Full textRozprawa doktorska związana jest z projektowaniem nowych katalizatorów oraz badaniem niestopowych synergii metali w takich materiałach, jako potencjalnych katalizatorach wybranych reakcji redukcji lub acetalizacji o dużym znaczeniu w chemii ochrony środowiska. Na potrzebę niniejszej pracy otrzymano i zbadano szereg mono-, bi- i trój-metalicznych nanokatalitycznych układów metali przejściowych (Re, Ru, Rh, Ir, Pd), osadzonych na krzemionce (SiO₂) oraz na nośniku metalicznym (Ni lub Mo). Są to nowe, nie opisane wcześniej nanomateriały o działaniu katalitycznym. Badane układy nanokatalityczne mogą być w sposób powtarzalny otrzymywane opisanymi metodami syntetycznymi. Opisane nanokatalizatory heterogeniczne mogą być wykorzystane w procesach przemysłowych, ze szczególnym uwzględnieniem reakcji metanizacji dwutlenku węgla, rozkładu amoniaku i acetalizacji glicerolu. W reakcji niskotemperaturowego rozkładu amoniaku wysoką aktywność wykazał katalizator nano-Pd/Ni. Katalizator ten może być wykorzystany do generowania wodoru w ogniwach paliwowych. Katalizator nano-Ru/Ni wykazuje wysoką aktywność w reakcji niskotemperaturowej metanizacji tlenków węgla i może być wykorzystany do produkcji metanu jako odnawialnego źródła energii przy jednoczesnej redukcji emisji CO₂, pochodzącego ze źródeł stacjonarnych. Uzyskane nanokatalizatory: Re/SiO₂, ReRu/SiO₂, ReIr/SiO₂, ReRuIr/SiO₂, ReRhIr//SiO₂, ReRuRh/SiO₂, RuRhIr/SiO₂, Ru/Mo, RuRh/Mo, RuRhIr/Mo oraz ReRhIr/Mo wykazują wysoką aktywność w reakcjach acetalizacji. Nano-Re na nano-SiO₂ jest wysoce aktywnym i selektywnym katalizatorem acetalizacji glicerolu do pięcioczłonowych cyklicznych acetali (np. solketalu) i może być wykorzystany do przetwarzaniu odpadów glicerolu. We wszystkich badanych układach katalitycznych obserwowano efekty synergiczne między poszczególnymi składnikami katalizatorów. Badane układy katalityczne mogą mieć praktyczne zastosowanie i posłużyć rozwojowi opisanych procesów technologicznych, co niesie za sobą ekologiczne oraz ekonomiczne korzyści.

Full textThe Polish law does not differentiate homosexual people from other relevant categories, with two essential exceptions. The former refers to the interpretation of Article 18 of the Constitution of the Republic of Poland. The latter refers to the penalty for hate speech due to the sexual orientation feature. Article 18 of the Basic Law legally protects the marriage as a union of a man and a woman. On this basis, the doctrine and judicial decisions often refuse non-heterosexual people the right of legalization of cohabitation. However, equally often this view is questioned due to the obsolete character and incompliance with law and legal standards applicable in Europe. Articles 256, 257 and 119 of the Penal Code are the second discrimination area. These Articles include the closed lists of factors, for which hate speech is penalized. The doctrine criticizes the closing of such lists, in particular due to failure to cover the factor of sexual orientation, as in any form hate speech is an undesirable phenomenon.

Full textThe subject of the dissertation is an image of a person who is convicted or against whom there are pending criminal proceedings. The main problem considered in the dissertation is a settlement of a conflict between private interest of a perpetrator and public interest (the social interest and the interests of justice) in disclosing and publishing perpetrator`s image. Besides the constitutional analysis connected with this problem, the dissertation discusses protection of an image of a person against whom there is a pending criminal proceeding and refers to the ban on disclosing and publishing an image of above mentioned category of people. On the other hand, regulations that allow to disclose and publish an image of a suspect are analyzed. It was also the subject of the dissertation to describe issues of recording a trial and using an image in searching for a perpetrator. In the end, the matter of publishing an image of a convict was presented.

Full textThe protection of cyberspace is a part of the area of the freedom security and justice (AFSJ) and remains within the divided competences. However, it constitutes sensitive and ambiguous issue. According to the fundamental assumption, posed in this thesis, there is a clear need to take the actions by the European Union to create the system of cyberspace protection. The proposed system aims at providing the better effectiveness of the EU action as well as avoiding copying of subjects and doubling works of the EU institutions and bodies involved in discussed issues. In order to substantiate the assumption, put forward in the thesis, the current legal bases of the protection of cyberspace`s elements are moved closer and analysed. Basing on the methodology used in the thesis, i.e. formal-dogmatic, legal-comparative and historical-descriptive, the imperfect legal measures and gaps in this protection are indicated and the ways of their improvement are expressed.Taken subject is introduced in the light of the developing division of two directions of the EU actions in the scope of cyberspace protection, i.e. the network and information security in relation with the development of the information-communications technology and securing of users as well as their activities in cyberspace. The description of shown directions is presented from a perspective of appearing problems with creating legal basis as well as determining and distributing of the competence scopes between the EU and the Member States and legislative process on the European Union level.At the final stage of the research process the protection system of cyberspace in the European Union is described. Therefore, it is a need to adopt the detailed hypothesis according to which it is possible to implement such a system which will solve existing gaps and will refute the claims of both the EU`s multi-layered actions and accompanying them the competence chaos. This dissertation consists of six chapters in frames which the analyses of the current conditions of cyberspace protection are carried out in the light of the EU law as well as the needs and the possibilities of their change.The first three chapters are devoted to clarify the basic concepts related to cyberspace, present both the tendencies in the law being an outcome of the digitization process and appearing threats to the security in the digital space. Next chapters, i.e. fourth and fifth, have a research character. Using the formal-dogmatic and historical-descriptive methods allows to present the activities of the Member States and the European Union that stayed in the context of cyberspace protection.For the whole of thesis, the sixth chapter is an axis. In this part of the deliberation the results of analyses and findings of conducted examinations are presented which aim at formulating the author's system specification of cyberspace protection in the European Union based on the hybrid system. The innovative approach consists in merging three elements: substantive law of the protection of cyberspace, model PDCA (Plan-Do-Check-Act) in cyberspace (Cyber-PDCA) and decentralised institutional system. The proposed system of cyberspace protection in the EU is based on four dimensions of actions: strategic, legal, proactive prevention and international.In the thesis three issues closely linked with cyberspace are also considered, which are regarded as the positive trends of digitalisation. All of them influence on creating of legal aspects of cyberspace. The concept of the Internet law, cyberlaw and cyberculture of the law constitute the objects widely presented in the literature indicating a new field in the law system. Moreover, an international dimension of the EU activity was taken into account with regard to current works and the EU initiatives in terms of connection between cyberspace protection in the internal dimension and the Common Foreign and Security Policy aspects.

Full textThe subject of this dissertation is to analyse the rail passengers’ rights protection in the European Union (EU). The aim of the research is to review and attempt to evaluate the existing EU law provisions in terms of their implementation and effectiveness in ensuring the protection of rail passengers’ rights at the level of EU member states. The main legal act in this area is the regulation (EC) no 1371/2007 of the European Parliament and of the Council of 23 October 2007 on rail passengers’ rights and obligations. Two research hypotheses were verified. According to first one, Regulation 1371/2007 provides a minimum level of protection for the rail passengers’ rights in the EU. The substantive provisions and procedural safeguards in the scope of protecting rail passengers’ rights are sufficient at the EU level, and their effectiveness in the implementation at the national level is determined mainly by three elements: (i) the scope of application of the provisions of regulation 1371/2007 in the EU member states, (ii) the severity of national sanctions for violation of the provisions of this regulation; and (iii) the tasks and institutional efficiency of national bodies responsible for enforcing and applying the provisions of regulation 1371/2007. The second hypothesis assumes that due to the fact that the rail passenger is a consumer on the railway transport market, his rights protection is also ensured by the EU law adopted as a part of consumer policy, including on tourist services. In order to verify the above hypotheses, it was necessary to answer the following research questions: - to what extent EU material law affect the protection of rail passengers’ rights? - what are the rights of rail passengers in the EU? - which EU member states and to what extent have granted exemptions from the provisions of regulation 1371/2007? - what sanctions for the violation of the provisions of regulation 1371/2007 are provided for by the national law of the EU member states? - what are the tasks and institutional efficiency of the national bodies responsible for enforcing the provisions of regulation 1371/2007? - what are the mechanisms and procedures for pursuing claims arising from the rail passengers rights in the EU? - do the EU institutions control compliance with the rail passengers’ rights protection in the EU member states and, if so, how do they do? The presented research problems were the subject of consideration within the respective chapters of the PhD thesis. The dissertation consists of an introduction, five chapters and a conclusion. In the first chapter, the legal bases concerning the rail passengers’ rights in the EU, starting from the international law, have been ordered and characterized. EU secondary legislation has been assigned to one of two areas: the rail transport sector or consumer law. The second chapter is devoted to the discussion of respective rail passenger rights resulting mainly from the relevant provisions of regulation 1371/2007. The analysis also covered exemptions from the provisions of regulation 1371/2007 granted by the EU member states and national sanctions for breach of these provisions. The third chapter analyzes the rail passengers’ rights protection from the point of view of regulation and issues related to the EU internal market. The fourth chapter, on the other hand, deals with the protection of rail passengers’ rights in the light of EU consumer law, including legal acts concerning the tourist services. The last, fifth chapter presents procedural guarantees to protect the rail passengers rights in the EU. The analysis covered the legal and institutional solutions adopted by the EU member states that responded to the questions in the questionnaire attached to the dissertation. The PhD thesis ends with a conclusion containing de lege ferenda remarks.

Full textIn June 2014 the Polish Financial Supervision Authority issued the Recommendation U on good practices in bancassurance. The U Recommendation has been prepared in response to e.g. notices of the Insurance Ombudsman concerning irregularities in the development and practical functioning of selling insurance through banks within the bancassurance channel, which was also noticed during the supervision activities by the Polish Financial Supervision Authority. In January 2016 the Council of the European Union and the European Parliament officially adopted the IDD Directive on insurance distribution regarding offering and selling insurance products. The provisions implementing the IDD Directive into the Polish legal system are primarily in the Act on insurance distribution, but also in the amended Act on insurance and reinsurance activity, the Act on handling complaints by financial market entities and the Financial Ombudsman, and in the Act on insurance and pension supervision. The text aims to describe the collaboration between banks and insurance companies in offering insurance products, which is formed to jointly offer insurance products to the bank's customers, taking into account the corresponding regulations changes concerning the insurance distribution and customer protection interested in purchasing insurance product through the bank's distribution channels. The purpose of the dissertation is to determine whether the guidelines on good practices in bancassurance, set out in the Recommendation U and the provisions of the Act on insurance distribution, guarantee protection of the customers’ interests, as well as whether they have a positive impact on the cooperation between banks and insurance companies. While pursuing the research goals a special attempt was made to the impact of Recommendation U and the Act on insurance distribution, not only on the mediation of banks in insurance sales but also on the situation of customers opting to purchase insurance in the bank. Consequently, the text answers the question of how, following the entry into force of the new regulations, the customers’ situation and the rules of collaboration between banks and insurance companies in bancassurance changed. The analysis allowed to clearly confirm that the Act on insurance distribution and Recommendation U, referring to protecting the customers’ interests and guaranteeing, inter alia, choosing an insurance product that suits their needs, makes it necessary to change the terms of cooperation and the insurance products, formed by banks and insurance companies, in order to offer each customer a product that meet its expectations, based on an analysis previously carried out in this regard.

Specific conditions of agriculture justify the need to create various types of protective and separate legal structures.Not only the justification for granting agriculture support in the provisions on the enforcement of pecuniary debts has been examined, but also the proper subject of protection - agricultural activity, farmer, farm or its type, family farm.The purpose of the dissertation is to assess the applicable provisions on legal enforcement in terms of implementation of the constitutional program norm imposing the obligation to provide support for family farms as the basis of the agricultural system. Real support for family farms requires comprehensive regulation of their legal situation, including the effects of non-performance of financial obligations and the state of insolvency or threat of its creation.The dissertation consists of an introduction, five substantive chapters in which the legal provisions are discussed in terms of their usefulness as an instrument of protection of agriculture in enforcement. The thesis closes with the ending, which contains de legelata and de lege ferenda conclusions.

Full textSummary: The assumption that human life is a fundamental value was adopted for the purpose of this dissertation. Therefore, the issue of human health protection is among the crucial concerns of mankind regardless of the epoch in which people live. The ancient Greeks already considered health as one of the biggest treasures. The issue of health care in Poland has not been discussed before from the philosophical and legal point of view. This dissertation aims at filling this gap. The issue of health care comprises numerous elements. The purpose of this dissertation is to point out problems related to patient treatment, however, not solely in the context of its financing. The level of healthcare spending is generally presented as an indicator of the proper functioning of the health care system. The issues in health care not directly related to finances are often ignored. The point of view which dominates in the literature on health care is a legal point of view. What the discussion is missing is reference to higher values which are explored in the philosophical and legal approach. The most popular issue of equal access to health care financed from public funds is seen as a social justice issue, which term is not clearly defined.

Full textThe purpose of the this is to demonstrate that the protection of the interests of third parties referred to in the Act of 7 July 1994 Construction Law (ustawa z dnia 7 lipca 1994 r. Prawo budowlane), in the light of the applicable administrative and civil law regulations, taking into account the existing doctrine, as well as the jurisprudence of administrative and civil courts and the Constitutional Tribunal (Trybunał Konstytucyjny), despite certain reservations of a detailed nature regarding the shape of legal regulations, issufficient from the point of view of a democratic state of law. The main research hypothesis is that the protection of the interests of third parties referred to in Art. 5 sec. 1 point 9 of the Construction Law serves participants in the construction procedure at its various stages. It has a public-law character, regardless of the nature of the normal serving it included in the entire legal system. The weave of private law norms with public law norms is the essence of the construction of protecting the interests of these persons. It seems that the legislature indicated criteria (subjective and objective) based on the norms of substantive administrative and civil law, deciding whether, in a specific factual and legal situation, certain interests of third parties are protected and what they will be (the status of a party to administrative proceedings or general). taking into account the adopted assumptions, the main research problem of the dissertation comes down to determining whether the protection of the interests of third parties in the Act of 7 July 1994 Construction Law in its current formula is effective (in the light of the principle of a democratic states ruled by law). This question arises due to numerous doubts identified in the practice of jurisprudence and in the views of the doctrine regarding the objective and subjective determination of the scope of this protection at each stage of the construction procedure. The doctoral dissertation consists of an introduction, five chapters, a conclusion and annex and bibliography. The conducted research made it possible to achieve the assumed objective and proved the assumed main hypothesis. The thesis shows that the title protection of “legitimate interests of third parties” serves participants of the construction procedure at each of its stages. It is of a public law character, regardless of the nature of the norms that serve it. It does not include private interests, but public law interests, i.e. those that may arise during the construction procedure and are related to with the issue of securing goods protected by this law. The intertwining of the norms of private law with the norms of public law is the essence of the construction of protecting the interests of third parties. It follows from the norms derived from the legal system whether third parties will be provided with protection of their interests on an individual basis, i.e. by ensuring individual protection consisting in the possibility of third parties participating in a specific administrative procedure under the rights of a party, or under general principles, i.e. established in public interest, specific regulations aimed at designing, building, dismantling rousing a building in such a way meeting all the requirements specified in Art. 5 of the Construction Law. Thus, this protection exists irrespective of whether third parties have been granted individual protection or not. The concept of legitimate interests of third parties is defined as legal and factual interests of these persons, significant from the point of view of the Construction Law, as public law interests, i.e. those that may appear during the entire construction process and are related to the issue of securing goods protected by this law. It should be emphasised that the legislator ensures protection of the legitimate interests of third parties, and not their respect. The protection of interests of third parties is an institution of the Construction Law which, apart from one exception – it generally ensures protection of legitimate interests of third parties, as it guarantees the participants of the construction process at various stages of its implementation, adequate to the standards of a democratic state of law, protection of their rights. It is protection appropriate to the goods protected by this law and consistent both internally and in connection with the provisions of other areas of law (primarily civil law). At the same time, the set of legal provisions sublime from various regulations being part of the institution for protection of interests of third parties, it is consistent and requires only the necessary corrections in the issue of admitting third parties with a legal interest in the meaning of the Construction Law to participate in the procedure for granting the occupancy permit for a building object. Moreover, it seems justified to restore the previous definition of the impact area, since the current definition of the “impact area of a building structure” limits the group of third parties who may participate in it as a party. This solution raises doubts as to its compliance with Art. 21 sec. 1, art. 31 sec. 3, Art. 64 sec. 1 and 2, Art. 45 sec. 1 and Art. 78 of the Polish Constitution, and thus is compliance with the principle of a democratic state ruled by law. Therefore, it seems justified to present this postulate as a de lege ferenda conclusion. The thesis presents the legal status as of 31 August 2020.

Full textThe exchange of information on tax matters is considered to be the most appropriate measure to detect and prevent tax avoidance and tax evasion. The level of control of cross-border operations is increased. Moreover, exchange of information on tax matters contributes to increasing the level of transparency. Thus, it contributes to the reduction of harmful tax competition between states. The primary task of information exchange is to contribute to determining the correct amount of tax. This mechanism may work in the interest of the taxpayer by contributing to the avoidance of double taxation. The main research purpose of the dissertation is to answer the question whether the rights of the Polish taxpayer are protected in the course of the exchange of information on tax matters. The dissertation presents the mechanisms of the exchange of information and provides an answer to the question what kind of taxpayer’s rights should be entitled to in the course of exchange of information. The objective and subjective scope of information exchange in tax matters was analyzed. The analysis was conducted in order to assess whether the scope of the collected information is not excessive and, as a consequence, does not unjustifiably infringe the taxpayer's right to privacy. Moreover, the analysis covered the protection of tax information in the light of the provisions on the concerning personal data. The dissertation deals with aspects of the taxpayer's legal situation as part of tax proceedings, which includes the exchange of tax information. The considerations focus on the issues the issues of the taxpayer's right to active participation in the proceedings, the right to an effective remedy and freedom from self-incrimination (the admissibility of using evidence obtained through the exchange of information for the purposes of tax proceedings in criminal proceedings). The consequence of the fact that the taxpayer's rights have not been taken into account in an appropriate proportion along with the extension of the scope of information exchange may hinder the efficient functioning of the information exchange.

Full textPersonal interests are non-proprietary values, inherent to every legal entity. Nowadays it is commonly agreed that the protection of the aforementioned values is granted also to legal persons. The regulations concerning such protection in particular legal systems differ, sometimes significantly.The Polish court of law, when considering a case regarding the protection of personal interests of a legal person, in a situation connected with more than one state is obliged to determine, which substantive law should be applied. This decision is taken basing on the norms of the Polish private international law. The aim of the dissertation is to analyze these norms in the scope presented above, to evaluate these norms and to propose remarks on the interpretation or amendment of the present regulations.In the dissertation the following issues are considered:- prerequisites and means of protection of the interests of a legal person in the selected systems of substantive law, especially in Poland- national jurisdiction of the Polish courts in cases regarding the protection of personal interests of legal persons,- origin of the present Polish regulation of the law applicable to the protection of personal interests of legal persons, including the reasons of the exclusion of this matter from the scope of application of the unified norms of the EU law- interpretation of the norms regarding the protection of personal interests of legal persons in the Polish private international law and delimitation of its scope and the scopes of some other norms of this area of law, - method of determination of the substantive law on the basis of art. 16 par. 2 of the Act – Private International Law, - significance of general provisions of Polish private international law in the scope of the dissertation- significance of the personal law in determination of the law applicable to the protection of personal interests,- issues governed by the law applicable- desirable regulation of the Polish law in the analyzed scope: the objective connecting factor, the choice of law by the parties, the clause of the closest connection. The results of the research are following conclusions:- Legal persons, whose personal interest is threatened or infringed, may demand protection on the basis of the law of the state in which territory the event causing the threat or infringement occurred or on the basis of the law in which territory the consequences of the threat or infringement occurred- Law applicable is indicated by two equivalent connecting factors and one of them has to be chosen by a person seeking protection of his or her personal interests; this competence is a form of exercise of autonomy of will.- Law applicable governs all prerequisites of protection including the existence of a personal interest and the subjective right connected with it- Polish norms of private international law regarding protection of personal interests should be interpreted in accordance with the EU law, especially with the Rome II regulation, and thus should be applied only in situations regarding dissemination of information- Regulations analyzed in the dissertation raise some important objections concerning, among others: the possibility to determine a place where personal interests are infringed, the indication of the law applicable by two equivalent connecting factors with no possibility to determine the law applicable before the case is tried by the court, the lack of application of common personal law, the lack of accessory method of determination of the law applicable, the doubts concerning the application of the personal status of a person seeking protection- It is desirable that the present statutory provisions of the analyzed issue are replaced by the provision, according to which the obligations arising out of violations of personal interests are governed by the law applicable to non-contractual obligations, unified in the EU in the Rome II Regulation

Find full textSummary of Ph.D. dissertation:Protection of minority shareholders in the case of resignation of listed company status The subject of this dissertation is the resignation from a status of a listed company (also known as delisting). It should be emphasized that obtaining or losing the status of a listed company has a direct influence on the principles of corporate governance applicable in the company, including mutual relations between its shareholders. The EU has standardized the rules for obtaining listed company status. However, the legal requirements for the reverse process, known as delisting, are still determined separately by the individual member states.One of the aims of this work is to identify the reasons for, and consequences of, delisting. I argue that the main reason for a voluntary resignation of listed company status is the negative balance of benefits in relation to costs associated with the listing of a company's shares on a regulated market. This imbalance may result from two types of changes (i) a decrease in the benefits of the company or its majority shareholders from listed company status; or (ii) an increase in the costs associated with a status of a listed company,In addition, during the process of delisting, conflicts of interest between majority and minority shareholders may arise. The potential conflicts of interest elucidate the different values protected by national legislators in their framing of delisting regulations. These values are primarily: (i) the economic interest of a company, understood as the company’s ability to take an independent decision to delist itself; and (ii) the interests of minority shareholders, understood as the creation of legal mechanisms ensuring that delisting is carried out in a manner that does not undermine their interests. Consequently, the rules for delisting determined by legislators in individual EU member states aim to manage potential conflicts of values.Analysis of the reasons, consequences and values protected by delisting rules serves to realize of the second objective of this work. That is indicating how the Polish legislator has set the rules for delisting in the context of values prioritized by Polish law. In my opinion, the existing delisting regulation is primarily aimed at protection of the interests of minority shareholders rather than the economic interests of the company. Therefore, it was decided to discuss the legal mechanisms envisaged by the legislator in the case of the delisting and assessing them. It was also reasonable to identify and analyze the basic legal issues related to the process of delisting, taking into account the minority shareholder protection mechanisms provided for by the Polish legislature.

Full textThe subject of the doctoral dissertation is legal protection of secrets of the party to antitrust proceedings concerning competition-restricting practices. Three categories of the eponymous parties' secrets have been analyzed, i.e. information that constitute business secret, secrets related to the financial market and the legal professional privilege. The main thesis of the dissertation is contained in the statement that Polish legal provisions regarding protection of secrets of the party to antitrust proceedings concerning competition-restricting practices do not, in general, prevent the Polish antimonopoly authority from monitoring the compliance with the provisions prohibiting competition-restricting practices. Simultaneously, the applicable legal provisions and the practice of their application indicate that the need for protection of legitimate interests of the party who is a beneficiary of the secret as well as the other parties and the third parties when granting the legal protection to these secrets is taken into account to an insufficient extent. Therefore, there is a need to implement changes in this regard. The main research method is formal-dogmatic analysis. The elements of the comparative legal analysis and statistical data from the Office of Competition and Consumer Protection were also used.

Full textThe dissertation consists of an introduction, four chapters answering individual specific questions and endings. Chapter 1 is the theoretical outline of the problem and discusses key concepts related to the subject of the study with reference to economic and legal sciences. It also presents solutions adopted in four selected EU Member States and at the EU level. The second chapter analyzes the model of legal protection against unfair use of superior bargaining power functioning before the entry into force of the Act on counteracting the unfair use of superior bargaining power in agricultural and food products trade,as well as legal measures that appeared after 12.07.2017.Chapter 3 is devoted to substantive law. It refers to the subjective and objective scope of Polish regulation.The fourth chapter examines methods of enforcing the prohibition of unfair use of superior bargaining power. It discusses the powers of the competent authority. The dissertation conclusion refers to proposed solution to the research problem, as well as an assessment of the currently applicable regulations in the analyzed area and the de legelata and de legeferenda proposals.
