Full textSeveral countries applied the notion of tax expenditures. The comparative analysis (Canada, United States, France) shows that difficulties bound to their identification and to their integration in States activities remain. To operationalize tax expenditures, thesis proposes restrictive definition as well as the elaboration of parameters and a typology frame. These elements allow comparing the budgetary expenditure of tax expenditures having the same objectives of public policy. The application reveals a series of advantages, notably: i) to standardize the way of their identification; ii) to make some tax expenditures completely comparable with budgetary expenditure; iii) to integrate their cost into the budget of the State; iv) to improve the evaluation of the budgetary choices by transferring their management to the concerned ministries. These modifications should lead to a better use of interventionist tax policy

Full textAt the origin of this research project, we find a suggestion of B. Rabe, according to which sub-national governments (at least, within the framework of the United States and of Canada) can be considered as central actors in the programs of greenhouse gas (GHG) reduction. This bottom up approach suggests that a lack of serious commitments on behalf of the mentioned national governments can be partially compensated with sub-state level actors. This hesitation at the national level has been effectively compensated with actions realized at the regional level as was the case with the States of the New England, according to B. Rabe. Given that this region of the United States encompasses participants from the Conference of New England Governors and Eastern Canadian Premiers (NEG/ECP), we asked ourselves questions as to the GHG reduction policies of the Canadian part of this regional grouping. More concretely, from this intra-regional comparison, we tried to make a replication of the model of B. Rabe. Inspired by an interdisciplinary approach and by a taking into consideration factors coming from ideas, interests and institutions, this research work is structured as a succession of chapters. After the introductory part, the first chapter (section 2) handles the positioning of the Canadian provinces members of the NEG-ECP, compared with States of the New - England concerning the governments’ policies on the reduction of the GHG. We wanted to determine the framework of these provinces, consider the (possible) presence of political learning (apprenticeship) as well as an analysis of the sectorial dimensions of the action plans. Based pa r t ia l ly on the results of the first chapter , the study of a link between the sectorial composition of the provincial economy and the type of government policy on the GHG reduction represents the foundation of the second chapter (section 3). The presence of natural resources (and/or of maritime resources), the economic diversification as well as the nature of the energy base of the province seem to influence the government policy about climate change. The third chapter (section 4) aims at analyzing the phase of elaboration / formulation of the most recent Quebec’s action plan on GHG. To cast more light on the political path of this plan, various elements are considered: Québec’s historic environmental commitments, the intergovernmental interactions, the presence / absence of coalitions as well as the role of the governmental public servants. And finally, the conclusion evokes possible contributions and limits of the entire process of our research. We also mentioned certain potentially interesting developments concerning the future researches on the subject.

Full textThis research consists of a literature review with the aim to analyze the modes of voluntary self-regulation, government licenses and new governance in order to find the most appropriate regulatory framework for the Temporary Help Industry (THI). This research report consists of three parts. The aim of the first chapter is to explain the staffing industry and the arising key issues. The goal of the second chapter is to analyze the advantages and disadvantages of the two traditional forms of regulation practiced by the THI, voluntary self-regulation and governmental licenses and to verify whether or not these two modes of regulation may disadvantage workers' rights. The goal of the third chapter is to establish a regulatory framework with new governance and responsive regulation intended to determine whether or not it may present the option of a third way for the regulation of the THI.

Full textThe aim of this geopolitics research is to analyze the particular sociopolitical situation of the Canadian Arctic using the representations it generates at different scales. The increasing interest in the Arctic zone, associated with a warming climate, makes us think back certain strategies, especially the regulation of maritime spaces. There is already a conflict between the United States and Canada in how the Arctic water is perceived, including the Northwest Passage, in terms of statute: international strait versus Canadian inland waters. In this context, Canada – which, over the past years, is continually claiming sovereignty over those Arctic waters – must also guarantee a safe navigation; otherwise it will lose credibility if any maritime problem occurs. Thus, my analysis focuses on navigation in Arctic waters. First, I give information about this navigation in a tangible way. Second, I broaden the study to what are the stakes and the consequences on the Arctic territory and its development. From a management perspective, stakeholders interact with the territory according to the perceptions and the representations they have of it and, vice versa, the territory is built by the means of these generated representations. However, the enhancement of the Arctic territory under the influence of navigation expansion shows rather exogenous development and the mark of extremely diversified representations. Finally, we will enquire into the context of structuring formation by means of a historical approach before discussing risks and vulnerabilities of navigation.

Full textPlébiscité à titre de 22ième Premier ministre du Canada, Stephen Harper dirigea pendant près d’une décennie un gouvernement conservateur qui, mû par une philosophie Tough on Crime, ratifia plus de cinquante politiques pénales ayant toutes comme épicentre la promotion et l’accentuation de l’usage de la force pénale. Or, il appert que les réformes pénales de l’administration Harper ne reposaient pas uniquement sur des desseins répressifs ; elles étaient également traversées par une série d’idéaux populistes. Marquée par les possibles répercussions d’une telle approche pénale, la présente recherche documente certains des aspects populistes ayant sous-tendu les politiques pénales ratifiées par le gouvernement de Stephen Harper. Pour réaliser un tel objectif, la première partie de ce mémoire illustre que le gouvernement Harper a engendré, à des fins politiques, un impetus de punitivité sans précédent dans la sphère pénale canadienne. Poussant la réflexion à un autre niveau, la seconde partie de la présente recherche est constituée d’une série d'analyses qualitatives et de réflexions critiques portant sur trois des politiques harperiennes ayant eu les impacts les plus significatifs sur le champ pénal canadien, soit les projets de loi C-2, C-10 et C-59. À la lumière de ces analyses et de ces réflexions, ce mémoire aspire à mettre en exergue diverses facettes de l’ancrage populiste du gouvernement Harper en matière pénale. Loin de se limiter à l’oeuvre pénale du gouvernement Harper ce mémoire tente également d’offrir une compréhension des réalités sous-tendant les vagues populistes et les dérives que celles-ci peuvent engendrer en justice pénale.
Elected as the 22nd Prime Minister of Canada, Stephen Harper’s Conservative government ruled for close to a decade. Driven by a “Tough on Crime” philosophy, the Harper government ratified over fifty penal policies. All of these policies were centered on the promotion and increased use of penal force. It appears, however, that Harper’s penal reforms did not rest solely on such repressive intents but were also laced with a plethora of populist ideals. Struck by the implications of such a penal approach, this study is built on the necessity to document the populist aspects undergirding Harper’s penal policies. To achieve such an objective, the first part of this thesis illustrates that the Harper government created, under political imperatives, an unprecedented punitivity impetus on the Canadian penal scene. Pushing the reflection to another level, the second part of this thesis consists in a series of qualitative analyses and critical reflections on three of Harper’s penal policies which had the most significant impacts for the Canadian penal field: Bills are C-2, C-10 and C-59. From these analyses, this thesis highlights various aspects of the Harper government's penal populist stance. Going well beyond the penal work of the Harper government, this thesis also attempts to offer an understanding of the realities behind populist waves and drifts that can occur in Criminal justice.

Full textA generous employment insurance system to protect those who lose their job does not encourage them to look for work. The 2012 Employment Insurance Reform in Canada is part of a long series of legislative changes in employment insurance policies aimed at encouraging the unemployed, and more specifically seasonal workers who are the most frequent claimants, to return to work. In this thesis, we use the Double Difference Regression Method to study the effect of this reform on couples. According to our results, the objective sought through this public policy seems to have been achieved, by stimulating the research and the acceptance of new jobs among men workers in the seasonal industry. On the other hand, there appears to be no negative impact of the Added Worker Effect on their spouses.

Full textGovernments are increasingly turning to social media platforms such as Twitter to disseminate public health information to the public, as evidenced during the COVID-19 pandemic. The purpose of this paper is to gain a better understanding of Canadian government and public health officials' use of Twitter as a dissemination platform during the pandemic, and to explore the public's engagement with and sentiment towards these messages. We examined the account data of 93 Canadian public health and government officials during the first wave of the pandemic (December 31, 2019 – August 31, 2020). Our objectives were to: 1) determine the engagement rates of the public with Canadian federal and provincial/territorial governments and public health officials' Twitter posts, 2) illustrate the evolution of the Canadian public discourse during the pandemic's first wave by a hashtag trends and 3) provide insights on the public's reaction to the Canadian authorities' tweets through sentiment analysis. To address these objectives, we extracted Twitter posts, replies and associated metadata available during the study period in both English and French. Our results suggest members of the public demonstrated increased engagement with federal officials' Twitter accounts as compared to provincial/territorial Twitter accounts. Hashtag trends analyses illustrated the topic shift in the Canadian public discourse, which initially focused on COVID-19 mitigation strategies and evolved to address emerging issues such as COVID-19 mental health effects. Additionally, we identified 11 sentiments in response to officials' COVID-19 related posts. This study illustrates the potential to leverage social media to understand public discourse during a pandemic. We suggest that routine analyses of such data can provide real-time recommendations to government and public health officials on public sentiments during a public health emergency and can provide useful insights on the accounts/actors with which members of the public are most engaged, which can be leveraged to disseminate key messages.

The Changing Dynamics of the Indexing Theory: A Content Analysis ofThe Globe and Mailand The Toronto Star, ” is dealing with the theory of indexing in a Canadian context. Therefore, the main problem illustrated by Bennett and Pfetsch (2018) is that indexing theory removes “alternative voices, ” instead of including these “new” voices in order to balance the sources. In this new fractured environment, it is more complex than before to balance different perspectives and opinions because of the involvement of different actors in the political arena. The main argument of this thesis is that it is imperative totest the theory of indexation and to adapt its central elements to the new political environment. This means an inclusion of this new environment to the basic assumptions that will include alternative narratives. It is in this context that we decided to analyze the issue of immigration policies in Canada and its indexing by the media. Consequently, this thesis is devoted to an analysis of the relationship between the media and official political authorities in Canada, in particular, by addressing the question of the place of alternative narratives in Canadian journalistic discourse.

Full textPending the possible implementation of the Trans-Pacific Partnership Agreement (TPP), the protocol of which was signed at the autumn 2015, we have analyzed its economic impacts using a partial equilibrium model on the supply-managed Canadian dairy sector. The issue was addressed in terms of tariff liberalization with a minimum access increase per tariff line. Using the short-term scenarios (no adjustments) and long-term scenarios (reduction of the national marketing quota), we analyzed the implications of the TPP for the welfare of the various actors in the sector, inputs and outputs and the quantities offered and consumed. The results show a decrease in the domestic price and the quantity offered of the input as well as a net increase in general short-term and long-term welfare of 0.3% and 0.7%, respectively. -- Keywords: dairy sector, tariff liberalization, minimum access, supply management, Trans Pacific Partnership (TPP).

Full textThis paper focuses on the analysis of the conditions of the effectiveness of public participation in the Canadian and Quebec legal regimes when examining interprovincial pipeline projects. Participation mechanisms and processes implemented by the federal government, as part of the National Energy Board's review of projects, those developed by the Crown as part of its constitutional obligation to consult First Nations and those participating in the hearings of the Bureau of Public Hearings on the Environment in Quebec will be under consideration. The assumption in this essay is that despite their appearance as participatory, the mechanisms implemented by the various levels of government for this purpose are more akin to consultation than to true participation. The analysis of the legal conditions for the effectiveness of public participation will make it possible to identify potential gaps in participatory processes. It will then be possible to propose ways of thinking about how to guarantee better public participation in federal and Quebec law, while taking into account the current reforms in the country.

Full textDisability is a major barrier to the labor market. In Canada, federal and provincial initiatives aim for a better integration of people with disabilities. The province of Quebec in particular has an unique programme to promote the hiring and retaining of people with disabilities in a non sheltered workplace: the job integration contract. The objective of this research to draw a portrait of the Canadian population with disabilities and to assess the impact of the job integration contract on employment. We use data from the Survey of Labor and Income Dynamics and the Canadian Survey on Disability. We apply the difference-in-difference method using people with disabilities in the rest of Canada as our control group. We find that education, severity and the need for the workplace adaptations are the most important factors in the job market for people with disabilities. The first results of the evaluation suggest that the policy had no significant effect for men with disabilities but that it contributed to an increase in the participation of women with disabilities by 9 percentage points over the studied period. However, additional results from the triple difference are not significant for both men and women.

Full textCette thèse s’intéresse aux pratiques d’intervention en maison d’hébergement auprès des femmes immigrantes victimes de violence conjugale (FIVVC). L’objectif général de la thèseest d’explorer, à partir de la perspective intersectionnelle (PI), les manières dont lesintervenantes des maisons d’hébergement du Québec, tout en considérant les expériences vécues par les femmes immigrantes en situation de violence conjugale, analysent cette situation et interviennent auprès de ces femmes. Pour la collecte de données, cinq groupes focalisés et une vignette clinique ont été utilisés pour explorer les points de vue de 33 intervenantes de maisons d’hébergement de quatre régions du Québec (Montréal, Gatineau, Québec et Sherbrooke). Une analyse de contenu thématique a permis de dégager deux discours chez les intervenantes sur les expériences des FIVVC : un discours d’homogénéité et un discours d’hétérogénéité. Le premier discours, moins présent que le deuxième, tend à homogénéiser les expériences des FIVVC. Cette tendance s’explique par une vision essentialiste du vécu des femmes, construite à partir de l’axe du genre. L’intervention féministe en violence conjugale —entrée sur la victimisation des femmes et la domination masculine —, largement utilisée dans les maisons d’hébergement, expliquerait cette vision homogénéisante des femmes de la part des intervenantes rencontrées. Des aspects positifs et contraignants de ce type de discours sont aussi soulignés dans cette recherche. Le second discours met en avant une représentation diversifiée et hétérogène des FIVVC. Cette hétérogénéité se base sur la présence d’oppressions structurelles (lois et politiques sociales, racisme, discrimination, non reconnaissance des diplômes) dans les expériences des femmes dans leurs pays d’origine et dans le pays d’accueil. Notre recherche a pu dégager du discours des intervenantes une perception des FIVVC, comme plus vulnérables à la violence conjugale; cette vulnérabilité découlerait d’une multiplicité d’expériences d’oppression ainsi que d’une représentation contraignante de la famille, des croyances religieuses et des communautés d’appartenance des femmes immigrantes. Des enjeux de ce type de discours sont abordés dans cette thèse. Bien que le deuxième discours témoigne de la complexité de l’analyse des intervenantes sur les réalités des FIVVC en général, il se présente de façon désarticulée. Concernant les points de vue des intervenantes sur leurs pratiques, l’analyse des résultats a permis de dégager trois thèmes principaux autour desquels s’articulent les discours des intervenantes : 1) les caractéristiques de l’intervention en contexte interculturel, 2) les facteurs modulant les pratiques en contexte interculturel et 3) les défis de l’autonomisation des femmes. Nous avons relevé de la part des intervenantes une reconnaissance des besoins différents chez les FIVVC en lien avec leurs appartenances culturelles et leurs positions sociales multiples. Des stratégies — surtout de collectivisation — permettent, selon les intervenantes, d’intégrer les aspects culturels et religieux liés à ces appartenances, afin de favoriser l’inclusion, le respect, la justice et la solidarité entre femmes. Divers facteurs modulent les pratiques en contextes interculturels, notamment la langue parlée, la position sociale, le statut et l’expérience d’immigration. Les intervenantes se montrent préoccupées par l’autonomisation des FIVVC. Bien que le « maternage » ressorte comme une pratique courante quand il s’agit d’intervenir auprès des FIVVC, les intervenantes sont critiques à l’égard de cette façon de faire. La défense des droits est aussi une pratique couramment utilisée dans le but de favoriser l’autonomisation des FIVVC. Concernant l’application de la perspective intersectionnelle dans l’intervention auprès des FIVVC en maison d’hébergement, nous concluons que son utilisation favorise les pratiques d’inclusion, car elle considère plusieurs systèmes d’oppression qui se croisent dans la vie des FIVVC. Cette perspective offre des opportunités de développement des pratiques quiintègrent les aspects micro et macro — notamment les aspects identitaires des femmes et les aspects structurels —, ainsi que le développement de pratiques réflexives. L’utilisation de la grille d’analyse de Patricia Hill Collins a permis d’apporter un éclairage sur la manière d’appliquer la perspective intersectionnelle dans l’analyse des expériences et des pratiques des intervenantes auprès des FIVVC en maison d’hébergement. Nous abordons aussi certaines limites de l’application de cette perspective, notamment en ce qui concerne la place que le genre devrait occuper dans l’analyse et dans l’intervention en violence conjugale. Des pistes d’intervention et de recherches futures découlant de nos résultats sont finalement proposées.
This thesis constitutes an analysis of intervention practices used with immigrant women victims of domestic violence (IWVDV) in shelters. The purpose of the research was to adopt an intersectional approach to explore how shelter workers in the Province of Quebec assessand choose to intervene in situations affecting IWVDV. Data collection was carried out using five focus groups and one clinical vignette to explore the different viewpoints of 33 shelterworkers in women’s shelters in four regions in the Province of Quebec (Montreal, Gatineau, Quebec City and Sherbrooke) regarding their experiences with IWVDV and their choices of intervention practices used with these women. A thematic content analysis enabled us to identify two discourses in the shelter workers regarding their experiences with IWVDV: one discourse centered on homogeneity and the other, on heterogeneity. Less present than the second, the first discourse tended to homogenize shelter workers’ views of the IWVDV’s experiences. This tendency can be explained by an essentialism gender-based view of women’s experiences. Feminist intervention in domestic violence—which is centered on the victimization of women and the domination of men and which is widely used in women’s shelters—is one explanation for the homogeneous vision among the shelter workers we met with. Our research also highlights both the positive and limiting aspects of this type of discourse. The second discourse puts more emphasis on the diversity and heterogeneity of the IWVDV. This heterogeneity can be seen as a consequence of structural oppression (laws, social policies, racism, discrimination, non-recognition of credentials), both in the countries of origin and in the host country. Our research helped us to identify in the shelter workers’ discourse a perception that the IWVDVwere more vulnerable to domestic violence. This vulnerability, according to the shelter workers, would seem to be the result of multiple forms of oppression stemming from the families, religious beliefs and cultural communities. The present thesis thus addresses issues arising from this type of discourse. Although the second discourse illustrates the complexity of the analysis carried out by the shelter workers regarding the IWVDV’s situation, this discourse remains somewhat disorganized. In terms of the shelter workers’ viewpoints about their interventions, our analysis enabled us to identify three main themes on which their discourse primarily focused: 1) the characteristics of an intervention in an intercultural context, 2) the factors affecting practices in an intercultural context, and 3) the challenges in addressing women’s empowerment. We discovered that the shelter workers recognized the different needs of the IWVDV regarding their different cultural belongings and their multiple social roles. According to the shelter workers, different strategies, particularly collective approaches, made it possible to integrate the cultural and religious dimensions of these belongings, and thereby encourage inclusion, respect, justice, and solidarity among women. A variety of factors influenced the practices adopted in intercultural contexts, in particular the language spoken, the social position, the immigrants’ status, and their immigration experience. The shelter workers were particularly concerned by the issue of empowerment in IWVDV. While the issue of “mothering” was recognized as a widespread practice when shelter workers intervened with women in this group, these same workers tended to be critical of this approach. The defense of immigrant women’s rights was also an approach widely used by the shelter workers to further the BIW’s empowerment. Full textLa présente recherche est née de la volonté de comprendre si les lois sur l’immigration par le parrainage affectent ou non les relations entre les hommes et les femmes qui choisissent d’immigrer au Canada par cette filière. À première vue cette loi, qui facilite le regroupement familial pour des résidents permanents ou des citoyens, pourrait paraître positive, pour les femmes notamment. Les récits des dix femmes qui ont participé à ma recherche montrent qu’au contraire, la situation est extrêmement complexe et mène parfois à des formes variées de violence, en même temps qu’elle contribue à créer des relations asymétriques et des inégalités au sein des couples. Les entrevues semi-dirigées auprès de ces immigrantes parrainées habitant la Ville de Québec montrent clairement que ce processus d’immigration a ses particularités et que les effets sur leur vie ne sont pas que positifs.

As long as this form of expression meets the criteria of copyright, the work is protected and enjoys the same rights and prerogatives as other more classical works, we shall say, such as paintings of Masters, literary works of the most beautiful feathers of this world... However, when their creator decides to stage his art without consideration for the owner of the medium on which he fits, this protection even if legitimate is called into question. Criminal law and property law, for example, rise up to copyright, and compromises must be found to ease tensions arising from such a practice. Owner or author, do we necessarily have to favour only one?
