Abstract:
The aim of the study was to evaluated the effect of giving water hyacinth and fish oil in quail diet on the performance, egg cholesterol and egg fatty acid profile. This study used 200 unsex day old quail divided into 5 treatments and 4 replications that were reared 5 weeks and then selected male or female. The results of sexing quail at week 5 were 95 females and 86 males. Growth period diets (0-5 weeks) contains 24% crude protein and metabolic energy of 2900 kcal kg-1 and production period diets (5-12 weeks) contains 22% crude protein and 2900 kcal kg-1. The experimental design used a completely randomized design with the treatment of using water hyacinth that was 0%,1%, 2%, 3 % and 4% with fish oil which was 0%, 4%, 5%, 6% and 7% in quail diet. The variables measured were quail performance (0-5 week age and 5-12 week age), egg cholesterol, and egg fatty acid profile. The results showed that using of water hyacinth meal 1% -4% and fish oil 4%-5% in the diet of the growth period resulted in higher feed consumption and body weight gain than diet without water hyacinth and fish oil but feed conversion rasio were same. Quail performance of the production period was not affected by all treatments. Unsaturated fatty acids tend to increased in quail eggs. The lowest cholesterol level of quail eggs was by giving 2% of water hyacinth meal and 5% of fish oil in the diet. It was concluded that water hyacinth can be used as local feed ingredients in quail diet until 4%. Abstract:
SUMMARYThis study determined the prevalence and antimicrobial susceptibility of Salmonella isolated from broiler flocks in Japan. Caecal dropping samples were collected from 288 broiler flocks between November 2007 and February 2010. Salmonella was prevalent in 248 (86·1%) broiler flocks. The top three serovars were S. Infantis, S. Manhattan and S. Schwarzengrund. S. Infantis was found in all regions tested in this study. However, S. Manhattan and S. Schwarzengrund were frequently found only in the western part of Japan. High antimicrobial resistance rates were observed against oxytetracycline (90·2%), dihydrostreptomycin (86·7%) and ampicillin (36·5%), and 258 (90·5%) of 285 isolates were resistant to two or more antimicrobial agents. Interestingly, 26·3% of isolates were resistant to ceftiofur, especially 38·1% of S. Infantis isolates, although its use in broilers has not been approved in Japan. This study showed that Salmonella is highly prevalent (86·1%) in Japanese broiler flocks, that 90·5% of Salmonella isolates were multidrug-resistant, and that S. Abstract:
Syncordulia (Odonata: Anisoptera: Libelluloidea) inhabits mostly cool mountainous streams in the Cape Floristic Region of South Africa. It is found at low densities in geographically restricted areas. Syncordulia is endemic to South Africa and, until recently, only two species were known, S. venator (Barnard, 1933) and S. gracilis (Burmeister 1839), both considered Vulnerable by the World Conservation Union (IUCN). Two new species, S. serendipator Dijsktra, Samways & Simaika 2007 and S. legator Dijsktra, Samways & Simaika 2007, were described from previously unrecognized museum specimens and new field collections. Here we corroborate the validity of these two new species using multiple genes and propose intergeneric relationships within Syncordulia. Molecular data from two independent gene fragments (nuclear 28S and ribosomal and cytochrome oxidase subunit I mitochondrial data) were sequenced and/or downloaded from GenBank for 7 libelluloid families, including 12 Syncordulia specimens (2 Syncordulia gracilis, 4 S. serendipator, 2 S. legator and 4 S. venator). The lower libelluloid group GSI (sensu Ware et al. 2007), a diverse group of non– corduliine taxa, is strongly supported as monophyletic. Syncordulia is well supported by both methods of phylogenetic analyses as a monophyletic group deeply nested within the GSI clade. A DIVA biogeographical analysis suggests that the ancestor to the genus Syncordulia may have arisen consequent to the break–up of Gondwana (>120 Mya). Divergence time estimates suggest that Syncordulia diverged well after the breakup of Gondwana, approximately 60 million years ago (Mya), which coincides with the divergence of several Cape fynbos taxa, between 86 – 60 Mya. DIVA analyses suggest that the present distributions of Syncordulia may be the result of dispersal events. We relate these phylogenetic data to the historical biogeography of the genus and to the importance of conservation action.

Abstract:

Syftet med uppsatsen är att beskriva och utreda en säljares upplysningsplikt vid försäljning av fast egendom. Frågeställningen aktualiseras därför att i rättsfallet NJA 2007 s. 86 har en säljare ålagts en upplysningsplikt trots att huvudregeln enligt gällande rätt är att säljaren inte har någon upplysningsplikt. I uppsatsen utreds även om utgången i målet kan anses förenlig med lagstiftning och rättspraxis på området. I syftet ingår också att besvara hur omfattande säljarens upplysningsplikt anses vara samt vilket prejudikatvärde NJA 2007 s. 86 bör ges.

Upplysningsplikt för en säljare finns inte upptagen i lagtext utan framgår av att denne enligt rättspraxis kan bli ansvarig för fel om säljaren vid köpet förfarit svikligt eller handlat i strid mot tro och heder enligt 30 § eller 33 § avtalslagen (1915:218). I proposition 1989/90:77 s. 41 påpekas att en säljare inte skall anses ha någon generell upplysningsplikt.

I NJA 2007 s. 86 ålades en säljare av fastighet en upplysningsplikt. Fallet rörde frågan om en köpare haft rätt att häva köp av fastighet på grund av fel utgörandes av buller från en motocrossbana oavsett att köparen inte iakttagit sin undersökningsplikt. Trots att banan var belägen på ansenligt avstånd från fastigheten, kunde buller höras på fastigheten i sådan utsträckning att bullervallar tvingades uppföras vid banan. Säljaren hade upplevt bullret som påfrestande och domstolen konstaterade att säljaren bland annat borde ha insett att banans existens skulle kunna vara av väsentlig vetskap för köparen. Säljaren borde därför ha upplyst köparen om banan. Köpet hävdes. Sedan rättsfallets tillkomst har domen debatterats flitigt. Anledningen till den uppmärksamhet som domen har fått är att säljaren ålades en upplysningsplikt som inte grundades på de ovan nämnda paragraferna i avtalslagen. Domen motiverades istället med att säljaren borde kunna bli felansvarig för sitt handlande utan att agerandet inordnas under avtalslagens bestämmelser samt på lagstiftarens vilja att anpassa felreglerna i jordabalken till köplagens regler om fel...

I samband med fastighetsaffärer har ansvaret mellan parterna delats upp så att köparen ansvarar för faktiska fel medan säljaren svarar för andra typer av fel. Köparen har dessutom en långtgående undersökningsplikt för fel som denne inte har möjlighet att senare påkalla mot säljaren. Säljaren har å sin sida en upplysningsplikt som dock inte är generell utan omfattar endast vissa fall. I samband med domen i NJA 2007 s 86 kom frågan om felets väsentliga betydelse för köparen och själva köpet som sådant upp. Tyvärr gjorde HD ingen utförligare utredning av vad som skulle bedömas eller omfattas av begreppet. Till följd av att rättpraxis saknar en utförlig förklaring kring vad som ska omfattas av begreppet väsentlig betydelse trots att det vid flera tillfällen använts i både rättspraxis och doktrinen har detta utgjort grunden för den här uppsatsen. Uppsatsen är framförallt baserad på uppgifter från aktuella rättsfall och doktrin för att genomföra en utredning kring begreppet, dess omfång och kriterier för att begreppet ska kunna vara tillämpligt. Efter den genomförda utredningen står det klart att det finns vissa kriterier som omfattas i bedömningen om felet är av väsentlig betydelse för köparen. Inget av kriterierna som kommit fram kan på egen hand användas för att bedöma begreppet utan dem är beroende av varandra. Dessa kriterier är inte absoluta utan varierar beroende av köparens och fastighetens unika karaktärer. Några av kriterierna är av mer objektiv karaktär och kan bedömas utifrån fastigheten medan andra kriterier är ytterst beroende av den specifika köparen och dennes krav gällande standarden på fastigheten och blir därav av en mer subjektiv karaktär
In connection with a property transaction there are some responsibilities that have been split up between the parties. The buyer of the property has a responsibility to investigate the property before to find out factual errors in the property. On the other side the seller has a kind of responsibility to inform the buyer and the seller is also responsible for other kinds of errors in the property. The buyer of the property do by law not have the right to refer a factual error against the seller that the buyer is supposed to find during the examination of the property at hand. Due to the ruling by the Swedish supreme court in the case NJA 2007 s 86 have the question about an errors essential reason for the transaction and the specific buyer occurred. The Swedish Supreme Court does not investigate further into this why this is the subject of this thesis. The investigation in this thesis have been done by looking into case law from the Swedish courts since there is not much information about the subject to find in the Swedish legislation. The investigations finds out that there are some criteria that need to be evaluated in connection to if a factual error is of essential reason for the buyer and the transaction. There are some criteria that are of a more objective level close to the actual property. On the other side there are also some criteria that are of a more subject material and closely linked to the actual buyer of the property. According to the investigation it is not possible to give an exact ruling about the subject due to the fact that every property and potential buyer is unique.

SammanfattningVid en fastighetsöverlåtelse är det mångt och mycket som skall regleras så som köpe-kontrakt med alla dess skriftliga krav. Gällande regleringen av fel i fastighet har lag-stiftaren valt att dela upp ansvaret mellan säljare och köpare för att underlätta an-svarsbördan. Faktiska fel i fastighet tillhör köparens ansvarsområde och denne har en undersökningsplikt som fastställer att denne inte äger rätt att gentemot säljaren åbe-ropa de fel denne bort upptäcka vid sin undersökning. Denna ansvarsfördelning har dock ställts på sin spets efter domslutet i NJA 2007 s. 86 då HD ålade en säljare an-svaret kring faktiska fel i form av en upplysningsplikt.Då HD inte lämnat någon vägledning för hur en liknande upplysningsplikt kan ak-tualiseras är rättsläget idag något oklart gällande faktiska fel och vem som bör stå an-svarig. Efter den i uppsatsen utförda utredningen av rättspraxis på området menar författaren att en upplysningsplikt endast bör aktualiseras i de fall där säljaren inte upplyst om ett fel denne haft kännedom om, men även förstått att köparen saknat kännedom om det aktuella felet. Vidare är det av vikt huruvida felet i sig är av en all-varligare karaktär.Därmed har brännpunkten i utredningen fastnat kring säljarens och köparens känne-dom kring felet och även hur allvarligt felets karaktär är. Dock kvarstår viss osäkerhet i rättsläget då HD inte avgjort fler rättsfall kring frågan efter NJA 2007 s. 86. Därmed kommer det bli tämligen intressant att följa framtida mål kring frågan och se hur HD argumenterar för upplysningsplikten och vilka faktorer som de finner avgörande för att upplysningsplikten kring faktiska fel aktualiseras.
AbstractWhen selling a property many matters need to be taken in account for, such as the contract between the parties with all the forms prescribed by law. When settling which party that should carry the liability regarding upcoming errors on the property the legislator has chosen to facilitate the burden of liability between the parties, a delegation that is a quite complicated matter. The buyer is obligated to examine the property for errors that are factual; it is laid down by law that a buyer does not pos-sess the right to refer to factual errors on the property that the buyer would have found while examining.Delegation of liability was subject of matter when the Swedish Supreme Court made the rulings in case NJA 2007 s. 86 public. The property owner was signed a general liability re-garding errors that are factual. The legal position is somewhat indecisive on this liability due to lack of reasoning from the Swedish Supreme Court on how to implement this new liabil-ity. When analyzing relevant case law the author is of the conclusion that, the property owner’s liability to inform the buyer regarding errors that are factual only should be imple-mented when he has not informed the buyer about the errors he has knowledge about. Furthermore the factual errors have to be of a severe nature and the property owner must have understood that the buyer was without knowledge of the errors. The focal point re-gards the knowledge of the property owner regarding the factual errors and the severity of the same. The author is of the conclusion that liability can be signed the property owner only in those cases where the errors is of a severe nature. However uncertainty remains pending rulings from the Swedish Supreme Court on the question. Thus, following the Swedish Supreme Court regarding further case law to see how they interprets the liability will most certainly be of interest.
