O presente estudo tem como mote a a??o de nuncia??o de obra nova, procedimento especial por meio do qual se pode exercer o direito constitucional de propriedade. A partir de um panorama desse procedimento tra?ado tanto no sistema jur?dico brasileiro quanto no ?mbito do direito comparado, procurou-se desenvolver os aspectos processuais da a??o de nuncia??o de obra nova, objetivando um melhor aproveitamento pr?tico do instituto. Destacou-se a utiliza??o da propriedade consoante os limites constitucionais estabelecidos, bem como os decorrentes dos direitos de vizinhan?a previstos na legisla??o civil brasileira. Com esse intuito, buscou-se delinear as hip?teses de pedidos poss?veis neste procedimento, bem como a efic?cia sentencial proveniente em caso de senten?a de proced?ncia relativa a cada pedido formulado. Estudou-se o rito com suas particularidades, bem como os recursos poss?veis das decis?es proferidas. Nessa vereda, apresentou-se o estudo do embargo de obra nova no direito comparado, restando demonstrada sua presen?a na legisla??o estrangeira estudada. Verificaram-se caracter?sticas comuns e outras divergentes em rela??o ao procedimento previsto no Brasil. No direito brasileiro, o instituto foi abordado desde o seu ingresso no ordenamento jur?dico atrav?s das Ordena??es Filipinas at? o C?digo de Processo Civil vigente, constando-se que n?o houve grandes altera??es no procedimento especial entre os C?digos de Processo Civil de 1939 e 1973. A partir do hist?rico referido, restou clara a import?ncia da a??o de nuncia??o de obra nova, uma vez que esteve sempre presente no direito processual civil brasileiro. Ademais, p?de-se identificar a rela??o existente entre as limita??es do direito de propriedade e as possibilidades de utiliza??o desse procedimento para dirimir conflitos da? advindos. Concluiu-se que o regime procedimental especial encontra-se adequado ? natureza do direito material debatido. O provimento liminar garante a suspens?o da obra que est? causando dano, ou est? na imin?ncia de caus?-lo, e o provimento definitivo possibilita a cumula??o de pedidos para ver satisfeito todos os inc?modos causados ao demandante pela obra nova. Al?m disso, vislumbra-se a economia processual atingida, bem como a efetividade do processo uma vez que a suspens?o da obra que est? causando inc?modo ? medida poss?vel de ser deferida liminarmente. E, finalmente, foram apontadas as cargas de efic?cias da senten?a, em seu conte?do, adequadas para a solu??o dos conflitos dessa natureza.

John Donne’s poetry has long been famous for its metaphysical conceits, which powerfully register the impact of the “New Philosophy,” yet the question of how his work is implicated in the new forms of knowledge-making that exploded in the early seventeenth century has remained unanswered. “Donne and the Sidereus nuncius” examines the relation between method and metaphor on the cusp of the Scientific Revolution by reading the poetry and prose of Donne in the context of developments in early modern astronomy, anatomy and natural philosophy. I focus primarily on two texts, Ignatius, his Conclave (1610) and the Anniversaries (1611-2), which are linked not only by chronology, but also by their mutual concern with the effects of distorted perception on the process of understanding the universe. Written directly after the publication of Galileo’s Sidereus nuncius (1610), these works offer a historicized perspective on Donne’s changing use of scientific metaphor in relation to the transformative crux of the discovery of the telescope, which provided a startling new optical metaphor for the process of knowing. In this context, “Donne and the Sidereus nuncius” considers the conceptual work performed by scientific metaphor as part of an ongoing transformation from emblematic to analogic figuration. Donne’s search for material that is, in his phrase, “appliable” to other subjects, depends on an analogic conception of metaphor, a comparison that enables new thinking by identifying underlying commonalities between disparate objects. Building on this understanding of metaphor as comparative, I examine Donne’s self-conscious use of metaphors of methodical knowledge making—invention, innovation, anatomy and progress—in the context of instrumental metaphors, such as the telescope, spectacles, perspective, and travel narratives. In doing so, I suggest that Donne’s metaphorical conceits explore the conflict between scientific attempts to discern order in nature and the distorting effects of methodological frameworks imposed on the object of analysis.

Parish clergy and religious change in Prague's diocese from Council of Trent till the end of the 17th century The religious change that happens in Bohemia in the 17th century has no equivalent in the Europe at this time: the whole country, where Catholics were in a very minority, comes back to the roman Church. This evolution is here seen from a very prosaic point of view: how lay people live this change, and so how acts the parish clergy in this matter. Conversion's strategy, at the end of the Council of Trent, was to permit the use of the chalice to the laity. The consequence of this permission was a very hazy situation in the parishes, but Holy See did nothing before the battle of White Mountain, and after the battle, he suppressed chalice, mainly for pastoral reasons. During the Thirty years War, the kingdom is the place of a general reform, which has its origins in the catholic missionary movement of the beginning of the century and in the political theories of this time. Bohemia is strongly marked by the war that acts as a catalyst; at the same time political and religious authorities were lacking. The inhabitants, usually just formal Catholics at the beginning, convert themselves more and more deeply during the 17th century. Abstract:
American jurisprudence currently applies two incompatible validity standards to determine which laws are enforceable. The natural law tradition evaluates validity by an uncertain standard of divine law, and its methodology relies on contradictory views of human reason. Legal positivism, on the other hand, relies on a methodology that commits the analytic fallacy, separates law from its application, and produces an incomplete model of law. These incompatible standards have created a schism in American jurisprudence that impairs the delivery of justice. This dissertation therefore formulates a new standard for legal validity. This new standard rejects the uncertainties and inconsistencies inherent in natural law theory. It also rejects the narrow linguistic methodology of legal positivism. In their stead, this dissertation adopts a pragmatic methodology that develops a standard for legal validity based on actual legal experience. This approach focuses on the operations of law and its effects upon ongoing human activities, and it evaluates legal principles by applying the experimental method to the social consequences they produce. Because legal history provides a long record of past experimentation with legal principles, legal history is an essential feature of this method. This new validity standard contains three principles. The principle of reason requires legal systems to respect every subject as a rational creature with a free will. The principle of reason also requires procedural due process to protect against the punishment of the innocent and the tyranny of the majority. Legal systems that respect their subjects' status as rational creatures with free wills permit their subjects to orient their own behavior. The principle of reason therefore requires substantive due process to ensure that laws provide dependable guideposts to individuals in orienting their behavior. The principle of consent recognizes that the legitimacy of law derives from the consent of those subject to its power. Common law custom, the doctrine of stare decisis, and legislation sanctioned by the subjects' legitimate representatives all evidence consent. The principle of autonomy establishes the authority of law. Laws must wield supremacy over political rulers, and political rulers must be subject to the same laws as other citizens. Political rulers may not arbitrarily alter the law to accord to their will. Legal history demonstrates that, in the absence of a validity standard based on these principles, legal systems will not treat their subjects as ends in themselves. They will inevitably treat their subjects as mere means to other ends. Once laws do this, men have no rest from evil.
