Abstract:

Legislation regulates rights also of individuals with mental disorders. Observance of these regulations is monitored by so-called Ombudsperson,or the Public Defender of the Rights. Since 2002, special attention has been paid to young generation in Slovakia. Developmental problems and issues of rights of ordinary and mentally handicapped children have also been dealt with, applying the paradigm that childhood is entitled to special care and assistance. And this is the ground for collaborators of the Public Defender of Rights, i.e. for school. They are helpful to parents of the minor, to teachers, healthcare professionals and to other adults working with minors. Thus the children ombudspersons become assistants of pedopsychiatry. From the viewpoint of a child psychiatrist, it was important to solve cases of Child Abuse and Neglect syndrome of various scope. Since December 2008, a project for creating the network of children collaborators of the Public Defender of Rights is in operation in Slovakia. Children from a school or other institution selected from their ranks a “children ombudsperson” who is willing to defend the rights of each member also with mental problems and disorders. For this reason is the necessity of development of international cooperation of ombudspersons for children which takes place in 22 European countries within the ENOC (The European Network of Ombudspersons for Children) which was commenced in a greater scale in April 2010. The children ombudspersons should be taken into account in the public healthcare system and they should become a part of the standard care for minor patients.

Abstract:

The article is devoted to analysing the activities of the European Network of Ombudspersons for Children. The experience gained so far allows us to draw conclusions as to the activities of the institution coordinating the activities of ombudspersons for children in Europe and confirms that the exchange of good practices, support and coordination effectively strengthens the protection of children’s rights. This article aims to draw attention to selected problems related to the specificity of the activity of this European institution, which integrates not only the institutions of children’s rights ombudspersons but also other institutions established to protect the rights of the youngest in the situation of multifaceted threats of the modern world. The author tries to show that the European Network of Ombudspersons for Children undertakes intensified efforts to protect children’s rights and is effective in this respect.

Abstract:

The global diffusion of administrative institutions such as the Ombudsperson office provides clues into wider questions of democratic development. Explanations of institutional diffusion tend to assume, however, that the essential character of the institution remains relatively stable. While the office of the Ombudsperson has become a potent symbol of administrative fairness and independence in defense of the individual against the powerful public agency or corporation, we show that the essential identity of this office has changed over time. As the number of agencies calling themselves ombudsmen has proliferated, the number of functions performed have diversified, shaping public perceptions and expectations. The article describes this pattern of institutional diversification into a widespread network of classical, executive, organizational, and advocacy ombudspersons. The institutional proliferation has led to processes of institutional standardization, and an increasing motivation to defend the ombudsman “brand” to justify its status and distinguish its place within different political and administrative systems.

Abstract:

ABSTRACT This paper aims to reflect on the theoretical and practical challenges in the methodological path of building the Institutional Accreditation process of the Unified Health System (SUS) ombudspersons, developing teaching materials, and the dynamics of fundamental interactions between the stakeholders involved. It discusses the trajectory of a working partnership between a team of researchers and a department of the Ministry of Health, which aims to theoretically and methodologically support the actions of the sector working on the principal participation and social control topics and, in particular, the ombudspersons, generating evidence for management decision-making. The authors present the challenges in partnership and the process and discuss from a methodological, reflective, and participatory viewpoint, presenting ideas and concepts that have evolved and govern the pedagogical materials prepared for the instrumentalization of the Institutional Accreditation process of SUS ombudspersons as a theoretical-practical framework. The authors conclude that adopting a challenging constructivist method is a healthy effort for self-improvement and guarantee of the affirmation of democratic values, effective in the constant search for the qualification of the actions of the ombudspersons, research activity, management practice, and services and public policies.

AbstractThis paper addresses the politicization of public institutions through the case of national ombudspersons. While there is an established literature on the politicization of top public officials, we lack research on the politicization and / or de-facto independence of supreme or supervisory bodies, including ombuds institutions. In this paper, we combine the insights of three bodies of literature in order to build a framework for the empirical study of national ombuds institutions: Literature (1) on the independence of public institutions, in particular ombuds and regulatory agencies, (2) on politicization and party patronage in state institutions, and (3) on career patterns and selection criteria of top public officials and the administrative elite. We then discuss these issues on the basis of an empirical field study of the Austrian om-buds institution: First, drawing on a socio-demographic analysis of ombudspersons we identify common features of their profiles and career paths. We find that overall the ombudspersons represent a relatively homogenous group, but the political party represents an explanatory variable for some of the ombudspersons’ characteristics. The second set of empirical results, drawing primarily on qualitative interviews with case-handling staff, demonstrates that despite the institution’s public efforts and many interviewees’ reassurances that the AOB is independent and acts as such, there are several areas in which party-related positions become visible in the AOB’s work. These results are integrated into a typology on the effects of political appointment modes of ombudspersons, which should enable further research in this field.

Abstract:

ABSTRACT Based on the Qualification course of External Evaluators for the Accreditation process in the Unified Health System (SUS), held in 2018, this paper aims to discuss the challenges to the training process of these evaluators from a perspective of participatory evaluation to contribute to the improvement of external evaluation and self-evaluation devices. To this end, 33 documents produced with the practice of these devices were analyzed within the project. In external evaluation, the main challenge is to ‘look at the other’. This specific type of perspective requires the External Evaluation Team’s mastery over the previous knowledge, skills, and attitudes necessary for the work to capture knowledge, intentions, and relationships expressed in the statements of the subjects. In self-evaluation, the main challenge is ‘looking at oneself’. Taking oneself as an object of knowledge and field of transformation requires specific ways of doing to gain quality in work processes. Building a culture of evaluation in which the information produced supports decision-making is a challenge for the ombudspersons, which can be overcome with the Quality Benchmark of the Ombudsperson Services of the SUS.

Abstract Powerful tools for promoting children’s rights include direct reporting, which refers to communicative acts performed by individuals below the age of 18 to draw the attention of public authorities to rights’ violations experienced by themselves or their peers. However, for various reasons, children rarely reach out to public authorities to report offences or abuse. Drawing on data collected from focus groups with children, field visits to children’s ombudspersons, and two surveys conducted as part of the Children Digi-core project, we argue that while direct reporting can empower young people by giving them a voice, it can also result in secondary victimisation if not properly managed. Therefore, it is crucial to establish clear guidelines and procedures to ensure the well-being and protection of children. In light of this, the article offers recommendations to public authorities, particularly local ombudspersons for children, on how to collect and handle children’s reports.

Abstract:

This study introduces a cross-country comparative analysis of the role of News Ombudsperson in the public media corporations in Spain and France. It investigates the specific media self-regulatory processes established to reduce reputational risks and increase the trust and credibility of the media organisations. It aims to fill in the gaps in prior research by applying a qualitative framework developed using indicators derived from scholarly work on regulation and governance and media management. The variables selected for the analysis are extracted from prior interdisciplinary research and focus on media self-regulatory processes, complaints management mechanisms, election, reporting procedures, checks and balances, roles, visibility and transparency of News Ombudspersons in two countries which represent the Polarised Pluralist media system category. Research questions are raised in relation to the main variables identified for the comparative analysis. Data were collected from multiple publicly available international sources, including public media organizations databases, national media regulatory authorities, and academic studies. Results reveal cross-country variations. The systematic investigation of different forms of self-regulatory procedures might lead to concrete recommendations and best practice models for media organizations beyond the European Union. Further research could address the role of media audiences as relevant stakeholders in media governance processes.

RESUMO Com base no Curso de Qualificação de Avaliadores Externos para o processo de Acreditação no Sistema Único de Saúde (SUS), realizado em 2018, o objetivo deste artigo foi discutir os desafios postos ao processo de formação desses avaliadores, fundamentado em uma perspectiva da avaliação participativa, como forma de contribuir para aperfeiçoamento de processos dos dispositivos de avaliação externa e autoavaliação. Para isso, analisaram-se 33 documentos produzidos com a prática desses dispositivos no âmbito do projeto. Na avaliação externa, o principal desafio consiste em ‘olhar para o outro’; esse tipo específico de olhar exige que a Equipe de Avaliação Externa detenha o domínio sobre os conhecimentos prévios, competências e atitudes necessárias ao trabalho, para captar saberes, intencionalidades e relações, expressos nos atos de fala dos sujeitos. Na autoavaliação, o principal desafio consiste em ‘olhar para si’; tomar a si próprio como objeto de conhecimento e campo de transformação requer formas específicas de fazer, visando ao ganho de qualidade nos processos de trabalho. Construir uma cultura de avaliação, em que as informações produzidas subsidiem a tomada de decisão é um desafio para as ouvidorias, que pode ser superado com o Referencial de Qualidade das Ouvidorias do SUS.

AbstractThis article attempts to understand the distinctive role of independent human rights institutions for children (IHRICs) in Europe, in the context of the proposed EU strategy on the rights of the child. It begins by explaining the distinctive characteristics of IHRICs, their presence, location and organisation in Europe, and the role of the European Network of Ombudspersons for Children (ENOC). It goes on to examine their developing relationships, individually and collectively, with European institutions (in particular the institutions of the European Union, but also with reference to the Council of Europe). The article draws on observations of the annual conference of ENOC in 2010, and on interviews with members of ENOC. The article follows this with a discussion of how IHRICs may be understood as operating at the interface of regional, national, European and global mechanisms, and concludes with a review of current issues and some questions for future research.

This article reports a study of the impact of independent human rights institutions for children, using methods drawn from critical realism and appreciative inquiry. A survey of member institutions of the European Network of Ombudspersons for Children enquired into the contexts, mechanisms and outcomes of their work. The results showed wide variation in the situation, aims and methods of working of the institutions, along with some strong commonalities. The survey was followed by two in-depth case studies, to explore how staff and external stakeholders understood and evaluated the impact of their work. A conclusion was that the impact of such institutions has to be understood in a grounded way, and pre-designed general indicators are therefore of limited value. One product of the research is a template, developed collaboratively with the institutions, which can be used to understand and evaluate the effectiveness of their work.

AbstractSecurity measures taken in the name of the ‘war on terror’ have frequently been understood to operate through a domain of exception, defined as an extra-legal space of intervention where normal rules of juridical protection and due process are suspended. Yet whilst most analyses of the exception are critically reliant on notions of legal threshold, they are largely dismissive of the potentially productive nature of legal contestation. This article inquires into the dynamic confrontation between law and exception in the context of the UN 1267 sanctions system, focusing on the Office of the Ombudsperson as an institutional experiment designed to remedy the fundamental rights deficiencies of the regime. Drawing on Agamben's analysis of the exception as a ‘hybrid space’ and Dyzenhaus's concept of the ‘legal grey hole’, our analysis of the Ombudsperson demonstrates the emergence of novel, hybrid procedures and evidentiary standards being deployed in the 1267 delisting process. First, we assess the Ombudsperson's logics of decision-making and argue that their appeals to fairness hinge on the production of a temporal chasm that legitimizes the deployment of intelligence material in listing cases. Second, we show that the Ombudsperson is in the process of carving out novel evidential standards that are more attentive to notions of inference and speculation than conventional standards of proof. These standards serve to fortify the use of sanctions as a pre-emptive security measure and do not, in principle, appear to exclude material that may be obtained by torture.

Abstract:

In the center of the article is the new regional ombudsman institution in Russia and its activities vis-à-vis the protection of women’s rights. The article seeks to analyze how complaints filed by women are presented and how the status of women’s rights within the context of human rights is described in the ombudsmen’s annual reports. The analysis of the reports proves ambiguities of interpretations of human rights; it also shows that many of those filing complaints do it because of the violations of social and civil rights, and that the majority of those experiencing discrimination are women. However, in most of the cases the ombudspersons do not pay attention to the gender-specific dimensions of the discrimination nor have they identified this as an important problem in contemporary Russian society. This situation is connected with the absence of a legal or political mechanism for gender equality in Russia as well as a displacement of women’s rights issues in favor of a focus on family issues and demography in the Russian public discourse of the late 2000s.

Abstract:

Objective: This talk will explore the ongoing and progressive ways of promoting genital autonomy for female, male and intersex children and youngsters. Within the last few years in various countries across Europe, especially in Germany, UK and the Nordic countries, the right to bodily integrity as a sexual right has been on the agenda creating constructive discussions as well as promising practices and statements. Design and Method: The key developments have been reflected in the governmental agencies, such as Nordic Ombudspersons for Children and the Council of Europe after persistent work in the field of NGO. Many organizations are working separately and increasingly together to develop advocacy strategies and lobby decision-makers. Also, general public is now better informed of the multiple problems of non-therapeutic genital surgery. Results: Even if governments act for the future, there is still a need to cater for the needs of those who are suffering from the loss of their sexual rights. Counsellors, therapists, psychologists and medical personnel need to be able to provide relevant data, support and advice. Conclusions: This progress is possible by educating people to combat the harmful traditions and by raising awareness of sexual rights.

Abstract:

Abstract Background Trainees may not always be comfortable providing frank feedback or constructive criticism to their Program Director (PD) due to fears of negative repercussions. PDs likewise may lack the means to obtain high quality feedback from trainees, particularly among smaller training programs, e.g. fellowships. An ombudsperson is defined as an independent appointee whose task is to investigate and attempt to resolve complaints and problems. Methods The PDs from Infectious Disease (ID) and Endocrinology fellowships partnered to meet with fellows from the opposite program. Meetings were held with fellows in December and June of the academic year. Each PD started their meeting with 2 questions on a 1-10 scale: How do you rate the fellowship program? How do you rate the job the PD and program leadership are doing? Additional questions covered the fellow evaluation process, faculty feedback, education vs. service balance, and gaps in training. Additional time was allotted for fellow-raised concerns. Meeting notes were summarized anonymously and returned to the PD of the other program. Fellows were asked to complete a brief questionnaire about their experience. Results A total of 15 fellows completed the survey (6 Endocrinology, 9 ID; Table). All 15 fellows agreed that the goal of the ombudsperson review meeting (i.e. to address fellow concerns in a more confidential setting) was achieved and were comfortable sharing concerns and feedback to the ombudsperson. The majority of fellows (53%) was more comfortable sharing concerns regarding the fellowship to the ombudsperson than directly to the PD. Thirteen (87%) agreed that concerns raised during the first ombudsperson meeting were addressed by the Program in subsequent months. All fellows (100%) found it helpful that the ombudsperson was another PD and recommended that the ombudsperson review meetings should continue in the fellowship. Table. Characteristics of participants and outcomes of questions about fellowship ombudsperson program Conclusion The fellowship PD ombudsperson meeting is a novel means for soliciting constructive feedback from trainees at small training programs. Fellows were comfortable with the ombudsperson arrangement, felt the meetings achieved their goal, and recommended that the meetings continue in the future. Zur Diskussion aktueller Themen guter wissenschaftlicher Praxis, welche die Arbeit der Ombudspersonen wissenschaftlicher Einrichtungen betreffen, findet in Deutschland alle zwei Jahre das sogenannte Ombudssymposium statt. In diesem Jahr standen unter der Überschrift „Was dürfen und sollen Ombudspersonen? Rahmen und Grenzen der Ombudsarbeit“ die praktischen Herausforderungen, vor denen Ombudspersonen bei Beratungen und Konfliktschlichtungen stehen, im Fokus. Die rund 200 Teilnehmenden diskutierten aktuelle Entwicklungen, wie den Einfluss von Algorithmen wie ChatGPT auf Wissenschaft und wissenschaftliche Integrität. Außerdem berichteten Expert:innen des Felds in zahlreichen Referaten und bei einer Podiumsdiskussion von ihren Erfahrungen und von Aspekten, die ihres Erachtens noch näher ausgeleuchtet werden sollten, um (etwa im Bereich des Rechts) mehr Klarheit für Ombudspersonen zu schaffen. Auch auf Erfolge und positive Entwicklungen in den letzten Jahren, wie die Implementierung des neuen DFG-Kodex „Leitlinien zur Sicherung guter wissenschaftlicher Praxis“ und Netzwerkbildungen unter Ombudspersonen, wurde verwiesen. Über die Videoaufzeichnungen des öffentlichen Teils des Symposiums sind die Beiträge noch einmal einem größeren Publikum zugänglich und laden zur Debatte ein.

Abstract:

Over the last two decades, municipal human rights institutions have proliferated around the world. One of the newest examples of such initiatives is the Seoul Human Rights Ombudsperson Office, which was established in January 2013 as one of the core institutions of human rights protection in Seoul, Korea. This article will present a case study of the operations of the Seoul Human Rights Ombudsperson Office based on interviews and documentary research. It will focus on the question of how this newly established institution fits into the existing human rights regime, and in particular address three distinct issues, namely the degree to which the Seoul Human Rights Ombudsperson Office reflects local versus national or international influences, the types of institutional relationships it has with other human rights actors, and the degree to which it implements local versus national or international human rights norms.

Abstract The investigators behind the first gene therapy trial with adenoassociated virus 8 (AAV8) Factor IX appointed a patient ombudsperson to help ensure participants were able to give truly informed consent. The experiences and challenges of the ombudsperson, who met with the first six UK-based patients, are described. It was stressed to potential participants that altruism, rather than any expectation of clinical benefit, should be the primary motivation to taking part. At the same time a sober assessment of the potential risks to their safety needed to be made.

Abstract:

Conventions adopted by the United Nations and Council of Europe pay special importance to the treatment of prisoners with mental health problems. Their treatment is closely related to respect for human dignity, torture, cruel and degrading treatment or punishment. The European Court of Human Rights, in many cases, has ruled that the detention of a mentally-ill person can raise issues from Article 3 of the European Convention on Human Rights and that the lack of adequate medical care can result in treatment contrary to this article, especially with regard to inhumane and degrading treatment or punishment. The Republic of Kosovo is not a member of the United Nations and Council of Europe. However, it has incorporated in its Constitution a number of Conventions adopted by the United Nations and Council of Europe, which are very important international instruments for the protection of Human Rights and Fundamental Freedoms. Also, Kosovo has adopted a legal frame work which prohibits torture, cruel and degrading treatment or punishment in accordance with the international Human Rights standards. The Constitution, also provides that Human Rights and Fundamental Freedoms guaranteed by the Constitution shall be interpreted in accordance with the case law of the European Court of Human Rights. This paper is based on the reports of international Human Rights monitoring mechanisms and their findings regarding treatment of prisoners with mental health problems, such as Council of Europe Committee for the Prevention of Torture, Ombudsperson of Kosovo reports, reports of governmental bodies, as well as reports of Kosovo NGOs, which are authorized to monitor Human Rights situation in places of deprivation of liberty. Based on Ombudsperson’s reports, Committee for the Prevention of Torture reports, reports of Prison Health Department of Kosovo Ministry of Health, as well as reports of the NGOs in Kosovo, the treatment of prisoners with serious mental problems in detention and correctional centers in the Republic of Kosovo remains a serious challenge, despite the efforts of the competent authorities to change this situation and to increase human and institutional capacities. Prisoners with serious mental health problems continue to be accommodated in detention and correctional centers, instead of being accommodated in the relevant health institutions, due to the lack of institutional capacities and personnel. El tránsito desde el paradigma de la visión de los niños, niñas y adolescentes como objetos (pasivos) de protección hacia su consideración como sujetos titulares de derechos con capacidad progresiva para ejercerlos, ha conllevado el surgimiento de una serie de organismos autónomos llamados a promover y garantizar la efectividad de sus derechos e intereses. En este contexto, el presente trabajo busca analizar, de forma particular, la institución del ombudsperson para la infancia o defensores de los derechos de la niñez, así como los modelos y principios que inspiran su creación y funcionamiento,para una vez efectuado dicho ejercicio, estar en disposición de poder contrastarlo con la realidad institucional colombiana. Para ello se realiza una investigación descriptiva de carácter cualitativo con enfoque hermenéutico de tipo documental, y se emplea la metodología dogmática —clásica de las ciencias jurídicas—. Como resultado, constatamos que la Defensoría Delegada para los Derechos de la Niñez, la Juventud y los Adultos Mayores no alcanza a reunir de forma íntegra todas las características propias que un ombudsperson debe ostentar como institución con efectiva capacidad para la reclamación de las garantías especiales de los niños, niñas y adolescentes. Lo anterior nos lleva a concluir la necesidad de reformular la mentada institución, para garantizar con ello que los derechos de la niñez y la adolescencia residente en Colombia sean garantizados de conformidad con los estándares internacionales.

Canadian prison-based arts and other programming are limited at best. Even the country’s Correctional Investigator, or prison-ombudsperson, has critiqued the lack of meaningful options in which prisoners can engage. Those programs that do exist tend to be focused on the logic of penal rehabilitation, with the end goal of reducing recidivism. In this article, we showcase the evaluation of a 9-week arts program in a women’s prison, the aim of which was to build community and foster artistic engagement, thus running counter to normative carceral logics.

Background In British Columbia (BC), Canada, clinicians are responsible for giving involuntary psychiatric patients rights information upon admission. Yet an investigation by the BC Office of the Ombudsperson found that clinicians are not always fulfilling this responsibility. The Ombudsperson recommended that the provincial government fund an independent body to give rights advice to patients. Methods To understand how clinicians feel about this recommendation, focus groups of clinicians who may give psychiatric patients rights information (n = 81) were conducted in Vancouver, BC, to probe their attitudes toward independent rights advisors. The focus group transcripts were thematically analyzed. Results Most clinicians believe that giving rights information is within their scope of practice, although some acknowledge that it poses a conflict of interest when the patient wishes to challenge the treatment team’s decisions. Participants’ chief concerns about an independent rights-advice service were that (a) patients may experience a delay in receiving their rights information, (b) integrating rights advisors into the workflow would complicate an already chaotic admission process, and (c) more patients would be counselled to challenge their hospitalization, leading to an increased administrative workload for clinical staff. However, many participants believed that independent rights advisors would be a positive addition to the admission process, both allowing clinicians to focus on treatment and serving as a source of rights-related information. Conclusions Participants were generally amenable to an independent rights-advice service, suggesting that the introduction of rights advisors need not result in an adversarial relationship between treatment team and patient, as opponents of the proposal fear. Clearly distinguishing between basic rights information and in-depth rights advice could address several of the clinicians’ concerns about the role that independent rights advisors would play in the involuntary admission process. Clinicians’ and other stakeholders’ concerns should be considered as the province develops its rights-advice service.

AbstractOn the basis of the transitional administrations in Kosovo and East Timor, this article analyzes the compatibility of the UN human rights obligations with the wide scope of immunity enjoyed by the organization and its officials. By focusing on the right to a fair trial (and especially the right of access to a court), the author submits that the almost absolute lack of judicial mechanisms to review acts of UN transitional administrations violates the local population's human rights. Although institutions such as an Ombudsperson or a Human Rights Advisory Panel (in Kosovo) have been established, they do not constitute means of protection that are reasonable alternatives to independent and impartial courts. As a corollary, the international responsibility of the United Nations is entailed.
