and preservation of digital archival documents municipal legislative. With the analysis of this information, it was possible to conclude that the municipal legislative digital archival documents need from its origin to follow appropriate procedures for their preservation, from the implantation of a Computerized Document Management System, such as Reliable Digital Archival Storage Repositories and Access Platforms , that follow the requirements established by CONARQ and other bodies and collegiate responsible for archival management. In this way it will be possible to maintain the authenticity of the documents in the long term.

A disseminação da informação do Poder Legislativo da Câmara Municipal de Salvador - CMS. O objetivo é acompanhar a modernização dos processos legislativos, tendo em vista a importância do uso da informação para a tomada de decisão. Aborda as diferenças do valor agregado da informação no cenário público e privado. Evidencia o Poder Legislativo como uma organização aberta, acometido pela reconversão social no momento pós Constituinte de 1988, retratando a relação entre a cultura e a organização hierárquica, destacando como a disseminação se processa na instituição tornando possível levantar o que muda com o uso das tecnologias que são introduzidas e modernizando os serviços, influenciando de forma positiva a Instituição.

Public spending has gained increasing relevance in the economic analysis. However, few studies have dealt with the public expense of the legislative branch. The goal of this dissertation is to analyze legislative spending of São Paulo cities between 1997-2010, as well as estimate the socioeconomic points for the level of this expense. Thereby, we used the methodology of cluster analysis and linear regression in cross-section of socioeconomic factors of the 645 counties, based on 2010 data. The results suggest that the number of councilors is not clearly relevant factor to explain the legislative municipal spending, pointing out, however, the municipal income as the most significant variable for the occurrence of this sort of expense
O gasto público tem ganhado cada vez mais relevância nas análises econômicas. No entanto, poucos estudos têm tratado do gasto público do Poder Legislativo. O objetivo desta dissertação é analisar os gastos legislativos dos municípios do Estado de São Paulo no período 1997-2010, bem como estimar os fatores socioeconômicos determinantes para o nível deste gasto. Para tanto, utilizou-se a metodologia de análise de cluster e de regressão linear em corte transversal de fatores socioeconômicos dos 645 municípios paulistas, com base nos dados de 2010. Os resultados sugerem que o número de vereadores não constitui fator claramente relevante para explicar o gasto legislativo municipal, apontando, em contrapartida, a renda municipal como a variável mais significativa para a ocorrência deste tipo de dispêndio

Esta dissertação pesquisou a implementação do ensino de música na rede municipal de ensino de Seropédica/RJ. Os objetivos foram: (1) investigar este processo, desvelando os principais desafios e as perspectivas para a continuidade; (2) pesquisar aspectos históricos e legislativos do município, bem como pedagógicos das escolas; (3) conhecer o ensino de música no âmbito da educação formal das escolas municipais de Seropédica. Foram mapeados desafios e possibilidades para continuidade da implementação com proposta junto à formação continuada de professores. A metodologia adotou os pressupostos da abordagem qualitativa com inserção de dados quantitativos. Foram utilizados os seguintes procedimentos: coleta documental, encontros presenciais, observações, questionários, criação de categorias a partir das respostas aos instrumentos de pesquisa, construção de gráficos e tabelas, análise de dados e reflexões sobre os mesmos. O amplo levantamento de publicações encontradas no site da ABEM (Anais da ABEM, Revista da ABEM, Revista MEB); no site da ANPPOM (Anais da ANPPOM), bem como alguns livros e textos relacionados ao tema desta pesquisa, deram elementos para a revisão de literatura. Finalmente, apresentamos a síntese dos resultados encontrados e as conclusões propondo como contribuir para a educação musical de Seropédica.
This thesis searched about the implementation of music education at the municipal net of education of Seropédica/RJ. Objectives: (1) to investigate this process, exposing the main challenges and the perspectives for the continuity; (2) to search historical and legislative aspects of the city, as well as pedagogical of the schools; (3) to know the education of music in the scope of the formal education of the municipal schools of Seropédica. Challenges and possibilities had been mapped, for continuity of the implementation, presenting proposal to the continued education of teachers. The methodology adopted assumptions of qualitative approach, with insertion of quantitative data. The following procedures had been used: documentary collect, presential meetings, observations, surveys, creation of categories from the answers to the research instruments, construction of graphs and tables, analysis of data and reflections on the same ones. The ample publication survey found in the ABEM web site (Annals of the ABEM, ABEM magazine, MEB magazine); the ANPPOM web site (Annals of the ANPPOM), as well as some books and texts related to the subject of this research, were source to elements for the literature revision. Finally, we present the synthesis of the main findings and the conclusions, proposing a way to contribute for the musical education of Seropédica.

O objetivo deste estudo é analisar o processo legislativo de formulação das políticas públicas sobre drogas no Município de Vitória/ES. Os dados foram obtidos através de visita ao Departamento do Legislativo da Câmara Municipal para identificação dos projetos de lei e leis no período de 1999-2005. Foram coletadas também informações contidas nos processos e Atas taquigráficas juntamente com o registro de todas as informações observadas em um diário de campo. Foram identificados 22 projetos de lei no período de 1999-2005. Após realizarmos uma análise geral dos projetos foram selecionados para uma análise aprofundada, os projetos de lei 66/2000 e 315/2005 sendo que para tanto era necessário discutir também o projeto de lei 371/1999 e o 192/2002. As entrevistas foram realizadas com quatro legisladores municipais autores das leis elaboradas no ano de 2005 (PL 13, PL 512, PL 122 e PL 315) e com os dois ex-vereadores cujas legislações estão relacionadas com as documentações encontradas nas Atas taquigráficas apontadas nos projetos (PL 66 e PL 315). Dos 22 projetos de lei propostos, 15 foram aprovados, 3 vetados pelo Executivo Municipal, 2 arquivados (1 a pedido do autor, outro em virtude do término da legislatura), 1 parou na Ordem do Dia por pedido de adiamento e 1 teve determinação do relator para ser apensado a outro PL. A proposição destas leis, em sua maioria, foi feita por vereadores filiados a partidos políticos vinculados à coligações vitoriosas nas eleições de 1996 e 2000 (PMDB e PSDB), constituindo-se maioria no legislativo municipal, no período de 1999-2004. As legislações municipais apresentaram conteúdos focados em: campanhas e ações educativas; restrições a locais de venda (no caso do álcool); proibição de publicidade; restrições a compra e proibição do uso. Dez dos projetos de lei eram proposições de medidas restritivas. As políticas públicas de drogas formuladas pelo legislativo municipal inscrevem-se em um contexto permeado por um lado, pela veiculação de explicações e recomendações que garantam a adaptação dos cidadãos à ordem social, concebida como entidade a-histórica, inquestionável, imutável e ideal; por outro, provem intervenções repressoras e punitivas que excluem o sujeito diferente, percebido como uma ameaça às instituições e à sociedade como um todo. A análise do processo legislativo possibilitou refletir o longo e emaranhado processo que envolve interesses divergentes, confrontos e negociações entre várias instâncias e atores governamentais e não governamentais na configuração de políticas públicas que não se restringe à questão das drogas
The objective of this study is to analyze the legislative process in the formulation of public policies for drugs in the city of Vitória, ES. The data were obtained from visitsto the Legislative Department of the local City Hall in order to identify projects of laws, as well as laws, in the period of 1999 to 2005. Information in processes and shorthanded records, in addition to registers in a journal were also collected. It was possible to identify 22 projects of laws within the period of 1999-2005. After the documents were carefully read, the projects 66/2000 and 315/2005 were selected for further studies, which required the analysis of projects 371/1999 and 192/2002. Four representatives, authors of laws created in 2005 (PL 13, PL 512, PL 122, and PL 315) and two former representatives, whose laws were related to the documents found in the above mentioned journals (PL 66 and PL 315) were interviewed. Of the 22 projects that were proposed, 15 were approved, 3 were vetoed, 2 were filed (1 as requested by the author and another due to the end of a term), 1 had a request for delay, and 1 was annexed to another. Most of the propositions were made by representatives who were affiliated to political parties linked to the victorious one in the election of 1996 and 2000 (PMDB and PSDB) which formed the majority in the city government from 1999 to 2004. The laws focused on: educational campaigns and actions; restrictions on sales in certain sites (alcohol); prohibition of publicity; prohibition of purchase and use. Ten of the projects proposed restrictive measures. The public policies on drugs formulated by the city government are inscribed within a context which is, on the one hand, permeated by the display of explanation and recommendations that could guarantee the adjustment of citizens to the social order, seen as a non-historical, unquestionable, unchangeable, and ideal entity; on the other hand, they provide repressing and punishing interventions which exclude users as a threat to institutions and society as a whole. The analysis of the legislative process made possible a reflection about the long and intertwined process that involves different interests, the confrontation and negotiation between several instances, and also between governmental, and non governmental, actors in the configuration of public policies that are not restricted to drugs

Integrated coastal governance (ICG) is becoming increasingly important nowadays, since the problems at coastal territories are continuously growing. The coastal zone, however, is a complex socio-ecological system which is extremely difficult to govern because it is very dynamic territory that is also very sensitive to various anthropogenic influences, as well as a lot of conflicts of interest occur there. Coastal area is characterized by a unique and diverse natural and cultural heritage as is the case with Jurmala municipality in Latvia. An integrated approach is important in the governance of such a complex socio-ecological system, but disciplinary/branch approaches are also necessary. The aim of the research was to study and evaluate the complex situation of the coastal governance at the local level, as well as to develop policy proposals for the chosen target territory – Jurmala municipality – and its main target groups. These studies included the analysis of the legislative acts and planning documents, interviews with all the main target groups in the municipality, observation studies, as well as the initial assessment of the coastal governance situation in the Jurmala municipality by using the model of three environmental governance dimensions: (1) coastal governance sectors; (2) coastal governance segments (stakeholders); and (3) coastal governance instruments.

The analyzes of public policies and their interface with the law are related to the effectiveness of fundamental rights. This article aims to analyze how the creation and execution of public policies aimed at the realization of fundamental social rights, especially those aimed at employment and income, as well as the judicial control of these public policies, are carried out. It seeks to identify the mechanisms and limits inherent to Public Administration to promote the realization of these rights in an equal way. The investigation of institutional designs, federative arrangements, and programs and the legal foundations and theoretical bases of public policies founded with the consolidation of the Constitutional State of Law seek to identify possible bottlenecks in the Brazilian Public Administration for the effectiveness of socialrights, such as those aimed at employment nationwide and the municipal administration, especially in Campos dos Goytacazes. The study will be based on a bibliographic research and analysis of the legislative and jurisprudential process on the subject, with data collection from the websites of the federal and municipal government of Campos, Ministério Público, Courts of Auditors, IPEA, IBGE, Federal Chamber of Deputies and well. as the Federal Supreme Court (STF). In recent years, concern over the continued use of limited fresh water supplies or similarly, cooling towers and their essential makeup, high maintenance and associated chemical treatment requirements has spawned a clever, yet dramatic change in powerplant surface condenser and heat exchanger cooling. The paradigm shift away from the established and typical toward the unconventional has produced an innovative and non-traditional cooling water source for surface condensers and heat exchangers. Pundits suggest water shortages will increase the amount of water reuse (Chart 1) in the US from a current estimated 1.7 billion gallons to an estimated 12 billion gallons by the year 20152. Given this dramatic prediction, water reuse, or the reclamation and treatment of impaired or gray water will be driven by and emerge as market incentives joined at the hip by emerging or mandated effluent discharge standards. Without a clear understanding of the legislative and political landscape, regulative complexities that deal with this type of cooling water could conceivably lead to an unattractive environmental legacy. Having duly noted the “trend or aberration” dilemma, this paper will further identify efforts by the municipal wastewater treatment plants to economically process a usable product. We will investigate the impact of ancillary add-on costs absorbed by the electric utility such as secondary filtration and examine an actual case study involving the extensive use of gray water. Finally, the paper will evaluate new operational conditions, emerging new corrosion issues with suggested abatement, metallurgical changes, pollution considerations, maintenance issues and other mechanisms which have forced utilities to develop innovative solutions when employing impaired cooling water sources for the main surface condenser and other heat exchangers.

The Federal Constitution of 1988 has in its body the so-called second dimension rights that aim to guarantee the dignity of the human person. However, when it comes to the homeless population, the reach of these rights, in practice, is distant or non-existent. The absence of official census data hinders the action of the State in the elaboration of effective public policies aimed at solving the various problems faced by individuals living on the streets, without guaranteeing the existential minimum. Given this scenario, the objective is to investigate the development, elaboration and implementation of public policies in the city of Campos dos Goytacazes for the homeless population, which aim to protect the minimum set of rights to have a decent life, reaffirming the importance existing policies or indicating the need for reformulation or the adoption of other measures that guarantee the minimum foreseen in the constitutional text.To achieve the objectives proposed in this research, the methodological procedures will start from a bibliographic, longitudinal, descriptive survey; legislative and jurisprudential analysis on the subject, in addition to a qualitative and quantitative approach, through the collection of primary and secondary data at the Human Development Department and Centro Pop, drawing up a profile of the homeless population in the studied municipality. The aim of this research is to systematize the theoretical framework and the actions of the State through laws, projects, decrees, ordinances on the homeless population and the implementation of public policies as a way to guarantee the existential minimum; proposition of viable solutions at the municipal level for the implementation of effective public policies for the multi-cited population, and elaboration of an article bringing together the results achieved by the studies carried out during the project.

Este artigo aborda a necessidade do estudo da Transparência Governamental sob a ótica da Tecnologia da Informação. Para tanto, é apresentada a construção de uma Metodologia de Avaliação de Portais da Transparência Municipais, à luz das normas da série ISO/IEC 25000 e da legislação brasileira. O modelo proposto conta com 443 itens de avaliação, divididos em um indicador específico para medir o grau de Transparência Ativa do Poder Legislativo e outro para o Poder Executivo municipal. A metodologia construída se baseou em critérios objetivos para a atribuição dos pesos de cada indicador e teve foco em reduzir o grau de subjetividade do processo de execução da avaliação. O trabalho contou, ainda, com o desenvolvimento de um software de apoio operacional ao processo de avaliação, para agilizar o trabalho de campo. A metodologia foi aplicada com a realização da medição da transparência ativa dos municípios do Estado do Espírito Santo, e os resultados mostraram um baixo grau de atingimento dos critérios estabelecidos.
