The 35,882 former offenders released by Virginia's Department of Corrections during the period of July 1, 1998, through June 30, 2002, are profiled using data provided by Virginia's Department of Corrections and Department of Correctional Education as well as the Virginia Employment Commission. Demographic characteristics of recidivating and non-recidivating former offenders released during this period, with sub-groupings to include gender, race, age, employment status, earnings, employment stability, and educational completion, as defined in the operational definitions of the study, are detailed, and the researcher's observations are noted.<br>Ph. Abstract:
The media, which help define what we think and our roles in the society, have a crucial role to project both men and women’s issues so as to change people’s perceptions and stereotypes about the role men and women play in the society. There is need, therefore, to ensure gender equality in the operations of the media so that issues to do with both men and women get adequate and equal coverage. This study on the reportage of the land redistribution exercise in Zimbabwe has, however, exposed the gendered nature of the operations of the media, particularly in the news production process. It provides that, overally, the news discourse is a masculine narrative whose androcentric form is a result of, and is protected by, claims to ‘objectivity,’ ‘professionalism’, ‘impartiality’ and the pursuit of a journalistic routine system that hegemonically prioritises men’s issues over those of women. The situation, as the research shows, has not been helped by journalists’ incapacity to do thematic appreciation of issues and their over-inclination towards a simplistic event-based journalism that fails to question policies as they are enacted and implemented in gender-skewed processes. The lack of gender policies, the operations of patriarchy and the pursuit of a journalistic routine system that sees nothing wrong with the ostracisation of women issues are very fundamental findings that the research uses in its attempts to explain why the gender equality discourse was left out of the news reports about the land reform exercise in Zimbabwe.

Abstract:
On May 16 2006 the government of Zimbabwe embarked on a clean-up programme of urban centres, destroying informal human settlements and informal businesses. This operation, which the government called operation "Restore Order", resulted in the displacement of nearly one million people and left thousands of families homeless. This study is a discussion and an analysis of the coverage of the clean-up operation by two of Zimbabwe's leading Sunday newspapers, The Sunday Mail and The Standard. The Sunday Mail is owned by the Zimbabwe government and The Standard is privately owned and perceived to be oppositional to the current Zimbabwe government. The two newspapers, therefore, covered the clean-up operation from different perspectives and often presented conflicting reports explaining why the clean-up operation was carried out and the extent of its impact on the lives of millions of Zimbabweans. The chosen research approach is the Critical Discourse Analysis (CDA) framework as developed by Fairclough (1995). Using CDA, this study seeks to find out and expose the underlying ideological struggles for hegemony between different social and political groups in Zimbabwe and how the newspapers became actors in this process. This process is made possible by looking at how news reporting is organised in the two newspapers, issues of language use, sourcing and external factors that influenced the coverage of the operation.

- Das Folterverbot und das Verbot unmenschlicher oder erniedrigender Behandlung aus Art. 3 EMRK gelten absolut; die so genannte „Rettungsfolter“ ist mit der Konvention unvereinbar. - Für den Wegfall der Opfereigenschaft reicht die Verurteilung der Polizeibeamten, welche die unmenschliche Behandlung angeordnet und durchgeführt haben, nicht aus. Relevant sind weiterhin die Höhe der Bestrafung, die Angemessenheit disziplinarischer Maßnahmen sowie die Dauer eines vom Beschwerdeführer aufgrund der unmenschlichen Behandlung eingeleiteten Amtshaftungsverfahrens (Große Kammer). - Die Verwertbarkeit der mittelbar aufgrund der unmenschlichen Behandlung gewonnenen Beweise wird im Rahmen des Art. 6 EMRK geprüft. Allerdings besteht die Möglichkeit, dass auch im Rahmen des Art. 3 EMRK der Ausschluss der Verwertung missbräuchlich erlangter Beweise notwendig werden kann. - Die Verwertung von Beweismitteln, die infolge einer Art. 3 verletzenden Maßnahme gewonnen wurden, wirft stets schwerwiegende Fragen in Bezug auf die Fairness des Verfahrens auf. Die Ablehnung der Fernwirkung von Beweisverwertungsverboten verstößt aber nicht per se gegen Art. 6 EMRK. Zulässige, für eine Verwertbarkeit sprechende Kriterien sind das fehlende Beruhen der Verurteilung auf dem missbräuchlich erlangten Beweismittel und die hypothetische Möglichkeit der rechtmäßigen Beweismittelgewinnung. Eine klare Entscheidung zur von der deutschen Rechtsprechung durchgeführten Abwägung der Schwere des Grundrechtsverstoßes mit der Schwere des begangenen Verbrechens trifft der EGMR nicht.

(International Commercial Law)<br>This dissertation concerns a comparative analysis of Brazilian, Indian and South African private international law principles on the exercise of jurisdiction in international civil and commercial cases. The intention is to uncover the fundamental grounds of jurisdiction in these legal systems and in doing so draw attention to their comparable characteristics. Emphasis is placed on matters of a commercial nature. Furthermore, a discussion of the Hague Convention on Choice of Court Agreements provides insight on the Convention’s purpose and its possible influence on and implications for jurisdictional rules found in the private international law of the IBSA countries should they become members to the Convention.

Sendo amplamente conhecido que as micro, pequenas e médias empresas, que representam a quase totalidade do tecido empresarial português, têm-se mantido, nos últimos anos, excessivamente endividadas e dependentes do financiamento bancário, foi aprovado e publicado – no âmbito do Programa Capitalizar, e como forma de fazer face à relevância do crédito bancário nas sociedades portuguesas – o Decreto-Lei n.º 79/2017, de 30 de junho. Numa tentativa para induzir ao financiamento das sociedades mediante capital próprio, este diploma introduziu no Código das Sociedades Comerciais um procedimento de aumento do capital social por conversão de suprimentos que pretere o processo deliberativo. Uma vez que nos propusemos a estudar o referido diploma de vários ângulos, além da mera análise das regras por ele implementadas, o presente trabalho ocupar-se-á do estudo de várias formas de financiamento da sociedade pelos sócios, em particular o contrato de suprimento, culminando no estudo da motivação e do seu potencial para a capitalização das sociedades comerciais portuguesas.<br>As it is widely known that micro, small and medium-sized enterprises, which represent almost the entirety of the Portuguese business world, have been excessively indebted and dependent of bank financing, it was adopted and published – within the scope of Capitalize Program and to cope with the importance of bank credit to Portuguese companies – the Decree Law 79/2017 of June 30. In an attempt to lead companies to financing through equity, this piece of legislation introduced a share capital increase procedure in the Code of Commercial Companies that disregards the necessity of a shareholders meeting. Since we proposed ourselves to study said piece of legislation from multiple views, beyond a mere analysis of the rules implemented by it, the present work will be responsible for the study of different forms of corporate financing by the shareholders, particularly the shareholders’ loan contract, concluding with the study of its motivation and potential in the capitalization of Portuguese corporations.

Abstract:
In virtual worlds such as Second Life, participants can engage in a variety of activities with other online residents. The personality type of the resident inherently guides the activities in which he or she chooses to participate. Choices, such as communication method (i.e., group communication versus one-to-one) and in-world community participation (i.e., exploring new worlds versus building their own), can be directly linked to the personality preferences of the virtual world user. Carl Jung’s work entitled “Personality Types” (1921) is regarded as one of the foundational works in understanding the personality preferences of oneself and others. Jung’s work is the foundation for extrapolated personality theories and the basis for personality assessments on personality type. Understanding the personality types of virtual world users may help educators when designing online experiential learning activities. This understanding may also help educators understand why some students thrive with online experiential learning activities while others struggle. Utilizing a demographic survey and the Majors Personality Type Inventory, a quantitative analysis of Second Life users was conducted. An examination of a resident sample size (n=91) in relation to population norms will be outlined. Statistically significant differences between the Second LifeTM population and population norms will be discussed. The implications of this study for educators who choose to employ Second LifeTM as an experiential learning tool will also be examined.<br>2013-08

O impacto do conflito de interesses numa empresa e, num país como Portugal, pode constituir um entrave ao desenvolvimento de uma economia, sociedade e, por vezes, um limite à sua internacionalização. Na presente dissertação de mestrado, pretendemos explorar a temática dos conflitos entre sócios e, também, de todos os elementos que consideramos essenciais para o efeito. Sob uma perspetiva concreta e deveras ilustrativa desses possíveis conflitos, analisaremos as implicações que o novo processo de conversão de suprimentos em capital social, aprovado a 30 de junho, pelo DL 79/2017, desencadeia perante a sociedade, os sócios e, até, para com os restantes stakeholders. As alterações nos artigos 87.º a 89.º do CSC, introduzidas por este diploma, serão, então, o cerne e o foco de uma análise que se procura completa e exaustiva, contextualizada na conciliação dos deveres e princípios agregados à completude do processo, com o potencial futuro do mesmo nas sociedades comerciais portuguesas. Assim sendo, procederemos a uma análise dos conflitos de interesse entre sócios e a forma variada como podem surgir. De seguida, passaremos ao estudo dos padrões de conduta dos sócios, destacando os deveres e direitos dos mesmos. E, por fim, como mencionado anteriormente, exploraremos o novo processo de conversão de suprimentos em capital social, sob a génese dos possíveis conflitos entre sócios.<br>The impact of conflict of interests in a company and, in a country like Portugal, can constitute an obstacle to the development of an economy, society and, sometimes, a limit to its internationalization. In the present master's thesis, we intend to explore the theme of conflicts between partners and, also, of all the elements that we consider essential for the purpose. From a concrete perspective and very illustrative of these possible conflicts, we will analyze the implications that the new process of converting supplies into share capital, approved on June 30, by DL 79/2017, unleashes before society, the partners and, even, for with other stakeholders. The changes in articles 87 to 89 of the CSC, which emerged with this DL, will then be the focus and focus of an analysis that is sought to be complete and exhaustive, contextualized in the reconciliation of duties and principles, added to the completeness of the process, with the future potential of it in Portuguese commercial companies. Accordingly, we will proceed to an analysis of conflicts of interest between partners and the varied manner in which they may arise. Then, we will move on to the study of the partners' standards of conduct, highlighting their duties and rights. And finally, as mentioned earlier, we will explore the new process of converting supplies into social capital, under the genesis of possible conflicts between partners.

(International Commercial Law)<br>This essay seeks to look at the role of express submission to jurisdictjon under the Brussels I Regulation,lthe Brussels I (recast) Regulation2 and the Hague Convention on Choice of Court Agreements.3 The express submission to jurisdiction under the three instruments mentioned in the previous sentence refers to the situation in which parties to an international commercial contract include in their contract a court of their choice to govern any disputes that may arise between them. This designated court may or may not be situated in a country that is a member of the three instruments mentioned above. The purpose of this thesis is to determine what will occur when the court chosen is from a country that is not a member of either of the three instruments mentioned. We will first look at express submission and the role it plays in determining which court has jurisdiction. This section on express submission will provide the definition of express submission in the context of a contract which incorporates a choice-of-forum agreement between the parties who are engaged in an international commercial transaction. The thesis will view the role of submission in a common-law and civil-law country in light of express submission by contract. Finally, a distinction will be made between an exclusive and non-exclusive jurisdiction clause. A brief discussion ofthe Brussels Convention4 (The Convention) will be provided in order to present the fact that the Convention only applies when a choice-of-forum agreement in a contract has assoned thejurisdiction to a court of a country which is a member of the Convention. The Convention would not apply when a choice-of-forum agreement in a contract has assigned jurisdiction to the court of a country which is not a member to the Convention. ln order to determine whether the position has changed since the enactment of the Brussels I Regulation (Regulation) with regard to choice-of-forum agreements that designate jurisdiction to the court of a country in a nonmember state of the Regulation, provisions relating to express submission clauses will be discussed. A further discussion will be provided to ascertain whether the enactment of the Council Regulation (EC) No 4412001 of 22 December 2000 on jurisdiction and the recognition and enforcement ofjudgments in civil and commercial matters.
