Abstract: It is possible to distinguish three key historical motives underlying the formation of national civil codes: economic motives, reasons of state interest, and the interests of citizens. The question arises as to whether these motives can teach us something about the possibility of the successful implementation of a European Civil Code. The modern civil codes share a common legal tradition and, to some extent, a homogeneous legal culture, based on the reception of Roman legal rules and principles. A further question thus arises: Is it possible to derive inspiration from the ‘old’ ius commune for the formation of a European Civil Code? Résumé: La formation des codes civils nationaux obéit historiquement à diverses considérations dont les trois principales sont celles d’ordre économique, celles tenant à l’intérêt de l’État et celles tenant aux intérêts des citoyens. L’identification de ces motivations peut conduire à se demander si elles recèlent des enseignements quant aux chances de succès de l’entreprise d’élaboration d’un Code civil européen. Les codes civils modernes s’inscrivent dans une même tradition juridique et partagent une culture juridique relativement homogène, toutes deux fondées sur la réception des règles et principes du droit romain. Cette observation soulève donc une autre question, celle de savoir s’il est possible de s’inspirer de ‘l’ancien’ ius commune pour élaborer le Code civil européen.

The paper is devoted to the new Czech Civil Code, thanks to which the Czech private law has experienced its greatest legislative change in the last fifty years representing its ultimate diversion from the socialist law principle. The author discusses briefly the development of Czech private law in general, as well as the recodification process. However, the focus of the paper lies mainly in the presentation of the new Czech Civil Code to the public of Visegrad Group countries. The aim of the presented paper is to provide a complex and unbiased view on the new Czech Civil Code, which in some respects may serve as an inspiration for the drafters of the new Slovak and Polish Civil Code.

Après la description du processus de codification du droit civil en Catalogne, l’auteure s’intéresse à la transposition juridique de certaines institutions du Code civil québécois dans le nouveau Code civil catalan. La réception de celui-ci est plutôt partielle, par rapport à des institutions déterminées ou bien à la philosophie qui les inspire et, sans aucun doute, dans la plupart des cas, l’importation s’adapte à la vision du législateur catalan. L’auteure s’attache spécialement au cas de l’adoption de la disposition préliminaire ainsi qu’à la perspective d’implantation de la fiducie et de l’administration du bien d’autrui. Dans le domaine du droit de la personne, elle souligne que d’autres emprunts seraient souhaitables.

L'objet de cette étude est de présenter et de questionner les œuvres plastiques et littéraires qui offrent une représentation explicite du Code civil. L'ambition de l'étude est ainsi double: d'une part, elle consiste à composer et articuler un corpus d'œuvres d'art - tableaux, sculptures, romans, drames, meubles et gravures - dans lesquelles figure le Code civil. D'autre part elle entreprend de distinguer et analyser les représentations du Code que ces œuvres ont cristallisées ou véhiculées. Au vrai, la richesse et la diversité des représentations artistiques du Code civil sont surprenantes, singulières, stimulantes aussi bien pour l'historien du droit que pour l'historien de l'art. Toutefois, par delà cette multitude d'expressions se dessine une tendance nette qui constitue la trame de notre recherche: la divergence radicale des représentations du Code civil selon qu'il s'agit du recueil en son entier ou de ses réalisations casuelles. En effet, que ce soit en littérature ou dans les Beaux-Arts, les représentations du Code dans sa globalité sont tendanciellement apologétiques tandis que les évocations de ses articles sont généralement critiques. La chronique que nous proposons entreprend méthodiquement de le révéler et l'illustrer au travers des œuvres exposées: dans le domaine artistique, le Code civil fut globalement magnifié et ses seules détractions concernent les détails de son texte.

El autor realiza un análisis desde la época Medieval hasta la actualidad para evidenciar el cambio y la evolución que hicieron los pensadores para aplicar el método geométrico al Derecho y la forma de configurar de las normas en el Civil Law. Asimismo, se reconoce y analiza los aportes de los escritores y pensadores europeos, que impulsaron la Revolución Científica del siglo XVII, en especial la obra del abogado Gottfried Wilhelm Leibniz.

Les applications de cet article font l'objet d'une attention doctrinale soutenue, non le procédé en jeu. Cette thèse lui est donc consacrée. Elle souligne que l'accord de volontés n'est pas la convention. Le passage de l'un à l'autre résulte d'un mécanisme "d'appréciation". Cela distingue cet article des règles d'interprétation et de l'article 1134, alinéa 3. L'article 1135 emporte des effets complétifs, effets inexprimés, complémentaires et accessoires qui ne procèdent pas de la volonté des parties, mais des sources d'obligations que sont la loi, la norme coutumière et l'équité. Ils visent à inscrire de simples accords dans l'environnement normatif auquel ils doivent leur force obligatoire. Pour devenir convention, il ne suffit donc pas qu'un accord soit légalement formé; il faut encore qu'il soit légalement composé. The applications of article 1135 of the Civil Code are the subject of constant doctrinal scrutin, not the process involved. Thus, this thesis is devoted to it. She points out that the agreement is not the contract. The contract results from an "appreciation" proceed. It distinguishes article 1135 from the rules of interpretation and from article 1134, al. 3. From article 1135 result "completive effects", unexpressed, complementary and incidental that do not result from the will of the parties, but from these sources of obligations which are statute, usage and equity. They aim at registering simple agreements in the normative environment to which they owe their binding force. To give place to a convention, it's thus not enough that a, agreement is "legally stated"; it must also be legally fulfilled. This setting in conformity (by way of addition) with the requirements of substantive law is the characteristic office of this article

The 2008 California Building Code (CBC) will adopt the structural section of the 2006 International Building Code (IBC), which includes alterations to the procedure to determine earthquake design loading, and a drastic move to a complicated method to determine design wind pressures. The implementation of the revised 2006 International Building Code, and the subsequent California adoption of the structural section will have significant effects on the design and construction of structures not only in California, but also the rest of the country. Through a comparison of the design of a steel moment-resisting frame low-rise structure, it was determined that the new code will result in design values that differ from those resulting from the previous codes. In order to compare the relevant codes in different areas of the country, this thesis considers three design scenarios for the low-rise structure: seismic loading in Southern California to compare the 2001 CBC, the 2003 and the 2006 IBC, seismic loading in the Midwest to compare the 2003 IBC and the 2006 IBC, and wind loading in Northern California to compare the 2001 CBC and the 2006 IBC.
(cont.) In the first case, the change from the 2001 CBC to the 2003 IBC was an 8 percent increase in base shear, but a 2 percent decrease from the 2001 CBC to the 2006 IBC. The second case resulted in a 29 percent increase in base shear from the 2003 IBC to the 2006 IBC. The result of the third case was design wind pressures that decreased 20 percent from the 2001 CBC to the 2006 IBC. These design differences will change the design of the lateral force resisting system, especially the later two cases. In addition, the design engineers in California will have to learn a new, greatly more complicated method to design for wind loading. These combined effects of the code changes will impact both engineers and the resulting building designs in all parts of the country.

Selon une doctrine classique sans doute encore dominante aujourd'hui, le droit du travai se serait construit pour pallier à l'inaptitude du Code civil à régir adéquatement les rapports entre employeurs et salariés. Le Code civil serait, selon certains, à l'origine de certains maux dont souffrirait le droit du travail et devrait être mis à l'écart à chaque fois que cela est possible. Cependant, paradoxalement, les articles L. 121-1 et L. 120-2 autorisent la participation du Code civil à l'ordonnancement des relations du travail. De plus l'analyse des décisions de justice montre que loin d'être marginales, les manifestations du Code civil en la matière sont à la fois diverses et multiples. En effets, contairement à ce que l'on à pu écrire et à ce que laisse entendre l'article L. 121-1 du code du travail qui vise le "droit commun", les dispositions du droit des obligations ne sont pas seules en cause : le livre premier consacré aux "personnes" est également sollicité ( notamment les articles 7 et 9 du Code civil). Enfin, sur un plan plus théorique, même si le droit du travail est incontestablement doté de règles et de principes qui sont spécifiques, il n'est pas un droit autosuffisant (autonome) et, à ce titre, il a besoin du renfort du Code civil qui fait figure de droit autonome. Cependant, si la contribution du Code civil est possible en la matière c'est le plus souvent parce que les règles "civilistes" subissent des inflexions particulières dans leurs applications aux relations du travail ou reçoivent des exceptions purement prétoriennes. Etudier le jeu du code civil conduit ainsi à démontrer à la fois l'ambivalence des rapports que ce Code entretient avec le droit du travail et la réversibilité de ses techniques. Cette faculté d'adaptation dont font preuve les dispositions du Code civil est riche d'enseignement au niveau de la théorie. Elle montre, d'une part, que le texte du Code civil ne correspond pas forcément à la règle de droit civil et qu'il a une texture ouverte. D'autre part, cette distance entre le texte visé et la solution adoptée en droit du travail au regard de ce texte est également un élément supplémentaire à verser au dossier de l'appréhension non-déontique et instrumentale de la règle de droit
According to a conventional doctrine undoubtedly still dominant today, the labour law was said to be created to overcome the incapacity of the civil code to adequately govern employer/employee relations. According to some, the civil code would be behind certain troubles of labour law is suffering from and should be ruled out whenever possible. However, paradoxically, articles L. 121-1 and L. 120-2 allow for the participation of the civil code in putting working relations into order. In addition, this analysis of decisions law shows that far from being marginal, displays of civil code in such matters are both diverse and multiple. Indeed, as opposed to what one may have written and what article L. 121-1 of the labour code aimed at "common law" leads to believe, the provisions of the law of obligations are not the only ones at issue : book one dedicated to "persons" is also concerned (namely articles 7 and 9 of civil code). Finally, more theoretically speaking, although the labour law is undeniably endowed with rules and principles specific to it, it is not a self-sufficient (autonomous) law and, with regard to this, it does need to be backed by the civil code which acts as common law. However, although the contribution of the civil code is possible in this respect, most often this is because the "civilist" rules are subject to specific inflexions in terms of their application to working relations or accommodate purely praetorian exceptions. Studying the civil code game thus makes both the ambivalence of the relations this code maintains with the labour law and the reversibility of its techniques apparent. This facility of adaptation, evidence of which is shown in the provisions of the civil code, is rich in teaching on a theoretical level. On the one hand, it shows the text of the civil code does not necessarily correspond to rule of civil law and that is has an open texture. On the other hand, this distance between the text in view and the solution adopted in labour law with regard to this text is also an additional element to be added to the file of non-deontic and instrumental apprehension of the rule of law

La rencontre entre les contrats et les droits fondamentaux est au centre de très nombreux débats juridiques contemporains : qu’il s’agisse notamment de la place du fait religieux dans la société, de la marchandisation du corps humain, ou encore du respect de la dignité de la personne. Cette rencontre stimule la réflexion de nombreux juristes, le sens de l’étude est de contribuer modestement à celle-ci dans la perspective d’une comparaison entre les droits français et québécois.On peut alors observer que l’exigence de respect des droits fondamentaux dans les contrats progresse dans les deux systèmes. En premier lieu, parce que nos droits font une place de plus en plus grande aux instruments de protection des droits fondamentaux, leur autorité s’impose en matière contractuelle. Ensuite, il faut remarquer que l’autorité des droits fondamentaux n’épuise pas leurs effets dans ce domaine. Ils rayonnent dans les contrats, car de relecture en réécriture les droits français et québécois des contrats sont de plus en plus imprégnés par l’exigence de respect des droits fondamentaux. Toutefois, en France et au Québec, à cette progression répond la nécessité de permettre l’inscription sociale des droits fondamentaux. On voit alors que le pouvoir sur les droits fondamentaux dans les contrats s’affirme, et que de contrat médical en contrat de travail, il devient incontournable pour permettre leur exercice. Toutefois, la dangerosité inhérente du pouvoir sur les droits fondamentaux justifie une réflexion sur les limites qui peuvent lui être assigné, à la fois en considération du respect de la dignité de la personne, mais également en considération de sa légitimité
The meeting of contract law with fundamental rights is at the center of numerous contemporary legal debates, notably with regard to the place of the religious in society, the commodification of the body, or respect for human dignity. This encounter has prodded a reflection from numerous jurists. The aim of this study is to bring a modest contribution to the discussion, through a comparison of French and Québec law. The exigencies of respect for fundamental rights is evolving in the two legal systems. Because fundamental rights instruments play a larger role in our laws, their authority in contractual matters is becoming ineludible. Indeed, it should be noted that fundamental rights have not reached their full extent in this field. They emerge within contracts, because from revisiting to re-writing, Québec and French contract law are increasingly influenced by the obligation to comply with fundamental rights.However, this evolution in France and in Quebec is accompanied by a requirement that fundamental rights be allowed social admission. From that point on, we can see power over fundamental rights being asserted within contacts, that power evolving from medical contracts to work contracts towards becoming inescapable for their enforcement. Yet, the danger inherent in such power over fundamental rights calls for serious deliberations on the limits that must be set upon it, both with regard to the dignity of the human person, and in relation to its legitimacy

Raymond Saleilles (1855-1912) és considerat pels comparatistes com pare del dret comparat modern. De fet fou el màxim responsable de l'organització del primer congrés internacional de dret comparat a París el 1900. L'època marcada per la internacionalització dels intercanvis, la crisi del mètode jurídic francès i el repte de la codificació alemanya i suïssa motivà alguns juristes a buscar noves formes d'estudiar el dret. Saleilles defensava pel dret comparat un mètode, un objecte i un fi propis i autònoms diferents dels que fins ara tenien la dogmàtica jurídica o l'estudi de la legislació estrangera. El mètode tenia els seus fonaments en la sociologia i la història. L'objectiu del dret comparat havia de ser la construcció d'un ideal "droit commun de l'humanité civilisée". Aquest dret comú havia de ser construït no només per la doctrina sinó també per la jurisprudència i el legislador.
Raymond Saleilles (1855-1912) is considered by many comparatists as the father of modern comparative law. Saleilles had a great responsibility in the organization of the first International Congress on comparative Law in Paris in 1900. This event is still today considered as the foundation moment of modern comparative law.
Saleilles' times were those of the internationalization of exchanges, of the crisis of the "Exegèse" Method and of the new challenging German and Swiss civil codification.
Saleilles tried to build a new discipline, comparative law, with its own method, object and aim. This method had its basis on sociology and history and tried to break the national and scientifical fences of Jurisprudence.

Abstract:
The promulgation of the "Civil Code" provides a path for the codification of other important legal departments closely related to the socialist market economy and the improvement of the socialist legal system with Chinese characteristics. However, due to the fact that the development of economic law in our country is relatively short and the economic development is changing rapidly, the current economic code is facing numerous obstacles. This article analyzes the relationship between civil law and economic law, drawing on the innovation of the content of the Civil Code, and puts forward new requirements for the development of the content, concept and system of economic law, and promotes the development of economic law.

It is readily apparent to everyone that there are multiple and serious concerns that face Muslim societies today. Terrorism, civil strife, poverty, illiteracy, factionalism, gender injustices and poor healthcare are just a few of the challenges to governance across the Muslim world. These are core issues for governance and public administration in any form of government. However, before we can engage with good governance within the context of Islam, we need to be clear what mean by good governance itself. A simple definition of good governance is that of an institutionalised competency of administration and institution leading to efficient resource allocation and management[1]. Another way of looking at it is as a system which is defined by the existence of efficient and accountable institutions[2]. Civil society now tends to look at good governance by way of impact measurement and how a certain set of processes result in a set of measurable and desirable outcomes.

Abstract:
The article considers contractual designs aimed at transferring exclusive rights to industrial property. The problem of the contractual process was identified when concluding a contract on the transfer of a set of exclusive rights. Based on the study, a number of changes to Russian laws have been proposed. First of all, this applies to a commercial concession contract. The author proposes to amend the Civil Code of the Russian Federation by supplementing the article on commercial concession with the right of organizations that do not conduct commercial activities to conclude the same contracts on a general basis. The appropriateness of applying the classification of transactions into real and consensual ones in relation to this contract is justified. The peculiarities of transfer of the complex of exclusive rights to objects of industrial property with participation of social enterprises under the legislation of the Russian Federation are studied.

Abstract:
Terminal ballistics of concrete is of extreme importance to the military and civil communities. Over the past few decades, ultra‐high performance concrete (UHPC) has been developed for various applications in the design of protective structures because UHPC has an enhanced ballistic resistance over conventional strength concrete. Developing predictive numerical models of UHPC subjected to penetration is critical in understanding the material's enhanced performance. This study employs the advanced fundamental concrete (AFC) model, and it runs inside the reproducing kernel particle method (RKPM)‐based code known as the nonlinear meshfree analysis program (NMAP). NMAP is advantageous for modeling impact and penetration problems that exhibit extreme deformation and material fragmentation. A comprehensive experimental study was conducted to characterize the UHPC. The investigation consisted of fracture toughness testing, the utilization of nondestructive microcomputed tomography analysis, and projectile penetration shots on the UHPC targets. To improve the accuracy of the model, a new scaled damage evolution law (SDEL) is employed within the microcrack informed damage model. During the homogenized macroscopic calculation, the corresponding microscopic cell needs to be dimensionally equivalent to the mesh dimension when the partial differential equation becomes ill posed and strain softening ensues. Results of numerical investigations will be compared with results of penetration experiments.

Abstract:
This paper explores post-Nazarbayev state-building in Kazakhstan, focusing on domestic and foreign policy implications of the power transition. After thirty years of incumbency, President Nursultan Nazarbayev stepped down in 2019, smoothly transferring the power to his nominee, Kassym-Jomart Tokayev, and thus plunged the country into a sensitive phase of power transition. This study suggests that the power transition in Kazakhstan has not led to significant improvements in terms of human rights and political freedoms protection, leaving the state of the weak opposition and constrained civil society intact. Kazakhstan keeps maintaining the core features of oil-rich countries, with hydrocarbon-based economy and regime stability stemming from an “authoritarian bargain” between the state and society. Besides, there has been continuity in foreign policy, with Kazakhstan further pursuing a multi-vectoral foreign policy agenda.
