Abstract:
In the civil-law doctrine, there is a debate regarding the admissibility of “negative” obligations – that is, those performed by inaction. In the author’s view, this scientific problem turns out to be a semantic tangle in which conflicting ideas about the essential features of obligations are intertwined. The goal is not just to unravel the knot, but also to trace to what sources the semantic threads go, which will allow us bettering comprehension of the nature of mixed legal phenomena. Starting from the concept of obligation, the author shows the fallacy of the idea that inaction would amount

Abstract Obligations embody a sense of responsibility, whether they are directed toward close relationships or the broader public community. Middle-aged adults may find themselves in increased caregiving roles, but research examining the role of their obligation on their well-being and relationships is scarce. Across studies, obligation is linked with both positive (e.g., higher well-being and relationship quality) and negative outcomes (e.g., greater burden). A previous study in the U.S. suggested that these mixed findings may be partially because there are various types of obligations that d

These are perfect and imperfect obligations, which include the obligation to oneself and the obligation to others. The second criterion for the division of obligations is the subjective attitude to the obligated subject.

There is a common view that the utilitarian theory of John Stuart Mill is morally realist and involves a strong kind of practical obligation. The negative theses are that Mill is not a moral realist and that he does not believe in certain kinds of obligations, those involving external reasons and those I call robust obligations, obligations with a particular, strong kind of practical authority. The positive thesis is that Mill's metaethical position can be interpreted as a Humean constructivist view, a metaethical view that is

Introduction. Negative obligations are the kind of civil obligations that have caused a lively scientific discussion for several centuries in a row, but at the same time they remain extremely poorly researched. Most civil scientists touch upon the problem of negative obligations in general terms, speaking about the legal nature of obligations or their classification. In the domestic science of civil law, there are still no large-scale and comprehensive studies that would be devoted to the specific features of negative obligations. But might we sometimes also have epistemic obligations to voice disagreements? In this paper, I will argue that we sometimes do. In other words, sometimes, to be behaving as we ought, qua epistemic agents, we must not only disagree with an interlocutor who has voiced some disagreed-with content but must also testify to this disagreement. It first argues in favour of the emergence of a new general principle of international law, according to which States have the duty to protect people at sea and to ensure that people enjoy their human rights. It then explores the nature of these duties and the extent to which an extensive range of positive obligations accompany negative ones. International studies suggest that these contributions can enhance family happiness, while domestic research in China predominantly highlights negative aspects, such as the pressures these families encounter. The review methodology involves analyzing both qualitative and quantitative s

The entrepreneurship patent system in the Republic of Moldova was initially designed to support small businesses by providing a simplified framework. However, over time, it has led to significant drawbacks, such as tax evasion and the growth of the underground economy. The system's minimal administrative requirements allow for quick issuance, which some exploit for illegal activities. Moreover, patent holders face fewer regulatory obligations than other businesses, creating unfair competition and potentially lowering the quality of goods and services. However, as a result of structural deterioration, bank mergers were experienced, banks' capital was strengthened and many of them were seized by TMSF. This situation has created a distrust of the banking system. In order to change the negative perception, problematic loans which prevent the flow of funds should be solved. This paper shows that workers who do not receive legally mandated benefits due to employer noncompliance have a negative view not only of their employers, as has been documented, but also of the State. Those workers believe that the State did not protect their rights, and hence they feel fewer obligations to comply with their duties as citizens. Using a list experiment, as well as household data from nine Latin American countries, the paper shows that non-registered workers are less likely to obey the law, pay taxes and vote compared to registered workers.

We need a new way of talking about global warming. UN Secretary General António Guterres underscored this when he said the “era of global boiling” has arrived. Although we have made remarkable progress on a very complex problem over the past thirty years, we have a long way to go before we can keep the global temperature increase to below 2°C relative to the pre-industrial times. Climate models suggest that this next decade is critical if we are to avert the worst consequences of climate change.
