Abstract:
The article deals with the problem of the legislative regulation of advocacy done by the Law of Ukraine on the Bar and practice of law from 2012 and the Rules of the Bars’ ethics confirmed by the electing meeting of the Bars of Ukraine on June, 9th 2017. The structure and competence of the Ukrainian national bodies of the lawyers’ self-governance crated according to the Law from 2012 and after the requirement of the Council of Europe as a precondition of the membership of Ukraine on the European Union are also outlined. The author illustrates the main types of conflicts that a lawyer encounters during his / her professional activity like the conflict situations, conflicts and the tense conflicts and proposes the ways to reconcile them. It is shown, that the most effective ways to reconcile conflicts are compromises and negotiations. Such methods of conflict’s reconciliation often used in the lawyers’ milieu without significant positive results as the blackout of conflicts or attempts to salve them are also mentioned. Special attention is paid to the very important question of entrance of the Ukrainian Bars to the leading European and world lawyers and legal societies which became possible only after the creation of the Ukrainian National Bar Association as the national regulator in the lawyers’ profession. The author has reviewed the requirements of the Ethics Rules of European Union’s countries regarding the resolution of lawyers' conflicts with colleagues and clients, a.o. from foreign countries. The author has also analyzed the Ukrainian Ethics Rules regarding the most common conflicts in the activity of Ukrainian lawyers, in particular regarding conflicts of interest, the combination of legal practice with public, scientific and journalistic activities, as well as lawyers’ activities and communication on the Internet.

Abstract:
Introduction. The problem of Ukraine's economic development in modern conditions is directly related to the implementation of the Ukraine–European Union Association Agreement, so the national economy is facing new opportunities and challenges, including the lack of effective mechanisms to restrict timber exports. The research aimed at assessing the effectiveness of the export bans to the EU. Aim and tasks. The aim of the paper is to study the mechanisms of regulation of the timber market and their export to the EU. Results. The impact of the imposed moratorium on the declared goals is analyzed in the paper. Analyzed statistics show no effect moratorium on the reduction of deforestation and halt exports of unprocessed timber. It is also impossible to make a clear conclusion about the positive impact of the moratorium on the supply of raw materials of domestic enterprises woodworking and furniture industries. However, within the structure of Ukrainian exports, the share of products of woodworking and furniture industries has increased. This was due to the reduction of Ukrainian export volumes against the background of increasing the share of exports of timber and wood products, as well as the resumption of sales of the furniture industry. Conclusions. A study of the ban on raw wood showed that in general, the effect of the moratorium imposed is not obvious, since the number of woodworking enterprises has increased and the level of employment in these sectors has increased. Ukraine requires the adoption of a comprehensive targeted program that would combine measures to develop both the woodworking and forest industries. The national interest of Ukraine is the preservation and restoration of forests, and the moratorium introduced is an example of how partial, fragmentary unsystematic decisions are made. The practical significance of the results allows to analyze existing and find new alternative export balance, ensuring equal opportunities and non-discrimination between domestic and European Union market.

Abstract:
In this article, consideration is given to the investigation of the meaning and peculiarities of the semantic structure of the linguacultural concept MODERN LIFE functioning in modern Ukrainian worldview. Linguacultural concept is treated as a multi-layered mental formation in culture that organizes the knowledge of a certain fragment of reality in the consciousness of a certain language and cultural community. Linguacultural concept accumulates knowledge about a certain fragment of reality in the collective consciousness of a certain national language and cultural community, it is objectified by its linguistic form and marked by language and cultural specifics. The concept MODERN LIFE plays an important role in the life of every civilized man. Its significance for Ukrainian culture is grounded because it serves as one of the most important key phrases with high emotional intensity and broad associative field. Aiming to determine the main lexical means that stand for the investigated concept this research demonstrates the strong connection between language and culture and theirinfluence on each other.The article focuses on the peculiarities of the free association experiment and the receptive experiment. Associative experiment allows to reconstruct the relations of language units in the language consciousness of native speakers and to specify the peculiarities of the occurrence of these units in language consciousness. The advantage of this method is also reflected in the fact that it can reveal more distinctive features of the concept, and through the frequency of reactions to define the relevance of these features in language consciousness. The receptive experiment aims at discovering the specifics of understanding and perception of a concept, its subjective definition. It allows obtaining more information about the understanding of specific units in the process of concept verbalization. Moreover, by application of receptive and associative experiments the article aims at specifying the thematic fields in the semantic representation of the concept. The interpretation of experimental data, allowing to specify the meanings associated with the concept in the minds of Ukrainian native speakers provides the analysis of semantic modifications caused by social and political events in Ukrainian realis, history and society. Receptive and associative experiments were held with 87 Ukrainian speaking students, graduate students (81 females and 6 males) at Foreign Languages Department of Ternopil Volodymyr Hnatiuk National Pedagogical University, Ukraine. The respondents’ age was from 18 to 22.With the help of the free word association test the connections of the concept MODERN LIFE in the Ukrainian language consciousness and the semantic zones of this stimulus phrase were determined. Psycholinguistic ideas about modern life in Ukraine are manifested in the ambivalence of the components, the semantic clues of which are “technology/gadgets”, “internet/online” and “communication”. Qualitative analysis of the results of the free word association test helped to build the respondents’ images of modern Ukrainian hallmarks (borshch, EuroMaydan / Maidan and war). The linguacultural concept MODERN LIFE functioning in modern Ukrainian worldview bears negative connotation. Next, we subtracted the highest and lowest values displayed above the group of bars andmade comparison between the with the reference to results, the tallest vertical bar for the value The essential components of this concept are “self-confidence” and very close to it is “strong family”. Thus, the benefits of the methods of the experimental study of the concepts in the study of the features of the national worldview are stated in the research.

The paper substantiates the need of implementation of energy saving policy in Ukraine on the state level. The changes of the structure of national production, implementation of energy saving technology are mentioned as the way of the policy implementation, as this would lower dependence from oil and gas import and lead to economy stabilization and provide the conditions for energy safety of the country. The proposed method of energy efficiency increase for electric drives with use of group power supply from common feeder bars of direct current with capacity storage, as well as normalizing of traditional power quality indicators by means of AVI of PWM connected in the system input enable significant energy saving on the national scale.

Abstract:
The signing of the Association Agreement by Ukraine with the European Union and its member-states provides for the country a perspective of its integration in the Union with possible membership in it upon the creation of the free trade area between both partners. The realization of the Association Agreement is carried out on the international and national levels and is exercised by various means-accessions by Ukraine to international treaties, making national laws consistent with legal acts of EU institutions, recognition by Ukraine of national standards of EU Member States, mutual recognition of rules of the other side etc. The effective using of implementation legal tools requires from Ukraine establishing the proper and relevant legal background. Certain prerequisites for the application of the EU law into the Ukrainian legal framework have been existed. Nevertheless, they require be improving and reforming. The legal mechanism for implementing acts of association is still unsettled. It is related to the Council and the Committee of the association decisions. The corresponding mechanism in Ukraine has not been set up. It has the same concern with the European standards. Ukraine has to transpose the array of technical regulations as national standards with the conformity with EU legislation. However, it is not clear how this will be achieved. The article is focused on the analysis of the legal bases of the interaction of the European Union law and the Law of Ukraine. Specially elucidated the questions of the correlation of the EU law and the law of Ukraine, as well as the actual means of the implementation of the EU law in the legal order of Ukraine. The ways of the improvement of the legal mechanism of the realization of the EU law in the internal legal order of Ukraine are determined. There is emphasized that integration of Ukraine into the European Union will require important amendments into Ukrainian Constitution and other national legislation to provide the legal prerequisites for the realization of the EU law in the internal legal order of Ukraine. Special attention is paid to the means of implementation of international legal obligations in Ukraine.

Abstract:
The article is devoted to the history of the formation and activity of one of the first in the history of independent Ukraine public organizations of the national Greek community, i.e. the Kyiv City Association of the Greeks. After all, in today’s world, public associations of national minorities are an extremely important structural component of the civil society, which can play both a consolidating role and serve as a source of aggravation of interethnic conflicts. The grounds of the source base of the research were the materials of the current archive of this organization (the Statute, protocols of meetings, resolutions, agreements, etc.), part of which in 2017 was already transferred to the funds of the Central State Archives of public associations of Ukraine. However, up to now, these documents have not become available yet to the general public concerned. Taking this into consideration, we find it appropriate to publish some of them in the full volume as an annex to this research, especially those that most clearly highlight the main achievements of the organization in the development of national and cultural life of the Greek community of Kyiv and Ukraine in general, and show the dynamics of the establishment of the Ukrainian-Greek intercultural dialogue. Important information on the activity of the Kyiv City Association of the Greeks is found on the pages of its printed edition, the newspaper “Elpida”, as well as on the organization site operating since 2016. The importance of recording and systematization of information on the current institutional development of national minorities in Ukraine is preconditioned by the necessity to form a conscious evaluation of the role of associations of national minorities in the process of forming public associations and the establishment of national Ukrainian culture in opinion of public and scientific communities.

Abstract:
The article is devoted to the analysis of the legal nature of the implementation mechanism of the EU-Ukraine Association Agreement in the legal order of Ukraine as well as coordination mechanism of its implementation. It is noted that the principles and provisions enshrined in the Association Agreement become the integral part of the contemporary legal order of Ukraine. Nevertheless, due to the peculiarities of the Agreement, Ukrainian authorities introduced special implementation coordination mechanism. It is pointed out that all major central authorities are included in the implementation mechanism and the Government Office for the Coordination of European and Euro-Atlantic Integration being on the forefront of these activities. It is underlined that the amendments introduced to the Constitution of Ukraine in 2019 played the unprecedented significance for the implementation of the Association Agreement. These amendments provided for inevitable foreign policy course of Ukraine for European and EuroAtlantic integration. Special attention is paid to the challenges that authorities are facing in the process of preparation for the implementation of the Agreement. The idea of National Implementation Program’s (NIP) development was supported and the proposals were made regarding the policy issues that need to be included into the NIP.

Abstract:
This article looks at the first phase of the implementation and application of the EU-Ukraine Association Agreement, which triggered unprecedented political, economic and legal reforms in Ukraine. In particular, the article focuses on the constitutional challenges that have arisen for Ukraine in the course of implementing the Association Agreement into its legal system. Two issues form the focus of consideration in the article. The first issue is effective implementation and application of the Association Agreement within the Ukrainian legal order. The second issue is compatibility between the Association Agreement and the Ukrainian Constitution. The latest political and legal developments in Ukraine are analyzed through the prism of effective implementation of the Association Agreement and the rise of pro-European judicial activism in Ukraine. In conclusion it is argued that the EU-Ukraine Association Agreement enhanced the adaptability of the national constitutional order to the European integration project and European common values.

Abstract:
La déontologie des avocats émane-t-elle d’eux à raison des nécessités de l’exercice ou des autorités politiques parce qu’elle touche une tâche régalienne ? La France a peu hésité. S’inspirant notamment de THEODOSE puis JUSTINIEN, empruntant aux carolingiens et à la chevalerie une morale religieuse, les rois à compter de Saint LOUIS ont légiféré d’autant que la naissance des juridictions royales à la fin du XIIIème siècle stabilise le rôle et le titre de l’avocat. Les coutumes et les « stiles » complètent ce dispositif. Ces principes (loyauté, indépendance, respect) se transformeront au cours des époques en « usages ». Tant que l’avocat est un membre de l’institution judiciaire ayant vocation d’en devenir un cadre la déontologie reposait sur un consensus. La vénalité des charges lui ôtant cette promotion, le transforme en simple « auxiliaire », rétif aux injonctions au point de fomenter d’improbables grèves. Imprégné de la grandeur fantasmée de ses ancêtres antiques il préfère consolider son rang social (noblesse, préséance). A partir de LOUIS XIV la déontologie se fige. La Révolution balaie cet héritage multiséculaire. Pressés par les concepts de liberté et de gratuité les constituants, majoritairement avocats, suppriment la profession et les Parlements honnis. Des « défenseurs officieux », souvent sans foi ni loi, se substituent aux avocats. La déontologie disparut pendant vingt ans. Rétablis avec réticence par NAPOLEON, ces « factieux » lutteront tout le XIXème contre l’Etat pour la maîtrise des « usages » fragilisant un peu plus ceux-ci déjà traversés par les courants sociétaux (émancipation, nationalité). Le décret de 1920 régla cette situation qui faillit engloutir les Ordres. Jamais plus jusqu’en 1971 les avocats ne participeront à la définition de leurs règles. Tout au plus une association (ANA) fera avec succès des propositions. Les guerres illustrèrent le pouvoir d’intervention du Prince dans la déontologie en la suspendant, l’aménageant en profondeur (interdiction des juifs) ou en créant des institutions pérennes (CAPA). La France Libre conserva de Vichy tout ce qui ne heurtait pas des principes fondamentaux. Les années 54/57 introduisirent des modifications libérales (droit de manier des fonds, de s’associer, de réclamer des honoraires impayés). Il est un endroit où l’Etat n’a pas renoncé à l’avocat fonctionnaire : l’outre-mer. L’Algérie mise à part, « prolongement naturel de la France », dans les autres pays sous domination française, dans un désordre total, sans cette unité rêvée, la France a, dans l’indifférence des Ordres, créé une paradéontologie évoquant vaguement l’avoué. En dépit d’une prolifération législative la France n’a pas plus réussi à imposer une déontologie universelle. Usant de procédés imaginatifs renouvelés, les gouverneurs ont, principe de réalisme oblige, tout inventé pour sauver un système notoirement défaillant jusqu’à l’inadmissible (interdiction de plaider pour les indigènes). Dans les années 1930/1936 la République se résolut à instaurer des « barreaux libres », grosso modo calqués sur ceux de métropole, tentative libérale sans lendemain à raison de la guerre puis des conflits de décolonisation. Il faudrait réserver un sort à part à l’Algérie, « prolongement naturel de la France ». La Loi du 31 décembre 1971 en créant un « avoué plaidant » redouté par les caciques a initié une réforme profonde du rôle de l’avocat et posé ainsi les jalons d’une évolution ultérieure de la déontologie (institution d’une représentation nationale -CNB, octroi à celle-ci du pouvoir législatif en la matière). C’est néanmoins sans les avocats que fut publié le décret de déontologie en 2005. Une déontologie aussi linéaire s’explique par le souci pour le Prince d’assurer jusqu’à l’infini détail la perfection de sa mission de juger, une métaphysique du parfait. La marchandisation du droit, l’extension du domaine de l’avocat, l’industrialisation des acteurs contrarient cet objectif. La France tranchera-t-elle enfin ?
Is ethics of lawyers emanating from them because of the necessities of its exercise or from the political authorities because it touches a sovereign task? France has not hesitated. Inspired in particular by THEODOSIUS and JUSTINIAN, borrowing Carolingians and chivalry religious morals, kings from St. Louis have legislated especially as the birth of royal courts at the end of the thirteenth century stabilized the role and title of the lawyer. The customs and the "stiles" completed this device. These principles (loyalty, independence, respect) will change over time into "uses". As long as the lawyer is a member of the judicial institution with a vocation to become executive, the deontology was based on a consensus. The venality of the offices depriving him of this promotion, transforms him into a simple "auxiliary", wayward to the point of stirring unlikely strikes. Impregnated with the fantasized grandeur of his ancestors in the antiquity he prefers to consolidate his social rank (nobility, precedence). From LOUIS XIV the deontology (ethics) freezes. The Revolution sweeps away this multisecular heritage. Pressed by the concepts of freedom and gratuitousness, the constituents, mostly lawyers, suppress the profession and the parliaments that are being hated. "Unofficial defenders", often without faith or law, take the place of lawyers. Ethics disappeared for twenty years. Reluctantly reinstated by NAPOLEON, these "factious" struggle all the nineteenth against the state for the control of "uses" weakening them (already in butte to societal currents: emancipation, nationality) a little more. The decree of 1920 settled this situation, which almost engulfed the Orders. Never again until 1971 will lawyers participate in the definition of their rules. At most one association (ANA) will make successful proposals. The wars illustrated the Prince's power of intervention in deontology by suspending it, overhauling it (prohibiting Jews) or creating permanent institutions (CAPA). “France Libre” preserved from Vichy everything that did not conflict with fundamental principles. The years 54/57 introduced liberal modifications (the right to wield funds, to associate, to claim unpaid fees). It is a place where the state did not give up to make the lawyer a civil servant: overseas. Except for Algeria, a "natural extension of France", in other countries under french domination, in a total disorder, far from its dreamed unity, France has, in the indifference of the bar associations, created a paradeontology vaguely evoking the “avoué”. Despite a legislative abundance, France has no more succeeded in imposing a universal code of ethics. Using renewed imaginative processes, the governors have, as required by a principle of realism, all invented to save a notoriously failing system until the inadmissible (prohibition to plead for the natives). In the years 1930/1936 the Republic resolved to establish "free bars", roughly modeled on those of metropolis, a liberal attempt without a future because of the war and the conflicts of decolonization. The Law of December 31, 1971 creating a "pleading-solicitor" dreaded by the caciques initiated a profound reform of the role of the lawyer and laid the groundwork for a subsequent evolution of ethics (institution of a national representation -CNB granting it legislative power in this area). It was nevertheless without the lawyers that the decree of ethics was published in 2005. Such a linear deontology is explained by the concern for the Prince to ensure to the infinity detail the perfection of his mission to judge, a metaphysics of the perfect. The commodification of the law, the extension of the field of the lawyer, the industrialization of the actors contradict this objective. Will France finally decide ?

The results of public opinion survey of Kharkiv region residents on public safety and trust in law enforcement conducted by Kharkiv National University of Internal Affairs (Research Lab on Crime Enforcement) together with the Sociological Association of Ukraine, Kharkiv Regional State Administration and the Main Directorate of the National Police are presented. in the Kharkiv region in 2013–2021. The key indicators of the efficiency of law enforcement agencies of Kharkiv region and the problems of law enforcement activities at the local level from the public point of view are analyzed, the expectations of local residents from law enforcement agencies are determined, the problems of interaction with the police are considered. The publication contains empirical data and practical recommendations designed to implement specific tasks in the work of the police and other law enforcement agencies for the needs of the local community.

Abstract:
The results of sociological monitoring of the spread of addictive behavior among young people in Kharkiv "Youth and Drugs" and the results of the student module of Ukrainian Longitudinal study (ULS+) are presented. The "Youth and Drugs" study conducted since 1995 by the Kharkiv National University of Internal Affairs together with the Sociological Association of Ukraine with the support of the Department of Science and Education of Kharkiv Regional State Administration. The key indicators of drug, alcohol and tobacco use and misuse among young people, the prevalence of gambling, computer and Internet use, the structure of youth leisure, bullying, suicidal behavior, mental and behavioral disorders, etc. were analyzed. For educators, law enforcement, physicians, scientists and anyone interested in the prevention of addictive behavior.

This chapter discusses how a continuing belief in the power of radio to change people's lives shapes Prison Radio Association (PRA) activity. The impact of National Prison Radio (NPR) for people in prison is demonstrated through annual audience increases and listener feedback. Yet, from the outset, the PRA has recognised the need to develop some kind of continuation service for people leaving prison. Each year, more people are locked up in prisons around the world, with increasing numbers returning to prison in a cycle of reoffending. The chapter also shows how imprisonment serves to exacerbate the complex disadvantage that leads to criminalisation, separating people even further from any preexisting support networks.

This chapter examines a partnership project in the West Midlands region which developed prison radio beyond Radio Feltham. It particularly analyses the role of the BBC in the process and the impact of the activity on establishing and formalising the Prison Radio Association (PRA). Developed through the combined influence of national broadcaster and independent prison radio activity, the chapter argues that the PRA is representative of new forms of Public Service Broadcasting (PSB) within changing media and institutional environments, achieved in partnership, and demonstrating the enduring importance of PSB values. It is evident that the partnerships and relationships forged during this period played a major role in the establishment and ongoing development of the PRA.

Abstract:
Internationalization has become a subject of global interest and global geographical coverage. In order to develop a National Internationalization Strategy of Ukraine, it is necessary to take into account trends and patterns in the global market of international education services. The aim of this article is to examine national policy of Ukraine for higher education internationalization, consider issues of foreign students’ study in Ukraine and give recommendations for National Internationalization Strategy development. To achieve the above aim, several methods have been used, including internet search, analysis, systematization of evident information. The European vector for developing Ukraine has been confirmed by the accession to the Bologna Process (2005) and Association Agreement between the European Union (EU) and Ukraine (2014). Basis for higher education internationalization (Bologna instruments and legislative documents) have been analyzed. The goals and tasks of the Ukrainian State Center for International Education of the Ministry of Education and Science of Ukraine (the official state source of information on the education of foreign students in Ukraine) are presented. Statistical data from Development Strategy of the state enterprise “Ukrainian State Center for International Education for 2021–2025” prove the increase of foreign students in Ukraine. SWOT analysis of the higher education internationalization in Ukraine revealed strengths, weaknesses, opportunities and threats of higher education internationalization. The current state of higher education internationalization in Ukraine is also clarified by the results of PESTL analysis identifying Political, Economic, Social, Technological, and Legal aspects of the external environment that affect this process. It is stated that Ukraine faces the following challenges concerning academic mobility: insufficient / no funding; non-recognition of degrees / diplomas; unsatisfactory level of foreign language proficiency; inappropriate educational programs / training organization; legal issues; lack of information and encouragement; personal problems of students. The degree of involvement of scholars and academics in international cooperation is very low. The main aspects for the National Internationalization Strategy in Ukraine and their content components are highlighted as following: worldview and value aspect (mission, vision, values, principles); organizational and resource aspect (goals and objectives, approaches, methods, tools, forms, mechanisms, organizational structure and functions, resources); regulatory and legal aspect (legislative regulation: tools for recognition, implementation of mobility, introduction of joint educational programs, mechanisms for ensuring the quality of higher education). It is recommended to develop National Internationalization Strategy; to involve foreign experts for the accreditation of Ukrainian educational programs and participate in the accreditation of foreign educational programs; to develop the Ukrainian rating of universities taking into account indicators of internationalization: foreign students; foreign academics in the Ukrainian universities; publications in foreign scientific journals; joint educational programs / research.

Abstract:
This contribution looks at the application of EU case law by the Ukrainian judiciary in the course of implementation of the EU–Ukraine Association Agreement, which triggered unprecedented political, economic, and legal reforms in Ukraine. Several issues form the focus of consideration in the chapter. The first issue is the evolution of EU–Ukraine relations and reform of the Ukrainian legal system and judiciary in the course of the ‘Europeanization’ of Ukraine since its independence in 1991. The second issue is effective implementation and application of the EU–Ukraine Association Agreement within the Ukrainian legal order and its compatibility with the Ukrainian Constitution. The latest political and legal developments in Ukraine are analysed through the prism of effective implementation of the EU–Ukraine Association Agreement and the rise of pro-European reforms of the Ukrainian judiciary since the ‘Maidan Revolution’/‘Revolution of Dignity’ in 2014. In conclusion, it is argued that the EU–Ukraine Association Agreement enhanced the adaptability of the national constitutional order to the European integration project and reinvigorated judicial activism by Ukrainian judges to refer to the case law of the Court of Justice of the European Union (CJEU).

It places the National Loan in the context of previous popular political fundraising campaigns in Ireland, such as Daniel O’Connell’s Catholic Rent and Repeal Rent, the fundraising efforts of John Redmond’s Irish Parliamentary Party via the United Irish League, of the Ulster Volunteers, the Irish National Aid Association and Volunteers’ Dependents Fund, and the Anti-Conscription Fund. It shows how a drop in domestic funding presaged the Irish Parliamentary Party’s defeat in the 1918 general election. It also places the Dáil’s fundraising efforts alongside those of its contemporary self-proclaimed nation states in Lithuania, Georgia, and West Ukraine.

Subject of study. The published article is determined for studying such a question as arising in the field of criminal law and criminal procedure protection of the rights of lawyers and representatives of persons guaranteed by the Constitution and legislation of Ukraine to carry out professional independent activity. The current state of social and legal relations in this area, the problems that exist in the field of handing lawyers and representatives of persons, the circumstances that led to their emergence and possible solutions. Methodology. In this study, the authors used the logical method, the method of semantic analysis, as well as the comparative law method. The purpose. The purpose of this article is analyzing the feasibility of transferring a criminal offense, which іs provided by Article 397 of the Criminal Code of Ukraine, from the category of crimes to the category of misdemeanors from the point of view of the impact of this transfer on the state of protection of the defenders’ or representatives’ of the person lawful activity of legal assistance from interference. The authors consider all types of defenders in the criminal and the administrative proceedings. The authors consider all types of representatives of the person and legal representatives of the person in the criminal, the administrative, the civil, the commercial proceedings. The authors concluded that advocates are best suited to engage in the defenders’ and representatives’ lawful activity of legal assistance, because only advocates have most of the rights and guarantees that ensure the lawful activities of defenders’ and representatives’ lawful activity of legal assistance. As part of this study, official statistics on criminal offenses in the field of interference in the activities of a lawyer or a representative of a person and the results of their investigation were obtained and investigated, which together determine the existence of problems in this area. The article considers and analyzes a number of existing determinants that lead to an increase in the quantitative characteristics of criminal offenses, the object of which is the professional activity of defenders and representatives of persons. The authors reviewed all the opportunities provided by law to interfere in the defenders’ and representatives’ lawful activity of legal assistance. The authors concludes on the circumstances that lead to interference in the lawful activities of a defender or a representative of a person, namely: insufficient attention of the state to address problems in this area; law enforcement officers and court employees have the preferential opportunity to violate the legal rights and guarantees of advocates during their official activities, and, in particular, the recent legislative definition of interference in the the defenders’ and representatives’ lawful activity of legal assistance as an offense with a very low level of public danger. Сonclusion of the study. Therefore, the authors propose to transfer the misdemeanors, which are provided for in Part 1 and Part 2 of Article 397 of the Criminal Code of Ukraine, to the category of crimes by adding to the sanctions of Part 1 and Part 2 of Article 397 of the Criminal Code of Ukraine, imprisonment for up to three years as an alternative main punishment. Practical implications. This proposal can be used by the National Association of Advocates of Ukraine to develop measures to strengthen the responsibility for violating the guarantees of advocacy. Value/originality. This study is an оriginal proposal to solve the current problem of the interference in the defenders’ and representatives’ lawful activity of legal assistance, after transfer of criminal offense, which іs provided by Article 397 of the Criminal Code of Ukraine, from the category of crimes to the category of misdemeanors.

Abstract:
The European Nuclear Education Network (ENEN) was established in 2003 through an EU Fifth Framework Programme (FP) project, as a legal nonprofit-making body. Its main objective is the preservation and further development of expertise in the nuclear fields by higher education and training. This objective is realized through the cooperation between EU universities involved in education and research in nuclear disciplines, nuclear research centers and the nuclear industry. As of March 2018, ENEN has 66 members in 18 EU countries and has concluded Memoranda of Understanding (MoU) with partners beyond Europe for further cooperation, including organizations in, Russian Federation, Ukraine, Canada and Japan. ENEN also has good collaboration with national networks and international organizations such as the Belgian Nuclear Education Network (BNEN) and the International Atomic Energy Agency (IAEA). The main activities developed, and results achieved, within the first 15 years of the ENEN Association are presented and discussed. These include, for example, the launch of the European Master of Science in Nuclear Engineering (EMSNE), the annual ENEN Ph.D. competition and the portfolio of more than 10 EURATOM projects dealing with nuclear education, training and knowledge management through development of teaching methods and materials, courses, and exchange of students and teachers within EU and beyond. Those projects were all supported by the European Commission with the ENEN Association acting as the coordinator or as a partner.

Abstract:
Harlequin ducks (Histrionicus histrionicus) are sea ducks that migrate inland each spring to nest along fast-flowing mountain streams. They are considered one of the most imperiled duck species in North America and occur in two distinct populations on the Atlantic and Pacific coasts. The Pacific coast population includes Washington State, where harlequin ducks breed in the Olympic, Cascade, and Selkirk Mountains. This species is designated as a Management Priority Species by the National Park Service within North Cascades National Park Service Complex (NOCA). This report summarizes harlequin duck surveys conducted during 15 years across a 27-year period (1990 and 2017) on major streams within NOCA, and incidental observations collected from 1968–2021. The primary objectives of these surveys were to 1) document the distribution and abundance of harlequin duck observations within NOCA boundaries, 2) describe productivity (number of broods and brood size), 3) describe breeding chronology of harlequin ducks, and 4) describe habitat characteristics of breeding streams. Sixty-eight stream surveys over 15 years resulted in observations of 623 individual harlequin ducks comprising various demographics, including single adults, pairs, and broods. In addition, we collected 184 incidental observations of harlequin ducks from visitors and staff between 1968–2021. Harlequin ducks were observed on 22 separate second- to sixth-order streams throughout NOCA across the entire 53-year span of data, both incidentally and during harlequin duck surveys by Park staff. Harlequin ducks were detected on 8 of the 13 streams that were actively surveyed. Excluding recounts, 88.7% (n = 330) of individual harlequin duck observations during surveys occurred in the Stehekin River drainage. Between all surveys and incidental observations, 135 unpaired females without broods were sighted across all NOCA waterways. Thirty-nine broods were recorded between NOCA surveys and incidental observations, with a mean brood size of 3.61 (± 1.44 SD; range = 2–10). Breeding pairs were recorded as early as April 5 and were seen on streams until June 15, a period of less than seven weeks (median: May 2), but most pairs were observed within a 3-week span, between April 26 and May 17. Single females (unpaired with a male, with (an)other female(s), or with a brood) were observed on streams between April 26 and August 25 (median: July 3), though most observations were made within a 5-week period between June 12 and July 19. Habitat data collected at adult harlequin duck observation sites indicate that the birds often used stream reaches with features that are characteristic of high-energy running water. While adults occupied all instream habitat types identified, non-braided rapids and riffles were used most frequently, followed by pools and backwaters. Larger instream substrate sizes (cobbles and boulders) were present at most observation sites. Adult harlequin ducks were more often found at locations that lacked visible drifting or lodged woody debris, but drift debris was a slightly more abundant debris type. The presence of gravel bars and at least one loafing site was common. Adult harlequin ducks were more often observed in association with vegetation that offered some cover over the channel, but not where banks were undercut. The average channel width at adult observation sites was 34.0 m (range: 6-80 m; n = 114) and 27.6 m (± 15.7 m; range: 10-60 m; n = 12) at brood observation sites. Compared to adult harlequin duck sites, broods were observed more frequently in low velocity habitat (pools, backwaters), but rarely in rapids. Cobble and boulder substrates were still the most dominant substrate type. Contrary to adult ducks, broods were observed most often observed in meandering stream channels, a morphology indicative of low gradient, low velocity stream reaches. Abstract:
In the article investigational three magazines which went out after Second World war in Germany and Austria in the environment of the Ukrainian emigrants, is «Theater» (edition of association of artists of the Ukrainian stage), «Student flag» (a magazine of the Ukrainian academic young people is in Austria), «Young friends» (a plastoviy magazine is for senior children and youth). The thematic structure of magazines, which is inferior the association of different on age, is considered, by vital experience and professional orientation of people in the conditions of the forced emigration, paid regard to graphic registration of magazines, which, without regard to absence of the proper publisher-polydiene bases, marked structuralness and expressiveness. A repertoire of periodicals of Ukrainian migration is in the American, English and French areas of occupation of Germany and Austria after Second world war, which consists of 200 names, strikes the tipologichnoy vseokhopnistyu and testifies to the high intellectual level of the moved persons, desire of yaknaynovishe, to realize the considerable potential in new terms with hope on transference of the purchased experience to Ukraine. On ruins of Europe for two-three years the network of the press, which could be proud of the European state is separately taken, is created. Different was a period of their appearance: from odnogo-dvokh there are to a few hundred numbers, that it is related to intensive migration of Ukrainians to the USA, Canada, countries of South America, Australia. But indisputable is a fact of forming of conceptions of newspapers and magazines, which it follows to study, doslidzhuvati and adjust them to present Ukrainian realities. Here not superfluous will be an example of a few editions on the thematic range of which the names – «Plastun» specify, «Skob», «Mali druzi», «Sonechko», «Yunackiy shliah», «Iyzhak», «Lys Mykyta» (satire, humour), «Literaturna gazeta», «Ukraina і svit», «Ridne slovo», «Hrystyianskyi shliah», «Golos derzhavnyka», «Ukrainskyi samostiynyk», «Gart», «Zmag» (sport), «Litopys politviaznia», «Ukrains’ka shkola», «Torgivlia i promysel», «Gospodars’ko-kooperatyvne zhyttia», «Ukrainskyi gospodar», «Ukrainskyi esperantist», «Radiotehnik», «Politviazen’», «Ukrainskyi selianyn» Considering three riznovektorni magazines «Teatr» (edition of Association Mistciv the Ukrainian Stage), «Studentskyi prapor» (a magazine of the Ukrainian academic young people is in Austria), «Yuni druzi» (a plastoviy magazine is for senior children and youth) assert that maintenance all three magazines directed on creation of different on age and by the professional orientation of national associations for achievement of the unique purpose – cherishing and maintainance of environments of ukrainstva, identity, in the conditions of strange land. Without regard to unfavorable publisher-polydiene possibilities, absence of financial support and proper encouragement, release, followed the intensive necessity of concentration of efforts for achievement of primary purpose – receipt and re-erecting of the Ukrainian State.
