Abstract:
All books in this flagship series contain carefully selected substantial extracts from key cases, legislation, and academic debate, providing able students with a stand-alone resource. This chapter investigates legal property rights in land. The numerus clausus (or ‘closed list’) principle is of crucial importance when addressing the content question of legal property rights in land. The Law of Property Act 1925 (LPA 1925) creates a distinction between legal estates and legal interests. As a result of s 1 of LPA 1925, there are now only two permissible legal estates in land. The chapter then e

Abstract:
Abstract Copyright statutes across many jurisdictions regard copyright as a property right, though it is not always clear in what sense it is a property right. Some regard copyright simply as a statutory right, and others argue that copyright is merely a chose in action similar to contractual debts and shares. Since copyright has nothing in common with any of the choses in action other than its intangibility, copyright’s conceptualisation has become limited to its statutory ontology. This offers no normative yardstick with which to assess copyright, its scope, and the direction of its growth.

Abstract:
This chapter considers express termination clauses in detail, and briefly considers retention of title clauses and clauses restricting set-off. As a matter of general principle, parties are free to incorporate their own express regimes for termination of the contract; such clauses are common in contracts of any significant duration. The chapter presents an overview of the process and examines the issues which might arise from express termination clauses. With the retention of title clauses (or Romalpa clauses), the chapter focuses on issues of construction and characterization to address the n

Abstract:
This book studies the micro-variation in the syntax of negation of Southern Levantine, Gulf and Standard Arabic. By including new and recently published data that support key issues for the syntax of negation, the book challenges the standard parametric view that negation has a fixed parametrized position in syntactic structure. It particularly argues for a multi-locus analysis with syntactic, semantic, morphosyntactic and diachronic implications for the various structural positions. Thus accounting for numerous word order restrictions, semantic ambiguities and pragmatic interpretations withou

This chapter introduces three common types of long sentence in Thucydides: the “tree,” in which the main action is presented as an initial fact to be explicated and complicated, the “funnel,” in which the main action is final culmination of a complex of motives or observations, and the “diptych,” in which the main action is a hinge that opens to the reader two tableaux, a “before” and “after,” and displays how they contrast with or mirror each other (the diptych). The chapter explicates the syntactical complexities of Thucydides’ long sentences schematically in order to demonstrate the relatio
