Abstract:
This chapter discusses Article II of the Bermuda Form, which addresses the mathematics of the policy. The Article lays out the framework that translates the general grant of coverage into an actual financial response. It sets out the principles that determine at what point the insurer's liability to the policyholder is engaged; the relevance and consequences of underlying insurance; how the level of policy response to an excess liability is determined; and how it is limited. It also addresses the financial complications that may develop when a policyholder notifies an occurrence to the insurer, and subsequently notifies an integrated occurrence that includes the earlier notified individual occurrence. Finally, the Article addresses the special circumstances relevant to the presence of an insured joint venture, partnership, or other similarly organized, non-corporate entity in the equation.

Abstract:
This chapter discusses the activities of the Mormon Tabernacle Choir under conductor Anthony Lund, with particular emphasis on its foray into broadcasting. In October 1915, the Salt Lake Telegram reported that Evan Stephens was being fired. A high Church committee, it said, had notified the First Presidency that it was time for Stephens to go in favor of a younger and presumably more flexible, less autocratic man. Lund was chosen as the new conductor, with Brigham Cecil Gates as his assistant. This chapter first considers Stephens's resignation as Choir conductor before describing Lund's initiatives for the Choir. It also looks at the Choir's repertoire and recordings as well as its television and radio broadcasts. Finally, it cites the appointment of Spencer Cornwall as Lund's successor.

Abstract:

Full text
Abstract:
This chapter examines Article 39.1 of the Vienna Convention on Diplomatic Relations which deals with the commencement of privileges and immunities given to members of the diplomatic mission of the sending State. The Article states that every person entitled to privileges and immunities shall enjoy them from the moment he enters the territory of the receiving State on proceeding to take up his post or, if already in its territory, from the moment when his appointment is notified to the Ministry for Foreign Affairs or such other ministry as may be agreed. This notion was based on the view that privileges and immunities began when the diplomat entered the territory of the receiving State and made his appointment known. The chapter also looks into numerous cases where a person has sought to rely on the apparent protection given by Article 39.1, using it to grant them immunity from jurisdiction.

Eileen, Denza. Persona Non Grata. Oxford University Press, 2016. http://dx.doi.org/10.1093/law/9780198703969.003.0010.

Full text
Abstract:
This chapter examines Article 9 of the Vienna Convention on Diplomatic Relations which refers to the status persona non grata given by the receiving State towards members of a diplomatic mission. The state renders the members as ‘unwelcome’. Article 9 gives the receiving State the right to notify the sending State that any member of the diplomatic staff is considered a persona non grata at any time, including before arrival. After being notified, the sending State must either recall the member or terminate his or her functions. If the sending State refuses or fails within a period to carry out the obligation, the receiving State may refuse to recognize the person concerned as a member of the mission. The Article proves to be a key provision in the Convention which enables a State to protect itself against unacceptable behaviour by members of diplomatic missions and forms an important counterweight to the immunities conferred elsewhere in the Convention.

Full text
Abstract:

Full text
