Abstract:
This paper discusses the quality of prison life and prison size in relation to the notion of ‘Scandinavian exceptionalism’. Using the questionnaires ‘Measuring the Quality of Prison Life’ (MQPL) for prisoners and ‘Staff Measuring the Quality of Prison Life’ (SQL) for staff, data were collected from all 32 closed prisons in Norway. Based on the assumption that prison officers’ working lives, their perspectives and their values influence prisoners’ quality of life, the main focus in the paper is on the officers. Small prisons (fewer than 50 prisoners) obtain more positive results than medium-sized (50–100) and large (more than 100) prisons, on several dimensions measured. The relationship between officers and prisoners seems to be of better quality in small prisons than in medium-sized and large prisons. Officers in small prisons also report more positive relationships with senior management than their colleagues in medium-sized and large prisons. The results are discussed in light of previous studies on officers and prison working life dynamics.

AbstractThe social world of prisons is typically described as hierarchical in the prison sociological literature where offence type, displays of (hegemonic)masculinity and involvement in the informal economy impact prisoners’ social standing. Based on fieldwork and interviews (N=181) with men and women in seven different Norwegian prisons, this article describes prisoner cultures where such hierarchies were either absent or of little significance. Rather than pointing out differences in status and standing, the prisoners interviewed tended to insist that they were equal and the same. In order to make sense of this finding, which contrasts dominant accounts in the prison sociological literature, the article engages with scholarship on the role and roots of egalitarianism in Norwegian society. Organizing the discussion around the concepts of ‘egalitarian permeability’, ‘pragmatic egalitarianism’ and ‘social labour’, the article argues that the egalitarian culture of Norwegian (open) prisons is shaped by norms in the wider Norwegian society and the pragmatic choices prisoners make to cope socially in prison everyday life.AbstractI fengselssosiologien blir fengselets sosiale liv ofte beskrevet som hierarkisk. Studier har vist at lovbruddstype, (hegemonisk) maskulinitetog involvering i den illegale økonomien har betydning for fangenes sosiale status og posisjon. Basert på feltarbeid og intervju (N=181) med menn og kvinner i syv norske fengsler viser denne artikkelen at slike hierarki var enten fraværende eller av liten betydning. I stedet for å påpeke forskjeller i status og posisjon vektla fangene som ble intervjuet ofte at de var like og likeverdige. For å forstå dette forskningsfunnet, som bryter med beskrivelser i deler av forskningslitteraturen, henter artikkelen inspirasjon fra forskning om den norske egalitære kulturen. Ved å organisere diskusjonen om begrepene ‘egalitarian permeability, ‘pragmatic egalitarianism’ og ‘sociallabour’ argumenterer vi for at den egalitære kulturen i norske (åpne) fengsler er formet av normer og verdier i det norske samfunnet, og av de pragmatiske valgene fangene gjør for å håndtere fengselshverdagen best mulig.

AbstractThis article discusses the use of prisons as punishment in Norway during the period 1850 to today. It looks at ideas about prisons and how they manifest themselves in prison sites and buildings. It also investigates the implications of various prison ideas and designs to prisoners and prison policy.Parts of the article are based on an exhibition that took place in Oslo in 2018: Six Norwegian prisons 1850-today: Ideas, spaces, experiences. The exhibition included a total of 20 interviews in which prisoners were asked whether prison ideas and designs were relevant to them. The article ends with a discussion of the implications of architecture for prisons, their purposes, and their effects. AbstractDenne artikkelen diskuterer fengsel som straff i Norge fra 1850 til i dag. Den ser på fengselsidéer og hvordan de er kommet til uttrykk i fengselsområder, bygninger og interiør. Artikkelen spør videre om disse endringene, slik fengsler fremstår i dag, har betydning for fanger. Dette leder til en diskusjon om hvilken betydning fengselsidéer og arkitektur kan ha for fanger og for fengselspolitikken.Artikkelen bygger for en stor del på en utstilling i Oslo i 2018: Six Norwegian prisons 1850-today. IntroductionWhile prison inmates have an increased risk of mental illness, psychiatric services are often less accessible and insufficient for this group. A low level of awareness or a fear of becoming stigmatised could also influence the help-seeking behaviour of some inmates.ObjectivesTo study the knowledge and beliefs regarding mental health and mental illness as well as the help-seeking behaviour of inmates in Norwegian prisons.MethodsWe describe a study of help-seeking behaviour and mental health literacy of prisoners. This is a qualitiative study involving in-depth interviews with inmates in prisons in North Norway.ResultsRecruitment and data collection is ongoing. Central topics in the interviews are inmates’ associations regarding positive mental health and how they can enhance their own well-being while in prison, and how other external factors can contribute to increased well-being. Furthermore, the inmates are asked about their attitudes, beliefs, and knowledge regarding mental illness, and what they think might be factors that can contribute to the development of mental illness. Moreover, we cover topics such as the inmates’ beliefs regarding the treatment of mental illness, strategies for handling such health problems, and sources of information regarding mental health and mental illness.ConclusionsThe study will increase knowledge about how prisoners think about mental health and mental illness and the help-seeking behaviours of prison inmates. In a next step, this understanding can be utilized in improving information about well-being, mental illness, and psychiatric services to prisoners.

Within the past three decades, the Scandinavian countries have acquired an international reputation for the development of innovative and humane prisons. Most of the favorable attention from journalists and social scientists has centered upon the socalled “model prisons,” which are typically smaller, newer, and “open.” However, the majority of Scandinavian prisoners are still incarcerated in the larger, older, locked prisons that are rather traditional in design and function. One might question whether these traditional prisons are, in fact, superior to American state prisons and whether they would meet emerging U.S. standards for conditions of confinement. This investigation surveyed the nature of prison programs, staffing ratios, living conditions, and visiting conditions within 16 “closed” or secure prisons, including 4 each from Norway, Sweden, Finland, and California. On most measures, the conditions of confinement were most severe in California prisons, much less severe in Finnish prisons, and least severe in Norwegian and Swedish prisons.

Abstract:
The aim of this cross-sectional study was to analyse the educational background, educational desires and participation in education among three samples of female prisoners with Norwegian citizenship in Norwegian prisons over the period from 2009 to 2015. The female participants were n = 106 in 2009, n = 74 in 2012 and n = 79 in 2015, respectively, with a mean age of 38 years. Moreover, the study examined whether self-reported learning difficulties could predict participation in education activity while incarcerated. The results show that the female prisoners included in this study increased their educational level over the studied years. Similar education patterns were observed in the 2009 and 2012 samples regarding all educational levels for the female prisoners. A different pattern was observed in the 2015 data, with 44.3 % having mandatory education as their highest level compared to 57.6 in 2009 and 53.4 in 2012, respectively. However, these differences in percent between the samples at any education level were not significant. Significant differences were, however, found regarding the desire for upper secondary education between the samples in 2009 and 2012, and 2009 and 2015, respectively. In 2009, 20.2% reported upper secondary education as an educational desire, whereas 35.2% reported this as a desire in 2012, and 36.7% in 2015. Participation in educational activity during incarceration also changed during the time period of these studies. Many of the female prisoners participate in educational activity, but a significant difference was found between the samples in 2012 and 2015 as there was a decrease in activity. In 2012, 41.9% did not participate, whereas in 2015, almost 60% (58.2) of the female prisoners did not participate in any educational activity. Both the highest completed education level and self-reported learning difficulties predicted participation in education activity among the female prisoners in the 2015 sample.

It is investigated in this article how the task of rehabilitation and improvement during imprisonment is understood and interpreted by prison officerswho are responsible for guarding, handling and interacting with the prisoners in Norwegianhigh-security wings. Firstly, I will describe how punishment is justified in the criminal justice literature and in policy documents in the perspective of the so-called improving effects of punishment. After the presentation of data materials and method,I present two different approaches in the prison officers’ affecting and organizing work with prisoners. One approach emphasizes that the work of prison officers contains a correctional element; the officers should practice their role with a conscious intention of transmitting a set of values, attitudes and skills to the inmates. The other focuses on the officers’ role as an organizer of opportunities and ways to create better living conditions for the prisoners. Here the attention is primarily on the inmate’s future, on how things will be for them when they are released from prison: if, for example, they have jobs to go to and/or have a permanent place to live. The article ends with some value-oriented reflections on these two approaches.

In the article I discuss the ideology underlying the Norwegian Correctional Service’s institutions’ treatment of prisoners, analyzing some of its core concepts, such as “humanism”, “normalizing”, “rehabilitation”, “subject- and objectifying”. The article emphasizesthat the service has developed through two basic ideas; understanding prisons as (i) penal institutions; and (ii) institutions for rehabilitation. Both of these ideas have been strongly influenced by modern and traditional managerial principles, which are strongly governedby economic considerations and efficiency demands. The historical analysis reveals the roots of the prison system as a penal institution with rigid disciplinary, control and security practices, which dominate and influence the institution’s content and form. The ideology of rehabilitation, which contrasts this view, can be separated into two directions and forms of practice, wherein one is adjusted to the system (and not the individual) and the other is somewhat more adjusted to the individual. In the article, I argue that the contradictions in the prison system stems from its historical and ideological roots. Furthermore, I argue that the prison system has been characterized by a fixation on practice, wherein the measures for rehabilitation and treatment of the prisoners implies a technocratic and objectifying perspective. The prison system remains a repressive and powerful system that has to be studied and discussed more thoroughly. We tend to focus on the positive functions of the system, neglecting that the system also inflicts inhumanity and suffering.

Abstract:
This article examines the Norwegian prison system, which focuses on the rehabilitation of inmates and their reintegration into society, and whether this system can be implemented in Australia. It focuses on the individual experiences of inmates within open and closed Norwegian prison systems and highlights the differences and challenges they face. Open prisons aim to mimic community living by affording inmates greater freedoms. However, open prisons also introduce complexities such as confusion, anxiety, ambiguity, relative deprivation, and individual responsibility. Closed prisons, like the renowned Halden Prison, present different challenges which are similar to those in classic styles of prisons. Inmates within these two systems express mixed views about the rehabilitative effects they perceive the prison to have. The article also explores the social perceptions of punishment and how they influence the implementation of similar prison models in other countries. This analysis aims to contribute to the ongoing discourse on the effectiveness of various prison systems in reducing recidivism and promoting inmate rehabilitation across different societies.

Abstract:
This essay closely studies several works written by American male writers--either while the author was in an American prison, or shortly after he was released. The first works studied, from the nineteenth century, introduce the themes and questions for the later discussion of the other works, all of which are taken from the twentieth century. A central focus of the essay is on the process by which all of the authors studied attempt a textual reversal of the positions of reader and author. In each of the works, the reader, generally seen as a member of 'outside' society, is portrayed as a representative of the imprisoning society. Thus, the textual confrontation is between a prisoner/author and a warden/reader; and the subsequent reversal that takes place through the medium of the text places the reader in the position of being a prisoner, with the author becoming the prison-authority, or warden. This reversal is used by the authors examined as means or attempt at freeing themselves from both the defining and imprisoning texts of society, as well as from the actual prison where the author finds himself. The writing of the prison-text, therefore, is a verbal act intimately associated with the gaining of various forms of at least visionary freedom.

This thesis is a comparative examination of prisoners' rights in England and Germany. The thesis has three dimensions: first, it is a description of the legal status of the prisoner in Germany and England; second, it is an examination of the social, political and cultural dynamics which have shaped prisoners' rights in each jurisdiction; and third, it is in itself an exercise which seeks to address the problems of comparative law which are identified in the introduction. England and Germany have been chosen as comparators as their respective approaches to prisoners' rights present illuminating contrasts. In England, despite significant judicial activity in the development of a prisoners' rights jurisprudence, prisoners' rights protection remains partial and equivocal. Many aspects of prison life are left within the realm of executive discretion, and the present Government, much like its predecessors, is unlikely to entrench a bill of prisoners' rights. Proponents of prison reform in England argue that the system of prisoners' rights protection is inadequate, not only in terms of the rights which prisoners can claim, but in terms of the possibilities of enforcement and the independence of enforcement bodies. This equivocal commitment to rights in England is heightened when juxtaposed against Germany's highly articulated rights culture and ambitious system of prisoners' rights protection under the Prison Act 1976. The German Prison Act, which is underpinned by a considerable constitutional jurisprudence on prisoners' rights, sets out foundational principles of prison administration, affords prisoners positive rights, defines the limitations of prisoners' constitutional rights and provides prisoners recourse to a Prison Court. Moreover, the rights and principles under the German Prison Act have been developed and refined in a substantial body of prison law jurisprudence over the last thirty years. Chapters one to three of the thesis make available to an English audience an in-depth account of the conception and protection of prisoners' rights in Germany and the broader context in which this has taken place. Chapters four and five of the thesis examine the method and manner of conceiving of the prisoner's legal status in England in the light of the German conception and explore the deeper political and cultural reasons for the divergence between England and Germany.

Abstract:
This research explores prisoners’ attitudes for undertaking distance-learning courses whilst in prison, and considers both the benefits and the difficulties experienced by prisoners as a result of their academic work. It is based on over 35 questionnaires completed by 300 current prisoners. The research was conducted in three prisons throughout the country in three different provinces. In addition to providing an in-depth account of the role that education can play during a prison sentence and beyond, it is intended that the experiences shared by these prisoners will provide the basis for additional guidance and support for future distance-learning inmates. The data of this study show that the prisoners in general demonstrated positive attitudes toward using distance education whilst in prisons. The remarkable finding was that the prisoners were self-motivated to engage in the computer and Internet use to continue their academic studies whilst in prison and learn new skills for getting jobs after prison. This finding supports the possibility of the prisoners’ engagement in distance education courses offered at prisons.

Abstract:
Since 2015, Colombia has been pioneering technology education in prisons by providing Telework certifications and bringing ICT access to prisoners in civil and military prisons. The goal of this program is for convicts to provide IT services to enterprises as part of their resocialization process. Although this program presented clear benefits for the prisoner’s resocialization process, implementing this initiative as a service was challenging due to several restrictions from the context and the grey areas in the related regulations that the prison ecosystem presented. In 2017, two years after the first phase of the program was deployed, the Ministry of Colombian Information and Communication Technologies (ICT), decided to perform a Participatory Design Process to analyze the program status, flaws, and opportunities for refinement so that it could be adjusted to enhance the prisoners’ resocialization process. This paper describes how the Participatory Design Process was carried out, as well as the lessons learned from the social, academic, and regulatory perspectives.

Abstract:
Normatively highly developed standardization of the provision of health care services in penitentiary institutions fails to neutralize the extreme non- complementarity between the concept of health and the concept of prison. Prison in itself endangers the health of prisoners, and the experience of going to prison overlaps in many ways with the experience of a serious (incurable) disease. This internal contradiction also opens up a special organizational-ethical dimension of health care in prisons, due to which health care services in prisons still have a strong tendency to oscillate in the space between punishment and medical care, between control and human rights, and a convict with health problems is evidently not (still) in the same position as every other patient. Security reasons can often be in conflict with the principle of complete professional independence of the medical staff and the necessary relationship of confidentiality between the medical staff and the convict who needs medical assistance and care. The paper points out the contradictions and complementarity of the convict-patient position and discusses important issues of the ethics of prison medicine, as well as the organizational aspect of the health care system in penitentiaries.

Being a correctional entity, the Malaysian Prison Department through its vision and mission is responsible to provide a safe detention and rehabilitation. One of its objectives is to ensure suitable and effective correctional programmes for all categories of inmates. One of the programmes set up by Malaysian Prison Department is to have a collaboration with higher education providers to offer tertiary education for inmates in order to equip them with knowledge and skills to pursue work after release. One of such engagement is the provision of the undergraduate and postgraduate programmes for inmates in selected Malaysian prisons by Open University Malaysia (OUM). OUM conducts undergraduate and postgraduate degree programmes for prison inmates. This study aims to determine the factors influencing prison inmates’ decision to pursue higher education in the prisons. 37 respondents from a total of 68 prisoners-students are involved in this study. The Stakeholder Theory and the Theory of Planned Behaviour were adopted as the underpining theories as they are related to attitude and planned behaviour. The Stakeholder Theory enables us to comprehend how a diverse range of stakeholders impact prisoner learning and comprehend the expectations and duties of distinct stakeholders regarding prisoner learning. Whereas, the Theory of Planned Behaviour postulates that an individual’s behaviour is determined by their intention to engage in such behaviour. Factor analysis was utilised to identify if these three factors (student attribute, social influence and financial aid) influenced prison inmates’ decision to pursue Open University Malaysia’s programmes in prisons. Results of the multiple linear regression indicated that there was a significant effect between student attribute and decision to study, which means that inmates' own characteristics will motivate them to continue learning which can lead to future success in their pursuit for excellence in tertiary education.

Abstract:
This policy brief delves into France’s strategy for managing Islamist terrorists and radicalized prisoners (2015-2023). The first part spans the evolution of challenges within the French prison system, covering the return of foreign terrorist fighters (FTFs) and responses to terrorist attacks carried out between 2015 and 2018. The second part details key approaches for managing radicalised inmates, encompassing assessment, prison regimes, rehabilitation, monitoring, and post-release reintegration. The last section explains why it was necessary to identify the Salafi-jihadism threat to tailor prison approaches specifically to this ideology. The recommendations underscore the importance of effective communication regarding the necessity to tailor prison regimes to levels of violent radicalisation while upholding human rights. Finally, the policy brief advocates adapting counter-terrorism strategies to address Salafi-Jihadi ideology. The analysis presented in this paper draws upon the professional experience of its author, who in prisons has dedicated six years to working in P/CVE within the French prison system, as well as insights gathered from open-source materials.

This report sheds light on challenges faced by Transgender persons in Indian prisons. The report analyses the international and legal frameworks in the country which provide the foundation for policy formulations with regard to confinement of LGBT+ persons, with particular reference to the Transgender community. This report also documents the responses received to right to information requests filed to prison headquarters across the country, which in addition to providing the number of Transgender prisoners in Indian prisons between 1st May 2018 to 30th April 2019, also provides relevant information on compliance within prisons with existing legal frameworks relevant to protecting the rights of Transgender persons in prisons, especially in terms of recognition of a third gender, allocation of wards, search procedures, efforts towards capacity building of prison administrators etc. The finalisation of this report has involved an intense consultative process with individuals and experts, including representatives from the community, community-based organisations as well as researcher and academicians working on this issue. This report aims to enhance the understanding of these issues among stakeholders such as prison administrators, judicial officers, lawyers, legal service providers as well as other non-state actors. It is aimed at better informed policy making, and ensuring that decisions made with respect to LGBTI+ persons in prisons recognize and are sensitive of their rights and special needs.

Abstract:
England and Wales have the highest per capita prison population in Western Europe. In October 2023, over 88,000 people were imprisoned, in an estate with a maximum capacity of 88,890. This was the highest number recorded. 94% of people in prison are adult men and the adult male prison estate is almost full. The prison estate is operating at 99% of its usable operational capacity and over 60% of prisons are overcrowded. Drivers of the current prison population growth include changes in sentencing policy (including increased sentence lengths). Other factors include remand, recall, reoffending and policing. The number of people given immediate custodial sentences has fallen from 98,044 in 2012, to 67,812 in 2022. This suggests that the prison population increase is not driven by more convictions. Nearing capacity can have negative implications for the safe operation of prisons, and for the health, wellbeing and rehabilitation of people in prison. Government action to avoid exceeding capacity includes expanding the prison estate and releasing some prisoners up to 18 days early. As of December 2023, three relevant bills are progressing through Parliament: the Sentencing Bill 2023, the Criminal Justice Bill 2023, and the Victims and Prisoners Bill 2023. Each contains a range of measures, with some likely to reduce the prison population and others likely to increase it. Various stakeholders have proposed additional policy options, such as the greater use of non-custodial sentences, and interventions to reduce the remand and recall populations. Some experts in this field have highlighted the role of public opinion in relation to sentencing policy and the relationship between prisons and the wider justice system. Evidence suggests that the public generally overestimate crime rates and underestimate sentence lengths, and that better-informed members of the public are less likely to view sentences as lenient. More high-quality research is needed to better understand the drivers of increased sentence length and to evaluate health and rehabilitation programmes in the prison context.

Abstract:
The study explored the views of prison officer students and their supervisors regarding (1) prison officer education, (2) prison officers’ continuing professional development, (3) prison officers’ training needs and opportunities, and 4) the future of prison work. A total of ten interviews were conducted in a prison in Norway in October 2021. The prison officer students who were interviewed expressed satisfaction with their education. Communication was highlighted as the most relevant learning topic. Regarding the continuing professional development of prison officers, learning about communication and mental health issues were expressed as areas of particular significance. Learning about services for female prisoners was also brought up. The issues that impede prison officers’ participation in training were the limited time to arrange training and the lack of financial resources. The importance of collaborating and learning together with mental health professionals was expressed, but borrowing learning resources from the neighbouring disciplines was considered to be problematic because of the specific character of prison work. The future of prison work was discussed from different viewpoints. The numbers of aggressive prisoners, old prisoners and those with mental health issues were expected to increase. The need to continue the development of prisons and concerns over the future role of prison officer were also expressed. The report provided five suggestions for future research concerning correctional services.
