Abstract:
The principle of Legality (nullum crimen, nulla poena sine lege) is the most fundamental principle of German criminal code since it was codified in the Bavarian Criminal Code 1813 for the first time. With the Foundation of the German Empire in 1871 it became an integral part of the new German Penal Code Reichsstrafgesetzbuch). It was constitutionalized in 1919 as a fundamental right with Art. 116 of the Weimar Constitution. It was unchallenged till the Nazi regime came to power. Not within the Empowerment Act but with other legal measures resulting from the burning of the Parliament (”Reichstagsbrand”) on 28 February 1933 till 1935 on, the Nazi regime changed the principle step by step from nullum crimen, nulla poena sine lege to nullum crimen sine poena. They made Analogy in disfavor of the accused person possible and they stated criminal offences with retroactivity. Unfortunately, the Supreme Court of Justice (Reichsgericht) accepted the new provisions and used it as a basis for its sentences. After WW II the allies nullified the Nazi provisions. With Art. 103 § 2 of the new (West-)German constitution from 1949 nulla poena sine lege has been constitutionalized again. The Paper deals with that development with a special focus on the role of the Reichsgericht as the highest body of judges, who were trained in the times before the Nazis came to power.

Artykuł ma na celu podjęcie problemu moralnej dostępności prawa w zestawieniu ze standardem nullum crimen, nulla poena sine lege możliwym do wywiedzenia z orzecznictwa Europejskiego Trybunału Praw Człowieka oraz pomocniczo także innych sądów i trybunałów w sprawach dotyczących przewidywalności bezprawnego i karalnego charakteru czynów składających się na zbrodnie międzynarodowe. Dwa pytania wyznaczają zakres prowadzonych analiz. Po pierwsze, analizie poddane zostaje to, do jakiego stopnia karalność zbrodni międzynarodowych była i jest przewidywalna dla zwykłego adresata normy karnoprawnej. Po drugie zaś, artykuł podejmuje kwestię, w jakim zakresie uzasadnione jest powoływanie się na argument z tzw. dostępności moralnej komunikatu kryminalizacyjnego w celu zrekompensowania pewnych niedociągnięć formalnych charakterystycznych dla legislacji międzynarodowej. Badane są ponadto poszczególne kryteria zasady legalizmu w zestawieniu ze zbrodniami międzynarodowymi. Szerszemu omówieniu poddano także trzy rozpatrywane przez ETPC sprawy (Kononov, Vasiliauskas oraz Korbely) odnoszące się kolejno do zbrodni wojennych, zbrodni ludobójstwa oraz zbrodni przeciwko ludzkości.

Peculiarities of a disciplinary misconduct as the actual basis for disciplinary responsibility are considered. The author draws attention to the fact that a disciplinary misconduct, unlike an offense, is usually not formalized, therefore, the sign of wrongfulness is not determinative for it. It is proved that in relation to disciplinary misconduct, the application of the principle of “nullum crimen sine lege” (there is no crime without law) is significantly limited.

Abstract:
This study aims to find out the dynamics of the legality principle in the renewal of criminal law laws in Indonesia. The type of research used is doctrinal research. All data obtained were analyzed qualitatively juridically. This study examines and examines secondary data about the dynamics of the legality principle in reforming criminal law laws in Indonesia. The principle of legality according to Paul Johan Anslem von Feuerbach is nulla poena sine lege; nulla poena sine crimine; nullum crimen sine poena legali. These three phrases then become the adage Nullum delictum, nulla poena sine praevia legi poenali, which means that no act can be punished except for the strength of the criminal rules in the legislation that existed before the act was committed. The results of this studystates that if an act does not meet the formulation of an offense in a written law, the judge can impose a sentence if the act is considered disgraceful, contrary to justice and other social norms in people's lives. So that implicitly the criminal law in Indonesia has recognized the teaching of material lawlessness in a positive function.

The article critically appraises Carl Schmitt’s 1945 expert opinion on The International Crime of the War of Aggression and the Principle ‘nullum crimen, nulla poena sine lege’. Each element of Carl Schmitt’s expert opinion is subjected to close scrutiny and contextualised with references, where appropriate, to the icc’s recently acquired jurisdiction to try crimes of aggression. It is shown that Schmitt’s legal arguments are on the whole tenable but that the expert opinion’s assumptions about the position of the ability of ‘ordinary’ citizens to assess their own actions are very problematic.

Abstract:
The principle “nullum crimen, nulla poena sine lege” is one of the core principles of German criminal law and constitutional law. However, the history of this principle is quite varied. This article will focus on an essential part of this history, namely on the version of this principle in the Weimar Constitution of 1919. It will be shown that the principle of legality of criminal law was indeed expressed in that constitution, but that the exact scope of application of this constitutional principle was quite unclear. In this regard, it was uncertain whether the Weimar Constitution also prohibited the retroactive application of criminal laws to those cases for which a more lenient penalty was provided at the time of the offense. This ambiguity of the Weimar Constitution finally became apparent in 1933 in the so-called Reichstagsbrandprozess (Reichstag fire trial). The issue in these criminal proceedings was whether the burning of the parliament building in Berlin (February 27, 1933) was punishable by death, although this sanction was not provided at the time the crime was committed. In this essay, it will be shown that the National Socialists had to go to considerable effort to be able to ignore prohibitions on retroactivity. This undermining of the principle “nullum crimen, nulla poena sine lege” forms an important example of the willingness of the legislature to negate essential protective principles of law in the Third Reich.

A szerző áttekinti az Európai Emberi Jogi Bíróság, az Európai Unió Bírósága, illetve az Alkotmánybíróság válogatott döntéseit. Különös figyelmet fordít a 30/2014. (IX. 30.) AB határozatra, amely lényeges fordulatot hozott az ítélkezési gyakorlatban. A testület ugyanis ebben a döntésében kifejezetten kiterjesztette az Alaptörvény XXVIII. cikk (4) bekezdésében biztosított garancia hatályát a közigazgatási szankciókra, miközben azonban annak védelmi szintjét ezekre nézve lecsökkentette a klasszikus büntetőjoghoz képest.

W artykule analizie poddana została wyrażona w art. 7 ust. 2 EKPC, art. 15 ust. 2 MPPOiP oraz art. 49 ust. 2 KPP klauzula norymberska. W założeniu jej twórców miała ona za zadanie źródłowo uszczegółowić zakres zasady legalizmu, pełniąc przy tym funkcję swoistej „tarczy” przed potencjalnymi zarzutami naruszenia zasady nullum crimen nulla poena sine lege przez powojenne procesy karne zbrodniarzy wojennych. W artykule wykazano, iż wbrew formułowanym niekiedy twierdzeniom, nie stanowi ona jednak wyjątku od zasady lex retro non agit, lecz konstytuuje autonomiczny pod względem źródeł zakazów karnych standard wyrażany przez zasadę nullum crimen sine iure. W pracy zbadano ponadto stosowalność ogólnych zasad prawa uznanych przez społeczność międzynarodową w kontekście odpowiedzialności karnej, a także wykazano praktyczną nieoperatywność klauzuli norymberskiej. Krytycznej analizie poddano także konstrukcję klauzuli norymberskiej. Artykuł wykazuje jej merytoryczną i logiczną wadliwość. W podsumowaniu, autor sugeruje natomiast zastąpienie klauzuli norymberskiej klauzulą prawa natury.

Il lavoro intende approfondire i profili strutturali e applicativi della c.d. clausola di Norimberga, disposizione contenuta all'art. 7, par. 2, C.e.d.u. e relativa ai crimini internazionali. A tale fine, il primo capitolo ricostruisce lo stato del principio nullum crimen, nulla poena sine lege all'indomani del secondo conflitto mondiale, mediante l'analisi delle esperienze di giustizia di transizione più significative: il processo di Norimberga, in sede internazionale, e l'impiego della formula di Radbruch, nell'ordinamento tedesco. Il secondo capitolo prende in considerazione la struttura della previsione convenzionale, con particolare riguardo ai principi generali del diritto riconosciuti dalle nazioni civili e al ruolo da essi rivestito nel moderno diritto penale. Il terzo capitolo, infine, passa in rassegna la giurisprudenza della Corte e.d.u., evidenziando un sostanziale mutamento di paradigma nel modo di intendere il principio di legalità internazionale. All'esito dell'indagine si osserva che il principio di legalità, oramai concepito come diritto fondamentale dell'individuo, attribuisce all'art. 7, comma 2, C.e.d.u. una funzione "mnestico-monitoria". Pertanto, una sua "ri-attivazione" non è più immaginabile, anche in virtù dei progressi compiuti dal diritto penale della comunità internazionale.

Esta tese é um estudo sobre a problemática inerente ao nullum crimen nulla poena sine lege no plano internacional. A aplicação do princípio nos tribunais de guerra, desde o início, se revelou problemática. Na primeira parte, explora-se a cláusula de Martens, o seu significado e a possibilidade de as leis da humanidade e os ditames da consciência pública serem fontes de normas penais. Na segunda parte, analisa-se de perto o julgamento do Tribunal Militar Internacional em Nuremberga e chega-se à conclusão que a ideia disseminada de que este aplicou direito ex post facto em detrimento do princípio da legalidade é errada. Os crimes de guerra, os crimes contra a paz e os crimes contra a humanidade são examinados em separado. Uma conclusão similar é atingida na terceira parte depois de se proceder a uma análise de vários casos decididos pelos modernos tribunais penais internacionais (Erdemović, Tadić, Norman, Furundžija e Vujin). Sublinha-se também que as fontes de direito internacional e os métodos de interpretação utilizados em Nuremberga continuaram a ser utilizados, de forma legítima, pelos novos tribunais ad-hoc. Na quarta parte, a viagem cronológica leva ao escrutínio de duas muito recentes decisões do Tribunal Europeu dos Direitos do Homem. Na primeira, Kononov, o direito da guerra é perscrutado com mais intensidade. Atacam-se os dilemas dos soldados, as operações no campo de batalha e as perplexidades que aqui se geram. A lei vigente – à altura da Segunda Guerra e hoje – em matéria de objetivos militares legítimos, punição solidária, represálias e ordens superiores é apurada. Na segunda, Maktouf, as ideias de que o nulla poena não existe no direito internacional e de que os crimes internacionais devem ser transformados em legislação nacional são impugnadas. Na última Parte, à reflexão sobre o conteúdo do nullum crimen, junta-se, por um lado, um olhar, com Hadžihasanović como pano de fundo, sobre os comandantes e a natureza do seu controlo sobre as máquinas de guerra a quem eles dão ordens que supostamente devem ser obedecidas e, por outro, a problematização entre o ‘possível status hodierno’ do nullum crimen como norma de jus cogens e o ‘possível poder de feitura de legislação retroativa’ pelo órgão crucial para manter a paz.
This thesis analyses the nullum crimen nulla poena sine lege principle on the international plane. From the outset, the application of the principle in war crimes tribunals proved problematic. The first part explores the Martens clause, its significance and the possibility that the laws of humanity and the dictates of public conscience are legitimate sources of international criminal norms. In the second part, a survey of the judgment of the International Military Tribunal at Nuremberg takes place. War crimes, crimes against peace and crimes against humanity are examined separately. The idea that this judgment involved the application of ex post facto law in violation of the principle of legality is rejected. A similar conclusion is reached in the third part, while dissecting several cases decided by modern international criminal tribunals (Erdemović, Tadić, Norman, Furundzija and Vujin). It is also highlighted in this part that the sources of international criminal law and the methods of interpretation used at Nuremberg continue to be legitimately used by the new ad hoc tribunals. In the fourth part, the ‘chronological journey’ leads to the scrutiny of two very recent decisions of the European Court of Human Rights. In the first one, Kononov, the law of war is scrutinized more intensively. Here one looks at the dilemmas of the soldiers and the operations on the battlefield. The law – both at the time of World War II and today – on legitimate military targets, collective punishment, reprisals and superior orders is checked. In the second one, Maktouf, the ideas that the nulla poena does not exist in international law and that international crimes should be transformed into national legislation are contested. The last part digs into the true content of the nullum crimen. The case at point here is Hadžihasanović. Commanders and their duty of control over the ‘war machines’ to whom they give orders are used to flesh that content out. Finally, two issues are tackled: the ‘probable present-day’ status of the nullum crimen as a norm of jus cogens and the ‘probable power’ of the most important organ to keep the peace to enact retroactive legislation.

Ademais será verificada a desconformidade da interpretação jurisprudencial estabelecida no Acórdão de Fixação de Jurisprudência n.º 8 / 2010 de 23 de Setembro e em que serão demonstradas as possíveis inconstitucionalidades da sua interpretação e aplicação.
This present dissertation will examine the welfare state, its origin, will present a concept, what it covers, where it is enshrined in the Constitution of the Republic, its sustainability, ways of financing it and if the crime of embezzlement against Social Security is the core of its support. Also it will be analyzed the disconformity of judicial interpretation established in the Judgement n.º 8/2010 of 23rd of September and which it will be demonstrated the possible unconstitutionality´s of its interpretation and application.

In this chapter, Jonathan Simon argues that the modern criminal system should adopt the value of dignity as its governing ideal. The chapter argues that the legality principle—once a primary engine for strengthening the criminal system’s democratic legitimacy—has exhausted its sociological and jurisprudential power. Surveying 150 years of criminal legal commitments, this chapter shows how the legality principle rose to prominence as a vehicle for reform and accountability, and then fell under pressure from mass incarceration and institutional racism. Accordingly, the legality principle should be supplemented with a dignity principle, “an increasingly prominent value in legal systems internationally since the middle of the 20th century.” Simon traces the development of various forms of dignity in Supreme Court jurisprudence, from police procedure to prison conditions, determinate sentencing, and mental health. The chapter concludes that “the great banner reading ‘nulla poena sine lege’ must now be, not lowered, but joined by another banner of ‘no crime and no punishment without respect for human dignity.’”

Abstract:
The article discusses the changes in the structure of the Laundering of the Proceeds from Crime in the Criminal Law as a legal norm, that has a blanket reference, after the implementation of the FATF recommendations in Latvia, especially paying attention to the object of Laundering of the Proceeds from Crime from the point of view of the Progressive criminal law school as of de lege ferenda, seeking to establish what the person is responsible for in the case of laundering crime. Thus, by taking a brief view at the findings of the Latvian criminal law theory on the object of a criminal offense and the protection of economic, fiscal and monetary interests in the Criminal Law in Latvia, the author finds that one of the constituent elements of a criminal offense – i.e., the object (protected interest) – theoretically de facto does not exist in the Laundering of the Proceeds from Crime offence. Thereby the principle of Nullum crimen nulla poena sine lege as provided in the Section 1 of the Criminal Law is not respected. At the end of the article, the author offers his solution to the established problem – it is to restore the previously stroked reference to the predicate crime in the description of the laundering crime, thus restoring the unbreakable link of money laundering crime with predicate crime, which would reveal to the law enforcer the legal interest protected by the Criminal Law.
