Abstract:
The implications of a Fusion Law for the management and treatment of people with impairments or disturbances in the functioning of mind who have committed offences is examined in this chapter. Concerns about public protection under a Fusion Law have been raised, particularly in relation to serious offences. Fusion Law principles can be applied with fair procedures regarding sentencing and hospitalization for those with a mental illness. The public can be protected on the same basis as for those without a mental illness. Options for extended sentences exist in many countries, equally applicable

Each Concentrate revision guide is packed with essential information, key cases, revision tips, exam Q&As, and more. Concentrates show you what to expect in a law exam, what examiners are looking for, and how to achieve extra marks. This chapter examines the defences of age, insanity, automatism, intoxication, and mistake. If D is under the age of ten, he is deemed incapable of criminal liability. Insanity is where D proves he had a disease of mind which caused a defect of reason so that D did not know the nature and quality of his act or that it was wrong. Non-insane automatism is an asse

This chapter presents an English translation of George Rust’s two poems, contained in his Latin academic text entitled Act Verses: Scripture teaches the resurrection from the dead, and reason does not contradict this and The soul, separated from the body, does not sleep. It surveys several areas where this convergence occurs: criminal cases in which religious delusions of the defendant figured prominently in the defense; civil cases involving the right to refuse treatment secondary to religious beliefs; the complexities of applying empathy to forensic evaluations where the physician’s task is not focused on healing the individual; the challenges of permitting certain forms of religious practice in maximum security forensic hospitals; an
