Full textThe European Union decided on July 19th 2002 to enforce the International Accounting Standards set by the International Accounting Standards Board (IASB). Workers and Trade Unions became concemed with accounting standardization matters. Some said the adoptior of fair value measurement could impact the management of the firm and shorten its view. Others emphasized on the fact that EU listed companies would now have to recognize a liability for the present value of their defined benefit obligations and wondered wether there could be an impact on their social protection. This research's purpose was to investigate the impacts of accounting standards within the labour law. To do so, we came back on the accounting standardization phenomenon in itself and its effects on accounting social functions. We analysed the way it impacted French labour law through the institution of work councils, profit-sharing, dismissal, and the adoption of such tools as the bilan social (social balance sheet) and the bilan de compétences (skills balance sheet). We also tried to find out if accounting standards truly provided a true and fair view of both the nature and value of defined benefit obligations and of the employees' value for the firm. As we came to the conclusion that it did not, we proposed some solutions to reconcile labour law and accounting standards

Full textSince the tax reforms of 20th century, the alignment of tax law on private law and accounting gradually became the imperative principle under French law.Concerning business taxation, the principle of book and tax conformity has been established based on scattered provisions, the case law, the majority of tax scholars and the pragmatism of the tax authorities; but specially in the name of the operating unity of the law matching with the tax values such simplicity, legal certainty, taxation in accordance with ability to pay.With regard to the main business taxes, the book tax conformity has very wide reach which is both material and formal.Facing the worldwide adoption of the IASB accounting standards and the harmonization of the direct tax on businesses within the European Union, the French law, despite tension, chose the preservation of the book tax conformity in the process of the convergence of the General accounting plan toward the IAS-IFRS without the account of the optimal tax policy that must aim at broadening the tax base with rates reduction and the reduction of tax conformity costs at least within the EU.In the light of theses canons, legal logic, the example of the US law, the potentialities of a disconnection must be explored namely the current EU project of CCCTB, backed by France, based on a broad and autonomous tax base ; a fiscal balance sheet election; the reduction of transversal tax concepts

Full textIslamic finance has grown steadily for three decades now. The research question consists inchecking whether the existence of specific standards of financial accounting for Islamicfinancial institutions can be a hindrance to the goal of international accounting harmonization undertaken over the last forty years with the creation of the IASC. A first normative phase of research suggests that accounting values resulting from Islamic moral are incompatible with the accounting values of International Financial Reporting Standards (IAS / IFRS). However, a second descriptive and comparative phase confirms the convergence of Islamic Financial Accounting Standards (IFAS) to IAS / IFRS illustrating a "schizophrenic" behavior of the Islamic accounting standard-setting body (AAOIFI). Indeed, this organization sets up standards in compliance with Islamic jurisprudence for accounting presentation rules but that are converged with IAS / IFRS for valuation rules, while highlighting the "relational communication" of accounting data. To study the factors of this convergence, we take in a third explanatory phase, a dual theoretical approach (neo-institutional sociology and theory of sacred-profane dichotomy) and perform some interviews with members of two operational committees of AAOIFI: the Shariah Board and the Accounting Board (AASB). Thus, the accounting convergence is explained by the mimicry of Islamic banks and Islamic accounting standard-setting body that adopt the same thoughts and behaviors than conventional banks and the International Financial Accounting Standards Board (IASB). Similarly, "professional struggles" between the two operational committees of AAOIFI lead to the domination of the accounting committee members that are more influenced by an "IFRS culture" while directing some decisions of standard-setting process towards greater convergence of IFAS to the IASIFRS.Thus, conflicts between professional jurisdictions with ill-defined borders allow theestablishment of a scale of power and facilitate the conduct of mimetic, coercive andnormative isomorphism

Full textCette recherche apporte une contribution à la compréhension du processus de normalisation comptable par l’IASB à travers le thème de la définition et de la présentation du résultat comptable. L’objet de recherche se décline en deux questions : Comment se positionnent les différentes parties prenantes dans le processus de normalisation du résultat comptable en IFRS ? Comment s’explique la pugnacité de l’IASB à imposer une nouvelle définition du résultat comptable ? La première partie présente le cadre théorique retenu. La seconde partie expose les enjeux de la normalisation du résultat comptable. La troisième partie rend compte des trois études qualitatives menées à partir d’un corpus d’écrits constitué de l’ensemble des documents publiés par l’IASB sur le thème de la définition du résultat comptable : normes, exposé-sondage, papier de discussion, réponses reçus par l’IASB suite à un appel à commentaires et synthèses de réunions de travail. Les principaux résultats concernent le fonctionnement du due process et la nature de l’argumentation utilisée par le normalisateur pour imposer sa conception du résultat comptable. Il apparaît ainsi que les avis des participants au due process sont peu pris en compte par le normalisateur et que ce dernier cherche essentiellement à accroître la cohérence de son référentiel comptable en imposant une définition et un format de présentation du résultat comptable dont la pertinence pour les utilisateurs peine à être mise en évidence

Full textThe International Public Sector Accounting Standards Board (IPSASB) engaged in the elaboration of set of accounting standards in response to the growing need for financial reporting harmonization. Although the standardization process serves the public interest by relying on a Due Process allowing the participation of all stakeholders interested many studies analyzing the same process in the private sector reveal that this standards development procedure is not democratic.This research ensures continuity to studies undertaken in the private accounting context and analyzes the IPSASB Due Process. After highlighting the relevance of the participatory democracy approach the study mobilizes the three-dimensional theory of Lukes' power (1974 [2005]) in order to understand the phases preceding the development of the public accounting conceptual framework. The participatory process analysis involves identifying respondents and their change requests using thematic content analysis method. The study compares then different versions of the conceptual framework document in order to appreciate the sensitivity of the IPSASB to the comments addressed by the participants. This study emphasizes that changes brought by the IPSASB in response to the commentaries received during the Due Process remain minor ones. The Due Process appears then as a conservative mechanism that permits conflict avoidance and a consensus building strategy
