Abstract:
This article aims to understand the criminal act of online gambling in juridical terms. The type of research that will be used by the author is empirical normative research. This research is limited to the Crime of Online Gambling Slot and Online Dark Toto Through the Website in detail and systematically. If someone is suspected or charged with gambling in cyber space, the Law Enforcement Official (APH) must prove that the person has fulfilled all the elements stipulated in Article 27 paragraph (2) of Law Number 11 of 2008 concerning Electronic Information and Transactions. The obstacles in eradicating online gambling crimes are inadequate facilities and infrastructure, inadequate human resources / law enforcement personnel, the police find it difficult to collect evidence and most importantly public awareness of online gambling is still lacking. The scholars agree that gambling (maisir) is haram. Although the prohibition of maisir (gambling) has been clearly explained, the punishment for this offense is not stipulated in the Qur'an and hadith so that maisir is included in the jarimah ta'zir. Abstrak Artikel ini bertujuan untuk memahami tindak pidana perjudian online yang ditinjau secara yuridis. Jenis Penelitian yang akan digunakan oleh penulis adalah penelitian normatif empiris. Penelitian ini terbatas pada Tindak Pidana Perjudian Online Slot Dan Toto Gelap Online Melalui Website tersebut secara rinci dan sistematis. Jika ada seseorang disangka atau didakwa telah melakukan perjudian dalam ruang cyber maka Aparat Penegak Hukum (APH) harus membuktikan bahwa orang tersebut telah memenuhi seluruh unsur yang diatur dalam Pasal 27 ayat (2) UndangUndang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik. Hambatan dalam memberantas tindak pidana perjudian online yaitu sarana dan prasarana yang kurang memadai, kurang memadainya sumber daya manusia/prosenil penegak hukum, kepolisian sulit mengumpulkan barang bukti dan yang paling utama kepedulian masyarakat terhadap perjudian online masih kurang. Para ulama sependapat judi (maisir) itu hukumnya haram. Meskipun keharaman maisir (judi) telah dijelaskan secara gamblang, namun hukuman atas pelanggaran ini tidak ditetapkan dalam al-Qur’an dan maupun hadis sehingga maisir termasuk kepada jarimah ta'zir. The research method used in this thesis is a type of qualitative research using the phenomenology method. The data collection technique used was various data obtained from observations, interviews, and documentation at market V in Tembung Village. The results of this study indicate that the phenomenon of online gambling under the guise of online games among students is that many students are familiar with online gambling in their free time and because there is no activity either on campus, at boarding houses or at home. Online gamblers utilize information and communication technology as a means of modern gambling, making it more profitable for online gamblers because it does not require them to meet in person. The forms are: Slots, Togel, Links, Websites, Poker, Rummy, Football Gambling and Higgs Domino. Where teenagers do online gambling as a form of activity in the process of fulfilling their needs, both psychological and material. The resulting impact affects themselves personally and others, both having a negative impact on academic achievement, the economy, psychology, time and resulting in criminal acts.

Background: online gambling (bets, casino games, poker, etc.) is an activity that is spreading worldwide, even in countries where it is not yet legalized. Although the situation in Latin America is very heterogeneous, it is possible that, as online gambling is developed and promoted, addiction problems arise. This has already happened in Spain since the legalization of online gambling in 2011. Thus, psychology should be developing intervention programs to face this new scenario. Goal: this paper describes the treatment protocol for a young man with sports betting addiction. Method: the treatment proposal consisted in a cognitive behavioral therapy which focused on deconditioning of gambling situations; training of skills needed to prevent relapses and overcome risky situations; information on gambling risks; change of attitude towards gambling; and promotion of a healthy lifestyle incompatible with gambling addiction. Results: both the treatment phases and the theoretical basis of the intervention proposal are described. The patient, diagnosed with a severe gambling disorder, showed improvements in the gambling disorder criteria and the Symptom Severity Scale Score. Conclusions: a treatment protocol for online gambling addiction, which is based on the principles of motivation and learning, has been developed. This protocol has demonstrated to be effective in reducing gambling behavior and promoting a new healthy lifestyle.

The latest amendment was No. 8 in the year 1962 and is still in effect today. without any additional amendments made in any way Although there were attempts to revise the Gambling Act again in 2011, the Gambling Bill was eventually dropped. Because the parliament was dissolved that year. As a result, the Gambling Act B.E. 2478 has not been amended again. For a period of up to 58 years, the obsolescence of such laws resulted in inefficient enforcement. In addition, in terms of content in some sections, there are inconsistencies with social conditions. This study aims to identify the motivational traits in online gambling in South Korea. To achieve this goal, 10 participants who had experienced problematic gambling in South Korea were selected, and the data were collected through 1 on 1 interview. The collected data were analyzed with deducted content analysis proposed by Elo and Kyngäs(2008). A categorization matrix was constructed based on the prior studies on the motivational traits in online gambling, and the matrix was utilized during the analysis. As result, 8 categories including 'accessibility,' 'convenience,' digitalization (unreality),' 'anonymity,' 'diversity,' 'attraction strategies,' 'management strategies,' and 'unrestrictedness' and 19 traits in online gambling in South Korea were discovered. Since there had been rare attempts to identify the motivational factors in online gambling in South Korea, this study demonstrated the new approach to separate online and offline gambling. Also, this study reflected the unique traits of Korea where most gambling behaviors are illegal. Finally, this study proposed several practical and political implications to regulate online gambling and recover from problematic online gambling.

ObjectivesThe aim of this study is to look at an Irish population in relation to the online gambling activities people are engaging with, the reasons for gambling online, their attitudes to online gambling and the financial/mental health consequences of online gambling.MethodsThe outline for this study was adapted from a study by McCormack et al. (2014) in relation to online gambling, with the aim of replicating this study in an Irish population. An online survey consisting of 11 categories related to online gambling was advertised online over a 7-month period. Participants answered on activities gambled online, devices used, duration of time gambling, as well mental health/financial consequences of their gambling.ResultsA total of 208 users participated in the online survey. The most popular gambling activity played was Sports Betting (26.9%) and the most commonly used device was Mobile app (68.6%). The main reason for gambling online was ‘To win money’ (84.6%), the main reason for ending gambling sessions – ‘Had something else to do’ (67.3%) and the most prominent emotion experienced – Excitement (60.6%). There were findings related to the severity of gambling addiction (75% – had to borrow or sell to fund gambling) and their attitudes towards online gambling (strongly agreed – 39.9% – The potential dangers of gambling should be advertised).ConclusionsOnline gamblers in Ireland share similar behavioural profiles to online gamblers in the United Kingdom and worldwide. The majority of participants in this research have been adversely affected from both a mental and financial perspective due to their gambling behaviours.

Abstract:
Ever since the National Lottery was introduced in 1994, there has been an increased prevalence of gambling in the UK. Technological innovation in this time has led to new ways in which people can gamble worldwide (e.g., internet gambling, mobile phone gambling and interactive television gambling), and increased accessibility to opportunities to gamble worldwide. The fastest growing form of gambling is internet gambling, however, little is understood in relation to the characteristics of internet gamblers, the psychosocial impact of internet gambling (e.g. problem gambling) and implications for public social policy. The overall aims of this thesis were to establish (i) what makes internet gambling potentially addictive, (ii) how is internet gambling located, accessed, and utilised by players, and (iii) what the salient structural and situational characteristics of internet gambling are and how these impacted (psychologically and socially) on peoples‘ lives. These aims were addressed through three stages of linked research utilising a multi-method design including a literature-based scoping study, in-depth interviews (n=40), and a comprehensive online survey (n=975) in order to triangulate the data to examine the psychosocial impact and potential addictiveness of internet gambling. The principal findings of this thesis noted certain structural characteristics have significantly more impact online than offline, and therefore the design of gambling websites can potentially manipulate gambling behaviour, thus making internet gambling potentially addictive. Gamblers were motivated to gamble online for the convenience, value for money, the greater variety of games, and anonymity. Inhibiting factors of online gambling included the reduced realism, the asocial nature of the internet, the use of electronic money, and concerns about the safety of online gambling websites. Predictors of online problem gambling were identified and included being male; having a disability; continued gambling after experiencing a near miss, lying about their age, engaging in two or more activities regularly, agreeing that internet gambling is more addictive than offline gambling.

Abstract:
This thesis considers and evaluates different approaches to regulating online gaming communities, including traditional top-down regulation, as well as bottom-up and hybrid forms led by participants. I examine the regulatory environment in both the video game and gambling industries through case studies of the science fiction, massively multiplayer game Eve Online and offshore gambling platforms and their community sites. I identify that the participant driven approach to regulation sometimes used in the offshore gambling industry was dependent on a number of factors, notably the strength of the community and the risks to platform operators of negative publicity. By subsequently comparing this to the video gaming industry, I suggest that participant driven processes may be an appropriate way to resolve disputes in the games industry, and show how these are – to a limited extent – already being applied.

Gambling has become ever more available and begun to employ more techniques, such as gamification, in order to engage their players. Today, Gambling with the use of your computer or smartphone is not deemed very different from playing any other kind of game. This shortens the availability cascade, or chain of events, that in the context of Gambling can ultimately lead to severe economical or social consequences for the players. This thesis seeks to find out how the increased availability can be counteracted by giving control back to the players through the use of personal informatics as well as if, and if so how, the social aspect of Gambling affects responsibility and the perceived experience. By conducting in-depth interviews with 20 participants I gained insights into what would assist them in maintaining control as well as their perception of Gambling. In order to evaluate these findings they were, in conjunction with related research, translated into a design concept. The results of the evaluations of this design suggest that many of the same techniques used to increase engagement with Gambling can also be utilized to counteract the increased availability. The prospects for future research are outlined.

Problem gambling is a public health issue that affects gamblers, relatives and society in general. The Swedish National Gambling Helpline, Stödlinjen, operates as a primary help to people with problems related to gambling. The 22,260 calls made to the helpline from 2009 to 2016 were studied with regards to gender, age, online gambling, psychosocial problems, and crime. Comparison between gamblers and relatives revealed gender and age differences. Reports of online gambling increased for both groups as time progressed, while crime declined. The results are discussed, and it is concluded that more research on the connection between gambling and crime is needed, as well as further develop a crime-aspect in the counsellors’ documentation of helpline callers.

It has been estimated that close to a million Australians engage with a gambling activity at least weekly, with close to a quarter being classified as problem gamblers. Unfortunately, traditional face-to-face therapies for problem gambling are underutilized suggesting they may not meet the needs of a proportion of individuals with gambling-related problems. The evolution of Internet communication systems has fostered potential treatment mediums, including Internet-based therapy. Internet-based therapy involves the delivery of treatment programs via the Internet, and can be provided in conjunction with clinician assistance. Past literature suggests that Internet-based interventions have resulted in positive treatment outcomes for numerous psychological disorders. The current thesis reviewed evidence for the efficacy of Internet-based therapy and conducted an RCT comparing two interventions; a online self-directed intervention for problem gamblers, with and without the addition of a one-off motivational interviewing (MI) telephone call. Randomly allocated participants (N = 126) were provided access to an online self-directed program, based on CBT and MI principles, for a duration of 6 weeks, and were followed up on 4 separate occasions (immediately post-treatment, 1-, 3- and 6-month follow-up). There was a significant reduction in gambling symptomology at post-treatment for both groups, with those in the iCBT + MI group producing superior outcomes compared to the iCBT-alone group, at post-treatment, with effects deteriorating at follow-up. The proposed study was the first empirical evaluation of using an online self-directed program for problem gambling in Australia and preliminary findings suggest that this can be seen as an advantageous treatment option to target this clinical population. Nonetheless, it is imperative that this Internet-based treatment program be tested in a second RCT against waitlist controls, in order to further establish its efficacy.

Abstract:
The quantitative study identified predictor variables of online sports problem gambling, as measured by the South Oaks Gambling Screen (SOGS) among fraternity students at major college universities. The data were composed of 125 college fraternity students from ages 18 to 25 years of age. The average SOGS score was 1.776 with a standard deviation of 1.93. A SOGS score of 5 or greater indicates a probable problem gambler. The study used the Blaszczynski and Nower (2002) pathways model to determine how fraternity students could become problem gamblers. A stepwise regression model was run in SPSS using multiple independent variables taken from the survey to determine which of the independent variables were significantly correlated with the dependent variable, SOGS score. The study found 5 independent variables to be statistically significant: family history of gambling, competitive wagering, tobacco use, placing a wager with a friend, and wagering with funds acquired by illicit means. These 5 variables hold an R-squared (adjusted) of .26, which means that about 26% of the variability in the SOGS scores can be accounted for by these 5 variables. The study results supported the hypothesis that a complex set of social, biological, and psychological factors may contribute to determine how fraternity students could become problem gamblers. This study identified multiple individuals and parties who would benefit from further research about the ill-effects of online sports gambling among fraternity students.

The thesis tends to answer how does the processing of online gamblers’ personal data, which is used for identification and commercial communication purposes, affect the protection of online gamblers in the EU? After the introduction into the context of online gambling in Europe and risks that jeopardize the protection of online gamblers and the concept of responsible gambling, the first part of the thesis sheds light on the relationship between the processing of online gamblers’ data and the provocation of problem gambling. The attention is given to the gambling-related commercial communication and its role in provoking problem gambling on one side. On other, data processing to identify gamblers is taken as a contributing factor to the recognition of problem gamblers and prevention of negative consequences deriving from gambling. In the second part of the thesis, the relations, tensions, and conflicts between the protection of online gamblers and the protection of personal data, as processed by online gambling service providers are analyzed. The work of Jaap-Henk Hoepman on privacy design strategies was used as an inspirational source for the designing of strategies for processing online gamblers’ personal data. The strategies for the processing of online gamblers’ personal data and accompanying tactics based on Hoepman’s proposals for data minimization and data separation strategies and their antipodes – data maximization and data linking strategies outline scenarios that may prevent/provoke problem gambling. The thesis analyzes the business practice regarding the types of online gambler data that is processed for gambling-related activities, including data processed for the protection of online gamblers. Finally, the legal analysis answers whether and to what extent the implementation of privacy-invasive strategies (data maximization and data linking strategies) could be lawful.

Earlier research within the subject are limited, however previously findings indicates that fast response time, logic site mapping and security are important factors when consumer are choosing supplier for mobile gambling. Data is collected through a consumer survey and interviews with three industry experts, moreover; a theoretical framework from previously conducted research are underpinning the study. The results show that firms should focus internal resources and capabilities to develop a superior technology. A superior technology can generate numerous of competitive advantages, as well as working as a leverage effect in other areas. Moreover, superior technology will also likely be sustainable over time by being governed by isolating mechanisms. Lower price is discussed as a competitive advantage in the mobile industry, however findings indicates several of long run negative effects enabled through a lower price. Future research needs to investigate how customization and dynamic offerings can optimize a firm’s profit. Future research should also investigate what kind of negative effects mobile gambling could have on the social welfare in terms of total effects.

he increased availability of gambling opportunities resulting from the progressive liberalisation of the gambling sector coupled with the widespread access to online gambling, is raising concerns regarding adolescents’ participation in gambling and possible increase in problem-gambling. However, the influence of the different gambling products commercialised across countries is less known. This is the first study estimating problem gambling (PG) prevalence and examining the contribution of individual factors and gambling products on gambling engagement and PG development among European adolescents. The study used data from a representative cohort of 16-year-old students (n= 85,000) in 33 European countries participating in the 2019 ESPAD survey. In order to control for self-selection a Heckman probit model is estimated, first controlling for the probability of being gambler and then for the correlated probability of becoming a problem gambler. The influence of individual and country-level factors is estimated on both outcomes, as well as among gamblers using each type of gambling products. Participants who reported stronger family support had lower risk of gambling engagement, whilst friends’ support, lack of school connectedness, low monitoring, higher parental education and access to money increased the risk. At the country-level, the higher diffusion of some gambling products was positively associated with gambling engagement. Once controlling for the influence on gambling engagement, factors that still increase the risk of becoming problem gambler independently from the country of origin were the lack of school connectedness and parental monitoring. Specific gambling products and online games increased PG risk. The influence of such factors on PG development is also analysed among gamblers using each product. Supportive family environments, school connectedness and limited access to money appear to be associated with a lower risk of PG among adolescents. At the country-level, governments should better enforce barriers to underage access to gambling products, particularly online.

AbstractThis qualitative study examines what factors and measures may contribute to the success of a state-owned gambling company online. As each jurisdiction restricts online gambling offer and demand according to domestic legislation, there are few tools to limit the competition of online operators.In order to understand how different stakeholders want to limit online competition and preserve the benefits guaranteed by a monopolistic gambling system, thematic interviews (N = 17) were conducted among the state-owned gambling company Veikkaus’ representatives and among public servants engaged in gambling regulation, ownership steering, the prevention of gambling harm, or the distribution and reception of gambling proceeds. Chantal Mouffe’s theorisation on ‘antagonism’ and ‘agonism’ is used to examine the impact of competition of these stakeholders.The results show that the challenges of the Finnish state-owned gambling operator were related to competition (e.g., losing customers and proceeds to international competitors) and to regulation (e.g., channelling gambling and preventing gambling harms). The results also indicated that Veikkaus’ representatives seem to have an agonistic relationship with the regulators and the public servants interested in prevention of gambling harms. The only antagonism found in this study is based on the conflicting power relations of Veikkaus and the international online gambling companies.

Most people these days prefer to gamble from the comforts of their home rather than going to �live� gambling establishments and Malaysia is no exception. This paper will firstly outline the different laws that are in place to govern violations of online gambling with respect to the Muslim and non-Muslim nationals. Next, this paper will address whether the current regulations in Malaysia are sufficient in the regulation of online gambling in the country. Finally, the paper will point out the enforcement authorities that are responsible to oversee the regulation of online gambling activities in the country and whether these enforcement authorities are effectively tackling online gambling violations within the country. In this paper, the authors conducted the research methodology by way of doctrinal research. The primary research was done by examining and assessing relevant legislations and cases, whilst the secondary research was conducted by reference with materials that include, amongst others, publications in journals, conference papers, legal encyclopaedias and news releases, this paper could be a useful source of information for practitioners, academics, policymakers and students and a guide for any possible future amendments to the current insufficiency.
