Abstract:
Objective - This article aims to (1) examine three concepts of practical ethics originating from fiqh muamalah studies, namely al kharaj bi al dhaman, maslaha, and nafaqa, as substitutes for the more philosophical basis of Baydoun and Willett’s (2000) Islamic ethics; and (2), apply the three concepts to improve the structure and content of Baydoun and Willett’s (2000) value-added statement. Methodology/Technique – Maslaha-based VAS can improve VAS weaknesses in Baydoun and Willett’s (2000) ICRs and be an alternative to the 1993 and 2010 AAOFI income statements. Findings – The use of the kharaj bi al dhaman, maslaha, and nafaqa concepts could direct the content and structure of financial reports from the “secular” one into sharia and humanistic. Novelty - The application of the concept of kharaj bi al dhaman substitutes for the matching concept; the idea of nafaqa substitutes for expenses; and the notion of maslaha makes the maslaha-based VAS more powerful, philosophical, conceptual, and practical than the VAS of Baydoun and Willett and the AAOIFI income statement Type of Paper: Review JEL Classification: M41, M42. Abstract:
Islamic Corporate Reports (ICRs) is an alternative synthesized Islamic accounting theory to explain and improve the ethical foundations and implications of Islamic financial reports guided by AAOIFI. This article aims to sharpen the ethical foundations of Baydoun & Willett's ICRs, particularly regarding the Islamic value-added reporting (VAR) as well as projecting its implications on the shape and substance of the report. Baydoun & Willett suggested the addition of current value to complement the historical value for the balance sheet and VAR as a substitute for the income statement. This study employs qualitative approach by examining three fiqh principles. The principle of al kharaj bi al dhaman (cost-reflected earning), maslaha (welfare) and nafaqa (expenditure) to build a new perspective on Baydoun & Willett's VAR. The examination of three fiqh principles on VAR can be understood in a broader perspective in a smooth and relatable way by the Muslim community because it has stronger roots in the legacy of Islamic scholars, especially in the financial sector. Abstract:
The Qur’ān is a marvellous book which contains various miraculous signs. Amongst its miracle is the use of polysemous words in the Book. An interpreter of the Qur’ān who does not acquaint himself with the proper use of Arabic words will mislead not only himself but others following such interpretation. The exegesis of the Book requires advanced knowledge of the Arabic Language and its branches to grasp the deep meanings of the Qur’ān. This article focuses on nafaqa mentioned in one hundred and seven (107) places in the Qur’ān as a case study of the polysemous nature of the Qur’ān and how it is being used in different ways as nouns, verbs or adjectives. As such, only expert exegetes can understand how these words are being used without misinterpreting the Qur’ān.

AbstractThe French Mandate authorities in Greater Lebanon formally recognized the Ja'fari madhhab in January 1926. As a result, state-led shari'a courts in Beirut, South Lebanon and the Bekaa Valley, the Lebanese Ja'fari court, were authorized to adjudicate matters of personal status—marriage, divorce, nafaqa, inheritance and property. As the first Lebanese Shi'i institution to enjoy communal autonomy granted by the state, the records from the Ja'fari courts provide insight into the everyday life-worlds of ordinary Shi'i Muslims in Lebanon during a period of gradual social change. Through a close reading of some unique cases—dealing with inheritance, maslaha and zinā—this article invites a consideration of how both the bureaucratization and practice of Shi'i law in these courts were central to the institutionalization of a new kind of Shi'i sectarianism in Mandate-era Lebanon.

Beginning in the early 1970s, Jewish and Muslim feminists, tackled “oral law”—Mishna and Talmud, in Judaism, and the parallel Hadith and Fiqh in Islam, and several analogous methodologies were devised. A parallel case study of maintenance and rebellion of wives —mezonoteha, moredet al ba?ala; nafaqa al-mar?a and nush?z—in classical Jewish and Islamic oral law demonstrates similarities in content and discourse. Differences between the two, however, were found in the application of oral law to daily life, as reflected in “responsa”—piskei halacha and fatwas. In modern times, as the state became more involved in regulating maintenance and disobedience, and Jewish law was backed for the first time in history by a state, state policy and implementation were influenced by the political system and socioeconomic circumstances of the country. Despite their similar origin in oral law, maintenance and rebellion have divergent relevance to modern Jews and Muslims.

Abstract In the late nineteenth and early twentieth century,1 Muslim communities in different parts of the world faced a common problem—women’s inability to obtain divorce after their husbands went missing. These women, deprived of provision (nafaqa), could neither sustain themselves financially nor remarry. In response to this situation, Muslim scholars, in their respective communities (Egypt, Ottoman Syria, British India and the Russian empire), produced legal decisions (fatwas) to facilitate women’s divorce. This paper focuses on the responses of Russia’s Islamic scholars to this problem which were collected and published by a prominent religious scholar of the Volga-Urals, Rizaeddin Fakhreddin. Among Volga-Ural Muslims, this problem was entangled with the question of religious authority under Russian imperial rule. I argue that since Russia’s legal pluralism and institutionalization of the ‘ulama under the Orenburg Muslim Spiritual Assembly were the main reasons behind the inability to solve the problem of women’s divorce from missing husbands, Fakhreddin initiated this collective deliberation as a preliminary attempt to resolve a legal issue through the consensus (ijmā‘) of legal experts within the framework of the OA. Finding a solution to the problem faced by the wives of missing husbands was inseparable from the question of the transformation of Islamic religious authority under imperial rule.

Alimony (nafaqa) is one of the most important financial institutions in Iranian family law, rooted in the principles of Islamic jurisprudence (Imamiyya) and codified in civil law. It plays a crucial role in meeting the material and emotional needs of women in marital life. This article aims to analyze the functions of alimony in Iran’s legal system and compare it with other countries. Initially, the theoretical foundations and economic and social functions of alimony are explored. The article then addresses the legal and practical challenges of implementing alimony in Iran, such as the lengthy judicial process, complexities in determining the amount of alimony, and evasion of payment by some husbands. Moreover, a comparative analysis of alimony in Iranian law with that of other countries, especially Islamic and European countries, highlights both differences and similarities in this legal institution. In the concluding section, the article offers legal and practical suggestions to improve the alimony system and reduce family disputes. These recommendations include legal reforms for clearer determination of alimony, strengthening oversight over the enforcement of alimony judgments, and raising social and cultural awareness regarding the significance of alimony in strengthening the family unit. The findings indicate that alimony, beyond being a financial obligation, serves as a supportive tool that enhances marital relationships and reinforces the family structure within society.

<strong>ABSTRACT</strong> The term &lsquo;&lsquo;Nikah Misyar&rsquo;&rsquo; translated sometimes as &lsquo;&lsquo;marriage of convenience&rsquo;&rsquo; or &lsquo;&lsquo;Traveller&rsquo;s marriage&rsquo;&rsquo;. It is not found in Quran or Sunna or classical works of Islamic jurisprudence because it is introduced recently by some clerics. In Sunni Islamic law, Nikah Misyar is a type of sunny Nikah that is ostensibly carried out with the objective of allowing a couple to engage in intercourse in a permissible manner. The husband and wife thus joined abandon several marital rights, such as living together, the wife&rsquo;s rights to housing and maintenance money (nafaqa) and the husband&rsquo;s rights to housekeeping and access. There exit so much confusion in the society about this matter, is it halal or haram? Its answer simply depends upon the conditions in this Nikah, if the conditions are according to Shariah than it is halal, and on the other way if it does not fulfil the teachings of Islam then it is haram. This paper discusses the viewpoints of various religious scholars, regarding Nikah Misyar. Some forms of this marriage have more negative effects than others, such as a man staying in another country for some work and getting married for a period of time and then ending it. This form of Nikah-e-Misyar will have more negative effects on society, whereas on the contrary, if a man or a woman living in the same country or city, due to some of their own constraints, choose this easy form of marriage and also agree to it, then this form has positive effects.

102 sayılı ILO Sözleşmesine göre aile yardımları, çocuğa bakma mükellefiyetinin kişilerin yaşam standartları üzerinde yarattığı olumsuz etkilerin ortadan kaldırılması ya da azaltılması amacıyla çocuğun bakımını üstlenen kişilere yapılan sosyal güvenlik yardımlarıdır. 102 sayılı ILO Sözleşmesi dikkate alınarak bu çalışmada aile yardımları, çocuklar göz önünde bulundurularak verilen yardımlarla sınırlı tutulmuştur. Çocuğa bakma mükellefiyetinin kapsamını; çocuğun bakımı, eğitimi ve gözetimi oluşturmaktadır. Söz konusu mükellefiyet, ebeveynlerin ayrı yaşaması halinde de devam etmektedir. Bu doğrultuda mahkemelerce belirlenen nafaka ödemelerinin nafaka ödeme yükümlüsü ebeveyn tarafından ödenmemesi halinde söz konusu ödemelere devlet tarafından aracılık edilmesi ve/ve nafaka ödeme yükümlüsünün ekonomik durumunun bu ödemeleri yapmaya imkân vermediği durumlarda söz konusu ödemelerin devlet tarafından yapılmasına yönelik yardımlar, aile yardımları sosyal güvenlik kolu kapsamına girmektedir. The literal meaning of Nafaqah is expenditure or spending. It refers to expenses related to religious obligations, family maintenance, and financial support for one's wife. In simple terms, any expenditure made from one's wealth, whether for personal use or for others, is considered Nafaqah. In Islamic jurisprudence, Nafaqah refers to the financial obligation of a husband to provide for his wife's essential needs, including food, drink, clothing, medical care, shelter, and beautification items. The obligation of Nafaqah upon the husband is firmly established through the Qur'an, Sunnah, scholarly consensus (Ijma’), and legal reasoning (Qiyas). The primary components of Nafaqah include food, drink, clothing, and housing. The amount of financial support should be sufficient for the wife's basic needs, and its standard is determined by social norms ('Urf). If both the husband and wife are wealthy, then the standard of Nafaqah should reflect a wealthy lifestyle. However, if they are poor, the Nafaqah should align with a modest standard. In cases where there is a financial disparity between the spouses, the husband's economic status will determine the level of Nafaqah. Furthermore, the husband is obligated to cover the medical expenses of his wife, as healthcare is considered a necessity. If a wife is unable to perform household duties due to illness or social status, then hiring a domestic helper is included in Nafaqah, provided that the husband has the financial capability. Likewise, the provision of adornments and beautification items is also an obligation upon the husband, but within the limits of his financial capacity. In Islamic jurisprudence, Nafaqah is recognized as one of the fundamental financial rights of a wife. This research provides an in-depth analysis of Nafaqah, highlighting the views of Islamic scholars (Fuqaha) and discussing the criteria, scope, and financial obligations of a husband. The study further clarifies that, alongside other financial and non-financial rights, Nafaqah is an essential right of a wife in Islamic law.

Tartışmalara konu olan evlilik nafakası İslam hukukunda sahih nikahla birlikte evlilik süresince erkeğe yüklenen bir sorumluluk olup iddet ile sona erdiği kabul edilmekle birlikte boşanma sonrası içinde nafaka yükümlülüğünün olabilirliği konusunda görüşler bulunmaktadır. Türk Medeni Kanunu’nun nafaka hakkını süresiz olarak düzenlemesi son dönemlerde çokça tartışılmakta ve birçok hukukçu tarafından da adil ve hakkaniyetli bulunmayarak eleştirilmektedir. İslam hukukunda boşanan bireyler arasında nafaka hakkından bahsedilmemekle birlikte erkeğin kadına ödeme yükümlülüğü altında bulunduğu bazı mali sorumluluklarının olduğu kabul edilmektedir. Dinen yasaklanmayan hususlarda sosyal adaletin sağlanabilmesi için kamu otoritesinin toplum yararı gereği yeni hükümler koyma yetkisi bulunmaktadır. This paper studies wife's right to Nafaqah in the light of selected Urdu Commentaries of the Quran and Existing Pakistani laws. It finds that there are some differences between Urdu commentaries and Pakistani law on Nafaqah, but as a whole the two are mutually exclusive. To all provision of Nafaqah is woman’s right; husband will keep the wife where he resides; he is responsible for her food and clothing. If a divorced woman asks for a wage to breastfeed the child, husband has to pay her. The wife can sue for the provision of Nafaqah and make this right possible through the law. However woman’s right to Nafaqah is due to the obedience that she voluntarily performs with her husband. If she does not remain bound to live with her husband, her right to Nafaqah will be revoked. As for the status of the husband in this regard is concerned, it will be decided keeping in view the relevant circumstances.

This research uses a qualitative method with literature data as the primary source. primary source is the book of Fath al-Qodir and Al-Muhazzab Fi Fiqh Imam Shafi'i, then the data is analysed using contents analysis. using contents analysis. The results of the study explain that the reason Hanafiyah scholars prohibit men from marrying because there is still a legal marriage bond and the husband is still obliged to provide nafafaf (maintenance) and the husband is still obliged to provide maintenance during the iddah period, so the husband cannot marry his wife's sister as in the iddah period husband may not marry his wife's sister as Allah says in Surah An-Nisa verse 23. Whereas the opinion of the Shafi'iyah scholars is that the marriage has been divorce ba'in kubra, besides that the husband does not have the obligation to provide nafaqah during the iddah period to provide maintenance during the iddah period of divorce ba'in. So it is permissible for a husband who has divorced his wife with a ba'in divorce may marry the sister of his ex-wife sister of the former wife.

For the sake of a respiratory philosophy, it makes sense to look to the East, since many Eastern traditions such as Sufism include breathwork in their somatic practices. In my paper, I aim to show how Rumi – a 13th century Muslim theologian and Sufi – used breath or nafas in his Persian poetry to outline how breathing is an originary phenomenon. My paper will take a few samples of his poetry to demonstrate how breath connotes a newness through the “gift” of life that it endows upon us, and how the creative, endowing, and primal nature of breath is linked to an openness to the Divine Other and to others. Furthermore, for Rumi, every passing breath ushers in a new existence, annihilating its older form and thus creating an ontological sense in the reader of both the finiteness of existence through what has passed and the infinite possibilities it holds when the newness arrives. Bridging the finite and infinite through breath enables us to develop a respiratory ontology that aims to conceive of dualities through an interrelated perspective. This, I wish to argue, is the true promise of Rumi’s poetry for a philosophy of breathing.

The claim for child’s nafaqah māḍiyah (past income) is often overlooked in the rulings of the Religious Court. This research aims to propose a shifting from the concept of li al-intifā’ (benefit) to li al-tamlīk (ownership) regarding child’s living costs claims in the Religious Court, employing the istihsān (juristic preference) approach. The objective is to ensure a more equitable judgment for the child. This study was conducted as a literature review using a normative juridical approach. The research findings reveal that the legal standpoint, which rejects any claim for child’s nafaqah māḍiyah in the Religious Court based on the argument that child’s living costs is categorized as li al-intifā’, contradicts Islamic legal principles regarding child’s living costs and fails to fulfill the principles of justice, as well as being incongruent with several other legislative provisions related to child protection. Therefore, this article proposes a shifting from the concept of li al-intifā’ to li al-tamlīk in determining child’s nafaqah māḍiyah in the Religious Court.

Abstract. The article considers the peculiarities of formation of the collection of educational and methodical funds of the Drawing Department of the National Academy of Fine Arts and Architecture (NAFAA). The purpose of the study is to identify the role of the custodian in the process of forming the collection; determination of special professional requirements and specific range of job responsibilities of the keeper of museum collection of the institution of higher art education by studying the history of the collection. On the basis of the study of NAFAA archival materials and conversations with employees of the Academy, the list of persons responsible for the preservation of the collection of educational and methodical funds of the Drawing Department since 1937 has been established. It was found out that the position of the person responsible for the preservation of the collection of educational and methodical funds of the Drawing Department, during second half of the 20th century and the beginning of the 21st century, had different names: Head of the drawing studyroom, Educational master, Master of industrial training, Head of the educational laboratory of the Drawing Department. People who worked with the funds mostly had higher art education (or intended to acquire it): they were practicing artists, graduates of painting, graphic arts, restoration, theory and history of art, pedagogical or architectural faculties. It was noted that the process of transferring art values took place between the responsible employees without any documentary support, and the employees themselves were changing their positions almost annually until the 1990s. It was proved that the absence of appropriate position of funds keeper in the staff schedule of the KSAI-NAFAA, which requires a professional education in art history and knowledge of museum management methods, had a negative impact on the preservation of collection. Thus, the museum, which is planned to be established under the NAFAA in the near future, should become a special structural subdivision. Along with its main activity related to the acquisition, recording, storage, conservation (preservation) and restoration of museum treasures, the NAFAA museum should perform an important educational and methodological function. To the typical duties of the Head keeper of the NAFAA museum collections there should necessarily be the requirement to know the history, methods and techniques of teaching artistic disciplines, as well as to have pedagogical experience.

Yurak va qon tomir kasalliklari (YQTK) butun dunyo bo&lsquo;ylab o&lsquo;lim darajasini yuqori belgilayotgan muhim tibbiy muammo bo&lsquo;lib qolmoqda. Bu kasalliklar nafaqat rivojlangan mamlakatlar, balki rivojlanayotgan davlatlarda ham keng tarqalgan. Ayniqsa, so&lsquo;nggi yillarda, yoshlar o&lsquo;rtasida yurak kasalliklarining o&lsquo;sishi jiddiy xavf tug&lsquo;diradi. Tibbiyot sohasidagi yutuqlarga qaramay, yurak kasalliklari hali ham insonlar hayotini sezilarli darajada qisqartiradi va hayot sifatini yomonlashtiradi. Maqolada yurak kasalliklari, ularning turlari, rivojlanish sabablarini tahlil qilib, bu kasalliklarning xavf omillari va ularni oldini olish usullari haqida kengaytirilgan ma'lumotlar keltirilgan. Shuningdek, yurak kasalliklarining davolash usullari, zamonaviy innovatsiyalar va ilg&lsquo;or tibbiy yondashuvlar taqdim etilgan. Ushbu maqola nafaqat yurak kasalliklarining muammolarini, balki kasalliklarni erta bosqichlarda aniqlash va oldini olishni ko&lsquo;zda tutgan tibbiy profilaktik tadbirlarni ham yoritadi. Jahon miqyosida yurak va qon tomir kasalliklariga qarshi kurashish nafaqat individual, balki ijtimoiy masalaga ham aylanmoqda. Kasalliklar va ularning xavf omillariga qarshi kurashishda to&lsquo;g&lsquo;ri ovqatlanish, jismoniy faollik, stressni boshqarish va zararli odatlardan voz kechish kabi profilaktik choralar muhim o&lsquo;rin tutadi. Ushbu maqola yurak kasalliklarining oldini olish, sog&lsquo;lom turmush tarzini targ&lsquo;ib qilish, shuningdek, ilg&lsquo;or diagnostika va davolash usullarini keng jamoatchilikka tanishtirishga qaratilgan.
