This chapter analyzes how threats and acts of blacklisting impeded the fair application of the collective agreement between UFCW Local 1518 and Sidhu &amp; Sons. The detection and analysis of the blacklisting of bargaining unit members at Sidhu uncover important “truths” about the management of migration among temporary migrant workers with the prospect of return. Broadly, it demonstrates that institutionalized programs' mechanisms, promoted in the global policy discourse embracing migration management as a means of stemming the flow of “irregular migration,” can impede access to and the exercise of labor rights. More narrowly, it shows that SAWP's “best practices” are by no means neutral, but are instead consistent with the dynamics of global capitalism, producing a race to the bottom in conditions of work and employment. This model temporary migrant work program (TMWP) permits state officials to behave in unprincipled ways that can involve, among other things, defying collective agreement provisions by delegating key responsibilities related to readmission—such as recruitment, selection, and aspects of documentation—to those in the interior and posted abroad. It also illustrates vividly how a labor relations tribunal compelled to prioritize national, and thereby sending-state, sovereignty, can be inhibited in—and even prevented from—implementing and enforcing host-state labor laws under its oversight.

This chapter explores Article XXIII of the Oklahoma constitution. Section 1 promotes industrial welfare of the people by fixing a high standard for employees on public work. It states that “eight hours shall constitute a day’s work in all cases of employment by and on behalf of the State or any county or municipality.” Section 1A reflects the state’s concerns that no person be forced to participate in, or pay for, a labor union and its activities. Section 2 prohibits the contracting of convict labor, while Section 3 prohibits “the employment of children, under the age of fifteen years, in any occupation, injurious to health or morals or especially hazardous to life or limb.” Section 5 deals with the health and safety of employees in factories, in mines, and on railroads. This chapter covers Article XXIX of the Colorado Constitution on ethics in government. The article was added by citizens’ initiative in 2006. Its essential purpose was to outlaw gifts defined in Section 3 to public officers, employees, and their families. The section’s stricter ban allows no gift of any value by lobbyists except for campaign contributions; it specifically outlaws meals and beverages. Enforcement is committed to an Independent Ethics Commission (IEC) appointed as specified in Section 5. Since undertaking enforcement of the amendment, IEC has issued numerous decisions. Abstract:
The author examines the dependence and impact of the distribution of powers of local governments, the content of their functions, activities and tasks in the context of the formation of professional competence, professionalism and professional mobility of officials as subjects of labor and activity. The main idea of the article is that in Ukraine there is now a separation of local government from state. This exacerbates the problem of redistribution and separation of functions and, accordingly, tasks and powers, which will be reflected in the substantive characteristics of professionalism and professional mobility of officials as their current professional qualities. The subject of the study is the impact of decentralization, the process of transformation of public administration on the process of professionalization of local government officials. The research methodology consists in the integrated involvement of the following research methods: methods of analysis: system analysis; complex analysis, decompositions, sequential comparison method and logical and dynamic methods; structural and functional method to clarify the basic concepts. The article uses construction methods: system method; methods of forecasting and planning processes, modeling method; method of structuring goals. The abstract-logical method was used for theoretical generalization and formulation of conclusions. The purpose of the study is to develop areas for improving personnel policy in local governments in Ukraine, through meaningful disclosure of the concepts of «human resources», «professional potential», «professionalism», «professional mobility» in relation to the professional group of local government officials, outlines problems and possible approaches to improving these potentials in Ukrainian realities. The result of the article is a set of main areas of development and improvement of personnel policy and activities of the structural unit for staff development in local government, which are designed to develop professional mobility as a modern top quality of officials. The conclusions indicate the need to improve the forms and methods of working with local government officials, the reserve of personnel, the use of mechanisms and principles of formation and implementation of personnel policy in local governments, creating organizational conditions, addressing the issue of rational selection, placement and professional development personnel through a comprehensive assessment of staff, in particular professional potential, including the activity expression of the latter. The time has come for radical changes in the content of training, retraining and advanced training, self-education of local government officials, which would correspond to the new powers and competencies of local governments, based on professional potential and suitability, aimed at achieving high professionalism and professional mobility, including high professional culture. From the author's point of view, it is necessary to provide for the allocation of funds in local budgets for the training of municipal employees in the amount of at least 4% of the salary fund. It is also necessary to strengthen the protection of local government officials from involvement in election campaigns, from unjustified dismissals of officials, in particular in cases where there is a renewal of politicians and leadership of local governments.

Abstract:
There have been significant changes to Mexican law recently that have provided prosecutors updated and enhanced tools to combat corruption. In May 2015, the Mexican Congress and the states approved a constitutional amendment that created the National Anti-Corruption System, which was put into full force and effect in 2017. This supplemented and broadened the already existing anti-corruption laws in Mexico’s public procurement process. Now individuals and legal entities can be criminally liable for bribery of public officials in Mexico. In November 2014, Mexico City passed modifications to the criminal code making bribery an offense that can be committed by both individuals and legal entities and created an innovative approach to calculating penalties against companies. However, even though laws have changed, much remains to be done. The OECD noted that Mexico has fully implemented very few of the recommendations that it has made to eradicate corruption. Mexico still had no prosecutions or convictions for foreign bribery. Corruption is still common in Mexico, with the widespread use of “gestores” or intermediaries to navigate the bureaucracies responsible for issuing licenses and permits, shell companies owned by family members of government officials seeking a bribe, fictitious service providers, and improper gifting and excessive hospitality to employees of state-owned entities. With the new Lopez Obrador Administration’s anti-corruption plan, further changes are anticipated in public procurement by the creation of a central mechanism to manage and monitor public contracts to achieve greater transparency. The new administration has also committed to creating an autonomous Special Prosecutor’s Office to independently investigate and prosecute corruption cases and to implement additional restrictions on entertainment and gifts provided to public officials.

Abstract:
This chapter provides further analysis of organizational incentive structures, linking the behavior of individuals to the larger macro structure of trade. The analysis here explores the unintended consequences of the private trade allowances. The unique private trade allowances of the English Company had created a perverse incentive for the captains and crew. Those who were engaged in the private trade (which was most employees) had an incentive to illegally extend their voyages in the East and seek out new commercial opportunities. Company officials condemned this practice; however it had an unexpected impact on the firm. While “losing the season” to extend their voyages, captains took the risks necessary to directly link distant markets within the Company network. Through opportunistic and malfeasant behavior, they wove the many regions and ports into one multilateral commercial network.

The quantitative and personal composition of the officials of these bodies, their changes over the years are analyzed. Significant differences have been revealed in the placement of information about employees of these bodies in the commemorative books of various provinces and regions.
