COORDENAÇÃO DE APERFEIÇOAMENTO DO PESSOAL DE ENSINO SUPERIOR<br>O Tribunal Europeu de Justiça começou sua trajetória como um tribunal internacional bastante fraco que sofria dos mesmos problemas enfrentados por outras instituições da mesma natureza. Assim, a questão crucial a ser respondida é como o Tribunal foi capaz de alterar os fundamentos do sistema jurídico comunitário, fortalecendo as bases de seu próprio prestígio político. O procedimento de reenvio prejudicial, criado pelo artigo 177 do Tratado de Roma, estabelece um vínculo direto entre os tribunais nacionais e o Tribunal Europeu, atruindo aos primeiros a responsabilidade pela aplicação das decisões do último. Isso siguifica que todas as sanções previstas pelo direito nacional podem ser aplicadas aos julgamentos do Tribunal Comunitário. Devido ao apoio dos tribunais nacionais, a maior ameaça política ao Tribunal Europeu - a ameaça da desobediência - foi em grande medida superada.<br>The European Court of Justice began as a fairly weak international tribunal, suffering from many of the problems faced by institutions of the same nature. So the crucial question to be answered is how the Court was able to change the foundations of theCommunity legal system, thus strengthening the bases of its own political prestige. The preliminary ruling procedure created by the Article 177 of the Treaty of Rome establishes a direct link between the national courts and the European Court, ascribing to the former the responsibility for the application of the decisions of the latter. lt means that all sanetions available under national law can be applied to the European court judgements.

Abstract:
This study seeks to provide a comprehensive analysis of the advisory role of the International Court of Justice in light of its jurisprudence and overall contribution over a period of more than 55 years. The last comprehensive study of the ICJ's advisory jurisdiction was published in 1973. Since then, there have been 11 more advisory opinions, some covering areas of great contemporary importance such as decolonisation, legal issues arising from the possession and possible use of nuclear weapons and international legal aspects of the Israeli Palestinian conflict. This thesis attempts to update previous work on the subject and also to reexamine the function of the advisory jurisdiction in light of these more recent opinions. The thesis highlights the "organic connection" between UN organs and the Court and the Court's contribution as one of the UN's principal organs to the Organisation. The basic argument of this thesis is that the advisory function should be understood as a two-sided process involving the interplay between UN organs and the ICJ. The request for and the giving of an advisory opinion is a collective coordinated process, involving more than one organ or part of the Organisation. Consequently, each must be mindful of the need for some degree of restraint. The collective commitment to achieving the purposes of the Charter should be the ultimate goal for all organs. The study concludes that the Court's role as a participant in the UN's work is circumscribed by its duty to act judicially. In practice, the Court has succeeded in establishing a balance between its role as a principal organ of the UN and its position as a judicial institution with a duty to administer justice impartially. Lastly, the study emphasises that since the San Francisco Conference the advisory function has proved to be a successful instrument for providing authoritative legal opinions that aid the UN in carrying out its functions. The advisory opinions rendered by the Court and by its predecessor, the PCU, have actually gone beyond the expectations of the founders of these Courts, particularly in terms of their contribution to International Law. Yet, as this thesis suggests, the advisory function can still be improved.

Abstract:
The present thesis deals with the projected Arab Court of Justice (ACJ) as a regional court, expected to be created within the League of Arab States system. Chapter one deals mainly with the basic structure of the League of Arab States itself, its membership, its organs, the settlement of disputes, and the reasons that are delaying the creation of the ACJ and the role it will be expected to play in settling inter-Arab disputes. In the second chapter comprehensive information on the function of the judicial power in Islamic Shariah is presented, including the status of judges in Islam, their appointment, qualifications, independence and other issues related to them. Chapter three concentrates on the organisation of the projected ACJ, comparing its draft Statute with the Statute of the International Court of Justice (ICJ) and other regional international courts. The chapter will also show how far the Arab draftsmen have been influenced by principles and rules of Islamic Shariah, especially in matters relating to the qualification of judges. Furthermore, the chapter will discuss other points related to the organisation of the bench such as nomination of candidates, system of election, constituting chambers, appointing ad hoc judges etc. The fourth chapter explains in detail at the level of theory as well as of practice the role of Islamic Shariah as a source to be applied by the projected ACJ. The chapter points to the need to discuss the origins and fundamental conceptions of Islamic Shariah as a law capable to be applied by the projected ACJ. Chapter five continues with a discussion of the jurisdiction of the ACJ, and makes detailed reference to the concepts of jurisdiction ratione personae, ratione materiae and the function of the ACJ to give advisory opinions. The thesis considers whether the Arab drafters have developed the above terms or have simply adopted them as they exist in the Statute of the International Court of Justice. The conclusions summarise the findings of the Thesis, and are accompanied by some critical remarks.

This paper analyses the international obligation of solving disputes peacefully and the International Court of Justice role as a jurisdictional means of the United Nations in solving disputes. From this point, it analyses the Court role in the last years and its work solving territorial and maritime disputes, for example, the one between Peru and Chile. It presents an interesting study of the international obligations that led Peru and Chile solve the dispute peacefully and the advantages and disadvantages of it. Finally, it presents the main challenges that arise from turning to the International Court of Justice.<br>El artículo analiza la obligación internacional de solucionar pacíficamente las controversias y el papel de la Corte Internacional de Justicia como medio jurisdiccional de las Naciones Unidas en la solución de dichas controversias. A partir de ello, analiza el papel de la Corte en los últimos años y su labor en la resolución de disputas territoriales y marítimas, como la que surgió entre Perú y Chile. Se presenta un interesante estudio de las obligaciones internacionales que llevaron a Perú y Chile a solucionar pacíficamente la disputa así como las ventajas y desventajas de este medio. Finalmente, se exponen los principales retos que surgen al acudir a la Corte Internacional de Justicia.

Le Traité sur l’Union Européenne assigne à la Cour de Justice la mission de veiller au respect du droit dans l’application et l’interprétation des traités. A ce titre, elle interprète le droit de l’Union de manière à garantir une application uniforme du droit dans tous les Etats membres. De même, la Cour Commune de Justice et d’Arbitrage (CCJA) est chargée, conformément au Traité relatif à l’Organisation pour l’Harmonisation en Afrique du Droit des Affaires (OHADA), d’assurer dans les Etats Parties, l'interprétation et l'application communes du droit uniforme. Ces cours de justice partagent avec les juridictions nationales l’application judiciaire du droit né des traités. Mais les traités n’ont pas réalisé une fusion du système juridictionnel qu’ils ont créé avec celui des Etats membres et, une hiérarchie juridictionnelle n’a pas été établie entre la Cour de justice et les juridictions nationales. Se pose alors la question des moyens par lesquels ces cours de justice arrivent à imposer une application uniforme du droit dans les Etats membres. Après analyse, on relève qu’à travers l’attribution des pouvoirs juridictionnels, les traités ont conféré une autorité supranationale à la Cour de justice européenne et la Cour de justice de l’OHADA. En plus de cette autorité conférée qu’elles ne se contentent pas d’entretenir à l’égard des juridictions nationales, elles génèrent aussi de l’autorité dans le cadre de leur activité juridictionnelle. Ainsi, ces cours œuvrent pour une meilleure intégration régionale. De leur propre gré, elles n’hésitent pas à adopter des positions impérieuses de plus en plus conquérantes. Ce phénomène fait donc évoluer la conception classique des sources de l’autorité de ces cours. La CCJA bénéficie des prérogatives les plus offensives d’origine textuelle, au contraire de la Cour de justice européenne qui, quant à elle, apparaît plus conquérante dans sa jurisprudence<br>According to the treaty on the European Union, the Court of justice ensures that, in the interpretation and application of the treaties the law is observed. As such, it interprets EU law to make sure it is applied in the same way in all EU countries. In the same way, the treaty of the Organization for the Harmonization of the Business Law in Africa (OHBLA) has conferred to the Common Court of Justice and Arbitration (CCJA) the power to rule on, in the contracting states, the interpretation and enforcement of the treaty. Both regional courts share with national courts the power to apply the law resulting from the treaties.But there has not been a fusion of the judicial system of the member states and the community judicial system. No judicial hierarchy has been established between community courts and national courts. This brings the question of by which means the regional courts can enforce the uniform application of the law in the member states. After analysis, it appears that by granting jurisdictional power, the treaties gave a supranational authority to the European Court of Justice and the CCJA. In addition to the power granted to them, the courts also generate authority through their jurisdictional activities. Thus, the courts work for a better integration of the judicial systems by adopting more and more conquering authoritarian positions. This phenomenon has led to a change in the classical conception of the sources of power of the courts. The CCJA enjoys more power from treaties than the European Court of Justice which is more offensive in case law setting

L’effectivité de l’accès aux instances de l’asile dépend de la réunion de plusieurs facteurs qui ne viennent pas uniquement du droit national. La condition sine qua non de l’effectivité d’un tel accès est une réception harmonieuse par les différents Etats, des garanties procédurales indispensables à celui-ci et définies au niveau européen, ce qui suppose toutefois une relation équilibrée entre le droit conventionnel et le droit de l’Union, construite dans un esprit de dialogue. Dans l’établissement de ce dialogue, le législateur de l’Union, tout comme la Cour européenne des droits de l’Homme et la Cour de justice de l’Union européenne jouent un rôle primordial, et si ce dialogue s’avérait dissonant, le droit national pourrait encore corriger les insuffisances ainsi constatées. Certes, à cette fin, il est nécessaire d’établir un dialogue également au niveau national, et ce, non seulement avec les instances européennes mais aussi à l’intérieur de l’Etat entre les autorités administratives et juridictionnelles. In fine, l’effectivité de cet accès est tout autant indispensable dans une dimension transfrontalière afin de rapprocher davantage les législations nationales et de proposer une solution européenne aux problèmes structuraux et systémiques caractérisant cet accès<br>The effectiveness of access to asylum bodies depends on a combination of several factors which are not derived solely from national law. The sine qua non of the effectiveness of such access is a harmonious reception by the various Member States of the procedural guarantees essential to it and defined at European level, which presupposes, however, a balanced relationship between ECHR law and Union law built in a spirit of dialogue. In establishing this dialogue, the EU legislator, like the European Court of Human Rights and the Court of Justice of the European Union, plays an essential role, and if this dialogue were to prove dissonant, national law could still correct any shortcomings thus noted. To this end, it is certainly necessary to establish a dialogue also at national level, not only with the EU legislator and the European courts but also between the administrative and judicial authorities at State level. Ultimately, the effectiveness of this access is also essential in a cross-border dimension in order to further approximate national legislation and to propose a European solution to the structural and systemic problems characterizing this access

Includes bibliographical references.<br>The Rome Statute of the International Criminal Court (Rome Statute) provides for a close relationship between the International Criminal Court (Court) and the United Nations Security Council (Security Council). This relationship is demonstrated through Security Council exercise of referrals and deferrals. This dissertation discusses first, the Security Council referrals of the situations in Darfur, Sudan and Libya. Second, the Security Council passing of resolutions 1422(2002) and 1487(2003), which deferred the Court from commencing any investigations or prosecuting of any crimes that could have arisen as a result of the United Nations peacekeeping operations. This dissertation argues that the Security Council has exercised referrals and deferrals contrary to the Rome Statute, the Charter of the United Nations (the Charter), and the Negotiated Relationship Agreement between the Court and the Security Council (Relationship Agreement) as envisaged by the drafters of the Rome Statute. It concludes by stating that, the relationship between the Court and the Security Council is at a crossroad because the latter has failed to exercise referrals and deferrals in the manner provided for in the Rome Statute and as envisioned during the drafting of the Rome Statute, thereby equating the Court to the proverbial bark of a toothless dog.

Abstract:
The study attempts to provide a comprehensive analysis of the role of the International Court of Justice (ICJ) as the principal judicial organ of the United Nations (UN). It considers the contributions of the ICJ towards the UN system and concludes that, although the ICJ's contribution has been significant, many practical and theoretical issues regarding its role remain unsettled. The study proceeds as follows. The first chapter sets out the history of international adjudication and the relationship between international adjudicatory mechanisms and political international organisations. It also includes a review of the legal basis and extent of the relationship between the ICJ and the UN. The second and third chapters aim to throw light upon the advisory role of the ICJ and the manner in which the Court, through this jurisdiction, plays a role in interpreting and developing the institutional law of the UN. The fourth chapter addresses the Court's role in facilitating the realisation of the purposes and principles of the UN through its contentious jurisdiction. This chapter discusses the basis of the contentious jurisdiction of the Court, then examines the practice of the Court in achieving these purposes and principles. The fifth chapter examines the role of the ICJ as a "constitutional court" in the UN framework and its competence to review the legality of acts of the UN organs. The sixth chapter evaluates the Court's role as a court of appeal in respect of the judgments of administrative tribunals established within the framework of the UN and its specialised agencies, particularly in the light of General Assembly Resolution 50/54 (1995). By way of conclusion, the Court's role within the UN system is evaluated and a number of recommendations are made with a view to enhancing the role of the Court to enable it to address new challenges.

Abstract:
International criminal courts do not operate to the exclusion of national legal orders, but co-exist with them. The present thesis provides an in-depth analysis of the above relationship. By examining the concepts of primacy and complementarity on the basis of which the ad hoc international criminal Tribunals and the permanent International Criminal Court seize jurisdiction, the foundations of the interface are explored. As effectiveness is a key concept to international criminal justice, the relationship between international criminal courts and national legal systems is tested, by examining the co-operation regimes envisaged in the Statutes of both the Tribunals and the ICC, as well as the problems that arise in practice. Moreover, the way the UN Security Council affects State interplay with international criminal justice institutions is crucial for a holistic understanding of the limitations of the interaction. The final part of the thesis focuses on national incorporation efforts and provides a detailed analysis of implementing legislation of a number of key States with a view to discerning some common approaches and highlighting problem areas. The present thesis argues that despite the different constitutional bases of the Tribunals and the ICC, similar questions of interface with national courts arise and the challenges presented could be better tackled by aiming for a "functional or workable interaction". Overall, the originality of this thesis lies in its analytical approach. By scrutinising a number of crucial aspects of the relationship between international criminal courts and national legal orders an overview of the research question posed is achieved. Moreover, the examination of the legal principles and their practical application is complemented by a comprehensive discussion of national implementing legislation which has not previously been attempted in a similar manner. In June 2012, the Supreme Court of the United States decided the fate of the Patient Protection and Affordable Care Act in a case called National Federation of Independent Business v. Sebelius. While initially the decision seemed favorable to supporters of the bill, Chief Justice Roberts’ majority opinion could likely render the bill ineffective in implementation and it creates more Constitutionally confusing precedent than it resolves. Among the questions that now rise to the surface are: will Congress be able to raise the tax to a level where it will become effective? What is now mandatory for states to adopt into their Medicaid programs? Where is the line for the federal government with regards to coercion? What are the definitions of direct and indirect taxes? And, how binding is the Origination Clause of the Constitution?

Abstract:
My dissertation project seeks to understand when and how do national judges play an active and significant role in how international legal orders do or do not affect their polities. Specifically, I look at when and how British judges play a role in how European Union law through the European Court of Justice and European human rights law through the European Court of Human Rights affect the British polity. These international legal orders contain both vertical and horizontal aspects. Vertical aspects include the highest court and its judges defined by the treaty, which operates as the international, hierarchical authority on the treaty and is tasked with ensuring the compliance of the member states of the treaty. Horizontal aspects include member state courts and judges who interact with other member state courts and judges as equals voluntarily to share an understanding of the law. Britain is interesting because it may seem like a counterintuitive place to find such dynamics. Britain has a strong resistance to international authority, a deeply entrenched idea of Parliamentary Supremacy, and a dualist legal tradition where Parliament translates international law into domestic law prior to its use by the courts, which contributes to a lack of expectation of British judges engaging in international judicial activism, making Britain a hard case. In this context, we should expect that international law only matters to the extent that domestic actors are forced to incorporate it by a strong international legal order with vertical supremacy and unambiguous authority. To the contrary, my dissertation shows that British judges are quite active in many international legal orders in ways that do not merely reflect the degree of established vertical legal authority. Through dynamics that are quite autonomous from British politicians' difficult interactions with international authority, British judges play a very active role in managing and integrating international law into British politics. To see these dynamics and understand how international law has affected British politics, we must pay special attention to horizontal legal integration. Horizontal legal integration occurs when judges intentionally and selectively borrow legal concepts and precedents from other national or international jurisdictions.

Elle exerce en effet, au-delà d’une variété de formes et designifications, une influence décisive sur l’office du juge ainsi que sur la fonction desautorités soumises à son contrôle. Pour appréhender pleinement la portée qu’elle revêt dansl’équilibre des pouvoirs établi par la Cour de justice de l’Union européenne, il est nécessairede se défaire de toute préconception de la distinction du fait et du droit (notamment auregard des pratiques observées en droit interne), afin de comprendre comment le juge del’Union européenne exerce un pouvoir de détermination à son égard, que ce soit dans lecontrôle de validité des actes juridiques ou dans les voies de recours dirigées contre desactes juridictionnels. Dans cette opération, elle reste toutefois soucieuse d’assurerl’acceptabilité de ses décisions, et prend donc en considération certaines contraintesjuridiques qui se présentent à elle dans son office. In order to fully grasp its significance inthe balance of power that the European Court of Justice has established, one has to discardany preconception related to the distinction between fact and law (especially those present inmunicipal law). This in turn leads to the understanding of the manner in which the EuropeanCourt specifies the distinction, should it concern the review against legal acts or the ways ofchallenging case law. Whilst doing this, the European Court remains wary of the acceptabilityof its decisions, thus taking into account several legal constraints. As a normative authorityand as the authentic interpreter, the European Court of Justice uses the distinction betweenfact and law as a way to divide the competences of the actors concerned with theimplementation of EU law. By performing this specification, it defines the way the legalsystem entitles these actors. In this way, the European Court of Justice emerges as theSupreme Court of this normative space

This thesis examines the challenges that the Federal and Amhara National Regional State (ANRS)1 Courts of Ethiopia face in the realisation of legal and social justice. The Ethiopia Constitution (1995) under Article 43 declares that Ethiopian people have the right to improved living standards and sustainable development where the basic aim of development activity is to enhance, through their full participation, citizens’ capacity for development and the meeting of their basic needs. The Constitution underlined this as the ‘North Star’ of social justice which would be meaningless unless dispute resolution mechanisms empower litigants and the people in gaining social justice and thus the attainment of the Constitutional objective. The attainment of the social justice is however problematic as the legal justice the formal court is administering does not meet the people’s Constitutional expectations. The mismatch between legal and social justice, coupled with the legal history and the prevalence of justice pluralism, tends to force the People of Ethiopia to use non-formal systems of dispute resolution. Thus, there is a need to refine the formal and non-formal systems and to align them with the Constitutional imperative of social justice. Judicial reform is being implemented, with the help of international institutions like the World Bank, but the underlining concern is whether the World Bank proposals on judicial and legal reform will meet these needs or whether they are too located in Western values, the suggestion being that they may suffer from the same problems as other modernisation projects. There also lies a tension between the Constitutional expectation, the conceptualisation of justice by professionals and clients, and the overall purpose of securing justice and preventing injustice. Litigants’ preference for justice is itself in conflict with other litigants and the diverse institutional understanding of justice that made the attainment of social justice a difficult exercise. The area is found to be so problematic that there is a need to re-connect the practical conceptualisation of justice with the Constitutional conceptualisation of social justice which the Federal and ANRS courts require the redoing of justice so that the conceptualisation of justice would not cause irreversible damage to people’s societal, economic, and ecological demands and to the sustainability of justice and development.

L'absence de définition du crime international d’agression, qualifié pourtant comme la mère de tous les crimes internationaux, par la Cour pénale internationale ainsi que l'incapacité du Conseil de sécurité de qualifier et de sanctionner de telles violations afin d’établir la justice et la paix internationales, participent au fait que l’agression, au travers du recours à la force armée, reste malheureusement de nos jours une vieille tradition aussi fréquente que dangereuse. Au-delà de la difficulté conceptuelle, il existe une autre difficulté difficilement surmontable sur les scènes nationale et internationale, à savoir la question de la répression de ces guerres. L’absence d’identification des auteurs et la non reconnaissance des victimes conduisent à une totale impunité, source de répétition de cette violation, par les grandes puissances. Afin de savoir s’il est réaliste et opportun de poursuivre les auteurs de ce crime en tant qu’acte de l’État sans cependant oublier principalement la dimension individuelle de l'acte, l'objet de cette recherche a été de déterminer tous les recours possibles tant par la voie judiciaire que par la voie politique (l’ONU, les organisations régionales, les parlements nationaux, l’opinion publique). Concernant la voie judiciaire, il s'est agi d'analyser tant la répression par le juge interne (dans les systèmes français, allemand, américain et anglais) que par le juge international devant la Cour pénale International et les autres tribunaux internationaux.Cette thèse s’efforce de faire une présentation de toutes les possibilités réelles d’engager la responsabilité pour crime international d'agression, aussi bien en ce qui concerne l’agression en tant que faute politique majeure que comme crime, l’étude de ces deux aspects étant dressée par une analyse des obstacles rencontrés par l’application du droit international et national dans le contexte du crime d’agression<br>The lack of definition of the international crime of aggression, described as the mother of all international crimes, by the International Criminal Court, and the inability of the Security Council to qualify and punish such violations to establish justice and peace, participate that the aggression, through the use of armed force, remains unfortunately nowadays a tradition as often as dangerous. Beyond the conceptual difficulty, there is another problem that is as difficult to overcome in the national and international scenes, namely identifying the way to repress these wars. The lack of identification of the authors of these wars and the non-recognition of the victims lead to lack of punishment which is the main source of repetition of the violations by the great powers.In order to know whether it is realistic and appropriate to prosecute this crime as an act of the State, without forgetting the individual dimension of the act, the purpose of this research was to identify all remedies whether through the courts or by political means (the UN, regional organizations, national parliaments, public opinion). Concerning judicial matters, this research analyzes internal repression by the judge (in the French, German, American and English systems) and by the international judge to the International Criminal Court and other international tribunals. This thesis aims to present all real possibilities of engagement and liabilities for international crimes of aggression, whether these are treated as major political mistakes or crimes, through an analysis of the obstacles encountered by the application of international and domestic laws in the context of crimes of aggression

Cette dernière s'est engagée dans la poursuite d'auteurs présumés de ces crimes à travers les différents mécanismes juridiques mis en place par la justice pénale internationale. Il incombe essentiellement aux États d'assurer l'effectivité de cette justice. Ainsi, quand des auteurs présumés de crimes internationaux se trouvent sur le territoire ou dans la juridiction d'un État, ce dernier est tenu de les poursuivre ou de les extrader vers d'autres États ou juridictions pénales internationales lorsque cela est nécessaire. Depuis la Deuxième Guerre mondiale, certains États mettent en application ces obligations en engageant des poursuites à l'encontre de criminels internationaux. La répression nationale des crimes internationaux se heurte à de nombreuses difficultés afférentes, le plus souvent, au manque de moyens ou de volonté, à l'inadéquation de certains systèmes juridiques nationaux, à la realpolitik (de l'allemand politique réaliste), à la nécessité de préserver les relations interétatiques, etc. Par ailleurs, il n'existe pas encore d'instance supranationale capable de contraindre les États à respecter leurs obligations internationales de répression des crimes internationaux. This international community has committed itself to prosecute alleged perpetrators of these crimes through various legal mechanisms created by international criminal justice. The States are primarily responsible for ensuring the effective implementation of international criminal law. Consequently, when alleged perpetrators of international crimes are on the territory or under the jurisdiction of a given State, national authorities must prosecute them in their own national courts or extradite them to others States or international criminal courts when necessary. Since the Second World War, some States implement these international obligations by prosecuting international criminals. The national prosecution of international crimes faces many barriers related most of the time to a lack of financial resources or political will. This can also result from the inadequacy of some national legal systems, realpolitik, the need to safeguard inter-state relations... In addition to this, a supranational body compelling States to respect their international obligations to prosecute international crimes has not yet been created. Therefore, the legal involvement of regional human rights courts in the implementation of national prosecution of international crimes is necessary. This is the consequence of international requirements related to the pursuit of international criminals reminding the States of their legal duties

Le système de la Cour pénale internationale (CPI), dont la mission est d’assurer la justice internationale, repose sur un lien étroit avec le Conseil de sécurité. Il convient donc de s’interroger sur le rôle du Conseil dans le fonctionnement de la justice pénale internationale. Cette question est fondamentale, car l'intervention d'un organe politique dans l’activité d’un organe judiciaire remet en cause les missions de chacune de ces institutions. L’intrusion du Conseil dans l’activité de la CPI, basée sur sa mission de maintien de la paix, est en fait établie au nom d’un ordre international voulu par le Conseil lui-même. Ce rôle affecte le fonctionnement, l’indépendance et même l’impartialité de la Cour. Les pouvoirs que le Statut de Rome confère au Conseil, lui permettent en effet de saisir la CPI, d’imposer aux Etats de coopérer avec la Cour, de suspendre son activité ou encore de qualifier un acte, de crime d’agression. Cependant, les rapports entre le Conseil et la CPI ne devraient pas être subordonnés, mais entretenus dans le respect mutuel, ainsi une véritable crainte existe concernant le respect du Conseil envers le Statut de Rome. L’étude met en évidence le conflit entre justice et politique et révèle les enjeux actuels en termes de justice pénale internationale<br>The international criminal Court system (ICC) whose mission is to ensure international justice, is based on a close relationship with the security Council. So it is proper to wonder about the Council’s role in the functioning of international criminal justice. Such a questionning is fundamental, for the intervention of a political body into the functioning of a judicial body calls into question the missions of both institutions. The Council’s interference in the activity of the ICC, based on its mission of maintaining international peace, is actually carried out on behalf of an international order intended by the Council itself. This role affects the functioning, the independence and even the impartiality of the ICC. The powers the Rome Statute gives to the Council allow it to refer to the ICC, to impose for the States to cooperate with the Court, to suspend its activity or also to qualify an act as a crime of aggression. However the relations between the Council and the ICC should not be subordinated, but maintained in mutual respect. Thus there is a real concern regarding the observance of the Rome Statute by the Council. The study highlights the conflict between justice and politics and reveals the current issues in terms of international criminal justice

Thus, the Constitutional Amendment nº 45 of the year of 2004 created the National Council of Justice, the administrative body responsible for that power. Since then, there are efforts in the administration of justice to become professionalized and modernized under the policies of this Council. This board has adopted in the year of 2009 the national strategic planning that stipulates mandatory goals for all courts of justice in the country. Therefore, this study sought to understand what are the perceptions of magistrates and officers of courts about the implementation of goals imposed by the National Counsel of Justice to the Court of Justice of the State of Rio de Janeiro and how this reinforce the strategic planning in the court. The research is characterized as qualitative and descriptive and the data was collected by bibliographic research and research in the field. There were conducted interviews among judges, officers of courts, administrative officers and employees, all working in the chosen court. The survey results show that while strategic planning is not widely known, nor that the goals are fully understood, the fact that they are being fulfilled can influence positively the strategic planning. However, both the NCJ strategic planning practices with their mandatory goals as the environment of planning in the court of Rio de Janeiro are not aligned with the ideas and concepts existing in the modern literature.<br>O Poder Judiciário brasileiro tem passado por uma crise de credibilidade frente à sociedade devido a sua morosidade. Assim, com a Emenda Constitucional nº 45 do ano de 2004 foi criado o Conselho Nacional de Justiça, órgão competente pelo controle da atuação administrativa e financeira desse Poder. Desde então, observam-se esforços na gestão da justiça para profissionalizar e modernizar os Tribunais pátrios sob as diretivas deste Conselho. Este órgão instituiu no ano de 2009 o planejamento estratégico nacional com a estipulação de metas de caráter obrigatório para todos os Tribunais de Justiça do país. Desta forma, o presente estudo buscou entender quais as percepções dos magistrados e servidores sobre o cumprimento das metas impostas pelo Conselho Nacional de Justiça ao Tribunal de Justiça do Estado do Rio de Janeiro e como tal processo influencia para reforçar o planejamento estratégico neste Tribunal. O trabalho caracteriza-se como qualitativo e descritivo e os dados foram coletados por meio de pesquisa bibliográfica e de campo. Foram realizadas entrevistas com juízes, desembargadores, secretários de juízes, diretores administrativos e serventuários, todos atuantes no TJERJ. Os resultados da pesquisa demonstram que embora não haja amplo conhecimento do planejamento estratégico em vigor ou ainda que as metas não sejam plenamente compreendidas, o fato de estarem sendo cumpridas mostra-se positivo para o planejamento do Tribunal. Todavia, tanto a prática de planejamento estratégico do CNJ consubstanciada na imposição de metas quanto o ambiente de planejamento no âmbito do TJERJ não estão em sintonia com as ideias e conceitos asseverados na literatura moderna.

A investigação, à semelhança daquela realizada pela comissão de verdade, tomará o interregno compreendido entre 1964 e 1969 como marco temporal, e se preocupará com o estudo dos habeas corpus de caráter político que chegaram ao Tribunal nestes primeiros anos da ditadura militar. Objetivando descortinar os critérios utilizados pela Comissão Nacional da Verdade, em seu relatório final, ao vaticinar que o Supremo Tribunal Federal, em consonância com todo o Poder Judiciário brasileiro, compactuou com as arbitrariedades e graves violações de direitos humanos perpetradas pelo Regime Militar, adotaremos uma abordagem multimétodo. Em um primeiro momento, serão levantadas fontes jurídico-históricas referentes à utilização da garantia do habeas corpus no Brasil e ao impacto que os Atos Institucionais editados durante a Ditadura Militar tiveram sobre o Supremo Tribunal Federal. Posteriormente, na segunda parte da pesquisa, buscaremos apreender o que é uma comissão de verdade, ferramenta de Justiça Transicional, e como a Comissão Nacional da Verdade, utilizando-se de métodos e materiais próprios, entendeu o funcionamento do Supremo Tribunal Federal nos primeiros anos do período de exceção brasileiro.<br>This research aims to analyze the perception expressed by the National Truth Commission on the judicial activity of the Supreme Federal Court, during the years of dictatorship the Brazilian military. Judiciary umbrella body, the Supreme Court was deeply affected by the Institutional Acts issued by the Executive Branch militarized. The research, like that carried out by the truth commission, will take the interregnum between 1964 and 1969 as a timeframe, and be concerned with the study of the political nature of habeas corpus which reached the Court in these early years of the military dictatorship. Aiming to uncover the criteria used by the National Truth Commission in its final report to predict that the Supreme Court, in line with all the Brazilian Judiciary, agreed with arbitrariness and serious human rights violations perpetrated by the military regime, adopt one multi-method approach. At first, legal and historical sources referring will be raised to the use of the habeas corpus guarantee in Brazil and the impact that the Acts Institutional edited during the military dictatorship had on the Supreme Court. Later, in the second part of the study, we seek to grasp what a truth commission, transitional justice tool, and as the National Truth Commission, using methods and materials themselves, understand the functioning of the Supreme Court in the early years Brazilian exception period.

<p>Sveriges inträde i EU 1995 har lett till många förändringar i det svenska rättssystemet. Svenska domstolar har därmed fått en ny arbetssituation och nya skyldigheter. Flera förändringar har skett i svensk processrätt, och grundläggande EU-rättsliga principer som de om direkt effekt och EU-rättens företräde framför nationell rätt, har ställt de nationella domstolarna inför flera utmaningar.</p><p>Den mest grundläggande skyldigheten de svenska domstolarna har gentemot EU är förpliktelsen att inhämta förhandsavgörande från EU-domstolen. Sistainstansrätterna är skyldiga att göra detta närhelst de är osäkra på tolkningen och/eller tillämpningen av en EU-rättslig bestämmelse. Detta är en långtgående förpliktelse som endast har två undantag: det första är i de fall EU-domstolen redan dömt i ett identiskt fall (acte éclairé); det andra är då den nationella domstolen anser att den EU-rättsliga bestämmelsen är tillräckligt klar och tydligt för att den självständigt ska kunna tillämpa den (acte clair).</p><p>Dessa skyldigheter har lett till ett flertal problem för de svenska domstolarna. Sverige har fått skarp kritik från Kommissionen för sistainstansrätternas obenägenhet att inhämta förhandsavgörande.</p><p>Huruvida EU borde ta hårdare tag mot medlemsstaternas nationella domstolar eller om kriterierna för när skyldigheten att inhämta förhandsavgörande borde mjukas upp diskuteras flitigt i nuläget. Det finns företeelser som talar för en utveckling åt både det ena och det andra hållet, vilket gör detta till ett väldigt spännande ämne att studera.</p><br><p>Since Sweden joined EU in 1995 many things has changed in the Swedish legal order. This has led to several new obligations for the Swedish courts. There have been a number of changes in Swedish law of procedure, and fundamental principles of law set down by EU, like the principle of direct effect of EU law and its precedence over national law, has presented many challenges before the national courts.</p><p>The most fundamental obligation of the Swedish courts to EU is the duty to make a reference for a preliminary ruling to the European Court of Justice (ECJ). The courts of last instance are obligated to do this in any case where they are insecure of the appropriate application of EU-law. There are only two exceptions to this rule, namely when the ECJ already has ruled in an identical matter (acte éclairé) and in cases where the national court feels that the correct interpretation of the rule of law in question is obvious (acte clair).</p><p>These obligations have lead to a number of problems for the Swedish courts. The Commission has criticized Sweden because of the national courts of last instance unwillingness to request preliminary rulings.</p><p>Whether EU should toughen up and take action against the national courts disobedience or if the criteria for when an obligation to make a reference for a preliminary ruling should get more flexible is constantly discussed at this time. There are several things that speaks for both of these developments and that makes this a very interesting topic to study.</p>

Abstract:
This thesis examines how the promise and institutionalization of 'justice for victims' has shaped the ICC's justice vision and identity. Drawing on interviews with 90 practitioners in The Hague, Kenya and Uganda, it undertakes a sociological and institutional analysis of how 'justice for victims' has evolved in the Court's first two decades through the definitions and redefinitions, pushes and pulls, strategies and miscalculations of the Court's diverse actors both in The Hague and in the field. It argues that the introduction of 'justice for victims' has led to a rift within the Court between those who embrace a narrow understanding of justice as 'fair trials' and those who see the ICC as an opening for broader justice processes. These rifts and gaps are reinforced by the Court's actors in the field such as victims' lawyers and intermediaries who sometimes assume political advocacy roles beyond what the Court's judges envisaged or follow their parochial interests on the ground. While the ICC's judges have increasingly curtailed victim participation and reparation in the court room, the Court's practices on the ground reflect an uneasy fusion of legal justice, development, local and national politics with a proliferation of new justice concepts including 'transformative justice' and 'gender justice'. So far, these justice contestations have not chipped away, much less undermined, the Court's legitimacy. Rather, the Court has thrived on its justice contradictions; its failure to commit to any particular justice vision while loosely relating to all possible visions, has made the Court impervious to critique. But the thesis will also show that 'justice for victims' at the ICC is schizophrenic: it is inherently unstable and its contradictory dynamics may at some point rip the concept apart - and with it the Court's legitimacy.

La Révolution française, « mère de toutes les révolutions » selon l’expression consacrée, est perçue comme une rupture radicale tant socialement que politiquement. Sur le plan juridique, elle ouvre les portes de la justice criminelle à l’humanité des lumières en accord avec les idées de Cesare Beccaria et de nombreux auteurs du XVIIIe siècle. La réforme pénale initiée par l’Assemblée constituante se veut comme une rupture franche avec l’Ancien Régime en repensant entièrement la carte judiciaire et le corpus législatif pour offrir à la cité « idéale » la justice qui lui revient. Pour autant, cette transfiguration aura-t-elle les effets escomptés ? Au-delà des mots, quel est son impact réel sur le rendu de la justice ? Les effets les plus néfastes qui prévalaient sous les conseillers du roi ont-ils disparu sous le règne des jurés de jugement ? Quelles sont les parts de continuité et de rupture avec l’Ancien Régime dans l’exercice de cette justice pénale ordinaire révolutionnaire ? Sur les traces de Tocqueville, cette étude se propose de répondre à ces problématiques en « descendant dans le tombeau de cette France qui n’est plus » au travers des archives du Parlement de Provence pour comprendre cette France qui vient de naître, incarnée par les tribunaux de district jugeant criminellement et le tribunal criminel départemental des Bouches-du-Rhône. Pour nous aider dans cette mise en perspective et naviguer entre ces deux périodes, nous monterons à bord de « Argo », une application que nous avons développée pour traiter et analyser les milliers d’arrêts de ces juridictions antagonistes<br>The French revolution, “mother of all the revolutions” according to the devoted expression, is perceived like a radical rupture both socially as politically. On the legal level, she opens the doors of criminal justice to the humanity of the lights in agreement with the ideas of Cesare Beccaria and many authors of the 18th century. The penal reform initiated by the Constituent Assembly wants to be like a frank rupture with the Ancien Régime by entirely reconsidering the judicial map and the legislative corpus to offer to the “ideal” city the justice she deserve. However, will this transfiguration have the desired effects? Beyond words, what is its real impact on the rendering of justice? Did the most harmful effects which prevailed under the advisors of the king disappear under the reign of jurors? What are the shares of continuity and rupture with the Ancien Régime in the exercise of this ordinary revolutionary criminal justice? In the footsteps of Tocqueville, this study proposes to answer these problems by "descending into the tomb of this France which is no more" through the archives of the Parliament of Provence to understand this France which has just been born, incarnated by the criminal district courts and the departmental criminal court of Bouches-du-Rhône. To help us in this perspective and navigate between these two periods, we will go up on board "Argo", an application we have developed to process and analyze the thousands of judgments of these antagonistic jurisdictions

L’internationalisation du droit communautaire de l’UE a engendré le développement de nouveaux centres de production juridique en dehors de l’espace juridique européen comme la CAN. Ce processus a stimulé un phénomène de pluralisme juridique mondial à double dimension : on note d’une part la création , à l’échelle régionale, de modèles alternatifs d’intégration ; d’autre part, au niveau national, l’émergence d’une discussion sur l’identité constitutionnelle et administrative des Etats au regard des systèmes juridiques supranationaux. La comparaison jurisprudentielle entre la CJUE et le TJCA montre une expansion du pluralisme juridique en Amérique latine et dans l’Union européenne, tant à l’échelle nationale que régionale ; constitutionnelle qu’administrative. Un tel pluralisme appelle la construction d’une jurisprudence de coordination-harmonisation régionale plutôt qu’une standardisation juridique mondiale telle qu’elle est envisagée par le droit économique de l’OMC, la doctrine du Global Administrative Law ou celle proposant des standards constitutionnels mondiaux. La jurisprudence comparée explique comment le dialogue –«spontané et débridé»- de juges nationaux et régionaux révèle les rapports conflictuels entre le droit économique du marché mondial (OMC) et la protection de l’ordre public à l’échelle régionale. La thèse aborde cette problématique du pluralisme juridique au prisme de la jurisprudence comparée de la CJUE et du TJCA. D’un point de vue constitutionnel tout d’abord, la notion de « savoir-pouvoir du juge » (se substituant à la notion d’activisme des juges) propose de comprendre le juge communautaire en tant que garant du pluralisme juridique national afin d’aborder une nouvelle configuration complexe du pouvoir juridique à l’échelle supranationale. D’un point de vue administratif ensuite, la notion de gouvernabilité régionale (se substituant à la notion de gouvernance mondiale) appelle à un espace d’étatisation juridique des pouvoirs économiques régionaux pour les placer sous le contrôle du droit. Il s’agit d’imaginer un droit public régional capable d’étatiser les pouvoirs régionaux en tant que contre-pouvoirs de régulation du marché face à l’indéfinition juridique de la gouvernance mondiale<br>The internationalization of Community Law in the EU has led to the development of new centers of legal production outside the European legal space such as CAN. This process has stimulated a two -dimensional global phenomenon of legal pluralism: on the one hand there is the creation of alternative regional integration models and on the other hand, the emergence of a discussion on national level about the constitutional and administrative identity of States under supranational legal systems. The comparison between different jurisprudences shows an expansion of legal pluralism in Latin America and in the EU, as much as in a national or regional scale than in a constitutional or administrative scale. Such pluralism demands the construction of a regional coordination-harmonization rather than a standardization of the legal world as envisaged by the WTO's economic Law, the doctrine of Global Administrative Law or the constitutional providing of global standards. Comparative jurisprudence explains how the national and regional judges’ “spontaneous and unrestrained” dialogue reveals the conflicting relationship between the beneficial owner of the world market (WTO) and the protection of public order at a regional level. The thesis addresses the problem of pluralism through the comparative analysis of both the ECJ's and the ACJ's jurisprudences. First, from a constitutional point of view, the notion of “power-knowledge of the judge” (replacing the concept of judicial activism) suggests the understanding of the community judge as the protector of the national legal pluralism to address a new complex configuration of legal authority at a supranational level. Secondly, from an administrative point of view, the notion of regional governability (replacing the concept of global governance) demands the judicial nationalization of regional economic powers to place it under the control of law. The aim is to imagine the regional public law capable of nationalizing the regional authorities as counter-powers regulating the market to face the lack of legal definition of the global governance

The dissertation aims to develop an understanding of the outcomes and limitations of formal and informal control of the Swedish state, and of the positions and strategies of the social agents involved in this field. The dissertation contributes with new perspectives on controls directed at the state, comparing various control organs (the Parliamentary Ombudsman, the Chancellor of Justice, the United Nations, the European Court of Human Rights and NGOs) and focusing on a wide range of wrongs and harms by the Swedish state. Paper I explores incidents for which the Swedish state and its agencies have been judged to be responsible by formal control organs. Paper II analyzes the accounts used by state representatives in judgments from formal control organs on issues related to migration. Paper III examines the characteristics of those who hold the state accountable via the European Court. Paper IV explores how formal and informal control organs frame problems in relation to the Swedish state’s treatment of residence permit applicants. The studies demonstrate that formal domestic control organs mainly direct criticisms at state agencies that focus on particular and procedural issues. International bodies of formal and particularly informal control publish criticisms of the state that focus on general and systemic issues. The dissertation highlights how control organs offer limited access to accountability, and how controls of the state may be perceived as both ineffective and counterproductive. Another conclusion is that the positions and strategies of the agents in this field are dependent on their specific capital (resources, knowledge and support). Control of the state is understood as a field of struggle for recognition and legitimacy, in which accusations are denied by representatives of the state and control organs balance their criticism in order to maintain credibility. Both informal control organs and those who hold the state accountable must adjust to the rules of the game or risk being defined out.<br><p>At the time of the doctoral defense, the following paper was unpublished and had a status as follows: Paper 4: Manuscript.</p>

From the 1930 Revolution there will be presented the main trends of the Justice System discussed during the Itamaraty (Ministry of Foreign Relations) subcommittee sessions created to elaborate a Constitution draft at the request of the leader of the Provisional Government and also at the 1934 National Constituent Assembly sessions. Starting from primary sources such as laws, meeting minutes, letters and articles published in journals of the time, the research will point out the importance of discussions on the Judiciary occurred at the time to the conception of the National State which was in full development. In order to understand the context in which the above-mentioned primary sources are located, the focus was on analyzing the academic papers developed in the 1980’s, mainly by the Center for Research and Documentation on the Contemporary History of Brazil (CPDOC) which help the understanding of a troubled period of the recent national past. The work supports that, rather than administrative or legal doctrinal issues, it was the body of ideas that involved the conception of the so-called New State that created the endorsing ideological and political conditions, not consolidated at the previous period of time, and that resulted in the non-inclusion of the First Instance Federal Court among the Judiciary organs in the 1937 Constitution.<br>O trabalho faz um retrospecto das principais discussões durante os primeiros anos da Era Vargas sobre a forma de organização do Poder Judiciário na busca de encontrar as motivações que ensejaram a extinção da Justiça Federal de 1a Instância através da Constituição outorgada em 10 de novembro de 1937. A partir da Revolução de 1930, serão apresentadas as principais correntes acerca do sistema de justiça debatidas durante as sessões da subcomissão do Itamarati, criada para elaboração de anteprojeto constitucional a pedido de Getúlio Vargas, então chefe do Governo Provisório, e também nas sessões da Assembleia Nacional Constituinte de 1934. Valendo-se de fontes primárias como normas legais, atas de sessões, cartas e matérias publicadas em jornal da época, a pesquisa destacará a importância dos debates sobre o Poder Judiciário ocorridos na época para a concepção do Estado Nacional que se encontrava em fase de plena construção. Para compreensão do contexto em que as aludidas fontes primárias estão inseridas, privilegiou-se o uso de trabalhos acadêmicos desenvolvidos na década de 1980, principalmente pelo Centro de Pesquisa e Documentação de História Contemporânea do Brasil (CPDOC), que auxiliam a compreensão de uma fase conturbada do passado recente nacional. O trabalho defende a ideia de que, mais do que questões de cunho administrativo ou doutrinário jurídico, foi o ideário que envolveu a concepção do denominado Estado Novo que criou condições ideológicas e políticas autorizadoras, não consolidadas em momento anterior, e que resultou a não inclusão da Justiça Federal de Primeira Instância entre os órgãos do Poder Judiciário na Constituição de 1937.

Current opinion pieces ask broad questions such as "Is the ICC worth it" while only focusing on a specific aspect of the ICC such as its budget or the work of the Office of the Prosecutor. Given the incredibly complex nature of human rights violations as well as the difficulty in assembling an international regime to deal with them, answering such questions requires a more complete analysis of the Court's functions, dynamics, and predecessors. The background chapter that discussed trends in international judicial organizations leading up to the creation of the ICC examined the Nuremberg International Military Tribunal, the interregnum national commissions, the Spanish Universal Jurisdiction system, the International Criminal Tribunal for the Former Yugoslavia, and the Inter-American Court of Human Rights, addressing key pitfalls that such organizations faced (including victors' justice and unilateralism) while noting how the ICC's policies and structure differed from its predecessors'. The dynamics chapter highlighted eight key elements currently affecting how the Court works– the member states who have ratified the Rome Statute, the Court's ability to apprehend criminals, the international response to ICC actions, how prosecutions may be initiated, the explicit and implicit functions of the Court, its consensus policymaking, the Court's budget and finances, and the role of the United States. With these dynamics in mind, the policy alternatives chapter recommended three actions that could serve to strengthen the ICC's capabilities – increasing its member states, increasing compliance with its warrants through different types of international agreements, and increasing its budget to be able to handle more cases. Following these policy alternatives to their likely outcomes in the policy forecast section, I analyzed how they would affect the ICC's effectiveness, its ability to gain more member states, and the member states themselves. Through this more comprehensive analysis that takes into account the external and internal factors affecting the ICC, this thesis offers realistic ways that the ICC can improve its capabilities and achieve its mission of ending impunity for war criminals.

La Cour de Justice Communautaire (CJC), la Cour des Comptes Communautaire (CCC) et la Cour Commune de Justice et d’Arbitrage (CCJA) sont les trois juridictions supranationales créées respectivement par les traités de la CEMAC et de l’OHADA pour renforcer les nouveaux processus d’intégration économique et juridique des Etats membres. Dans la mesure où ces juridictions exercent un contrôle juridictionnel déterminant de la norme communautaire, le premier contrôle étant effectué par les juridictions nationales des Etats parties, la conception, l’organisation, le fonctionnement, les caractéristiques, les rôles ou compétences de ces juridictions nouvelles ainsi que la destinée des décisions qu’elles rendent dans leurs fonctions strictement judiciaires ou dans celles accessoires d’appui à la procédure arbitrale, présentent un intérêt digne d’une recherche doctorale. S’il est apparu que des jalons supplémentaires d’efficacité des nouveaux processus d’intégration ont été plantés par la création desdites juridictions, il a également été constaté que des pesanteurs d’ordre juridictionnel, structurel ou fonctionnel continuent d’en retarder la vitesse de croisière. Les solutions que nous avons proposées pour surmonter ces difficultés se regroupent en une réorganisation des juridictions communautaires, une répartition claire des compétences entre elles, un renforcement de la procédure de contrôle du droit communautaire, une vulgarisation permanente du droit de l’intégration, une revalorisation des titres exécutoires, une clarification des fonctions du juge d’exécution, une restriction du domaine de l’immunité d’exécution, un réaménagement des procédures de recouvrement, une formation continue des acteurs de la justice, une amélioration de leur condition de travail et de vie, une résurgence de l’éthique morale, une réelle indépendance de la justice… C’est dire que l’étude met un accent sur les obstacles qui entravent les nouveaux processus d’intégration et propose des solutions pour parfaire les textes législatifs et leurs interprétations jurisprudentielles, dans la perspective d’accélérer le développement économique des Etats concernés en particulier, pour une meilleure prospérité globale des économies mondiales<br>The Communautary Court of Justice (CCJ), the Communautary Court of Account (CCA) and the Common Court of Justice and Arbitration (CCJA) are the three supranational jurisdictions respectively created by EMCAC and OHBLA treaties to reinforce the new processes of economical and judicial integration for their member States. In the measure where these jurisdictions are competent to exercise a juridictional control, by determining the communautary norms, the first control being carried out by the national juridictions, the conception, the organisation, the functioning, the characteristics, the roles or competences of these new jurisdictions and also the destiny of the decisions they rend in their strictly judiciary functions or in their accessory functions of supporting the arbitral procedure, present an interest worthy of a doctorate research. If it appears that the supplementary Milestones of efficiency of the new processes of integration had been installed by the creation of the said jurisdictions, it had also been observed that the gravities of jurisdictional, structural or functional order continue to delay the speed of cruise. The solutions that we have proposed to overcome these difficulties involves the reorganization of communautary jurisdictions, the clearly distribution of competences between them, the reinforcement of the communautarian law control procedure, a permanent vulgarisation of integration law, a revalorisation of executary titles, a clarification of immunity of execution domain, a development of the recovery procedures, a continual training of judicial actors, and improvement of their working and living conditions, a resurgence of moral ethic, a real independence of the Justice… This means that the study put a stress on the obstacles which hold up the new processes of integration and propose solutions to perfect the legislative texts and their jurisprudential interpretations, in the perspective of accelerating the economic development of the concerned States, for the best global prosperity of the world’s economies

This paper comparatively compares compliance to the rulings of the United States Supreme Court and the ECJ by the state/member state courts. Besides comparing the compliance to the two courts judgements, the paper also tries to establish how to increase compliance with these rulings in the future. This is done because compliance is an important aspect of a functioning judicial system, and a comparison might reveal solutions from one side that could be utilized on the other. The main resources used in this book are: articles, books, webpages and statistics on the subject. The main focus lies on the legal approach, but as a comparative study, elements of political science have been used as well. The results of the comparison show that although statistical compliance is quite high, the actual compliance might be lower due to lack of knowledge or political divisions. Increasing the actual compliance is then a good strategy to be sure that lower courts follow the rulings correctly. The conclusion of this paper is that political and policy divisions in a country, or between an organization and its members results in non- compliance. Reducing this kind of friction will help increase compliance to decisions, not only statistically but also in practice, as the lower courts will feel more comfortable with the rulings. An increase of knowledge of the subject, and the development of efficient judicial mechanisms in a state will also help assure correct interpretation of the rulings.

Abstract:
This thesis seeks to investigate the impact of the decisions of the International Court of Justice on third parties from the perspective of the general and specific guarantees available for the protection of their interests under the Court's Statute. In the first chapter, the general protection extended to third parties is considered from the viewpoint of the general principle of the relative effect of judicial decisions, their value as building blocks of the Court's jurisprudence and their role as a subsidiary legal source. The second and third chapters are devoted to a critical analysis of the nature, scope, effect and conditions for the operation of the specific third party guarantees, namely, intervention for the purpose of the protection of the interest of a third party and intervention when the construction of a convention is in issue in a pending case. The fourth chapter examines the position of third parties in relation to the Court's advisory jurisdiction by considering the nature and effect of advisory opinions, by defining and identifying "third parties" in the context of the advisory procedure, by assessing the nature and extent of their participation in advisory proceedings and by undertaking a brief empirical survey of the impact of advisory opinions on them. Finally, some of the principal observations are recapitulated and suggestions for improving and strengthening the third party safeguards, which have been explored, are offered. The main conclusion of this study is that in the final analysis the utility of the various third party safeguards considered, lies both in a liberal interpretation of the conditions governing their operation and in full participation by interested parties in contentious and advisory proceedings.
