Ronen, Boaz, Joseph S. Pliskin, and Shimeon Pass. The “Evils” of Long Response Times (DRAFT). Oxford University Press, 2018. http://dx.doi.org/10.1093/med/9780190843458.003.0010.

Full text
Abstract:
The “evils” of long response times, similar to the “evils” of excess work in process, are responsible for diminished quality and customer satisfaction. There is also an effect of diminishing throughput, control, and cash flow. Long response times (or high level of work in process) add to increase in operating expenses. Shortening response times and reducing the level of work in process are attainable and serve as leverage for significant improvement in organizational performance. Excess work in process can be caused by the efficiencies syndrome, viewing inventory as assets, and ignorance. The methods for reducing the level of work in process and shortening response times are detailed in the chapter 11.

Esayas, Samson Y. Data Privacy and Competition Law in the Age of Big Data. Oxford University PressOxford, 2024. http://dx.doi.org/10.1093/oso/9780198891420.001.0001.

Full text
Abstract:
Abstract The monetization of personal data has become an increasingly common business practice, igniting global debate on the interface between data privacy law and competition law. Data Privacy and Competition Law in the Age of Big Data provides a comprehensive, novel, and interdisciplinary analysis of this nexus. Drawing insights from emergent properties and complexity science, it exposes the commonalities and conflicts between how data privacy law and competition law address challenges resulting from the commercialization of personal data. The book begins by identifying key shifts in big data: the growing trend of processing personal data for diverse purposes, the aggregation of data across various operations, and the shift from offering stand-alone products and services to ecosystems of several, with personal data central in connecting the different markets. These shifts engender a complex economic landscape, marked by multiple actors, a web of interactions, and non-linear, emergent outcomes. Despite this complexity, the prevailing approach to data privacy law and competition law emphasizes isolated units of analysis—whether a relevant market or a distinct processing operation. This approach overlooks system-wide (emergent) risks borne of cumulative processing operations and cross-market practices. Additionally, a mindset focused on either data privacy law or competition law overlooks the increasing intersection between the two regimes, missing opportunities for synergy. In light of these challenges, the book calls for recalibrating data privacy law and competition law for a complex economy, emphasizing a holistic, systems-level perspective that addresses emergent harms and a polycentric strategy that leverages the strengths of each legal regime.

Baken, Denise N., and Ioannis Mantzikos. Al Qaeda. Praeger, 2015. http://dx.doi.org/10.5040/9798400608902.

Full text
Abstract:
What threat does Al Qaeda pose to the United States as it continues to evolve in the wake of the Arab Spring, and what are the group's evolving strategies for growth and survival internationally? This book provides answers. Ideal for both students of terrorism and general readers wanting to better understand modern terrorism, this book provides an in-depth look at Al Qaeda, including its origins, evolution, doctrines, structure, and terrorist operations. The authors examine Al Qaeda's operational transitions over the last two decades, and consider these changes in terms of the impact of the Internet, the viciousness of the violence employed, the leverage of colonial past, and the subsequent international implications. Particular attention is paid to Al Qaeda's changing strategies for growth and survival across the Middle East and Africa as well as the threats that it poses to the United States as it continues to evolve in the wake of the Arab Spring. The work addresses why Al Qaeda?now both a professional force and a network of so-called "lone wolves"?must remain a primary focus of the United States and other Western states while also recognizing that the threat of terrorism goes beyond Al Qaeda.

Timothy, Spangler. The Law of Private Investment Funds. Oxford University Press, 2018. http://dx.doi.org/10.1093/law/9780198807247.001.0001.

Full text
Abstract:
This book provides a clear and concise dual US/UK and pan-asset analysis on the legal and regulatory issues that arise in connection with private investment funds. The book advises on the structuring, formation, and operation of a range of asset classes, including hedge funds, private equity funds, real estate funds, and other non-retail collective investment vehicles. This edition has been revised to reflect the numerous and significant developments in financial services regulation on both sides of the Atlantic since the publication of the second edition. More elements of the Dodd Frank financial regulatory reforms, which increased the scope and reach of regulation applicable to private funds, have been implemented and commented on in this edition. In relation to European regulation, the impact of the commencement of the Alternative Investment Fund Managers Directive (AIFMD) has also now been analysed. The US/UK approach is maintained, but this edition now also includes consideration of third countries, particularly the Middle East and Asia. An entirely new chapter is dedicated to litigation and regulatory enforcement, and some treatment is given to the effects of the global financial crisis, in particular the regulatory response and the changes to negotiating leverage of fund managers and fund investors. The potential impact of ‘Brexit’ on the United Kingdom private funds industry and the future of the AIMFD and European private funds is also examined.

Eyre, Harris A., Michael Berk, Helen Lavretsky, and Charles Reynolds, eds. Convergence Mental Health. Oxford University Press, 2021. http://dx.doi.org/10.1093/med/9780197506271.001.0001.

Full text
Abstract:
The world is in the throes of a global health, economic, and mental health crisis with severe physical, societal, and economic ramifications. Modern mental health problems are characterized by their complexity, multisystemic nature, and broad societal impact, making them poorly suited to siloed approaches of thinking and innovation. To solve the unprecedented complexities and challenges associated with the current global crisis, a paradigm shift is needed. Convergence science integrates knowledge, tools, and thought strategies from various fields and is the focal point where novel insights arise. In the context of mental health, convergence involves integration of scientists, clinicians, bioinformaticists, global health experts, engineers, technology entrepreneurs, medical educators, caregivers, and patients; synergy between government, academia, and industry is also vital. A convergence mental health approach will lead to improved outcomes for patients and healthcare systems. Predicate examples of convergence science in adjacent fields to mental health provide a model for the path forward. Further, within the field of mental health, there are examples of convergence science currently in action that include early-stage companies, neuroscience initiatives, public health projects, and unconventional funding mechanisms. The world has a historic opportunity to leverage convergence science to lead to a new era of innovation and progress in global mental health. Contributions for this book come from authors affiliated with the Milken Institute, Asia Pacific Economic Cooperation, Organization for Economic Co-operation and Development, the National Academies of Science, Medicine and Engineering, Stanford University, and Harvard University. This book is written for practitioners and leaders in mental health innovation, including clinicians, researchers, policymakers, investors, entrepreneurs, and philanthropists.

Creighton, Breen, Catrina Denvir, Richard Johnstone, Shae McCrystal, and Alice Orchiston. Strike Ballots, Democracy, and Law. Oxford University Press, 2020. http://dx.doi.org/10.1093/oso/9780198869894.001.0001.

Full text
Abstract:
The purpose of the research upon which this book is based was empirically to investigate whether the ballot requirements in the Fair Work Act do indeed impose a significant obstacle to the taking of industrial action, and whether those provisions are indeed impelled by a legitimate ‘democratic imperative’. The book starts from the proposition that virtually all national legal systems, and international law, recognise the right to strike as a fundamental human right. It acknowledges, however, that in no case is this recognition without qualification. Amongst the most common qualifications is a requirement that to be lawful strike action must first be approved by a ballot of workers concerned. Often, these requirements are said to be necessary to protect the democratic rights of the workers concerned: this is the so-called ‘democratic imperative’. In order to evaluate the true purpose and effect of ballot requirements the book draws upon the detailed empirical study of the operation of the Australian legislative provisions noted above; a comparative analysis of law and practice in a broad range of countries, with special reference to Canada, South Africa, the United Kingdom and the United States; and the jurisprudence of the supervisory bodies of the International Labour Organisation. It finds that in many instances ballot requirements – especially those relating to quorum – are more concerned with curtailing strike activity than with constructively responding to the democratic imperative. Frequently, they also proceed from a distorted perception of what ‘democracy’ could and should entail in an industrial context. Paradoxically, the study also finds that in some contexts ballot requirements can provide additional bargaining leverage for unions. Overall, however, the study confirms our hypothesis that the principal purpose of ballot requirements – especially in Australia and the United Kingdom – is to curtail strike activity rather than to vindicate the democratic imperative, other than on the basis of a highly attenuated reading of that term. We believe that the end-result constitutes an important study of the practical operation of a complex set of legal rules, and one which exposes the dichotomy between the ostensible and real objectives underpinning the adoption of those rules. It also furnishes a worked example of multi-methods empirical, comparative and doctrinal legal research in law, which we hope will inspire similar approaches to other areas of labour law.

Knaack, Ulrich, and Jens Schneider. POWERSKIN CONFERENCE PROCEEDINGS. Edited by Thomas Auer. TU Delft Open, 2021. http://dx.doi.org/10.47982/bookrxiv.27.

Full text
Abstract:
The building skin has evolved enormously over the past decades. The energy performance and environmental quality of both the interior and exterior of buildings are primarily determined by the building envelope. The façade has experienced a change in its role as an adaptive climate control system that leverages the synergies between form, material, mechanical and energy systems towards an architectural integration of energy generation. The PowerSKIN Conference aims to address the role of building skins to accomplish a carbonneutral building stock. The focus of the PowerSKIN issue 2021 deals with the question of whether simplicity and robustness stay in contradiction to good performance of buildings skins or whether they even complement each other: simplicity vs performance? As an international scientific event - usually held at the BAU trade fair in Munich - the PowerSKIN Conference builds a bridge between science and practice, between research and construction, and between the latest developments and innovations for the façade of the future. Topics such as building operation, embodied energy, energy generation and storage in the context of the three conference sessions envelope, energy and environment are considered: – Envelope: The building envelope as an interface for the interaction between indoor and outdoor environment. This topic is focused on function, technical development and material properties. – Energy: New concepts, accomplished projects, and visions for the interaction between building structure, envelope and energy technologies. – Environment: Façades or elements of façades, which aim to provide highly comfortable surroundings where environmental control strategies as well as energy generation and/or storage are an integrated part of an active skin. The Technical University of Munich, TU Darmstadt, and TU Delft are signing responsible for the organisation of the conference. It is the third event of a biennial series: April 9th 2021, architects, engineers, and scientists present their latest developments and research projects for public discussion and reflection. For the first time, the conference will be a virtual event. On the one hand, this is a pity, as conferences are also about meeting people and social interaction; on the other hand, it offers the possibility that we can reach more people who connect from all over the world.
