Philosophically, we live in a liberal age, one that accords individual rights primacy of place among political values. Accordingly, contemporary conceptions of political and legal obligation treat sovereignty as perplexing, straining to justify how authority can impose on individual freedom and obligate one to obey law. From Hobbes to Kant to Rawls, liberal thinkers have had to stitch together a civic sovereign from the free will of each individual. As against the machinations required to justify sovereignty beginning from the liberal premise of individual freedom, I suggest a fundamental reexamining of liberal freedom. In its place, I will argue for a return to a classic conception of Athenian or Aristotelian republicanism as the basis of political obligation. Reigning for perhaps millennia, yet strangely absent from contemporary theory, the ancient view argues that political obligation is based on our natural and unavoidable interconnectedness. Aristotle’s persuasive arguments that human beings need political communities to survive and flourish, now fortified by modern social science, illustrates why sovereignty is not a puzzle but rather a natural extension of our civic interconnectedness and gives rise to political obligation.

The history of US landpower since September 11, 2001, has been a history of change as policy-makers sought to impose alterations on landpower, only to be forced to adapt to new conditions. The spirit of post-heroic warfare, stemming from the 1990s, influenced American understanding of landpower during the initial invasions of Afghanistan and Iraq, leading to transformation and the practice of post-heroic landpower. This interpretation and employment of landpower did not survive the rising challenges of insurgency, forcing landpower to return to its heroic roots. With the election of President Obama, US strategy returned to a post-heroic phase, with landpower largely excluded as a major instrument for the pursuit of US grand strategy, only for new challenges to rise, such as Russia, which seem to demand yet another return to the classical heroism of landpower.

The 1954 Hague Convention on the Protection of Cultural Property in the Event of Armed Conflict (1954 Hague Convention) remains the leading treaty on the treatment of cultural heritage during armed conflict and occupation. After several decades of relative dormancy, eleven States have joined the 1954 Hague Convention in the last decade, including two major military powers: the United States and the United Kingdom. In addition to the 1954 Hague Convention, a host of laws touch on the protection of cultural property in armed conflict, as well as those under customary international law. Nonetheless, there are disagreements in interpretations of States’ obligations toward cultural property during armed conflict stemming from a variety of factors. These factors can include: whether States are Parties to the instrument that conveys the obligation or if the obligation is one of customary international law, which itself is often contested; the individual State’s interpretation; interpretation by tribunals; and a plethora of other factors. Given these discrepancies in interpretation, a review of States’ military manuals is useful to see if they shed any light on the State’s interpretation of their obligations toward cultural property under the law of armed conflict (LOAC) and international obligations in LOAC more generally. This chapter will analyze and compare the military manuals of the United States and the United Kingdom to determine how they elucidate several key issues in the protection of cultural property during armed conflict, such as the definition of ‘cultural property’, requirements for ‘respect’, the doctrine of military necessity, and laws applicable in non-international armed conflicts.

This chapter details the experiences of both mariners and passengers during the waterborne evacuation across the New York harbor following the attacks of 9/11. The longstanding tradition of mariners assisting those in peril is as ancient as seafaring itself. Stemming from a moral duty rooted in pragmatism about the implicit dangers of nautical life, the obligation was signed into U.S. admiralty law in the aftermath of the April 15, 1912, sinking of the RMS Titanic. This rule, however, did not apply to the situation in Manhattan on September 11. At least not technically speaking in most cases. But that did not stop the boatmen and boatwomen from New York harbor and beyond from feeling compelled. At stake were notions of identity, of mariners' acclimatization to taking and mitigating risks, of what can be called “professional honor.” Without planning or protocols, many undertook the evacuation out of a sense of duty, unquestioningly, applying to this land-based calamity their mandate from the laws of the sea. The compulsion to rescue, stitched into the fabric of nautical tradition, propelled mariners into action, as did the sense, for many, of New York harbor as home.

First, they offer a brief review of different concepts of stigmatization, mainly stemming from psychology and sociology. Second, based on the previous review, they will offer a specific definition of stigmatization directed towards ex-combatants in the Colombian internal conflict. This definition encompasses social distance, label attribution, and emotional reactions towards the stigmatized group. Further, they present the validated scale to measure these attitudes in a non-representative sample of 289 people in 34 Colombian counties. Finally, they describe the psychometric properties of this scale as a way to measure stigmatization against ex-combatants in the Colombian internal conflict to be used in interventions aimed at attenuating this stigmatization and favoring their return to civilian society.
