Abstract This chapter examines to what extent the Romanian welfare system covers resident citizens compared to foreigners residing in Romania and Romanians living abroad. In doing so, we analyse existing social policies aiming to ensure their coverage against a variety of risks at different life-cycle stages, including unemployment, poverty, sickness and old-age. The main conclusion is that the Romanian welfare state is open to all residents, regardless of their nationality, thus providing everyone equal grounds for accessing social benefits. The criterion of residence on the Romanian soil is, however, prevalent. This implies that relatively few social provisions are extended for non-resident Romanians, which represent an increasingly sizeable community given the intensity of migration outflows in recent years. Furthermore, the Romanian social protection system has had relatively little impact on reducing the risk of poverty and income inequality in the country, despite regular amendments during the last years.

AbstractDiscrimination and stigmatization are costly for the society by lowering economic growth, by reinforcing ethnic inequalities, by fueling political conflicts and by jeopardizing social cohesion. Moreover, victims of unfair treatment pay a high price as discrimination and stigmatization. Far from being passive victims, however, many members of minority groups develop and deploy individual and collective strategies to meet such challenges. This chapter focuses on the impact of discrimination – for economy and society, but mainly focusing on the consequences of discrimination for the targeted individuals and groups. It discusses the history and background of age discrimination law, protected characteristics, prohibited conduct on grounds of age discrimination, and key debates about how the law operates and how it might be improved in the future. There is no longer a default retirement age in the UK. If an employer wishes to retire an employee at a particular age, he has to have objective reasons for choosing that age. This chapter discusses EU anti-discrimination law, which, over the past decade and a half, has expanded significantly to cover a wide range of grounds and contexts. In addition to requiring equal treatment for women and men, the Treaty provides legislative competence to combat discrimination on a range of grounds. The Charter of Fundamental Rights, which has a chapter devoted to equality, has been incorporated into the EU Treaties. Article 21 of the Charter prohibits discrimination on any ground. Articles 8 and 10 of the Treaty on the Functioning of the European Union (TFEU) contain horizontal clauses requiring the EU to promote equality between men and women, and to combat discrimination based on certain grounds, namely sex, racial or ethnic origin, religion or belief, disability, age, or sexual orientation in all of its policies and activities. The UK version contains a further section analysing issues concerning EU discrimination law and the UK post-Brexit.

The objective of this chapter is to analyze the regime of the prohibition of discriminations on grounds of age in EU law in the light of the judgments of Wolf, Petersen, and Kücükdeveci. In particular, this chapter demonstrates that EU law in this matter is moving towards a conceptual uniformity due to the fact that the ECJ recognized that the various principles prohibiting discriminations on grounds of age derived from the EU general principle of equality. Such approach allows the ECJ to extend the scope of Directive 2000/78 and to strengthen the legal force of the principle of non-discrimination on grounds of age. These cases also reveal an orientation to a conceptual autonomy of the principle of non-discrimination on grounds of age vis-à-vis the other basis of discrimination that seems inherent to the specificity of discriminations on grounds of age and to the possibilities of exception to the prohibition of discrimination on grounds of age.

This chapter addresses equality and non-discrimination, which are explicitly acknowledged as foundational values in the EU context in Article 2 TEU. Similarly, the right to non-discrimination enjoys wide recognition in international human rights law. In the EU, non-discrimination had a specific role to play from the outset of European integration. Despite being founded without explicit reference to human rights, the original Treaty of Rome nonetheless prohibited discrimination on the basis of nationality (now Article 18 TFEU), as well as discrimination regarding pay between men and women (now Article 157 TFEU). Today, the scope of non-discrimination was enlarged, paving the way for Directives on racial equality and non-discrimination in the field of employment on the grounds of religion, disability, age, and sexual orientation. Moreover, the Court of Justice of the European Union (CJEU) identified the principle of equality as a general principle of EU law.
