This chapter comments on Article 44 of the Rome Statute of the International Criminal Court. Article 44 is the basic text governing the appointment of qualified staff which make up the bulk of the employees of the Court. Earlier international criminal tribunals never bothered with such a provision. Most of its ‘norms’ merely stated the obvious. Nevertheless, article 44 addresses some contentious issues, notably the status of gratis personnel. Judges, the Prosecutor, the Deputy Prosecutors, the Registrar, and the Deputy Registrar are not contemplated by this provision, and are not considered ‘staff’ for the purposes of the Rome Statute.

Abstract:
This chapter looks at Beyer's final years. The summer of 1940 was busy for Beyer. She taught piano at a number of schools and private homes around the greater New York area, and the families for whom she taught were central to her social life. She also spent much of July house-sitting for the family of her gifted ten-year-old piano student Roland Leitner, with whom she was particularly close and to whom she dedicated one of her last works, the Sonatina in C, in 1943. The chapter then examines Beyer's illness, which became acute in 1941. According to Bertha Reynolds, Beyer received a diagnosis of multiple sclerosis in June of that year, and Reynolds later believed that to be the cause of her death. However, according to Beyer's death certificate, she had received a diagnosis of amyotrophic lateral sclerosis as early as 1938.

This chapter turns to the case study of Afghanistan. It first examines the Bonn Agreement that marked the start of the creation of the new Afghan State, and the status and development of the multinational military organization that was created to provide the security conditions conducive to the new State taking root, the International Security Assistance Force (ISAF). Next, this chapter looks at the status and development of the parallel military mission undertaken by the US-led coalition, known as Operation Enduring Freedom (OEF), to fight against al-Qaeda. Because of the way in which the missions of ISAF and OEF became blurred together in very real senses as the war in Afghanistan wore on, this chapter considers the challenges posed to the effective operation of the two status-of-forces agreement (SOFA) regimes. It also looks at how these challenges impacted and informed the new agreements that became effective in 2015.

Sciatic neuropathy presents with buttock pain worsened by sitting on the affected side and associated with ankle and knee extension weakness. Electrodiagnostic evaluation will help to distinguish it from peroneal or tibial mononeuropathies, lumbosacral plexopathy, or lumbosacral radiculopathy. It can be difficult to distinguish from a peroneal mononeuropathy due to the preferential involvement of the peroneal division of the sciatic nerve. EMG study of the short head of the biceps femoris allows for distinction between these entities. Long-term outcome and prognosis studies are sparse although Preservation of distal lower-extremity strength may be a significant predictor earlier and/or better clinical recovery.

The anxiety, obsessive-compulsive, and trauma- and stressor-related disorders are, together, the most common class of mental disorders. From a systematic review of prevalence studies across 44 countries, the global current prevalence for the DSM IV anxiety disorders was estimated at 7.3% (95% CI 4.8%–10.9%), suggesting that one in 14 people around the world at any given time has an anxiety disorder. Women are approximately twice as likely as men to have an anxiety disorder. Anxiety disorders are a substantial contributor to the heavy burden of disease conveyed by mental and substance use disorders worldwide, where they are second only to depressive disorders in years-lost-to-disabilility.

This chapters considers themes at the intersection of criminal and constitutional law in India. It considers two perspectives that address the tension between the competing goals of protecting individual liberty and promoting the public good. The first, the ‘liberty perspective’, that emphasises individual liberty by restricting State power, whereas the second, the ‘public order perspective’, that emphasises public order by limiting individual liberty and expanding State power. The chapter illustrates the liberty perspective by focusing on discussions in the Indian Constituent Assembly on criminal due process rights, and explores how the Indian Supreme Court’s understanding of these rights differs from that of the Constituent Assembly. It demonstrates the shift in the development of constitutional criminal procedure in India from a liberty perspective to a public order perspective.

This chapter provides historical background on Islamic institutions in Central Asia since the eighteenth century, as well as the social context of Islamic practices and institutions. It then explains the creation of the Central Asian muftiate, SADUM, in 1943 and its early struggles to cement control over selected Muslim communities. The chapter describes how this unsuccessful centralization drive set the tone for the more nuanced institution-building strategies that SADUM developed in the 1950s. The chapter also discusses early debates within the Communist Party (within the context of World War II) about how to adopt a more flexible posture toward religion after Stalin’s religious reforms of 1943‒44.

This chapter focuses on the Council for the Affairs of Religious Cults (CARC), created by Stalin in 1944 in order to supervise all officially recognized religions in the USSR with the exception of Russian Orthodox Christianity. CARC vigorously promoted an interpretation of Stalin’s 1943‒44 religious reforms that stressed moderation toward religion and the sanctity of freedom of conscience. As a result of this posture, CARC invested heavily in SADUM’s right to control Muslim communities and enjoy autonomy from local government authorities. It also began to sift through the maze of Central Asian Islamic practices in order to build a vision of a tolerable “Soviet Islam.” Thanks largely to CARC, the 1950s ended up being the most relaxed decade in terms of Soviet pressure on Islam.

Fast food probably originated in 1948, when Dick and Maurice McDonald re-designed their successful restaurant. Few of the brothers' "innovations" were entirely new. They specialized in a small number of familiar foods and applied systematic thinking to production. By fitting into existing and emerging cultures of age, family, leisure and consumption, the brothers' new outlet acquired a social life. Under Ray Kroc's leadership, McDonald's grew from its first outlet near Chicago to more than 300 locations in 44 states by 1961, when he bought out the McDonald brothers for $2.7 million. Over the next decade, McDonald's emerged as a dominant fast food chain in the United States, spread to Canada, and eventually turned into a global brand. Four themes—expansion, taste, systems, and social life—might be viewed as the basic elements of a global history of fast food, one that has similarities to the McDonald's story but is unique on its own. Technology and technocracy allowed food to become fast food.

Trauma remains the most common cause of death for all individuals between the ages of 1 and 44 years, and is the third most common cause of death regardless of age. It is also the leading cause of years of productive life lost. However, death rate underestimates the magnitude of the societal toll. Organized trauma systems have improved mortality by providing timely and expert care to severely-injured patients. Patient management consists of rapid primary survey, which should focus on the identification and simultaneous treatment of immediately life-threatening injuries. A classical ABC (airway, breathing, circulation) approach is recommended and is best carried out by a trained and practiced trauma team. The primary survey is followed by a more detailed examination, the secondary survey, which consists of a head-to-toe examination to identify all specific injuries. The secondary survey should be followed by investigation and definitive care.

The corpus of letters from and to Cicero that survives from the five-year period after Caesar’s crossing of the Rubicon in 49 BCE and his assassination on the Ides of March 44 BCE demands attention as a special medium of political commentary, intervention, and reflection—as well as community-building. The chapter shows how in a commonwealth shattered by civil war and in the process of being transformed in an autocratic key through Caesar’s victory and dictatorship, the letter offers Cicero a medium for various forms of political activism: in and through his correspondence, he tries to come to terms with Caesar, stake out a position for himself in Caesar’s world, and mediate between the centre of power and high-profile Republicans still languishing in exile in various places across the Mediterranean. These efforts are all designed to sustain a community of peers committed to a Republican commonwealth.

Capital punishment has been described as a ‘lottery’, implying that it operates at random; but in Ireland a pattern can be discerned. Murderers who avoided execution fell into one of six categories, with a clear gradient in how sympathetically they were viewed, as indicated by the duration of their coercive confinement and the likelihood that mercy would be recommended. At one end of the scale were those who destroyed an unwanted child, 92 per cent of whom aroused the sympathy of judge and jury and who were denied their liberty for 44 months, on average. At the other extreme were those whose treatment was capricious, only 20 per cent of whom received recommendations to mercy and whose average period of coercive confinement was 115 months. This chapter explores cases where the death penalty was imposed for the murder of an infant (usually, but not always, by the mother), romantic entanglements that had lethally soured, and sexual violence resulting in death.

Abstract:
This chapter looks at the significance of New York's Spanish-language press—specifically the weekly newspaper, Pueblos Hispanos: Semanario Progresista (Hispanic Peoples: Progressive Weekly, 1943–44)—exploring how Puerto Ricans employed journalism as a form of cultural and political transnational practice. Pueblos Hispanos promoted pan-Hispanism, the integration of Latin American countries, and socialist causes throughout the world, with a focus on Latin American countries such as Peru, Ecuador, Brazil, and Mexico. The paper offered detailed coverage of the politics of Puerto Rico and the Puerto Rican colonia while encouraging solidarity in the struggle for freedom and justice in countries across Latin America. In sharing news from Latin America and specifically Puerto Rico, the paper kept Spanish-speaking residents of New York City informed, establishing transnational connections as they tried to influence local politics.
