Abstract:
The politics of international law should be seen as a constant condition of international affairs within which the practices of international law and world politics unfold. This work aims to uncover several ways to understand the politics of international law, and in particular, to understand how law and politics interact within extended foreign policy sequences. These long foreign policy episodes are generally centered on a particular component, or body of, international law. Yet they are also subject to numerous elements and functions of international law which give form and content to a state’s policy development. These include complex compliance decisions, repeated public justifications over the terms of legal validity, learning what the law requires to meet thresholds of compliance, and states’ engaging in forms of legal rhetoric known as creative legal arguments: legal justifications that attempt to change international law when states face difficult policy choices. These various areas of international law highlight, in part, how international law ‘works’, or has effects within world politics. This project attempts to consolidate recent scholarship in this subject area by employing eclectic theorizing to explain the politics of international law as it unfolds in policy deliberation and choice. This task involves utilizing many insights from social constructivism and critical international legal theory, but also capturing the central ideas of legal realism, rationalism, and interactionalism in their ability to explain compliance decisions. From this point of departure, this work attempts to build theoretical bridges through a genuine interdisciplinary engagement with international relations and international law. Such an endeavor brings clarity to empirical events and historical legal phenomena. To demonstrate this claim, the analysis offered evaluates the foreign policy sequence in Canadian legal policy over the Arctic waters known as the Northwest Passage, a forty year legal dispute between Canada and the United States. The case study sheds light on how international law-making unfolds over time, by virtue of the numerous iterations between Canada and the United States in bi-lateral settings, international conferences, and the third codification conference on the Law of the Sea (UNCLOS).

Abstract:
The purpose of this thesis is to counterargue Simon Dalby’s claim that the national security perspective should be replaced by a global security perspective. Dalby argues that the national security is inappropriate to capture the current issues regarding the environmental security. To counterargue Dalby’s claim, I represent the national security perspective by using the perspective of states’ energy security, and compare current trends and issues regarding states’ energy security and the environmental security. This is done to argue that states can either chose to enhance their own energy security or the environmental security. Prisoners' Dilemma is then used as a theoretical framework on an explanatory example to provide insights about a dilemma, called the Energy- Environment Dilemma in this thesis, that curbs states’ ability to commit themselves to the cause of protecting the environmental security. The explanatory example used is the strategic importance of the Northwest passage for the U.S. and Canada. The results of this thesis suggests that the national security perspective, in combination with Prisoners’ Dilemma, is useful to provide insights about the Energy-Environmental Dilemma. Replacing it with a global security perspective would be to ignore a perspective which can provide insights about a challenge for states to commit to the cause of protecting the environmental security.

Abstract:
Climate change, with the possibility of an ice free Arctic ocean by 2015, has generated a renewed interest in the Arctic. This interest is being driven by the possibility of easier access to the abundant supply of resources such as oil, gas, minerals, and fisheries. Interest in Arctic tourism is also growing. Retreating sea ice will provide opportunities to avail of shorter routes for maritime traffic to and from Asia, North America, and Asia via the Arctic Ocean and Northwest Passage. In addition, the rate of population growth of local inhabitants in the Canadian Arctic is the fastest in Canada and one of the fastest in the world. A growing population will increase the demand for sealift resupply to Canada's northern communities. This work presents the first attempt to examine the role of privatization of icebreaking services in light of the present and projected shortages of infrastructure to support development in the Arctic. A unique combination of multiple methods within marine transportation, comprising of Delphi, grounded theory, and quantitative survey, is applied to investigate the potential for private involvement in the delivery of icebreaking services in the Canadian Arctic. This includes a novel application of Strauss and Corbin's Grounded Theory approach to develop hypotheses and relationships grounded in expert opinion. Although the Arctic Ocean may be ice free during the summers, there is still the issue of winter freezing and the threat of lingering multi-year ice which will impede marine transportation especially during periods of darkness and fog. The research shows that the future growth and development of the Canadian Arctic will undoubtedly require the use of designated icebreakers and ice strengthened vessels. However, Canada's fleet of Arctic icebreakers is ageing and considered unsuitable for future demands. While Canada has earmarked CAD $750M for the construction of one new icebreaker scheduled for delivery in 2017, the research shows that Icebreakers can be built outside of Canada for considerably less money and in less time. Also, the management and operation of the Canadian Coast Guard is under considerable security by the Auditor General of Canada. The research shows that not unlike others Arctic nations, there is potential for the creation of private-public partnerships in the delivery of Canadian Coast Guard services, principally icebreaking, in the Arctic.

Abstract:
The purpose of this paper is to analyse which navigational rights are applicable to foreign commercial vessels performing trans-arctic shipping through the Northwest Passage and how this affects the potential for Canada, through article 234 of the United Nations Convention on the Law of the Sea (UNCLOS), to issue national environmental legislation regulating pollution from ships. This is done through the method of legal dogmatics, characterised by analysis of the sources of law and the hierarchy between them. In this paper, the main sources of law employed are UNCLOS and relevant case law from the International Court of Justice. The main conclusions presented in the paper are that the Northwest Passage consists of a combination of territorial sea and exclusive economic zone, which generally means that commercial vessels are allowed innocent passage through the parts of the passage forming the territorial sea and are largely subject to freedom of navigation through those parts that form the exclusive economic zone. However, it seems likely that the Northwest Passage is a strait used for international navigation, in which case, the vessels passing through it are instead subject to the regime of transit passage. This would negatively affect the possibility for Canada to issue national legislation to regulate pollution from foreign vessels. However, as long as the Northwest Passage is covered by ice for most of the year, article 234 UNCLOS allows Canada far more leeway in regard to issuing anti-pollution legislation, both in the territorial sea and the exclusive economic zone, regardless of whether the Northwest Passage is found to be a strait used for international navigation. The passage regime applicable to foreign commercial vessels under article 234 could be characterised as a sui generis passage.

Abstract:

While the primary goal of the northwest Alaska Native village maternal transport program is safe deliveries for mothers from remote villages, little has been done to examine the impact of transport on the mothers and communities involved. I explore how present values (Western and Iñupiat cultural values) can influence the desire of indigenous women of differing eras and northwest Alaska villages to participate in biomedical birth practices, largely as made available by a tribal health-sponsored patient transport system. The work that follows portrays the varying influences on these women and their communities as they determine the level of importance for mothers to get to the hospital to deliver. I have enlisted viewpoints of Alaska Native families and women of different generations from various Iñupiat villages to help paint a picture of the situation. With this research, I ask, how do generations of mothers, transport situations, and villages compare in terms of experiences during the processes of these Iñupiat women becoming mothers? What gender, ethnicity, and power interplays exist in this dynamic helix of social and political elements (embodiment) during their periods of liminality? What are influences (biomedical and community) that contribute to a woman's transition to motherhood in this community? Moreover, how do women, families, and community members perceive the maternal transport policy today? I examine how the transport policy figures into stages of liminality, as these mothers and communities produce future generations. With theoretical frameworks provided by medical anthropology and maternal identity work, I track the differences concerning the maternal transport operation for Iñupiat mothers of the area. I compare the influences of cultural value systems present in each of the communities by birth era and location. Using content analysis to determine common themes, I found connections among presence of Iñupiat values, community acceptance of maternal transport, and expressed desire for community autonomy in maternal health care.

The superbly exposed Rocknest Formation, Wopmay Oroqen, N.W.T., Canada, is an early Proterozoic (l.B9 Ga) passivemargin carbonate platform. It is an eastward-thinning prism, 0 to 1,100 m thick, extending for over 220 km parallel to strike, and over 200 k.m perpendicular to strike. It contains from west to east, slope, outer-shelf, shoaloomplex, and inner-shelf facies. Slope facies are rhythmites, megabreccias and rhythmite breccias. Outershelf faciea include stromatolitic reefal boundstone and backreef ooid/intraclast grainstore. Shoal-complex facies are shallowing-upward cycles of tufa, cryptalgalaminite, laminated dolosiltite/lutite, overlain by tepees, breccias and pisolite; these formed a paleotopographic high, restricting an eastern "lagoon" from western ocean. Innershelf facies are dominantly asymmetric, shallowing-upward cycles of "lagoonal" mixed carbonates and siliciclastics, that grade up into intertidal stromatolitic dolomites; cyclic facies pass eastward into non—cyclic siliclastics of central and eastern "lagoon". The shelf was terminally drovmed during attempted subduction of the margin. Individual cycles are correlatable for over 200 km parallel to strike and over 120 Ion perpendicular to strike. Cycles formed in response to small, asymmetric (rapid rise/slow fall) eustatic oscillaticns in sea-level (= 10 m). An alpine glacio-eustatic model accounts for the origin of cycles best. During sea-level rise, rapid transgression and submergence of tidal flats occurred along eastern margin of the shoal-complex, followed by eastward expansion of the shoal—complex, and slow progradation of tidal flats over lagoonal facies during sea-level fall. Computer modelling of Rocknest cycle types across the platform provides important information on absolute l sedimentation rates and lag times.

In the Northern Athabaskan languages Tlicho Yatiì, Dene and Dene Dzage, copulas and auxiliary verbs are based on reflexes of two Proto-Athabaskan roots, *-LII and *-T’E’. I propose that in the first two languages, copulas with nominal complements show distributional differences that derive from a stage-/individual-level predicate distinction, and that historically, this distinction in the proto-language motivated the development of auxiliaries marking tense/aspect/mode distinctions solely from the copulas based on *-LII. Further, I propose that subsequent to this development, the original stage-/individual-level predicate distinction between the copulas disappeared in Dene Dzage, leaving the TAM markers as evidence of its historical existence. I provide support for these contentions with data from fieldwork in Tlicho Yatiì and from textual sources in all three languages, grounding the work in current theories of syntax and of temporal grammar.

This study examines how the legal dispute between Canada and the United States, on the status of the Northwest Passage could be resolved through diplomatic means. It asserts that Canada is unable to unilaterally defend its claim to the Passage because it is unwilling to allocate the financial and military resources necessary for such a large undertaking. Joint military enforcement and policy cooperation with the United States outlined in an informal regime in which both countries continue to agree to disagree on the legal status of the Passage, will provide a more cost effective and politically pragmatic alternative to the current dispute. The creation of such an informal bilateral regime should include future efforts for joint environmental protection of the region and the mutual collaboration between military and civilian personal as well as, government agencies in monitoring naval passage through the Strait.

Abstract:
This paper evaluates the current international environmental regime governing shipping through the Northwest Passage. Significant literature now exists claiming that the sole means by which to afford adequate protection for the Arctic marine environment is through a Canadian assertion of sovereignty. Historically, there have been strong challenges to Canada’s assertion of sovereignty over the waters of the Arctic Archipelago. Further, a focus on sovereignty could in fact be detrimental to the Canadian position, since it distracts from the practical issues involved in protecting the Arctic environment. Based on three primary sources of international law, namely the UN Law of the Sea Convention, the IMO Guidelines for Ships Navigating in Ice-Covered Waters and the activities of the Arctic Council, this paper argues that the current international regime provides a strong and adequate basis on which to pursue protection for the Arctic environment.

Seen as a valuable shortcut from Europe to Asia, the Northwest Passage could become an important shipping route, and Canada wants to be able to control it. However, the current Conservative Party government under Prime Minister Stephen Harper has led an aggressive, complex neorealist approach to securing sovereignty over the Passage consisting of loud diplomacy, military drills, and rejection of multilateral cooperation in the region. But this strategy that perceives Canada as a principle power is not sustainable. The government must accept that Canada simply cannot afford to unilaterally control and develop the Northwest Passage, and a liberal internationalist approach is what is needed. Rather than continuing to fight for international acknowledgment that the Passage is a domestic strait, Canada needs to recognize that the strait can be managed and developed much more effectively if it oversaw a multilateral development effort through the International Maritime Organization. La théorie transgouvernementale s’appuie sur l’existence de réseaux transfrontaliers entre composantes de l’État exerçant des fonctions similaires dans une optique de gestion de problèmes communs. Le transgouvernementalisme canado-américain se caractérise par un faible abandon de souveraineté des partenaires, une forte participation des acteurs régionaux, une informalité dans les relations et une intégration des secteurs privé et public et de la société civile au sein de réseaux mixtes. Le modèle de gouvernance binationale en place dans la région du bassin du Saint-Laurent et des Grands Lacs présente toutes les caractéristiques du modèle typique d’intégration transgouvernementale canado-américain. Une analyse poussée révèle en effet une matrice complexe et solide de réseaux transgouvernementaux dont les multiples ramifications s’étendent aujourd’hui beaucoup plus loin que le strict cadre des ententes sous l’égide desquelles ces réseaux ont pris naissance. Si le modèle de l’intégration par réseaux transgouvernementaux apparaît comme la solution retenue par les pouvoirs publics dans la gestion collaborative du bassin du Saint-Laurent et des Grands Lacs, s’agit-il du modèle à privilégier en ce qui a trait à la gouvernance du Passage du Nord-Ouest? Bien que le modèle en place dans la région du Saint-Laurent et des Grands Lacs ne puisse être reproduit intégralement relativement à la gestion du Passage du Nord-Ouest, un modèle d’intégration transgouvernementale, du « bas vers le haut », axé sur la mise en place d’une réglementation commune en matière de navigation et sur une intégration opérationnelle visant à assurer la mise en œuvre de cette règlementation, s’avère approprié pour la gestion du Passage du Nord-Ouest.
Transgovernmentalism is based on the existence of transboundary networks between sub-national entities exercising similar functions in order to address common issues. Canada-United States transgovernmentalism can be characterised by limited relinquishment of sovereignty by partners, significant participation of regional actors, informality in the relations and the integration of the private and public sectors and civil society into mixed networks. The governance model in place in the St. Lawrence basin and the Great Lakes region presents all the features of the typical model of Canada-United States transgovernmentalism. A thorough analysis indeed reveals a complex and strong matrix of transgovernmental networks which ramifications now extend far beyond the strict framework of agreements under whose auspices these networks arose. However, if transgovernmentalism is the solution adopted by both governments for the collaborative management of the St. Lawrence basin and the Great Lakes, it is an appropriate governance model for the management of the Northwest Passage? Although the model in place in the region of the St. Lawrence basin and the Great Lakes can not be entirely reproduced for the management of the Northwest Passage, a “bottom-up” transgovernmental model focused on the implementation of common rules in the field of navigation, and on collaboration at the operational level to ensure the implementation of this regulation, is appropriate for the management of Northwest Passage.

The new fact that the environment is becoming the main factor of geopolitical transformations in the Arctic region has been triggered mainly by climate change. In the North, this recent aspect of geopolitics, in correlation with the environment, leads sometimes to tensions between countries, but also to a need for cooperation. The question brought by such conditions is, to which extent will this climate change provoke cooperation or conflicts between the Arctic states. The purpose of addressing the problem is to understand what kind of challenges would be facing the international relations between circumpolar countries and how the environment is playing a geopolitical role in them. The objective of the main research question is to assess the importance of climate change over the geopolitics of the Arctic through several spheres of geopolitics: environment and bio-diversity, economic activity of the region, sovereignty and territoriality, security of the circumpolar states, and international and diplomatic relations. The trans-border and transnational nature of environmental issues is another important factor, since nature does not respect human-made boundaries and an environmental concern, such as climate change and its aftermaths, cannot be exclusive to a state along the lines of its borders.

The passive flux, a part of biological pump, is sinking organic matters produced by phytoplankton photosynthesis in the upper layer and escaped from regeneration in the euphotic zone. In addition, the vertical flux of dissolved organic matter (DOM) may be worth noting in the biological pump. Passive fluxes of carbon (C), nitrogen (N) and phosphorus (P) in the Northern South China Sea (NSCS) were respectively estimated to be 66.8±1.29 mg C m-2 d-1, 12.8±0.38 mg N m-2 d-1 and 0.99±0.07 mg P m-2 d-1 in the spring season, about 64.3±1.47 mg C m-2 d-1, 12.1±0.47 mg N m-2 d-1 and 0.93±0.04 mg P m-2 d-1 in the summer season, about 155±15.9 mg C m-2 d-1, 21.2±1.68 mg N m-2 d-1 and 1.79±0.19 mg P m-2 d-1 in an internal-waves induced event. The fluxes were also found to be 18.4~19.9 mg C m-2 d-1, 3.05~3.52 mg N m-2 d-1 and 0.29~0.38 mg P m-2 d-1 in the spring season in the Northwest Pacific (NP), and about 93.2 mg C m-2 d-1, 15.9 mg N m-2 d-1 and 0.97 mg P m-2 d-1 in a typhoon influenced event. Meanwhile, the organic carbon flux derived from the Vertical Generalized Production Model (VGPM) was 183±17 mg C m-2 d-1 in a winter anticyclonic eddy in NSCS. Passive fluxes of CNP were obviously enhanced by the special events (internal-waves and typhoons). Positive correlations were significant between the chlorophyll inventory and DIN inventory, and also significant between passive fluxes of CNP and DIN inventory in the euphotic zone. Thus, passive fluxes of CNP were apparently driven by primary production. The diffusion flux of DOM increased generally with depth and was enhanced obviously in the internal-waves condition. However, the DOM flux was not enhanced in a typhoon event. The proportions of CNP fluxes to the biological pump in NSCS are 66.5%, 74.3% and 71.3%, respectively, in regular spring, about 3.8±9.18%, 76.6±0.58% and 75.1±2.02%, respectively, in regular summer, and about 62.1%, 73.5% and 64.7%, respectively, in an internal-waves induced event, and about 62.6%, 65.6% and 64.7%, respectively, in regular spring in the NP. The passive flux accounts for the highest proportion of the biological pump. However, the proportion of DOM flux is insignificant in the biological pump.

During the 1740’s, Hudson Bay went from an obscure backwater of the British Empire to a locus of colonial ambition. Arthur Dobbs revitalized Northwest Passage exploration, generating new information about the region’s environment and indigenous peoples. This study explores evolving English and British representations of Hudson Bay’s climate and landscape in travel and natural history writing, and probes British anxieties about foreign environments. I demonstrate how Dobbs’ ideology of improvement optimistically re-imagined the North, opening a new discursive space wherein the Subarctic could be favourably described and colonized. I examine how Hudson Bay explorers’ responses to difficulties in the Arctic and Subarctic were seen to embody, even amplify, central principles and features of eighteenth-century British culture and identity. Finally, I investigate how latitude served as a benchmark for civilization and savagery, subjugating the Lowland Cree and Inuit to British visions of settlement and improvement in their home territories.

Abstract:
Time series of brightness temperature (TB) measurement obtained at various frequencies by the Advanced Microwave Scanning Radiometer–Earth Observing System (AMSR-E) are investigated to determine ice phenology parameters and ice thickness on Great Bear Lake (GBL) and Great Slave Lake (GSL), Northwest Territories, Canada. TB measurements from the 6.9, 10.7, 18.7, 23.8, 36.5, and 89.0 GHz channels (H- and V- polarization) are compared to assess their potential for detecting freeze-onset (FO)/melt-onset (MO), ice-on/ice-off dates, and ice thickness on both lakes. The sensitivity of TB measurements at 6.9, 10.7, and 18.7 GHz to ice thickness is also examined using a previously validated thermodynamic lake ice model and the most recent version of the Helsinki University of Technology (HUT) model, which accounts for the presence of a lake-ice layer under snow. This study shows that 18.7 GHz H-pol is the most suitable AMSR-E channel for detecting ice phenology events, while 18.7 GHz V-pol is preferred for estimating lake ice thickness on the two large northern lakes. These two channels therefore form the basis of new ice cover retrieval algorithms. The algorithms were applied to map monthly ice thickness products and all ice phenology parameters on GBL and GSL over seven ice seasons (2002-2009). Through application of the algorithms much was learned about the spatio-temporal dynamics of ice formation, decay and growth rate/thickness on the two lakes. Key results reveal that: 1) both FO and ice-on dates occur on average 10 days earlier on GBL than on GSL; 2) the freeze-up process or freeze duration (FO to ice-on) takes a comparable amount of time on both lakes (two to three weeks); 3) MO and ice-off dates occur on average one week and approximately four weeks later, respectively, on GBL; 4) the break-up process or melt duration (MO to ice-off) lasts for an equivalent period of time on both lakes (six to eight weeks); 5) ice cover duration is about three to four weeks longer on GBL compared to its more southern counterpart (GSL); and 6) end-of-winter ice thickness (April) on GBL tends to be on average 5-15 cm thicker than on GSL, but with both spatial variations across lakes and differences between years.

Abstract:
The importance of philosophy and the philosophical is not on the lips of many library and information science practitioners and scholars, even though pervasive in information science theory and practice. This investigation focusses on the relationship between information science, philosophy and the philosophical thinking attitude revealed through theoretical and practical concerns. This includes theory generation arising from the philosophical in exploring the role of philosophy and the philosophical. It takes into account perceived problems in recognising, accepting and rejecting the role of philosophical approaches and the impact in determining the nature and the theoretical and practical aspects of information science. The problem posed by not recognising philosophical approaches, is that the benefits of philosophical thought cannot be drawn on to understand how knowledge, information and its communication manifest through language and language expression. Three pathways are used in order to reveal philosophy and the philosophical in information science, the connection between information retrieval and language, and philosophical thinking attitudes at theoretical and practical levels. The value of the study lies in contributing towards knowledge and awareness of the effect of philosophical theories on problems seen as central research areas in information science and its domains. The methodological approach gives preference to the comparative and pluralistic epistemology of a journey. The study examines Peter Ingwersen’s cognitive perspective and information retrieval interaction, David Blair’s treatment of information retrieval with natural language as primary concern, and Fanie de Beer’s contribution on the inventive act of reading and knowledge organisation, as representative figures. It is argued that information science cannot avoid philosophy in its different manifestations. By understanding how philosophy manifests in information science, such as the role of philosophy revealed through language and information retrieval, an opportunity is offered to reconsider the discipline’s interdisciplinary nature in the existing scholarly and societal environment, and the contribution of its historical development to the assumptions and philosophies underlying the discipline. A further empirical study on how philosophy and the philosophical are embedded in information science research is recommended. It could investigate the influence of philosophy on decisions made by South African universities to redesign information science research and study programmes.

Dit sluit die skepping in van teorieë wat uit die filosofiese voortspruit met die ondersoek na die rol van filosofie en die filosofiese. Dit neem kennis van vermeende probleme met herkenning, aanvaarding en verwerping van die rol van filosofiese benaderings en die impak op bepaling van die aard en die teoretiese en praktiese aspekte van inligtingkunde.
