Abstract:
The UK population is ageing with over a quarter of people predicted to be over 65 by 2040. People are retaining their teeth into old age, often having experienced complex restorative dental work over the years. The increasing complexity of dental treatment that older people require will create challenges for those who provide care for this population, including dental treatment under sedation or general anaesthesia. This article discusses the medical, dental and social considerations that need to be taken into account when planning dental care for older patients under sedation or general anaesthesia. CPD/Clinical Relevance: Dentists who provide sedation must be able to appropriately assess and manage their older patients safely if considering this method of pain and anxiety control for dental treatment.

Abstract:
För att erhålla varumärkesskydd genom registrering krävs att det inte föreligger några absoluta eller relativa registreringshinder. VmL:s registreringshinder utgör även skäl till att ogiltigförklara ett redan registrerat varumärke. Ett relativt registreringshinder framgår av 2 kap. 8 § 1 st. punkt 4 VmL, i vilken föreskrivs: ”Ett varumärke får inte registreras om varumärket kan förväxlas med ett kännetecken som användes här i landet eller i utlandet av någon annan vid tidpunkten för ansökan och som fortfarande används, om sökanden var i ond tro vid tidpunkten för ansökan.” VmL innehåller emellertid inte något absolut registreringshinder eller ogiltighetsgrund mot registreringsansökningar som har skett i ond tro, trots att en sådan bestämmelse återfinns i VmD och är obligatorisk för EU:s medlemsländer att införa i den nationella lagstiftningen. I uppsatsen undersöks således huruvida VmL är förenlig med VmD vad gäller bestämmelserna om ond tro. I EU-domstolens rättspraxis har det visat sig att det inte behöver föreligga en förväxlingsrisk med ett äldre kännetecken för att en ond tros-situation ska vara tillämplig, något många har trott. Bland andra har Sveriges lagstiftare gjort denna feltolkning, vilket kan utläsas i propositionen till VmL. I EU-praxis finns vidare flera exempel på när ond tro föreligger som en absolut grund, där det således inte råder förväxlingsrisk mellan två varumärken. Sådana situationer föreligger när en registreringsansökan har skett med oärliga avsikter, vilka inte är att anse som god affärssed, och som medför att konkurrensen snedvrids. Ett exempel på ett sådant agerande är när ett företag registrerar sitt varumärke i varu- och tjänsteklasser, vilka det inte avser att bruka varumärket inom. Genom utredningen kan konstateras att sådana situationer inte går att förhindra med hjälp av VmL, i och med att lagen inte innehåller en bestämmelse om ond tro som ett absolut registreringshinder eller ogiltighetsgrund. En direktivkonform tolkning är heller inte möjlig på grund av att bestämmelsen i VmL uttryckligen erfordrar förväxlingsrisk med ett äldre kännetecken, för att ond tro ska kunna vara för handen. 2 kap. 8 § 1 st. punkt 4 VmL är följaktligen varken förenlig med VmD eller med EU-domstolens rättspraxis.
To obtain trade mark protection through registration, there must be no absolute or relative grounds for refusal. The Swedish Trade Mark Act’s grounds for refusal also constitute grounds for invalidating an already registered trade mark. A relative ground for refusal is stipulated in Chapter 2, Section 8 (1) (4) Swedish Trade Mark Act, which provides: "A trade mark may not be registered if the mark can be confused with a mark used in this country or abroad by someone else at the time of application and which is still in use if the applicant was in bad faith at the time of the application." However, the Swedish Trade Mark Act does not contain any absolute grounds for refusal or absolute grounds for invalidation of registration applications that have been made in bad faith, even though such a provision is found in the Trade Mark Directive and is mandatory for EU member states to implement into national law. The essay thereby examines whether the Swedish Trade Mark Act is compatible with the Trade Mark Directive concerning the provisions about bad faith. In the case law of the Court of Justice of the European Union, it has been found that there is no need for a confusion with an older trade mark for a bad faith situation to apply, something many have believed. Among others, the Swedish legislators have made this misinterpretation, which can be seen in the governments bill to the Swedish Trade Mark Act. Furthermore, in EU case law there are several examples of when bad faith exists as an absolute ground, where there is no likelihood of confusion between two brands. Such situations exist when a registration application has been made with dishonest intentions, which are not considered good business practice, and which causes the competition to be distorted. An example of such behavior is when a company registers its trade mark in goods and service classes, which it does not intend to use the trade mark within. The examining finds that such situations cannot be prevented by the means of the Swedish Trade Mark Act, because the law does not contain a provision of bad faith as an absolute ground for refusal or for invalidation. A consistent interpretation is also not possible because the provision in the Swedish Trade Mark Act explicitly requires the risk of confusion with an older trade mark, for bad faith to be available. Chapter 2, Section 8 (1) (4) Swedish Trade Mark Act is therefore neither compatible with the Trade Mark Directive, nor with the case law of the Court of Justice of the European Union.

I takt med att antalet företag ökar i Sverige, ökar dessvärre också antalet konkurser. Under 2018ökade antalet konkurser med 18 % jämfört med föregående år.1 Det bakomliggande syftet medkonkursförfarandet är att konkursboets samlade egendom ska fördelas mellan borgenärernaenligt en förutbestämd turordning. Det är inte bara den samlade egendomen som finns ikonkursboet vid tidpunkten för konkursutbrottet som kan fördelas; konkursförvaltaren har enmöjlighet, om än i begränsad omfattning, att återvinna viss egendom tillbaka till konkursboet.Regelverket som styr återvinning i konkurs återfinns i 4 kap. konkurslagen2 (KonkL). Denallmänna återvinningsregeln i 5 § innehåller ett subjektivt rekvisit i form av ett ondtrosrekvisit.Det krävs alltså att medkontrahenten var i ond tro, i första hand beträffande gäldenärensinsolvens, för att en rättshandling ska kunna återvinnas. Med anledning härav uppstår såledesfrågan huruvida medkontrahenten har någon undersökningsplikt avseende gäldenärensinsolvens.Förekomsten av medkontrahentens undersökningsplikt var länge osäker och föremål fördiskussion i den juridiska doktrinen. I en dom från 2017 konstaterade HD att det i vissa fall kanfinnas en undersökningsplikt för medkontrahenten.3 I framställningen genomförs en närmareanalys av framförallt i vilka fall undersökningsplikten aktualiseras, men även frågan om vilkaåtgärder som plikten medför berörs.Framställningens slutsats landar i att undersökningsplikten kan uppfattas på två sätt. Antingenkan plikten uppfattas som en sorts förlängning av ondtrosrekvisitet eller som ett verktyg för attavgöra huruvida ond tro föreligger. Mycket talar dock för att undersökningsplikten snarare skases som ett mätverktyg för att kunna avgöra huruvida medkontrahenten var i ond tro, främstbeträffande gäldenärens insolvens.

Denna C-uppsats i socialpsykologi syftar till att undersöka hur en grupp gymnasieelever reflekterar kring sina egna och andras erfarenheter av grupptryck. Arbetet ska bidra till att få en förståelse för socialpsykologiska interaktioner som återfinns i resonemanget kring grupptryck. Arbetet grundar sig på intervjuer av fem gymnasielevers upplevelser av grupptryck och använder hermeneutiken i sin metodologi. Empirin analyseras genom tre teorier som behandlar olika perspektiv på grupptryck; beteende, existentiellt och intersubjektivt. Dessa teorier är Social Proof, Sartres Ond Tro samt Meads intersubjektivitet. Vid arbetets slutfas har jag funnit att det existerar tre influenser som gör att man kan dra till sig grupptryck och som har negativa konsekvenser. Dessa tre krafter är, för det första, en önskan om maktlöshet för att fly ångest, för det andra, en osäkerhet som baseras på att andra vet bättre och, slutligen, en överidentifikation med samhällsrollen som utelämnar den lekfulla delen av självet.

Abstract:
Kungsgatan av Ivar Lo-Johansson visar urbaniseringen och moderniteten i mellankrigstidens Sverige. Romanen har framför allt studerats genom protagonisten Adrians bildningsresa, men denna uppsats framhåller statardottern Martas fall som kvintessentiell för Lo-Johanssons gestaltning av moderniteten. Med avstamp i det frihetstema Ola Holmgren identifierat i Lo-Johanssons författarskap tillämpar jag existentialistiska begrepp från Jean-Paul Sartre i syfte att undersöka vad Martas fall orsakas av och hur hennes fall relaterar till moderniteten såsom den beskrivits av Marshall Berman och Georg Simmel. Slutsatsen blir att Martas livsöde bör förklaras i termer av att hon agerar i ond tro och att hon därigenom antar ett omodernt levnadsmönster som inte fungerar i moderniteten. Orsaken till hennes agerande härleds till en obalans mellan transcendens och fakticitet, en orsak som rättfärdigas med hjälp av Lo-Johanssons andra skildringar av statarnas livsvillkor. Slutsatsen blir att moderniteten gestaltas som krävande invånarnas anpassning och att alla inte är kapabla till sådan, vilket förtydligas om man utvecklar Holmgrens forskning genom existentialistiska begrepp och nyttjar dem till att analysera Martas fall.

Abstract:
Ono no Komachi, the ninth century Heian poet, features in five Noh plays from the fourteenth and fifteenth centuries that are still in the repertory, the most of any woman, as her reputation for skill in poetry and the many legends about her made her an excellent choice for a main character. Most of the plays overtly feature poetry as a main theme, while often depicting her as an old woman. These plays pick up on themes which were already common in the legends about Komachi, including her destitution in old age and her use as a symbol of mujō, or impermanence. However, the ways they deal with these themes differ considerably from their precedents. This thesis examines three plays, Sotoba Komachi, Sekidera Komachi, and Ōmu Komachi, that deal with Komachi as an old woman and the ways in which they construct the relationship between women’s bodies, their poetry, and medieval Japanese Buddhism. Far from being celebrations of Komachi’s skill, the plays in fact control, degrade, and otherwise marginalize Komachi’s poetry through constructing her body as vulnerable, powerless and incapable, and controlling her relationship to areas and people of poetic power, particularly Tamatsushima shrine, the capital, and Sotoori-hime. By examining the revisions and changes made by the playwrights to the sources used in the plays, the thesis suggests that these three plays create a Komachi who acts as symbol of the impermanence of women’s poetry and of poetry-based social mobility for women.

Abstract:

The nature of evil is clearly defined in catholic dogma and tradition but, though very rarely addressed, what is actually preached and transmitted in pastoral context often differs significantly from this line of thought. Based on the experience that the topic is often evaded or treated poorly, as well as on information concerning a recent increase in reports of demonic possession in western society, this study explored the schism within the church concerning evil. It was noted that embarrassment - as in the face of 21st century-enlightened-thought the Church still officially states the existence of the Devil and associated malevolent spirits - seems to have promoted an intellectual cover-up. While not desiring to inhibit freedom of thought or opinion, this work aimed at establishing clarity, coherence and truthfulness concerning teachings of the Church, and implications. It was argued that left in the dark as to the Church’s concept of spiritual reality, and ensuing controversy, the laity is not given fair opportunity to make existential choices, reach own conclusions or put forth important questions and issues for debate. The study was grounded in a systematic presentation of catholic dogma on evil, followed by a phenomenologically inspired method of analysis. Recent theological arguments put forth by the New Theology were related to extracts of an extensive interview with a catholic exorcist in Sweden (included in full). It was shown how the traditional Christian idea of Jesus Christ is inseparably bound up with, and based on, the concept of spiritual forces of light/good and darkness/evil, mutually repelling each other. It was concluded therefore that annihilation of the devil in one way or another, inevitably ends up by making the incarnation pointless, deconstructing not only traditional concepts of evil but the whole Christian idea in itself. The need for open discussion was stressed, including uncomfortable implications of belief in the existence of a spiritual evil.

Abstract:
To reduce the long-term risk of the high-level liquid waste (HLLW) and the waste disposal cost, transuranium (TRU) elements should be removed from HLLW. A so-called TRPO process has been developed by Chinese scientists to partition HLLW. In this process, the extractant, trialkyl phosphine oxide (TRPO), is able to extract TRU elements into organic phase completely, which makes the treatment and disposal of raffinate HLLW much easier. However, the treatment of extracted TRU elements in organic phase, in return, becomes new troublesome issue. Generally, there are three promising ways to treat the extracted TRU elements: (1)transmutation; (2)conditioning; (3)recycling U+Pu in Purex-TRPO Integrated Process. In any of the three ways, the back extraction agents and processes play significant roles. In this paper, the investigations on back extraction agents for TRU elements, such as TTHA, DTPA, AHA, HEDPA, DOGA, and carbonates are introduced. The corresponding back extraction processes and experimental results are reviewed.

Abstract:
A unique solar technology that can be building-integrated, which harnesses both visible and infrared spectrums of solar radiation, utilizes direct and diffuse radiation to produce electricity and hot water, and delivers daylight, has been conceptualized. This technology is a three-in-one (named Tri-Sol), low/medium-concentration, building-integrated, skylight system for commercial buildings. However, this technology can be utilized for building facades and other building envelope components. A key component of the technology is linear Fresnel lenses. These lenses can be designed to be thin and light-weight. Sunlight, concentrated by the linear Fresnel lenses with a low-cost single axis tracker, focuses on a high-efficiency, thin Photo Voltaic (PV) strip that is in contact with a thermal absorber. Electricity produced by PV strips can be processed and distributed from an electric power management system. The thermal absorber houses a sealed heat pipe for cooling the PV strip and producing hot water. The water-cooled condenser section of the heat pipe is external to the skylight so that there is no issue of water leakage through the skylight. Hot water produced can be used for end-use, space heating, or absorption cooling. All diffuse light that cannot be concentrated by Fresnel lenses is delivered into the building interior space. A pre-prototype of Tri-Sol technology was designed and built at University of New Haven (UNH). Solar Testing and Training Laboratory (STTL) at UNH houses solar thermal collector equipment with a capability to perform Solar Rating and Certification Corporation (SRCC) tests. The Tri-Sol module was mounted on the SRCC test equipment at UNH and was tested outdoors to identify any issues or design enhancements.
